This permit, issued on March 13, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Excavation & Spoil Disposal
1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
2) The area of excavation shall not exceed the area depicted on the attached workplan drawings.
3) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
4) No excavation or filling of any vegetated wetlands is authorized by this permit.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
in issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
5) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
6) All excavated materials shall be confined above normal high Water level and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids
into any marsh or surrounding waters.
7) No spoil material shall be placed within 30 feet of the normal high water line.
8) The disposal area shall be properly graded and provided a ground cover sufficient to restrain erosion
within 30 working days of project completion.
9) The spoil area shall be inspected and approved by the Division of Coastal Management prior to the
beginning of any dredge activities.
10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at hap://www.fws.gov/nc-
es/manimal/manatee guidelines.pdf.
Maintenance Clause
11) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any
future. maintenance work, as authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities. -
D. The date of map revision and the permittee's signature shown anew on the original plan.
Sedimentation and Erosion Control & Stormwater
12) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do,not enter adjacent wetlands, watercourses and property.
NOTE: An Erosion and Sedimentation Control Plan may be required for this project. This plan should be
filed at least thirty (30) days priogto the beginning of any land disturbing activity. Submit this
plan to the Department of Energy, Mineral, and Land Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.

NOTE: A Stormwater Permit may be required for this project. This plan should be filed at least thirty
(30) days prior to the beginning of any land disturbing activity. Submit this plan to the
Department of Energy, Mineral, and Land Resources, Land Quality Section, 127 Cardinal Drive
Extension, Wilmington, NC 28405.
General
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
16) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The permittee is advised that if a well will be used for this facility, Public Water Supply shall be
contacted at (910) 796-7368.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project via Nationwide Permit 35,
Action ID No. SAW-2018-02184, which was issued 3/6/19.
NOTE: The N.C. Division of Water Resources authorized the proposed project via GC 4144 and
assigned DWR Project No. DWR-2002-0524v2, which was issued 01/17/19.
NOTE: An application processing fee of $400 was received by DCM for this project.

Permit on behalf of JHP Holding Co., LLC c/o James Price to undertake development
activities on their property at 1073 B-Var Road SW, in Supply, Brunswick County.
Although processing of the application is nearing completion, additional time is needed for
this office to complete the review and make a decision on your request. Therefore, it is
necessary that the standard review time be extended. An additional 75 days is provided by
G.S.113A-122(c) which would make April 7, 2019, the new deadline for reaching a
decision on your request. However, we expect to take action prior to that time and will do

The applicant proposes to perform maintenance dredging of an existing marina facility
along the AIWW at 1073 B-Var Road SW in Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Brunswick County Land Use Plan
and offer the following comments.
The general area of the project is classified as Conservation.
In general, Brunswick County allows development in conservation classified AECs
which is consistent with the State's minimum use standards. The Brunswick County
Land Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these standards appear to be applicable to this proposal.
This project appears to be consistent and not in conflict with the Brunswick County Land
Use Plan update.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport
for the subject project. This project is being reviewed under a Nationwide 35, however, due to the length of time since
the most recent DCM authorization, the Corps' believes agency review is prudent, and requests your comments by
January 27, 2019.
The proposed construction site is located at an existing marina at 1073 B-Var Road SW, within waters adjacent to the
AIWW, in Supply, Brunswick County, North Carolina. Coordinates are 33.919243 N, - 78.258968 W.
The applicant proposes to conduct maintenance dredging within the existing marina boat basin and drop zone.
According to the application, dredging was previously authorized by a number of DCM permits, however, this office has
no record of Department of the Army authorization. Dredging is proposed within the 55'X24' drop zone to -8'NLW and
within the 250'X120' boat basin to-8'NLW. A total of 5,849 cubic yards of dredged material is proposed to be removed
from a 31,320 square foot area. The proposed dredge method is by mechanical dredge and/or long reach backhoe.
Dredged material would be dewatered onsite, and then trucked to an upland disposal site located at 5399 Oak lane SW,
in Shallotte, Brunswick County, NC.
The proposed facility is directly adjacent to the Corps federal channel setback.
Please see the attached field investigation report /application and plans for more detailed information concerning the
proposed project. Google Earth .kmz files are attached for reference.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not
likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. Impacts are expected to be minimal due to temporary nature of
sedimentation impacts during dredging. The waters within the project area are NOT designated a496PivAV&ified as
SA/HQW and are closed to shell fishing. According to the application, SAV is not present within the project area. Water

depths within the project area range from -0' NLW to -6 NLW, with an average of -2'NLW within the drop zone, and -3
NLW within the boat basin.
ESA:
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project
will affect, but not likely adversely affect the West Indian Manatee. The use of Manatee Guidelines may be required as a
permit condition. The project would have No Effect on any other federally listed species.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places and initially determines that no
historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit
area: therefore, there will be no historic properties affected.

This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit

Dear Mr. Price,
You have our approval, in accordance with the attached conditions and those listed below, to
impact 0.72 acres of open waters in order to perform maintenance dredging at an existing marina
as described in the application received by the N.C. Division of Water Resources (DWR) on
November 15, 2018. After reviewing your application, we have decided that the impacts are
covered by General Water Quality Certification Number 4144 (GC4144).
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 Permit. This Certification can also be found on line at:

The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If
you change your project, you must notify the Division and you may be required to submit
a new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification and is responsible
for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name (I 5A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[I 5A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded
as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices
must be used to meet this standard. Turbidity curtains shall be used as appropriate. Please
notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
7. The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements
of State and Federal law. If the Division determines that such standards or laws are not

being met, including failure to sustain a designated or achieved use, or that State or Federal
law is being violated, or that further conditions are necessary to assure compliance, than
the Division may reevaluate and modify this General Water Quality Certification. [15A
NCAC 02H .0507(d)]
8. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional
Office at 910.796.7215 and after hours and on weekends call (800) 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
9. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
10. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
11. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed

This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Major Permit application for proposed actions that impact fish and fish
habitats. The applicant is proposing maintenance dredging on an existing marina. The
project will dredge 31,320 square feet, containing approximately 5,849 cubic yards of
reported sandy mud benthic habitat. The project is located along the Atlantic Intracoastal
Waterway (AIWW) in Supply, Brunswick County. The waters are not designated as a
nursery area and are closed for the harvest of shellfish. The waters within the project have
been classified as SA; high quality waters (HQW) by the NC Division of Water Resources.
The permit history had a 1984,1993, and 2002 permit for this facility. There was a
moratorium on in -water work (April 1- September 30) initially in the 84 permit that was
requested by USACE. In the 1984 permit, there was an authorized dredge depth of -8 feet
at mean low water (MLW). Subsequently, the 1993 and the 2002 permit history showed an
authorization of dredge depths to -6 feet MLW. In order to maintain the consistency
between the more recent previous permits for this facility, the DMF is recommending to
maintain the moratorium period and limit the dredge depth to -6 feet MLW unless the
applicant can demonstrate a purpose and need for a dredge depth of -8 feet MLW.

RECOMMENDATIONS FOR HEWETT MARINA. JAMES PRICE 11/08/2018
As proposed, the project appears to be CONSISTENT with the Specific Use Standards for Estuarine
Waters and Public Trust Areas, as set forth in NCAC 07H .0208 (b). This office has no objection to the
proposed work, provided that it is consistent with all other local, state, and federal permitting
requirements. In the absence of any concerns from the commenting agencies, it is recommended that
a permit be issued subject to the standard maintenance dredging as well as the following conditions:
1. This permit authorizes maintenance dredging within the marina's boat basin and lift slip.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work.
3. This permit does not authorize fill, excavation, or land -disturbance within federal or coastal
wetlands.
4. In order to protect juvenile fish, shrimp, and crab populations, no excavation will be permitted
between April 1 and September 30 of any year without prior approval of the Division of Coastal
Management (DCM) in consultation with the DMF.
5. Excavation will not exceed -8' below the normal low water level or deeper than the connecting
waters.
6. The temporary placement or double handling or excavated or fill materials within waters of
vegetated wetlands is not authorized.
All excavated materials will be confined above mean high water and landward of wetlands behind
adequate dikes to prevent spill -over of solids into any marsh, wetlands, or surrounding waters. All
excavated materials are to be deposited into the approved spoil disposal site.
8. Trucks used to haul the dredge spoil material are to have sealed tailgates.
9. The spoil disposal area must have erosion control devices sufficient to restrain the soil on the site
and must be kept in good repair until the area is completely stabilized.

The project site is located at 1073 B-Var Road SW, adjacent to the AIWW, near tte town of upply
(mainland side of Holden Beach), in Brunswick County. To locate the project site from the Wilmington
Regional Office (WiRO), travel southwest from Wilmington to Supply on US 74 W (Martin Luther King Jr
Pkwy) & US 17 S for approximately 33 miles until you reach Supply. Turn left onto Stone Chimney
Road and follow the road through the intersection of NC 211. Continue down Stone Chimney Road for
about 6 miles as it then becomes Old Ferry Connection SW. Then proceed straight for a mile and a
half until you reach Old Ferry Road SW, and turn left. Before you reach the end of Old Ferry Road SW
at Fish Peddler Seafood along the AIWW, turn left onto B-Var Road SW and the destination will be on
your right, 1073 B-Var Road SW.
Hewett Marina is an existing docking and boat repair facility located on the mainland side of Holden
Beach at the end of Old Ferry Road between Fish Peddler Seafood and Betty's Waterfront Restaurant
on the AIWW. The physical address of the property is 1073 B-Var Road SW, Supply, Brunswick
County. The project site is bounded by commercial properties immediately to the east and west, and
by the AIWW to the south. There is approximately 250' of shoreline which is stabilized by a bulkhead.
Elevation at the site averages approximately 5' above Normal Water Level (NWL) as stated by the
applicant. The existing facility consists of a small office building, boat repair shop, travel lift, boat ramp,
floating docks, two boatlifts, boat storage yard, bulkhead, and parking. The existing docks are located
on the AIWW. The applicant's property currently consists of three lots, one bordering the water and two
lots on the landward side of B-Var road. The three lots together are approximately 2.5 acres in size.
Previous CAMA permits have been issued on the original Hewett lot. This is the 0.92 acre tract with the
repair shop on it adjacent to the water. State Permit No. 40-93, State Permit No. 130-84, and State
Permit No. 62-02 authorized maintenance dredging as well as dock and bulkhead work. State Permit
No. 62-02 received a minor modification on July 30, 2003 which authorized the installation of two
boatlifts. State Permit No. 62-02 expired on December 31, 2005.
The Brunswick County Land Use Plan classifies the area in the vicinity of the project area as
Commercial — Low Density. The waters in the project area are classified as SA/HQW by the N.C.
Division of Water Resources (DWR). They are not designated as a Primary Nursery Area (PNA) by the
N.C. Division of Marine Fisheries (DMF), and they are closed to the harvest of shellfish.
PROPOSED PROJECT
The applicant is proposing to perform maintenance dredging of an existing marina facility along the
Atlantic Intracoastal Waterway (AIWW). According to the applicant, Hewett Marina boat basin and drop
zone/travel lift area have been filling in with sediment making navigation and docking in the marina
difficult. The applicant plans on performing maintenance dredging in the existing boat basin and drop
zone area of the marina to increase water depths.
The applicant proposes to perform maintenance dredging in the existing drop zone area of the marina.
The existing drop zone measures approximately 24' by 55' and currently has an average water depth of
-2' at Normal Low Water (NLW). The applicant plans on dredging at this location down to -8' at NLW.
The applicant also proposes to perform maintenance dredging in the existing boat basin which
measures approximately 250' wide and extends approximately 75' from the existing bulkhead out into
the AIWW. Existing water depths at the boat basin range from 0' to -6' at NLW with an average of -3' at
NLW as reported by the applicant. The applicant plans on dredging at this location down to -8' at NLW
beginning at the bulkhead along the entire tract of the property and extending waterward approximately
120' out into the AIWW (the size of the area to be dredged is approximately 250' by 120'). The existing
NLW depths at the marina are shown on drawing number 2 of 3. The proposed dredge work would be

accomplished using a mechanical dredge and/or long reach backhoe as reported by the applicant.
Spoil material would be stored on site for drying in the proposed 4' high berm with surrounding silt
fence temporary spoil retention area measuring 65' by 245' which is outside the 75' Coastal Shoreline
Area of Environmental Concern (AEC) (see drawing 3 of 3). Once dried, the spoil material would be
loaded into dump trucks and delivered to the spoil disposal area located at 5399 Oak Tree Lane SW in
Shallotte, Brunswick County as reported by the applicant.
10. ANTICIPATED IMPACTS
Approximately 293 cubic yards of spoil material would be generated as a result of the proposed
dredging at the existing drop zone. Approximately 5,556 cubic yards of spoil material would be
generated as a result of the proposed dredging at the existing boat basin. Collectively, a total of 5,849
cubic yards of spoil material would be dredged at the marina. The development as proposed would
result in temporary turbidity in the general area of the dredging activity. No wetland excavation or fill is
being proposed. Approximately 31,320 ft' of shallow bottom would be disturbed as a result of the
dredging. Approximately 15,925 ft' of uplands located outside the 75' Coastal Shoreline AEC will be
disturbed as a result of the temporary spoil -drying retention area. A total area of 47,245 ft' will be
disturbed as a result of this project.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for JHP
Holdings Company Go James Price, for State approval for maintenance dredging at Hewett Marina at the subject
property located at 1073 B-Var Road SW, adjacent to the Atlantic Intracoastal Waterway (AIWW), in Supply,
Brunswick County. It was received as complete on November 8, 2018 and appears to be adequate for processing at
this time with the exception of receiving the certified mail return receipts. The projected deadline for making a
decision is January 22, 2019. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 8, 2018, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and ff additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
