This permit, issued on Aueust 9, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Dockine Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee Nina Heard Permit N%63- 9 Page 2 of 3 ADDITIONAL CONDITIONS 3) In order to satisfy concerns of the resource agencies, physical stops shall be placed on the boat lift at a minimum height of 18" above the bottom substrate to prevent the boat lift from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 4) Any portion of the permitted access pier and docking facilities built -over Coastal Wetlands shall not exceed six (6) feet in width and shall be elevated a minimum of three (3) feet over the wetland substrate as measured from the bottom of the decking. 5). The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit, The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible.dur_ ing hours of darkness or inclement. weather. 8) This permit authorizes a maximum of three (3) formalized boat slips. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mainmal/manatee guidelines.pdf.- General 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the . written approval of the Division of Coastal Management. Nina Heasor*- Permit No. 63-19 Page 3 of 3 ADDITIONAL CONDITIONS 14) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 15) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2019-01010). NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2019- 0760. NOTE: An application processing fee of $250 was received by DCM for this project. The project is located at 2306 W. Yacht Club Drive, adjacent in Oak Island. I have reviewed this proposal for consistency with the Town of Oak Island CAMA Land Use Plan and offer the following comments. The general area of the project is classified as Residential. Waters at the project site are classified as SA; HQW and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. Areas of Environmental Concern (AFC's) are EW and PTA. Oak Island allows development in Residential classified AECs, which is consistent with the State's minimum use standards. The Oak Island Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these policies appear to be applicable to this project. PROJECT DESCRIPTION The subject property is located at 2306 West Yacht Drive, adjacent to the AIWW, in the Town of Oak Island, Brunswick County. To find the project site, travel south on US Highway 17 to NC-906. Travel approximately 11 miles south on NC-906 to Oak Island, cross Middleton Bridge and turn right onto West Yacht Drive. Turn right onto NW 23`d street and left on West Yacht Drive. The property of interest will be located on the right between NW 23`d and NW 24d' streets. The project site consists of one waterfront Parcel with approximately 66 linear feet of shoreline. The elevation of the high ground area of the lot averages approximately 6 ft. above normal high water (NHW). High ground vegetation consists primarily of native grasses and pine trees which transitions areas of Section 404 wetlands and then to an approximately 116 ft. wide area of Coastal Wetlands consisting of Salt Marsh Cordgrass (Spartina alternii fora), Spike Grass (Distichlis sp.), Black Needlerush (Juncus Roemaerianus), Sea Lavender (Limonium sp), Bulrush (Spirpus sp.) and Salt Meadow Grass (Spartina patens.). The existing pier extends approximately 90 ft. into the AIWW from NHW and the AIWW measures approximately 525 ft. in this area. The existing pier terminates at a 10 ft. long by 15 ft. wide covered gazebo. A ramp extends waterward along the eastern side of the gazebo to a 16 ft. long by 12 ft. wide floating dock with 4 adjacent pilings. There is an existing 21 ft. by 6 ft. finger pier extending perpendicular to the shoreline on the west side of the gazebo with an adjacent 12 ft. long by 12 ft. wide boat lift. Existing water depths at the waterward end of the two -slip docking facility are approximately -lft. at Normal Low Water (NLW). The project site is bordered by West Yacht Drive to the south, the AIWW to the north and residential lots to the east and west. The Town of Oak Island Land Use Plan classifies the high ground portion of the project area as Residential. The waters of the AIWW are classified SA; HQW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to extend the existing pier waterward, add a new gazebo and boatlift and relocate the existing floating dock and boatlift to deeper water for a total of three formalized boat slips. The applicant proposes to add a total of 36 ft. to the existing docking facility extending waterward from the existing gazebo. As proposed, a 7 ft. waterward extension of the existing finger pier would extend from the western side of the existing covered platform leading via ramp to the 16 ft. wide by 12 ft. long floating dock, which would be relocated waterward of the existing pier. Two boatlifts, measuring 12 ft. long by 12 ft. wide would be installed on either side of the floating dock. A new gazebo, measuring 16 ft. long by 15 ft. wide would be installed landward of the floating dock on the eastern side of the new finger pier extension. According to the narrative the added docking facility length would relocate the floating dock and boat lifts to deeper water where water depths measure approximately -2 ft. at NLW (see Drawing 1, 2 of 3 of 3). The waterward end of the docking facility extension would be in line with the established pierhead line for the area. As proposed the docking facility would not exceed the '/4 width of Eastern Channel, which measures approximately 525 ft. across and would not encroach into either adjacent 15 ft. riparian setback. ANTICIPATED IMPACTS The proposed new pier extension and re -located floating dock and boatlift would result in the additional incorporation of 748 Sq. ft. of open water area in the Estuarine Water and Public Trust Areas of Environmental Concern (AEC). The proposed docking facility extension would also alleviate the potential for detrimental impacts due to the current low water depths in the location of the existing floating dock and boatlift. Then relocating the existing floating dock and boat lift to the end of the extension. We will be adding a 15' x 16' covered fixed pier and also adding a second boat lift creating 3 slips. By moving out it will go from 69' to USACE to 32' to USACE and will be in line with existing pier line. Project will make new docking facility more in line with the Riparin Corridor. It will also move existing slips from 12" MLW to 24" MLW for new slips. All work will be done from a small barge and there will be no wetland disturbance.
