This permit, issued on November 13, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Shoreline Stabilization - Bulkhead
1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached
workplan drawings.
2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start
of construction.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
7) The fill material shall be clean and free of any pollutants except in trace quantities.
8) No backfill material is to be placed within 30 feet of the normal water line, except that which will be
used to backfill the area behind the permitted bulkhead.
Sedimentation and Erosion Control
9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
Docking Facility
10) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust
waters without permit modification.
11) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
12) This permit authorizes a maximum of 3 formalized boat slips.
13) The boathouse shall not be completely enclosed or have side coverage more than one half the height of
the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the
authorized workplans.
14) The authorized boathouse shall be single story, and shall not be designed to allow for second story use.
15) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

General
16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
17) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-01860).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 19-1296.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $250 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Recommendations
The applicant proposes to replace 533 linear feet of bulkhead 2 feet out from the existing
dilapidated bulkhead, construct a 30.5 foot by 13 foot boathouse with a lift and construct a
51 foot by 6 foot L-shaped finder pier off the North side of the existing dock. The property
is located at 158 Halsey Bay Road, Hertford, Perquimans County adjacent to the
Perquimans River.
The development proposal involves the Public Trust Area (PTA), Estuarine Shorelines
(ES), Public Trust Shorelines (PTS), and Estuarine Waters (EW) Areas of Environmental
Concern.
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to
this project and my findings are as follows:
15A NCAC 07H .0208 USE STANDARDS
(a) addresses General Use Standards, and subparagraph (1) requires that uses which are
not water dependent shall not be permitted in coastal wetlands, estuarine waters, and
public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks,
private roads, factories, and parking lots are examples of uses that are not water
dependent. Uses that are water dependent include: utility crossings, wind energy facilities,
docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments,

bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels,
access channels and drainage ditches.
Consistent: The applicant proposes to replace a bulkhead and add a finger pier. This
sub -paragraph lists these structures as water dependent.
(a)(2)(A) requires that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and
designed to avoid significant adverse impacts upon the productivity and biologic integrity
of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine
Fisheries Commission, and spawning and nursery areas.
Consistent: The development is designed to not interfere with Shellfish beds or
submerged aquatic vegetation.
(a)(2)(B) requires that the development shall comply with state and federal water and air
quality
Consistent: This development will not violate water and air quality.
(a)(2)(C) requires that the development shall not cause irreversible damage to
documented archaeological or historic resources as identified by the N.C. Department of
Cultural resources.
Consistent: There are no known archaeological or historic resources on the
property.
(a)(2)(D) requires that the development shall not increase siltation.
Consistent: It does not appear that this development will measurably increase
siltation.
(a)(2)(E) requires that the development shall not create stagnant water bodies.
Consistent: It does not appear that the development will create stagnant water
bodies.
(a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The development will have minimum adverse effects on life cycles or
estuarine resources.

(a)(2)(G) requires that the development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The development proposal minimal effects on navigation.
(b) Specific Use Standards
(b)(6) Addresses Piers and Docking Facilities.
(b)(6)(A) requires that piers shall not exceed six feet in width. Piers greater than six feet in
width shall be permitted only if the greater width is necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur.
Consistent: The proposed finger pier is 6 foot in width.
(b)(6)(B) requires that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline
with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open
water slips shall not be counted in the total. Projects requiring dimensions greater than
those stated in this Rule shall be permitted only if the greater dimensions are necessary for
safe use, to improve public access, or to support a water dependent use that cannot
otherwise occur. Size restrictions shall not apply to marinas.
Consistent: The proposed finger pier, boathouse and two jet ski lifts add 654 square
feet of shaded area to the already existing shaded area of 384.6 square feet The
shoreline along the project area is 706 feet which allows for the maximum 2,000
square feet of shaded area and combined the shaded impacts will be 1,135.1 square
feet
(b)(6)(D) requires that a boathouse shall not exceed 400 square feet except to
accommodate a documented need for a larger boathouse and shall have sides extending no
farther than one-half the height of the walls and covering only the top half of the walls.
Measurements of square footage shall be taken of the greatest exterior dimensions.
Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline.
Consistent: The proposed boathouse will be 396.5 square feet which is less than the
maximum for 400 square feet
(b)(6)(E) requires that the total area enclosed by an individual boat lift shall not exceed
400 square feet except to accommodate a documented need for a larger boat lift
Consistent: The proposed boat lifts will be 300 square foot and 24 square foot which
are less than maximum for 400 square feet

(b)(6)(F) requires that piers and docking facilities shall be single story. They may be
roofed but shall not be designed to allow second story use.
Consistent: The proposed finger pier is single story.
(b)(6)(G) requires that pier and docking facility lengths shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same
shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length
unless necessary to avoid unreasonable interference with navigation or other uses of the
waters by the public);
Consistent: The proposed finger pier will not extend beyond the existing piers
length.
(ii) not extending into the channel portion of the water body; and
Consistent: The proposed finger pier will not extend into the channel portion of the
waterbody.
(iii) not extending more than one-fourth the width of a natural water body, or human -made
canal or basin. Measurements to determine widths of the water body, canals or basins shall
be made from the waterward edge of any coastal wetland vegetation that borders the
water body. The one-fourth length limitation does not apply in areas where the U.S. Army
Corps of Engineers, or a local government in consultation with the Corps of Engineers, has
established an official pier head line. The one-fourth length limitation shall not apply when
the proposed pier is located between longer piers or docking facilities within 200 feet of
the applicant's property. However, the proposed pier or docking facility shall not be longer
than the pier head line established by the adjacent piers or docking facilities, nor longer
than one-third the width of the water body.
Consistent: The proposed finger piers will not extend will not extend more than 1/4
width of the waterway.
(b)(6)(1) requires that piers and docking facilities shall not interfere with the access to any
riparian property and shall have a minimum setback of 15 feet between any part of the pier
or docking facility and the adjacent property owner's areas of riparian access. The line of
division of areas of riparian access shall be established by drawing a line along the channel
or deep water in front of the properties, then drawing a line perpendicular to the line of the
channel so that it intersects with the shore at the point the upland property line meets the
water's edge.
Consistent: The proposed finger pier will remain outside of the 15 foot setback.

(b)(7)(A) requires that bulkhead alignment, for the purpose of shoreline stabilization, shall
approximate the location of normal high water or normal water level.
Possible Inconsistency: The proposed bulkhead is below normal water level and to
be placed 2 foot in front of an existing remnant bulkhead.
(b)(7)(B) requires that bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources.
Consistent: The propose bulkhead will not be placed near any wetland area.
(b)(7)(C) requires that bulkhead backfill material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the
bulkhead is a part of a permitted project involving excavation from a non upland source,
the material so obtained may be contained behind the bulkhead.
Consistent: The applicant has indicated that the fill will be trucked in and contain
clean sand/soil from an upland location.
(b)(7)(D) requires that bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results
from natural causes or adjacent bulkheads, or it has unusual geographic or geologic
features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under
the other provisions of this Rule.
Consistent: The property currently has 533 feet of dilapidated bulkhead along the
shoreline shows identifiable erosion problems.
(ii) the bulkhead alignment extends no further below normal high water or normal water
level than necessary to allow recovery of the area eroded in the year prior to the date of
application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship
resulting from the unusual geographic or geologic features.
Possible Inconsistency: The dilapidated bulkhead has had erosion behind it since
2012 and is currently in line with the existing bulkhead to the south with no existing
bulkhead to the north.
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners
Consistent: The proposed bulkhead will not result in adverse impacts on public trust
rights or to the adjacent riparian property owners.

(iv) the need for a bulkhead below normal high water or normal water level is documented
by the Division of Coastal Management; and
Consistent: The need for a bulkhead below NWL is documented by the Division of
Coastal Management.
(v) the property to be bulkheaded is in a non -oceanfront area.
Consistent: The proposed bulkhead is in a non -oceanfront area.
(b)(7)(E) requires that where possible, sloping rip rap, gabions, or vegetation shall be used
rather than bulkheads.
Consistent: The proposed development of a bulkhead where the existing dilapidated
bulkhead has caused some erosion will benefit from a new bulkhead where riprap or
vegetation may not properly protect the property.
Based on my review of the applicable subsections of the North Carolina Administrative
Code, the permit application, and plans, I recommend a Major Permit be issued to Donald
and Gwen Hudson with the permit with standard permit conditions.

Bulkhead & Boathouse Project
Perquimans County
On September 27, 2019, the Washington Regional Office of the Division of Energy, Mineral,
and Land Resources received a copy of your CAMA Major application for the subject project. The
proposal involves the construction of a bulkhead and boathouse located at 159 Halsey Bay Road
near Hertford, NC. Staff review of the plans and specifications has determined that the project, as
proposed, consists of activities that will not pose surface water quality threats from stormwater
runoff. The Director has determined that projects that are reviewed and approved by the Division
as not posing water quality threats from stormwater runoff should not be subject to the Stormwater
management permitting requirements of 15A NCAC 21-1.1000. Forthis reason; we are informing
you by way of this letter that the current project will not require a State Stormwater management
permit.
The stormwater rules require the Division to permit the common plan of development,
therefore, any future development on the property, regardless of whether a SEC plan or CAMA
Major permit is also required, will require a Stormwater Management Permit application and
permit issuance from the Division of Energy, Mineral, and Land Resources prior to any
construction. Any construction on the subject site, prior to receipt of the required permit, will
constitute a violation of 15A NCAC 21-1.1000 and may result in appropriate enforcement actions by
this Office.

other permits and approvals, which may be required by Federal, State, or local government

request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
CAMA Major Permit and General Permit(s) 198000291 issued by the US Army Corps of Engineers (USACE).

issues it.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in your
application do not require written authorization to utilize GC 4175. However, you are required to follow

Perquimans River; at 159 Halsey Bay Road, in Bethel, Perquimans County.

Consistency Determination: The request is consistent with/not in conflict with the
Perquimans County / Town of Hertford / Town of Winfall Land
Use Plan (LUP) certified by the CRC on February 10, 2016, as
amended through March 5, 2018.
Overview: The 9.77 acre subject property has approximately 706 linear feet of shoreline along
the Perquimans. River. Water depths range from 2.5 feet at the shoreline to 3.3 feet a distance
of 203 feet from the shoreline. The property has an elevation of 5 feet above Normal Water Level
(NWL). Section 404 wetlands are located at northwest corner of the property and along
approximately 290 linear feet of shoreline to the north. The property is located primarily outside
of a floodzone, with the. shoreline fringe and Section 404 wetlands located in the AE Floodzone.
Existing site improvements consist of a single -,family residential structure, a storage shed, a
playhouse and a gravel driveway. Existing shoreline improvements include approximately 533
linear feet of bulkhead, a 50 foot long "L" shaped section of riprap, three (3) 35 foot long groins,
and a 203 foot long pier with a 10 foot by 12 foot platform and 276 square foot gazebo at its
terminus and an 8 foot by 3 foot platform with two (2) tie pilings. An erosion escarpment 2 to 10
feet deep is located behind the failing bulkhead. Two (2) of the groins are dilapidated and the
third is in slightly better condition.
Installation of 533 linear feet of bulkhead, construction of a 30.5 foot by 13 foot boathouse with a
boat lift, and installation of a 6 foot wide by 51 foot long "L" shaped finger pier and a double jet -
ski lift are proposed. The existing bulkhead, will be replaced with bulkhead located 2 feet
waterward of the current alignment an average of 5 feet and a maximum of 10 feet waterward of

NWL. Backfill and grading will extend approximately 66 feet landward from the bulkhead. Fill
material will consist of clean sand and soil brought in from an offsite location. The "L" shaped
finger pier will provide access to the boathouse. Proposed development will result in the addition
of two (2) boat slips for a total of three (3) slips.
The waters of the Perquimans River in this area are classified as Class SB waters and are closed
to shellfish taking. No submerged aquatic vegetation (SAV) was found within the project area.
As indicated in the applicant's narrative, no historical or archaeological sites have been identified
within the project area.
Anticipated Impacts resulting from this project are expected to include: the filling of .77 acre of
High Ground within the Estuarine Shoreline Area of Environmental Concern (AEC) and 1,355 sq.
ft. of Public Trust Area/Estuarine Waters AEC, and; the shading of 654 sq. ft. of Public Trust
Area/Estuarine Waters AEC.
No impacts to Section 404 wetlands are anticipated.
Basis for Determination:
The property is designated as "Residential Agricultural" on the Perquimans County Future Land
Use Map (FLUM).. Designated conservation/open space areas" are also included within the
project area. As indicated on Page IX-34 "(t)he precise location of protected/regulated areas that
have a conservation or open space connotation such as coastal wetlands, estuarine waters,
estuarine shoreline, pubic trust areas, and Section 404 wetlands must generally be determined
by field investigation on a case by case basis. These areas, scattered throughout the County and
generally found along creeks and rivers, are not individually identified on the future land use map."

"Perquimans County, Hertford, and Winfall shall establish and/or maintain
requirements that, to the extent practicable, all development shall conform to
the natural contours of the land and natural and pre-existing man-made
drainage ways shall remain undisturbed. All developments shall be provided
with a drainage system that is adequate to prevent the undue retention of
surface water on the development site. No surface water may be channeled
or directed into a sanitary sewer. Whenever practicable, the drainage system
of a development shall coordinate with a connect to the drainage systems or
drainage ways on surrounding properties or roads. All developments shall be
constructed and maintained so that adjacent properties are not unreasonably
burdened with surface waters as a result of such developments."

"Because of water quality concerns, only limited construction will be allowed
within a landward buffer (provided in accordance with locally adopted best,
management practices) of the mean high water mark on subdivision lots which
adjoin the Little River, Perquimans River, Yeopim River, the Albemarle Sound,
or their impounded waters and tributaries. The landward buffer shall not
contain any buildings or related structure, such as decks, paved patios, or
Utility sheds. The primary use of the area is the growth of natural vegetation
such as a grassed lawn. The only structure permissible within the waterfront
set -back area is an elevated pier of wood construction constructed to provide
access to the water. On -site septic systems and nitrification lines are also
prohibited from the required setback area. The locations of buildings or
related structures, such as decks, paved patios, or utility sheds in new
developments shall be subject to the more or less stringent provisions of any
applicable State law."

and erosion, shall require that all development maintain a vegetated buffer
along each side of a stream or natural drainage way. The vegetated buffer

approved water -dependent uses such as marinas, docks, piers, boat ramps
and bridges. In cases which the buffer may not be practical or desirable, the

"Perquimans County, Hertford, and Winfall will adopt and enforce ordinances
and procedures to regulate land use, development, and redevelopment and
support applicable State and Federal laws and regulations regarding building,
land uses and development in areas of environmental concern to help
preserve, protect, and enhance the Perquimans River, Little River, Yeopim
River, and Albemarle Sound. Perquimans County and its towns support
continued management of these shorelines and their attendant wetlands and
shores to protect and preserve the natural resources of the water and
shoreline, relying primarily on the Division of Coastal Management's

development should not occur; that.a variety of residential zoning districts
should be considered with varying density and intensity standards and
development requirements; that cluster development should be promoted in
various residential zoning districts; that buffering of various land uses such as
commercial and industrial.uses should be included when proposed in or near
residential areas or adjacent thereto; and, that any such approval must be
consistent with LAC #30, page IX-22"

I was emailing to inquire whether the applicant for the Hudson project in Perquimans County had an SAV survey done
on their property. The project narrative mentions that there is no SAV on the property, however aerials as well as
historic NCDMF & APNEP SAV surveying indicates otherwise. According to RDMF rule, SAV habitat is defined as the
presence of SAV within the last 10 years.
Unfortunately, I do not have the time to perform an SAV survey for the applicant before the end of October growing
season. Would the field representative be able to provide information and site pictures to the fact that there is no SAV
in the proposed area of the new bulk head alignment? Also, would be applicant be willing to have a simple saavysurvey
performed within the footprint of their bulk head placement and docking facility? (V-5�

PROJECT SUMMARY:
The applicant proposes to install new bulkheading, construct a boathouse and boatlift within an
existing slip, construct an L-shaped finger pier around the boathouse and install a double jet -ski
lift on the existing pier on the Perquimans River.
Proiect Settin
The property proposed for development is located at 159 Halsey Bay Road (SR1400) in
Hertford and consists of 9.77 acres adjacent to the Perquimans River. The upland portion of
the property contains a single family residence, a storage shed and playhouse along with a
gravel driveway and indigenous yard grasses with a few trees. The property to the north is an
undeveloped private lot and the property to the south is a residential property with a
bulkheaded shoreline and single family dwelling.
Vegetation on the site includes, but is not limited to, indigenous yard grasses, loblolly pine
(Pinus taeda), white oak (Quercus alba), southern. magnolia (magnolia grandiflora), sweet gum
(Liquidambarstyraciflua), red maple (Acerrubrum), and Bald Cypress (Taxodium distichum).
Soil types include Roanoke Silt Loam (Ro) and Chowan Silt Loam (CO). The property has an
elevation of 5 feet above Normal Water Level (NWL).
The shoreline with a length of 706 feet currently contains a failing bulkhead with an erosion
escarpment between 2 -10 feet behind the existing bulkhead with riprap on the northern end.
There is currently a 203 foot pier with a 10 foot by 12 foot platform and a 276 square foot
gazebo at its terminus. A lower platform is located about mid -way up the pier measuring 8 foot
by 3 foot along with 2 tie pilings. There are also 2 dilapidated groins and a third that is in
slightly better condition, all are approximately 35 feet in length. The water classification for this
site is Primary Recreation, Salt Water (SB). Submerged aquatic Vegetation (SAV) was not
found within the project area. The water depths range from 2.5 feet near the bulkhead to a
depth of 3.3 feet at the terminus of the pier.
Development Proposal
The applicant proposes to replace 533 feet of bulkhead two feet out from the alignment of the
existing dilapidated bulkhead with an of average 5 feet waterward of NWL and a maximum
distance of 10 feet. The backfill and grading will extend approximately 66 feet landward from
where the new bulkhead is to be placed and will be brought in from an offsite location
consisting of clean sand and soil. On the north side of the pier,.the applicant is proposing to
construct a 30.5 foot by 13 foot boathouse with a lift. A 51 foot by 6 foot L-shaped finger pier
will be constructed around the boathouse to provide access to it. A double jet -ski lift will also
be installed on the north side of the pier. The development will result in the addition of two boat
slips for a total of three slips. The water depth at the terminus of the existing pier is 3.3 feet.
The existing pier is 197 feet long which is less than the quarterwidth of 1,749 feet. No portion
of the existing pier or proposed new additions will fall within the 15 foot setback on either side
of the pier.
Anticipated Impacts
The proposed development will result in the filling of 33,558. square feet of Estuarine
Shorelines and 1,355 square feet of Estuarine Waters Area of Environmental Concern. The
proposed development will also result in the shading of 654 additional square feet of Estuarine
Waters and Public Trust Areas of Environmental Concern. Temporary turbidity will occur
during construction.

Directions:
From the south end of the US Highway 17 bridge over the Perquimans River,
continue to the southwest to the intersection of State Road 1336 (Harvey Point
Road), and turn left. Proceed 4.3 miles to the southeast to a traffic circle.
Continue straight through the traffic circle on Harvey Point Road for another
1.9 miles to the intersection of State Road 1400 (Halsey Bay Road), and turn
left, Proceed northeast for 0.25 miles to a driveway on the left. Turn left into
the driveway and follow to its end. Development site, along the Perquimans
River is 190-ft straight ahead.
SITE: Description:
The project area consists of a 9.77 acre tract of land bordered along most of its
southeastern boundary by Halsey Bay Road, and along its northeastern
boundary by the Perquimans River. This tract is owned by Donald and Gwen
Hudson, and identified on Perquimans County Records as 159 Halsey Bay
Road, Bethel Township, and by PIN as 7877-33-0505.
The shoreline of the tract along the Perquimans River is 706 feet. This number
is measured between the lot boundaries and along the alignment of the
existing bulkhead, and does not take into account minor shoreline fluctuations
along this property boundary observed on a site visit on 5n12019.
AdjoiningDevelopment:
All lots surrounding this Hudson tract are zoned RA for similar uses as part of
a Rural Ag District. The lots to the west of the Hudson tract are currently
undeveloped, and are under active agriculture. The two lots to the north of the
tract, along the river, are undeveloped, while the 9 lots to the south of the tract,
along the river, have existing residential development, with all but the first and

sixth lots to the south having in -water development. The closest pier to the.
north of the Hudson tract lies approximately 0.5 miles away, while the closest
0 CT 1 5 2019 Pier to the south of the Hudson tract lies approximately 0.1 miles away.
Erosion;
Erosion is readily discernable along the shoreline of the Lot, landward of the
existing failing bulkhead. There exists approximately 785 square feet of
formerly uplands that has washed out from behind the bulkhead. At the most
severely eroded areas, there has been approximately 5-ft of uplands eroded.
The erosion escarpment in these areas is` approximately 4-ftabove. Normal
Water Level (NWL), extending landward and above the top of the existing
bulkhead, which.is situated approximately 2.7-ft above the NWL.
This shoreline along the Perquimans River is a high energy shoreline where
winds cross an open fetch of water ranging from approximately 3.6 miles
when blowing from the north-northwest, 5.2 miles when blowing from the
east, and a minimum of approximately 1.2 miles when blowing from the east-
northeast. This shoreline is sheltered by land when winds range from the
north-northwest, counter -clockwise, to the east.
Soils:
Information available from the USDA indicates two hydric soil types exist:
Roanoke Silt Loam (Ro), and Chowan Silt Loam (CO). The Roanoke Silt
Loam soil type comprises approximately 77% of the Lot and extends
approximately to all areas of the lot above the 4-ft contour level. The Chowan
Silt Loam soil type comprises' approximately 23% of the Lot, and extends
from the 404 wetlands in the northern comer of the lot in a southerly direction
between the confines of the 4-ft contour level. The soil in the area of proposed
development along the Yeopim River is classified in its entirety as Chowan
Silt Loam (CO) soil.
Hydrology:
The hydrology of the project area varies by soil type. The area of Roanoke Silt
Loam soil is 0 to 12 inches above the water table under normal conditions,
while the area having Chowan Silt Loam is normally 0 to 6 inches above the
water table.
The Roanoke Silt Loam soil is considered to be poorly -drained, having a
capacity of its most limiting layer to transmit water (Ksat) listed as very low
to moderately high (0.00 to 0.20 in/hr), and a depth to restrictive features of
more than 80 inches. It is listed as having,a high water capacity of about 9.2
inches. A typical profile is listed as: Silt Loam 0 — 8 inches; Clay Loam 8 - 13
inches; Clay 13 — 58 inches; Fine Sandy Loam 58 80 inches.
The Chowan Silt Loam soil is considered to be very poorly -drained, having a
capacity of its most limiting layer to transmit water (Ksat) listed as moderately
high to high (0.20 to 5.95 in/hr), and a depth to restrictive features of more
RECEIVED than 80 inches, It is listed as: Silt Loam 0 — 6 inches; Silty Clay Loam.6 = 27
inches; Muck 27 — 80 inches.
OCT 1 5 2019 Some of the drainage from this tract is naturally conveyed down -slope through
sheet flow to the 404 wetlands in the northern corner of the lot, and similarly

in a northeast, down -slope manner to the waters of the Perquimans River,
bordering the existing bulkhead. Other drainage, when not absorbed by soils,
finds an existing man-made drainage ditch through sheet flow along the
southeast border of the property.
The Normal Water Level of the Perquimans River appears, from vegetative
growth visible on tree buttresses and root mats, to vary by 12 to 16 inches in
response to seasonal wind direction. Strong, sustained, seasonal winds Likely
cause temporary excursions of the water level two to three feet above and
below the Normal Water Level.
Section 404 Wetlands:
A 404 wetland delineation has not been conducted for this tract. However, an
assessment has been made for the presence of any such wetlands within the
area where the shoreline protection development is proposed. No 404 or North
Carolina coastal wetlands were observed in the area of proposed development.
An area of uncleared 404 wetlands (approx. 1.1 acres) exists at the northern
comer of the property, extending inland from the shoreline. These wetlands
are separated from the area of proposed bulkhead replacement by
approximately 45 feet, and an existing riprap alignment. There also exists a
pocosin that constitutes a smaller area (approx. 0.3 acres) of isolated wetlands
to the south of the wetlands at the northern corner of the property. These
wetland areas consist of a canopy of loblolly pine (Pinus taeda), sweet gum
(Liquidambar styraciflua), Bald cypress (Taxodimn distichum), red maple
(Ater rubrum) and atlantic white cedar (Chamaecyparis thyoides), with lower
shrubs and vines, including cat greenbriar (Smilax glauca), giant cane
(Arundinaria gigantean) and Virginia creeper (Parthenocissus quinquefolia).
U12lands:
The upland area surrounding the residential structure has been largely cleared
(approximately 3.9 acres), with a number of trees remaining, including
loblolly pine (Pinus taeda), white oak (Quercus alba), and southern magnolia
(Magnolia grandiflora). There exists approximately 4.3 acres of the Lot that
have not been cleared in the northwest half of the Lot, including the areas of
the Lot above the 404 wetlands and below the 4-ft contour. The upland
vegetation in the uncleared areas consists predominantly of loblolly pine
(Pinus taeda), sweet gum (Liquidambar styraciflua), red maple (Ater rubrum),
atlantic white cedar (Chamaecyparis thyoides), Virginia creeper
'eclaW
(Parthenocissus quinquefolia) and American pokeweed (Phytolacca
americana). There exists approximately 1.2 acres of cleared land in the
southern corner of the Lot, which is utilized in active agriculture. Vegetation
is typically a rotational crop of corn, soybeans and cotton.
Waters:
RRECEIVE®
The waters of the Perquimans River, from a line from Barrow Point to Ferry
Point, extending to the Albemarle Sound, are classified by NC Division of
Water Quality as SB waters. 'Phis includes the waters along the project site.

'These waters are outside any primary or secondary nursery areas. The waters

along the project site adjoining the Perquimans River are Joint Coastal and
Inland Waters Management Areas, subject to the jurisdiction of both the
Wildlife Resources Commission and the Division of Marine Fisheries.
While the waters adjoining this tract lie outside any Primary or Secondary
Nursery Areas, and are not designated as an Anadromous Fish Spawning area,
the waters adjoining the project site are included within the Albemarle Sound
Striped Bass Management Area and the Albemarle Sound River Herring
Management Area. These waters have been designated by the NC Shellfish
Sanitation Commission to be prohibited areas for shellfish harvesting.
Submerged Aquatic Vegetation (SAV):
In that this,Permit seeks only limited in -water development no specific effort
was made to assess the entire nearshore areas for SAV. However, on 7/3/2019,
the footprint of the proposed replacement bulkhead, and the areas of the
proposed boat house and boat lifts were raked to detect the presence of any
SAV. The results were the detection of two, detached; non -rooted strands of
Southern Naiad (1Vajas guadalupensis) in the vicinity of the two existing
mooring piles, approximately 165-ft water -ward of the shoreline, at a depth of
approximately 3-ft. 'The Secchi depth for the entire area examined was 1.54
There were no beds of SAV detected, nor any rooted SAV plants associated
with the proposed docking structures or bulkhead.
Historical -Archaeological:
No Historical/Archaeological sites within the development area are indicated
on the location maps retained by the NC Division of Coastal Management.
There is one site, PQ322, located approximately 0.9 miles to the west-
northwest of the development area
Species of Concern: .
In Perquimans County, five vertebrate species of concern are listed by the US
Fish and Wildlife Service and the National Marine Fisheries Service, and one
vascular plant. Three of the vertebrate species are listed as Endangered These
are the Atlantic Sturgeon (Acipenser oxyrinchus), the Shortnose Sturgeon
(Acipenser brevirostrum) and the West Indian manatee (Trichechus manatus).
These species could be present in this area, but no reports of any sightings
have been identified. One of the vertebrate species is listed as Threatened.
This is the Red Knot (Cal idris canutus n fa): This species could be present in
this area, but no reports of any sightings have been identified. One of the
vertebrate species listed is the Bald eagle (Kaliaeetus leucocephalus), and it is
a protected species under the Bald and Golden Eagle Protection Act. This
species is known to be present in the area, and has been reported to be seen

in the vicinity. No nesting sites have been noted in the area, and there
was no nesting habitat for this specie observed in the area of proposed
development.

The vascular plant listed is Raven's seedbox (Ludwigia ravenii), and is,
classified as an At Risk Specie. This plant was not observed during the site
evaluation,and its typical habitat of peat soils and bogs make it unlikely that it
exists within the area of proposed development,
It is unlikely that the proposed development will have any impacts on the
identified species of concern.
DEVELOPMENT: Proposed New as Part of this Permit Application:
This project, in addition to the proposed replacement of the erosion control
bulkhead, includes proposed development of a double jet -ski boat lift, a boat
house, with supporting finger piers and boatlift for a single boat slip, within
waters of the State of North Carolina, including attachment to State bottom
beneath the waters, The proposed development would result in a total of 3
boat slips on this property. The project, as proposed, is in compliance with the
N. C. environmental Policy Act (N,C.G.S. 113A I-10).
Replacement Bulkhead: A 533-ft long sheet -pile bulkhead of approximately
18 inch width, with return walls on each end of the bulkhead, each of
approximately 16-ft length. The location of the replacement bulkhead is
proposed to be 2-ft water -ward of the existing bulkhead alignment.
Boat House: A boat house is to be constructed on the north side of the existing
pier, between the existing platform and existing bulkhead, where two mooring
piles now exist, Not greater than 400 sq ft, it will be of approximate
dimensions 13-ft x 30.5-ft, enclosing a boat lift, and accommodated by 6-ft
wide walkways, totaling 51-ft, along its southwestern and northwestern
dimensions
Boat Lift: A mechanical boat lift is to be constructed of approximate
dimensions of 1.2-ft by 25-ft within the confines of the Boat House. This boat
RECEIVED lift will be supported by three piles on each side of the slip.
Double Jet -Ski Lift: A double jet -ski boat lift is to be constructed adjacent to,

the existing bulkhead. It will accommodate two jet -skis, and will be supported

Additional Development: Additional development includes the grading, and/or
fill of the uplands (approx. 0.85 acres) landward of the alignment of the
proposed replacement bulkhead. It is proposed to achieve a slope 1:6 from the
a' C 0U i t1- top of the uplands down to a terrace even with the top of the replacement
bulkhead (+4 NWL), and nowhere steeper than a slope of 1:3.
Existing:
Prior development includes one residential structure, with an associated
playhouse, storage shed, brick paver sidewalks, a brick paver parking area, an
asphalt driveway and an asphalt roadway surface leading in from Halsey Bay

Road. Additional existing development includes a drainage ditch, a bulkhead
of approximately 533-ft, a short %" shaped section of riprap of approximately
50 feet, a pier of approximately 203 feet in length with a terminal platform of
approximately 128 sq: ft., and an adjoining gazebo of approximately 276 sq.
ft. Also existing are 3 wooden groins of approximately 35-ft in length, 2 to the
north of the existing pier, and 1 to -the south. Demolition of these three groins
is intended to take place at the time of the bulkhead replacement.
UTILITIES Wastewater:
Wastewater is handled by an onsite septic tank and leach field.
Potable Water:
Potable water is provided by Perquimans County.
Power: '
Power is provided on overhead poles through Albemarle Electric Membership
Corporation.
ele hone:
Telephone is provided on overhead poles by Century Link, and internet
service is similarly provided through Embarq.
IMPACTS Project development under this Permit application seeks no new impervious
surface. Overall project development involves the following impacts:
Built -upon Area: This will not be increased by the proposed development.
Boathouse and Boat Lifts: Shaded area over the Perquimans River will
increase by 611 sq ff. as'a result of the Boathouse, walkway and jetski lift
construction, bringing total shaded area to approximately 1094 sq ft. Driving
of pilings will result in minor, temporary acoustic shocks within the water
column. Driving or jetting of pilings will result in minor, temporary turbidity
in the water column. No shading of SAV beds is anticipated from the
Boathouse and Boat Lifts.
Bulkhead: Bulkhead backfill will fill approximately 1851 sq. ft. of the
Perquimans River. This will consist of approximately 785 sq. ft. where
uplands have washed out from behind the failing bulkhead, and approximately
1066 sq. ft. between the failing bulkhead and the replacement bulkhead 2-ft
water -ward. Driving of pilings and sheet -piles will result in minor, temporary
acoustic shocks within the water column. Driving or jetting of pilings and

sheet-piles/boards will result in minor, temporary turbidity in the water
column. Placement of bulkhead tiebacks and grading of uplands to slope to the
top of the bulkhead will result in soil disturbance of approximately 0.85 acres.

Access: Access for equipment and materials is available through the tract to
the Areas of Environmental Concern in the vicinity of the proposed
development without crossing any Section 404 wetlands or coastal wetlands.
AVOIDANCE AND
MIMIMIZATION Applicant seeks to provide additional boat use and mooring capacity for this
lot with a combined boathouse and boat lift, and a second double jet -ski lift.
Location and alignment of these strictures has been selected based on no
observed presence of SAV beds. Shading impacts are minimized by keeping
boathouse and walkway, and boathouse and platform areas to only 55% of that
allowed under the Rules of the Coastal Resources Commission.
Applicant seeks to provide erosion protection along the shoreline now
protected by a failing bulkhead adjoining the Perquimans River through the
construction of a replacement, pile -supported wooden, and/or vinyl sheet -pile
bulkhead two feet water -ward, as per the Rules of the Coastal Resources
Commission for General Permits.
Sedimentation and erosion control during construction will be provided by
construction sequence, with bulkhead construction being completed, where
possible, prior to disturbance of adjoining uplands to provide backfill. In
addition, construction of bulkheads will include the placement of filter cloth
along the landward side of the bulkhead structures, extending landward a
minimum of 6 feet from the ,exposed bottom of the bulkhead. If jetting of
bulkhead components is utilized, additional erosion protection will be
provided in the form of silt fence and/or turbidity curtain as may be
appropriate. If disturbance of uplands landward of the bulkhead alignment is
necessary before the bulkhead is in place, temporary silt fence will be placed
as needed.
Post -construction erosion is minimized by creating a nearly level terrace even
with the top of the replacement bulkhead at approximately +4-ft (NWL), and
grading the +6-ft landward uplands on a design slope of 1:6, and in no case
RECEIVE® greater than a slope of 1:3. Stabilization of adjoining uplands will be
addressed by providing seeding of the disturbed areas at the completion of the
land disturbance.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval to install bulkheading, construct a boathouse and boatlift within an existing slip, an
L-shaped finger pier around the boathouse and install a double jet -ski lift on an existing pier located
at 159 Halsey Bay Road, in Perquimans County. It was received complete on September 16, 2019
and appears to be adequate for processing at this time. The projected deadline for making a
decision is November 30, 2019. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 16, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.

APPLICATION FOR CAMA MAJOR
DEVELOPMENT PERMIT
The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 06/17/19. Donald and Gwen Hudson
propose to construct a boathouse and boatlift within an existing slip, construct an L-
shaped finger pier around the boathouse, install a double jet -ski lift and install new
bulkheading at 159 Halsey Bay Road in Perquimans County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 10/22/19, will be considered
in making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state
& federal agencies. Notice of the permit decision in this matter will be provided upon
written request.
