Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Geraghty Permit No. 68-19 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be constructed prior to any backfilling activities. 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials, through the structure. 6) The fill material shall be clean and free of any pollutants except in trace quantities. 7) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 8) No backfill material is to be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead. 9) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 10) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Observation Pier 11) This permit authorizes only the pier, platform, stairs, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this observation pier without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 12) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 13) This permit does not authorize any formalized boat slips. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. Jane E. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-01211) issue 8/2/19. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 19-0891 issued 8/13/19. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The applicant also is proposing to demolish an existing pier and platform and construct a 20' x 4' pier with a 20' x 20' platform SECTION .0200 — THE ESTUARINE AND OCEAN SYSTEMS 15A NCAC 07H .0203 MANAGEMENT OBJECTIVE OF THE ESTUARINE AND OCEAN SYSTEM It is the objective of the Coastal Resources Commission to conserve and manage estuarine waters, coastal wetlands, public trust areas, and estuarine and public trust shorelines, as an interrelated group of AECs, so as to safeguard and perpetuate their biological, social, economic, and aesthetic values and to ensure that development occurring within these AECs is compatible with natural characteristics so as to minimize the likelihood of significant loss of private property and public resources. Furthermore, it is the objective of the Coastal Resources Commission to protect present common law and statutory public rights of access to the lands and waters of the coastal area. The proposed alignment average of 9.1' is consistent with the rules or management objectives See use standards for bulkheads. 15A NCAC 07H .0208 USE STANDARDS (a) General Use Standards (1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. (2) Before being granted a permit, the CRC or local permitting authority shall find that the applicant has complied with the following standards: (A) The location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas; Consistent: No significant impact. (B) Development shall comply with state and federal water and air quality; Consistent: Not an issue. (C) Development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources; Consistent: No known sites. (D) Development shall not increase siltation; Consistent: As designed siltation should not be an issue. (E) Development shall not create stagnant water bodies; Consistent: Open design (F) Development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources; and Consistent: This standard can be met by permit condition. However, the same standard should be applied to this project with General Permit bulkheads and piers. (G) Development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The length of the pier will in line or shorter than adjacent piers (3) When the proposed development is in conflict with the general or specific use standards set forth in this Rule, the CRC may approve the development if the applicant can demonstrate that the activity associated with the proposed project will have public benefits as identified in the findings and goals of the Coastal Area Management Act, that the public benefits outweigh the long range adverse effects of the project, that there is no reasonable alternate site available for the project, and that all reasonable means and measures to mitigate adverse impacts of the project have been incorporated into the project design and shall be implemented at the applicant's expense. Measures taken to mitigate or minimize adverse impacts shall include actions that: Consistent: No conflict. (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; Consistent: Proposed pier is 4' in width. (B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: One pier is proposed with 75' linear feet of shoreline: 400sf is consistent with the maximum. (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: None proposed. (D) A boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas; Consistent: None (E) The total area enclosed by an individual boatlift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift Consistent: None. (F) Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use; Consistent: None (G) Pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: <100' (ii) not extending into the channel portion of the water body; and Consistent: Does not encroach into a navigation channel. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: No USACE channel and less than %the width of the sound. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100-foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. Consistent: <100' (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. Consistent: The proposed will maintain a minimum of 20' from the closest riparian line. (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. Consistent: No shellfishing franchise in the area. (7) Bulkheads (A) Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level; Inconsistent: The proposed bulkhead will be an average of 9.1', and a maximum of 11', waterward of NWL. The alignment is based on a desire of the owner to stop continuing deposition of debris that builds up along the bulkhead following storms and to reduce erosion on the landward side of the bulkhead. This is especially evident along shorelines with a long fetch. In the case of this property the prevailing winds are from the south southwest in the summer with a minimum of a 9-mile fetch. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: Geographic location intensifies the wave action on this property. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent: The proposed bulkhead will not adversely impact public trust rights. (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; Consistent: Failing bulkhead. (v) the property to be bulkheaded is in a non -oceanfront area. Consistent: Estuarine Shoreline in Joint waters. (E) Where possible, sloping rip -rap, gabions, or vegetation shall be used rather than bulkheads, Consistent: The use of gabions and vegetation along this shoreline would not be a successful method of erosion control. DATE: July 16, 2019 Consistency Determination: The request is consistent with/not in conflict with the Perquimans County / Town of Hertford / Town of Winfall Land Use Plan (LUP) certified by the CRC on February 10, 2016, as amended through March 5, 2018. Overview: The project site consists of a .24 acre lot with approximately 75 linear feet of shoreline along the Albemarle Sound. Water depths along the property vary from 2 feet at the shoreline to 3 feet at a distance of 50 feet from the shoreline. The property elevation is not included in the Field Investigation Report. Vegetation on the lot consists of domestic grasses, ornamental shrubs and a single tree. The southernmost two-thirds of the property is located in the AE Floodzone, with the remainder being outside of a Floodzone. Existing site improvements consist of a single -story residential structure with associated infrastructure and a storage building. Existing shoreline improvements consist of 78.6 linear feet of bulkhead, a 5 foot wide by 28 foot long pier with a 16 foot by 16 foot terminus platform and stairs, and two (2) tie pilings. The bulkhead connects to a bulkhead on adjacent property to the west at a 45 degree angle, notches landward for approximately 11 feet, then extends 63 feet before turning and extending a distance of 12.6 feet at the connection to a bulkhead on adjacent property to the east. The average landward depth of the cutback is 9.1 feet and the maximum depth is 11 feet. The cutback area has a history of collecting debris that settles on the water bottom. Both the bulkhead and pier are in poor condition. Installation of 75 linear feet of bulkhead and a 4 foot wide by 20 foot long pier with a 20 foot by 20 foot terminus platform is proposed. The existing bulkhead, pier and platform, and stairs will be removed. The elevation of the bulkhead will be 5 feet above Normal Water Level (NWL). The waters of the Albemarle Sound in this area are classified as Class SB waters and are closed to shellfish taking. The Albemarle Sound is greater than 8 miles wide at the project location. The applicant has stated that they found no submerged aquatic vegetation (SAVs) within the project area, however aerial photos and SAV maps clearly show the area to be SAV habitat. There are no known geological formations, historic sites or archaeological sites associated with the property. Anticipated Impacts resulting from this project are expected to include: the grading of 1,500 sq. ft. of Estuarine Shoreline Area of Environmental Concern (AEC); the filling of 686 sq. ft. of Public Trust Area/Estuarine Waters AEC, and; the shading of 480 sq. ft. of Public Trust Area/Estuarine Waters AEC. Basis for Determination: The property is designated as "Residential' on the Perquimans County Future Land Use Map (FLUM). "Designated conservation/open space areas" are also included within the project area. As indicated on Page IX-34 "(t)he precise location of protected/regulated areas that have a conservation or open space connotation such as coastal wetlands, estuarine waters, estuarine shoreline, pubic trust areas, and Section 404 wetlands must generally be determined by field investigation on a case by case basis. The property is a 75' wide residential lot, in a small waterfront residential community, fronting on the Albemarle Sound. The property consists of -10,554square feet (so of high ground. Adjacent uses are residential. Vegetation on the property consists of domestic grasses, ornamental shrubs, and one tree. Currently located on an adjacent to the property is a residence (and associated infrastructure), a storage building, a bulkhead, a pier, and two tie pilings. Both the bulkhead and pier are old structures in poorcondition. The existing bulkhead is -78.6' long, of that, only 3' at the southeast corner is in line with the neighboring bulkheads. The bulkhead cuts back into the applicant's property -11' and continues along the sound for 63', turning back out at a 45' angle for an additional 12.6', terminating in line with the adjacent bulkhead. The average landward depth of the bulkhead cutback is 9, V and the maximum depth is 11'. This area has a history of collecting debris that settles on the water bottom. The existing pier is 28' x 5' with a 16' x 16' platform and stairs to the water. Adjacent to the pier and platform are two tie pilings. Located -56' landward of NWL is a small single story frame dwelling. The dwelling is a second home for family use to fish and swim. The property is located in an AE Flood Zone according to Flood Insurance Rate Maps (FIRM), and is zoned RA 25 by the County. The waterbody width at the applicant's property is >8 miles. The waters of the Albemarle Sound adjacent to the applicant's property are SB and are not open to shellfishing. While the applicant has stated that they found no submerged aquatic vegetation (SAVs) within the prosed project area, aerial photos and SAV maps clearly show that area to be SAV habitat. Water depths along the property vary from 2' at the existing bulkhead to 3' at the waterward end of the proposed pier. There are no known geologic formations, historical sites or archaeological sites associated with theandi- nt's EIVED property.�EE((;; Development Proposal JUL 0 2 2019 Bulkhead Replacement: The applicant, proposes to replace a 78.6' bulkhead with a straight 75ft� � CITY paralleling the shoreline, and in line with her neighbors. If approved the development would result in 685.75sf of shallow water bottom fill. The average area of disturbance associated with bulkhead construction is 20' landward of the bulkhead being replaced. Anticipated disturbance associated with the bulkhead is -1 500sf of high ground. Pier and Platform: The applicant proposes to demolish an existing 5' x 28' pier and 16' x 16'sf platform (396sf) and construct a new 4' x 20' pier with a 20' x 20' platform (480sf of shallow water bottom). The proposed structure will be elevated 4' above NWL and result in an increase of 84sf of shallow water bottom shading. The new pier will be 52' from the neighboring pier to the southeast, 135'from the nearest pier to the northwest and 20' from the nearest riparian line. Geraghty) DIC E 252-903-2300 The property located at 461 Winslow Road, Hertford NC, has been owned by J. Geraghty for 20 years. Through those years the property has been through many tropical storms and hurricanes. On a regular basis the pier and bulkhead receive heavy wave action under high wind conditions. During last year's hurricane the bulkhead released two of its lag bolts that secure the pilings to the bulkhead face. The bulkhead face is not able to move approximately 2 to 4 inches. Last year's hurricane also had several days of over wash from high storm surge, high wind driven tides and low bulkhead height. The pier at this same time was lifted and resettled below its original height. The bulkhead over wash removed several cubic yards of dirt and grass just behind the bulkhead. This has created an area that is unusable for yard or our use. It has presented a problem to access the pier due to 3 feet of ground directly in front of the pier access being washed away. The Bulkhead has had no work done to it since it was installed prior to Mrs. Geraghty's purchase of the property. The pier has been patched up and repaired on several occasions due to storm damage. The pier was built with undersized materials for support when it was originally built before Mrs. Geraghty purchased the property. The pier currently is in need of a complete replacement due to the hurricane last fall and its damage. The main platform of the pier is sagging in the middle and it is uneven across all four sides. Some damage to the supports and pilings is evident. Our neighbors' properties are much farther out into the water than ours. This has been like this since before the purchase of the property. The west side owned by Richard Harrell (brother of Mrs. Geraghty) sits 9.5 feet out from the bulkhead of this property. It has a 45 degree angle form his bulkhead to ours to help alleviate the buildup of sea -grass, debris and help reduce the direct impact of the wave actions. The east side owned by Lorne Adams is 11 feet out from the bulkhead. This side is a 90 degree angle. It catches large amounts of debris, which we have to be constantly removed, it catches large amounts of floating sea grass which decays and smells horrible, it also catches items like crab pot buoys and dead fish from crabbers. We have had times where small children have been injured from debris under the water in this area. The water level is 2 feet at the bulkhead, but small children cannot use this area for fear of injury from objects that have collected in this corner. Wave action impacting this corner has no way to release the energy except directly into the bulkheads and it has caused severe damage and erosion on our bulkhead and the neighbors. The east neighbors entire bulkhead needs to be repaired or replaced also. They are in the process of applying to have their bulkhead permit issued at this time. Our desire is to catch up with the neighbors bulkheads and have a flat constant line with no setbacks to reduce the build up of debris. We have suffered through this issue for 20 years. By having the bulkhead line up it will help the entire strength of all the bulkheads. It will also assist our neighbors by not having to run a bulkhead back into the yard between our properties to prevent any wash out or over wash that ,,j could undermine the strength of the bulkheads. Our proposal is to move our new bulkhead out IVapproximately 9$feet on the west side to line up with the neighbors existing bulkhead and JLQ approximatelyltIL'A feet on the east side to align with the newkulkbeaalthe neighbors w4l�IK in66&ag. 'I ttuiy wpucaihairs. We plan to run 5 feet into the ground for the pilings and bulkhead boards and 5 feet above the ground for both also to help with over wash. Pilings will be set at normal spacings per the builder and the remainder of the bulkhead will be built with standard construction methods. Figures for this show we would need to fill a void of approximately 6300 cubic feet. That would require about 22 loads of fill dirt. The pier replacement would begin at the new bulkhead and run out into the water no more than 50 feet. We would have a 4 foot walkway to the pier and a 20 foot by 20 foot platform at the end. The water depth at the end is 2.5 feet, at the mid point 2.25 feet and at the bulkhead it is 2 feet. The pier would be constructed using 6 X 6 pilings and standard decking boards. Frame and runners will be 2x8 material. Spacing of the pilings will be normal per the builder. Steps will be on the seaward side of the pier. We know that asking for this distance out from our old bulkhead is not normal. We hope that you see we need to have our bulkhead pushed out to run even with both neighbors. Mrs. Geraghty is 81 years old and it is difficult for her to clean out any collected debris, it is difficult to have the spaced used by small children, it has a smell and a health hazard from the dead fish and sea grass that accumulates in this area also. The bulkhead catches more impact of the direct energy of waves and the indirect energy of waves due to being a pocket for the indirect energy to collect in. I ask you if this was your property and the pocket or set back of your bulkhead created this many issues, would you not want to have your new bulkhead pushed out even to alleviate these issues and allow you and your loved ones the ability to enjoy the water without the smell, debris cleanup and hazards? I tried to include plenty of photographs for you to view and be able to see how drastic a pocket this is. This property is the only property in the entire subdivision that has this waterfront feature.
