PROJECT SUMMARY: The project is for a pier and platform at 1520 Galley Circle in the Mariners Point s/d. As a requirement of the original major permit for the s/d each lot would be required to apply for a major permit if individual docks were requested. Field Investigation Report: Jones 1520 Galley Circle Mariners Point S/D Page 02 9. Narrative Description: The project is located at 1520 Galley Circle off Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right off ofN. 20°i St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. 1520 Galley Circle is .39 acres (17,004sf) in its entirety and is an average of 4' above NHW and has 102' of shoreline along the normal high water contour. There is an expanse (approximately 102' x 165') of Coastal Wetlands present along the shore adjacent to Dill Creek. This coastal wetland area contains Smooth Cordgrass (Spartina alterniflora). There are typical lawn grasses, scrub oaks and riprap (above NHW) along the high ground portion of the property. The lot to the east has an existing dock. The water depths within the tributary of Dill Creek are shallow (less than -2'nlw), and according to the applicant, reach —2.4' NLW within the channel portion and — .8 to -1.9 at NLW (depending on location) at the waterward end of the proposed structure. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Project Description: The applicant is proposing a 6' x 5' access over high ground, a 6' x 166' pier and a 13' x 30' L- head platform. They are not proposing any upland development at this time. The proposed pier would cross high ground for 5', coastal wetlands for approximately 166' (for a total length of 171') and would then intersect a 13' x 30' platform area. Depending on location, the platform would extend over coastal wetlands for 3' to 5' with the remaining portion of the platform (8') over open water within the 32' wide to 40' wide creek. There are no slips proposed. The water depths along the platform area is -.8' to 1.6' nlw. The most water ward portion of the structure would be located 10'-to 20' landward and parallel with the edge of the existing channel depending on location. Through previous permit activity in this area, the Division has determined that the configuration of marsh along the shoreline of this property establishes the point from which to measure the water body for the immediate area, creating a width of 32' at its most constrictive point and 40' at its widest point. In consideration of this, the impedance into the water body by the structure consequently extends approximately 8' into the 32' body of water. The pier and platform would be located 16' from the west riparian access line and 15' from the east riparian access line. The riparian access lines where determined on the previous original major permit submittal for the subdivision in addition to field visits and aerial photography. The Field Investigation Report: Jones 1520 Galley Circle Mariners Point S/D Page 32 riparian access line is drawn perpendicular to the channel location that runs east to west. All water depths as well as the outermost limit of the coastal wetlands, channel location and water body width have been field verified by DCM staff. 11. Anticipated Impacts: The proposed pier as would incorporate 35 ftz of high ground while shading and incorporating 1,143.8 ft2 of coastal wetlands. A total 240 ft2 of open water of would be shaded and incorporated by the platform. There are no oyster beds containing healthy populations existing along the shoreline and therefore should not be disturbed during the construction process. There is the potential for temporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the existing coastal wetlands in the area. The coastal wetland area terminates approximately 166' waterward ofNHW. The channel edge is located 25' to 35' from the north edge of the coastal wetlands. Since no formalized slips are proposed, there should be no turbidity or impacts from prop scarring. JONES, 1520 GALLEY CIRCLE, MOREHEAD CITY, CARTERET COUNTY The following are my comments and recommendations regarding the aforementioned proposal. The proposal is for the construction of an observation pier with an 1-head platform. The water depths within this area RANGE FROM -.8 to -1.9 nlw. The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office recommends the project be authorized as proposed on plats dated received 9/26/19 contingent upon all applicable general conditions and the following standard conditions: The pier and platform should not exceed a maximum distance of 169.6' waterward of NHW. The platform shall extend beyond the edge of coastal wetlands more than 8' due to a water body width of 32' (most constrictive point) to 40' depending on location. No more than 6' of platform shall extend over coastal wetlands. Due to the shallow water depths and silty sediment (mud fluff) substrate within a PNA the District recommends no slips should be authorized. DAVIS Director MEMORANDUM NORTH CAROUNA Envtrv="tal Quality TO: Gregg Bodnar, Major Permits Processing Coordinator Division of Coastal Management FROM: Rachel Love-Adrick, District Planner ment Division of Coastal Manage SUBJECT: Major Permit Request by Donald R. Jones DATE: November 1, 2019 Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead City Land Use Plan certified by the CRC on September 28, 2007. Overview: The project is located at 1520 Galley Circle adjacent to Dill Creek in Morehead City, Carteret County. The applicant is proposing a 6' x 5' access over high ground, a 6' x 166' pier and a 13' x 30' L-head platform. They are not proposing any upland development at this time. The project property is .39 acres (17,004 sf) in its entirety, has 102' ft of shoreline and is an average of 4' above NHW. Dill Creek borders the site to the east and north. The upland vegetation mainly consists of typical lawn grasses, scrub oaks and riprap (above NHW) along the high ground portion of the property. There is an expanse (approximately 102' x 165') of Coastal Wetlands present along the shore adjacent to Dill Creek. This coastal wetland area contains Smooth Cordgrass (Spartina altemiflora). Areas of Environmental Concern (AEC) in the project area include Estuarine Waters (EW), Coastal Wetlands (CW) and Public Trust Areas (PTA). Dill Creek has a water classification of SA/HQW. The site is a Primary Nursery Area, and is closed to taking of shellfish. Water depths within this project location are shallow (less than -2' NLW). The bottom substrate is thick organic mud. A review of SAV, cultural resources, and archaeological resources was not provided. Anticipated impacts The proposed pier would shade and incorporate 180 ft2 of coastal wetlands above NHW and 264 ft2 of coastal wetlands below NHW. The pier portion waterward of the edge of marsh would also shade and incorporate 2160 ft2 of SA V habitat. The platforms, wet slip additions with mooring pilings and boatlifts D Q North Carolina Department of Environmental Quality 1 Division of Coastal Management Morehead City Office 1400 Commerce Avenue I Morehead City, North Carolina 28557 252.808.2808 O_ would incorporate 2600 ft2 of shallow bottom habitat while shading 1634 ft2 of the shallow bottom habitat. The development would increase the number of slips from zero to five. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as "Low Density Residential" and "Conservation/Open Space" (due to the sites location in Coastal Wetlands, Estuarine Waters and Public Trust Area AECs). The following LUP policies may be applicable to this request: 4.2.6 Areas of Environmental Concern Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and development in AECs. Policy 2, pg. 94: Morehead City considers cogs al pvetland areas to be valuable passive recreation areas. Dunn, Coastal Coordinator Id f SECTION M H C Habitat Conservation Division DATE: November 12, 2019 SUBJECT: CAMA Dredge/Fill Permit Application for Donald Jones (Mariner's Point), Carteret County, North Carolina. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 1530 Galley Circle in Morehead City, adjacent Dill Creek. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct a 6' by S' access over uplands, a 6' by 166'pier, and a 13' by 30' L-shape platform for an undeveloped lot. Water depths at the L-shaped platform are -0.8' to - 1.6' NLW. No slips are proposed. Due to resource concerns during the original subdivision development (Cox 14 September 2007), each lot must apply for a major permit for individual docks. Dill Creek is classified SA HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). The NCWRC has reviewed the permit application and does not have immediate concerns with the structure as long as it is not used for any vessel use. A more narrow pier could be installed to minimize shading impacts and could be sufficient since the pier is to be used for observation and not boating. To deter vessel use, rails should be installed around the pier / platform We support any recommendations presented by NCDMF to minimize impacts to the shallow water habitat of a PNA. PNAs are defined as those areas inhabited by the embryonic, larval or juvenile life stages Mailing Address: Habitat Conservation • 1721 Mail Service Center • Raleigh, NC 27699-1721 Telephone: (919)707-0220 • Fax: (919) 707-0028 of marine or estuarine fish or crustacean species due to favorable physical,. chemical or biological factors. Charles M. Cullipher, PE 151-A Hwy 24 Morehead City, NC 28557 (252)773-0090 The Cullipher Group, P.A. is requesting a CAMA Major Permit for an observation platform and pier construction on Lot 77 of Mariner's Point Subdivision. The address for the project is 1520 Galley Circle, Morehead City, NC 28557. The Mariner's Point Subdivision's CAMA Major Permit conditions required that anytime development were to occur within the 75' AEC line and waterward that the work must be permitted through the CAMA Major process. The property's upland shoreline is 102 LF along coastal wetlands that are part of Crab Point Bay, Stream Index #: 21-30; Class SA;HQW. The lot currently is currently undeveloped. The owner is requesting to construct 171 LF of a 6' wide wooden pier from the Normal High Water (NHW) Line of Lot 77 to a 30.0' x 13' (390 sf) observation platform that borders the "One Quarter Line" of the water body. There are no proposed boat slips, boat lifts, tie piles or floating platforms with this pier construction. This observation platform is partially over the furthest extent of the coastal wetland but covers no more than 6' of coastal wetland at the widest point of coverage. The platform does not impact the channel. The extent of the channel within this body of water is determined from previously approved CAMA Major Permits for adjacent lots within Mariner's Point Subdivision as well as hydrographic survey performed by The Cullipher Group, P.A. This is generally where -2' at NLW is met and the bottom remains at this elevation or gets deeper going toward the center of the water body. Please see the attached 11x17 plan and contact Charles Cullipher at 252-773-0090 or chase@tcepa.com for questions or comments. - •.9 :a L SEA 037378 : p\ ' g RMi c` 6 2019 Z`/rrt 5EP 2 DCM-MHD CITY AGENT AUTHORIZATION FOR CAMA PERMIT APPLICATION Name of Property Owner Requesting Permit: Donald & Jessica Jones Mailing Address: Phone Number: Email Address: 208 Lord Granville Dr. Morehead City, NC 28557 252-241-9807 dri0709@yahoo.com I certify that I have authorized Charles M. Charles M. Cullipher, PE 151-A Hwy 24 Morehead City, NC 28557 (252)773-0090 h Cullipher Group, P.A. is requesting a CAMA Major Permit for an observation pier constructwon Lot 77 of Mariner's Point Subdivision. The address for the project is 1520 Galley Circle, Morehea ity, NC 28557. The Mariner's Point Subdivision's CAMA Major Permit conditions required that anyti development were to occur within the 75' AEC line and waterward that the work must be permitted through the CAMA Major process. The property's upland shoreline is 102 LF along coastal wetlands that are part of Crab Point Bay, Stream Index q: 21-30; Class SA;HQW. The lot currently is currently undeveloped. The owner is requesting to construct 171 LF of a 6' wide wooden pier from the Normal High Water (NHW) Line of Lot 77 to a 30.0' x 13' (390 sf) platform that borders the "One Quarter Line" of the water body. There are no proposed boat slips, boat lifts, tie piles or floating platforms with this pier construction. This platform is partially over furthest extent of the coastal wetland but covers no more than 6' of coastal wetland at the widest point of coverage. The platform does not impact the channel. The extent of the channel within this body of water is determined from previously approved CAMA Major Permits for adjacent lots within Mariner's Point Subdivision as well a hydrographic survey performed by The Cullipher Group, P.A. This is generally where -2' at NLW is met and the bottom remains at this elevation or gets deeper going toward the center of the water body. Please see the attached 11x17 plan and contact Charles Cullipher at 252-773-0090 or chase@tcaoa.com for questions or comments.
