This permit, issued on January 17, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Marina Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this marina facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
marina facility. Any sewage discharge at the manna facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

3) Any portion of the permitted access piers and marina facilities built over.Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
4) The ten (10) foot section of elevated walkway depicted on Sheet 4 of 9 shall be elevated a minimum of
six (6) feet above. normal high water.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third -party.
6) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structures in order to make them more visible during hours of darkness
or inclement weather.
7) . This permit authorizes a maximum of thirty (30) formalized boat slips.
8) In order to,satisfy concerns raised by the Division of Marine Fisheries, railings or other similar structural
deterrents to dockage shall be installed along the westernmost finger pier: adjacent to the area labeled
"not a slip" on workplan drawing 3 of 9.
9) Prior to the occupancy of any slips authorized under this permit, a marine pumpout sewage disposal
facility shall be installed in an easily accessible location and maintained in operable condition for the life
of the marina.
10) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a
representative of the Division to ensure that the required pumpout facility is in place and operable.
11) The marina facility shall display a sign showing the location of the on -site pumpout facility, including
other appropriate waste disposal information, at the entrance and exit from the mainpier(s).
12) The authorized covered platform(s) and gazebo shall not be enclosed. Any material used on the sides
shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with
benches and knee walls are permitted. Lattice is specifically excluded from being used under this
authorization.
13) The roof of the covered platform(s) and gazebo, shall not be designed for second story use._
14) Should the property to the west be sold prior to the initiation of construction of the marina facility, the
permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor
setback and submit it to the Division of Coastal Management prior to initiating construction of the
marina facility..

15) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structures and the adjacent property owner's riparian access corridor to the east, which is
determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel
line that intersects with the shore at the point where the upland property line meets the water's edge.
16) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation.
17) No portion of that authorized marina facility shall exceed one quarter the width of the water body.
18) ' This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, .the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

Easement
20) Prior to construction of any new boat slips or other docking facilities under this permit, the permittee
shall apply for and receive an Easement from the Department of Administration's State Property Office
as required under N.C.G.S. 146-12(e).
Urban Waterfront Development
21) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the walkway and other
associated infrastructure, all as expressly and specifically set forth in the attached permit application and
workplan drawings.
22) The new authorized covered platform(s) over Public Trust Waters shall not be enclosed by partitions,
plastic sheeting, screening, netting, lattice or solid walls.of any kind and shall be limited to a single
story.
23) The new authorized covered platform(s) over Public Trust Waters shall not extend more than 20'
waterward of the normal high water level.
General
24) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
25) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

26) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. .
NOTE: Future development of the permittee's property may require a modification of this permit..
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID No. SAW-2000-01053.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2000-
0360v2.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The applicant proposes to make improvements to and expand an existing commercial 8-
slip docking facility into a commercial marina with 12-Wet slips, construct a new five -
slip docking facility between two properties, and construct a new 12-slip marina. The
project is located at 9887 Oak Street and 1224 Riverview Drive, adjacent to the Calabash
River in Calabash, Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW, PTA, ES
UBA, and CW. Waters at the project site are classified as SA, HQW and are not open to
the harvesting of shellfish. The area is a not Primary Nursery Area.
I have reviewed this proposal for consistency with the Calabash CAMA Land Use Plan
update and offer the following comments.
The general area of the project is classified as Commercial and Conservation.
In general, the Town of Calabash allows development in Commercial and Conservation
classified AECs, which is consistent with the State's minimum use standards. The
Calabash Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these policies appear to be applicable to this project.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the Calabash Land Use Plan Update.

Water System. Per Title 15A Subchapter 18C Section. 0301 Rules Governing Public Water Systems, Plans and
Specifications should be submitted and approved by the Public Water Supply Section for all new waterlines
prior to construction beginning. Water supply wells must be approved from the county where the parcel address
seeking approval is located. Check with the local water system for cross -connection requirements for this
project. Public Water Supply Section guidelines are listed in Appendix B, Figure 2 in the Rules Governing
Public Water Systems but the water system may have additional requirements.

Dear Mr. Frink,
You have our approval, in accordance with the attached conditions and those listed below, to make
improvements and expand an existing 8 slip commercial facility into a 30 slip marina as described
in the application received by the N.C. Division of Water Resources (DWR) on October 26, 2018.
After reviewing your application, we have decided that the impacts are covered by General Water
Quality Certification Number 4144 (GC4144).
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 Permit. This Certification can also be found on line at:

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires yoit xp-follow the

The Additional Conditions of the Certification are:
This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If
you change your project, you must notify the Division and you may be required to submit
a new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification and is responsible
for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name 115A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded
as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices
must be used to meet this standard. Turbidity curtains shall be used as appropriate. Please
notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance: RECEIVEo
7. The applicant/permittee and their authorized agents shall conduct all acti er

being met, including failure to sustain a designated or achieved use, or that State or Federal
law is being violated, or that further conditions are necessary to assure compliance, than
the Division may reevaluate and modify this General Water Quality Certification. [15A
NCAC 02H .0507(d)]
8. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional
Office at 910.796.7215 and after hours and on weekends call (800) 858-0368.
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
9. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
10. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
11. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed

This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to Administrative Hearings

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport
for the subject project. The attached notice requests federal agency comments on this project by November 29, 2018.
The proposed construction site is located at the existing Captain John's Seafood house docking facility and adjacent
property, within waters adjacent to the Calabash River, at 9887 Oak Street and 1224 Riverview Drive, Calabash, in
Brunswick County, North Carolina. Coordinates are 33.98857 N,-78.5645 W.
The applicant proposes to reconfigure the existing 8-slip docking facility into a 30-slip commercial facility, remove
existing boat ramps, and construct new open and covered decking. Waterward work consists of improving the existing
enclosed building and roofed structure on the fixed pier, including adding a 16'x 5' covered platform to the north of the
building and 16' x 7' roof over the existing pier to the south of the building and another 8' x 12' covered platform on the
eastern existing fixed access pier. No portion of the platforms will extend over coastal wetlands. Construction of 4 new
3'-wide fixed piers (2 at 18' long, 1 at 16' long and 1 at 12' long) are proposed along the western portion of the existing
fixed pier.
The existing concrete boat ramp will be removed and a 50' long by 16'-wide fixed covered access platform will lead out
to a 16' x 22' covered gazebo and a 160' x 6'fixed pier for side -to dockage. The 16' x 50' covered access platform will
serve as a covered loading area for the charter fishing and head boats. The fixed pier will have a 10'-long section
between pilings that is elevated at least 6' above MHW to allow for access behind the structure. Slips 13 and 14 are
shown longer than 25' due to the location of the elevated section on the fixed pier.
An additional 34' x 6' fixed pier and 16' x 22' covered gazebo will be located at the existing concrete ramp on the eastern
property to provide another access point to the 160' fixed pier. The existing abandoned boat ramp and concrete slab at
this location will be removed.

A 22' x 29' fixed covered platform with a 4' x 16' ramp is proposed to provide access to a 13-slip floating docking facility.
The floating docking facility is comprised of a 8' x 6' ramp landing dock,a 148' x 6' access dock parallel to the shoreline,
five 4' x 20' finger piers and one 4' x 18' finger pier.
Dredging is not proposed as a part of this project.
The existing facility is adjacentto the Corps federal channel setback. According to the application and plans, the
proposed reconstructed docking facility would not encroach into the setback.
Please see the attached field investigation report /application and plans for more detailed information concerning the
proposed project. Google Earth .kmz files are attached for reference.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not
likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. Impacts are expected to be minimal due to temporary nature of
sedimentation impacts during the construction and reconfiguration of the docking facility. The waters within the project
area are NOT designated as PNA, are classified as SA/HQW and are closed to shell fishing. SAV is not present and there
are no shellfish resources within the project area. Average water depth within the project area ranges from -4.5 feet to -
6.5 ft MLW.
ESA:
The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest
North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project
will affect, but not likely adversely affect the West Indian Manatee. The use of Manatee Guidelines may be required as a
permit condition. The project would have No Effect on any other federally listed species.
NHPA 106:
Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and
the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and
records and the latest published version of the National Register of Historic Places and initially determines that no
historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit
area: therefore, there will be no historic properties affected.

The Federal agencies have completed review of the proposal as presented by the application and
your field investigation report. We recommend that the following conditions be included in the
modification to the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere
to all requirements therein. The guidelines can be found at http://www.fws. og v/nc-
es/mammal/manatee euidelines.pdf.
2. Dredging is not authorized.
3.The permittee must install and maintain, at his expense, any signal lights and signals prescribed
by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further
information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-
2191.
4. All work authorized by this permit must be performed in strict compliance with the submitted
plans, which are a part of this permit. Any modification to these plans must be approved by the US.
Army Corps of Engineers (USACE) prior to implementation.
5. Except as specified -in the plans attached to this permit, no excavation, fill or mechanized land -
clearing activities shall take place at any time in the construction or maintenance of this project, in such
a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the
reach of waters or wetlands.
6. Except as authorized by this permit or any USACE approved modification to this permit, no
excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, within waters or wetlands. This permit does not authorize temporary
placement or double handling of excavated or fill material within waters or wetlands outside the
permitted area. This prohibition applies to all borrow and fill activities connected with this project.
7. All mechanized equipment will be regularly inspected and maintained to prevent contamination
of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of
a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to
the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of

the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed.
8. If the permittee discovers any previously unknown historic or archeological remains while
accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who
will initiate the required coordination procedures.
9. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide each of
its contractors and/or agents associated with the construction or maintenance of this project with a copy
of this permit. A copy of this permit, including all conditions, shall be available at the project site
during construction and maintenance of this project.
10. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area.
This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate
devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate
stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all
aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter
113A Article 4).
11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that the
turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North
Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes
and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant.
12. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United States and in such time and manner
as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to
its pre -project condition.
13. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10
of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of
Engineers within 24 hours of the permittee's discovery of the violation.

It is staff s recommendation that the proposed upland improvements may be found CONSISTENT with the Rule 15 NCAC
7H.0209 (g)(4) (A) Use standards for Urban Waterfront provided it is determined to meet the criteria stated in rule 15A NCAC
07H.0209 (g)(1) Description of Urban Waterfronts.
The proposed walkway and covered platform located within the 30' buffer appears to be CONSISTENT with rule 15A NCAC
07H.0209 (g)(Axii) which states, "Impervious surfaces shall not exceed 30 percent of the AEC area of the lot". It is staffs
recommendation that the upland development proposed does not add any impervious surface to the lots and removal of the
existing concrete boat ramps reduces the total impervious surface for the lots.
The proposed increase in the existing facility usage to a 12-slip commercial marina and the construction of a new 12-slip marina
appears to be CONSISTENT with 07H.0208 (b) (5) Specific Use Standards for Marinas. It is recommended that the proposed
facilities be required to install a marine pump -out station and display "no sewage discharge" signage and a "pump -out available"
signage to become CONSISTENT with the Rule in 15 NCAC 7H.0208 (b) (5) (M) which states, "marinas shall post a notice
prohibiting the discharge of any waste from boat toilets and listing the availability of local pump -out services."
The proposed 6' by 160' pier located entirely over open water appears to be CONSISTENT with rule 07H.0208 (bx6) Specific
Use Standards for Pier and docking facilities.
Any permit issued should include standard permit conditions for commercial marinas with pump -out conditions

9. PROJECT DESCRIPTION:
The proposed project area consists of two adjacent parcels located at 9887 Oak Street and 1224 Riverview Dr. within
the Town of Calabash's Historic Waterfront area adjacent to the Calabash River. To find the properties from U.S: 17 S
Shallotte, turn left onto Seaside Rd SW/NC 904 and travel approximately 2.22 miles. Turn right onto Old Georgetown
Rd. S W/NC-179 and continue for approximately 4.5 miles. Turn left onto River Rd. and travel approximately 0.3 miles.
Turn right on to Oak St. and Captain John's (9887 Oak St.) is within 300ft on the right. Continue east on Oak St. to the
end and turn right on to Riverview Dr., the adjacent property (1224 Riverview Dr.) will be within 350' at the bend on
the right.
The property at 9887 Oak St. is approximately 4.4 acres with a shoreline of approximately 750 linear feet and has an
approximate elevation of 12' above normal high water (NHW). Existing upland development at this site includes an
asphalt parking lot, which appears to be located landward of the 75' Estuarine Shoreline Area of Environmental
Concern (AEC) and restaurant (Captain John's Seafood House) which is almost entirely located within the 75' AEC.
Within the 75' AEC is an existing dirt parking area that supports an existing approximately 20' in width by 80' in
length concrete boat ramp of which approximately 44' extends below Mean High Water (MHW) in to the Calabash
River. There is an existing drainage culvert on the east side of the lot that feeds in to a tidal drainage Swale and slough
which empties in to the Calabash River. Approximately 160' of shoreline frontage is stabilized by an existing vinyl
bulkhead authorized under General Permit #61608, with approximately 540' of shoreline on the easternmost portion of
the property stabilized by natural vegetation. There are two (2) existing access piers that extend waterward over coastal
wetlands from the high ground to the existing fixed docking pier; one begins at the restaurant and measures
approximately 6' in width by 110' in length, and the other begins at the dirt parking area and measures approximately
6' in width by 57' in length. The existing fixed docking pier runs parallel to the Calabash River channel over open
water and measures approximately 6' wide and 225' long. At the confluence of the 6' by 110' pier and fixed docking
pier is an existing non -conforming fixed enclosed structure measuring approximately 8' wide by 16' long located over
open water. At the confluence of the 6' by 57' pier and fixed docking pier is an existing approximately 12' by 16'
covered deck located over open water. The current docking facility can accommodate up to eight (8) vessels (See Sheet
No. 1 of 9). Permitting history for 9887 Oak St indicated that on May 12, 2000, State Permit #72-00 was issued to
Captain John's Restaurant for the construction of a replacement pier and dock. Plans for that dock did not show or
propose any open or enclosed platform area. Aerials as far back as 1994 do show a roofed structure near the west dock
access but no roofed structure at the east access. Upland vegetation consists of sparse Live Oak (Quercus virginiana),
Wax Myrtle (Morelia cerifera), Groudsel Bush (Baccharis halimifolia), Sea Oxeye (Borrichia frutescens), and Eastern
Red Cedar (Juniperus virginiana) as well as maintained lawn grass and ornamental landscaping. Low marsh coastal
wetlands are present waterward of the bulkhead and NHW with vegetation consisting primarily of Smooth Cordgrass
(Spartina altern fora). The coastal wetlands range in width from 50' to 165' waterward of the upland area.
The property at 1224 Riverview Dr. is approximately 1.7 acre with a shoreline of approximately 400 linear feet and has
an approximate elevation of 12' above normal high water (NHW). Existing upland development at this site includes an
asphalt parking lot, which appears to be partially located landward of the 75' Estuarine Shoreline Area of
Environmental Concern (AEC), a vacant commercial building which is almost entirely located within the 75' AEC, and
a wooden bulkhead. An existing concrete boat ramp is located at the southmost comer of the property and measures
approximately 10' in width by 52' in length and extends approximately 44' extends below NHW in to the Calabash
River. In the middle of the property extending from the shoreline is an existing dilapidated fixed platform measuring
22' in width by 29' in length. Approximately 260' of shoreline frontage is stabilized by natural vegetation and 200' of
shoreline is stabilized by an existing timber bulkhead. A permitting history search was performed for 1224 Riverview
Dr. but was inconclusive. Upland vegetation consists of sparse Live Oak (Quercus virginiana), Wax Myrtle (Morelia
cerifera), Groundsel Bush (Baccharis halimifolia), Sea Oxeye (Borrichia frutescens), Eastern Red Cedar (Juniperus
virginiana) as well as maintained lawn grass and ornamental palms and landscaping. Low marsh coastal wetlands are
present waterward of the bulkhead and NHW with vegetation consisting primarily of Smooth Cordgrass (Spartina
altern fora). The coastal wetlands range in width from 20' to 50' waterward of the uplanflaZEIVED

The Town of Calabash Land Use Plan classifies the adjacent high ground area of project site as Commercial. There are
no known archaeological sites located in the project vicinity. The waters of the adjacent Calabash River are classified
SA; HQW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the
N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant is proposing to expand an existing commercial eight (8) slip docking facility into a commercial
marina with twelve (12) wet slips, construct a new five (5) slip docking facility, and construct a new twelve (12)
slip marina on two separate properties. According to the application, improvements to the 9887 Oak St. property
would include expanding the existing docking facility capacity from eight (8) slips to twelve (12) slips, building
five (5) new covered platforms, adding four (4) new fixed finger piers, constructing a wooden walkway, and
building a new fixed dock to connect to a pier located at 1224 Riverview Dr. At the west end of the existing dock
located at 9887 Oak St., the applicant proposes to expand the existing non -conforming enclosed structure by
constructing a 16' in width by 7' in length roof over the existing dock on the south -facing side of the structure, and
a new 16' in width by 5' in length fixed covered platform on the north facing side of the structure. Both covers
and platforms would be located over open water. The applicant states that four (4) new fixed finger piers each
measuring 4' in width and 18', 18', 16', and 12' in length would be located on the west end of the existing docking
facility and would be spaced approximately 20' apart and aligned perpendicular to the channel. The westernmost
4' by 18' finger pier is proposed within the 15' riparian corridor and no permanent dockage is proposed on the
west side of the finger pier. The fixed finger piers would not exceed the US Army Corps channel setback and
would accommodate up to seven (7) vessels within water depths of -6.5' at Mean Low Water (MLW). At the
confluence of the existing docking facility and the existing 6' by 57' pier to the east, the applicant proposes to
expand the existing covered platform by constructing a new 8' in width by 12' in length fixed covered platform
located over open water (See Sheet No. 3 and 5 of 9).
In the upland area at the 9887 Oak St. property, the applicant proposes a 6' wide by 325' long wooden walkway
with 250' linear feet of the walkway leading from the asphalt parking lot to the existing 6' wide by 57' long pier
and a 75' long walkway extending east from the existing pier and terminating at the existing 20' by 80' concrete
boat ramp (See Sheet No. 2 of 9). Approximately 213 linear feet of the walkway would be within the 75'
Estuarine Shoreline Area of Environmental Concern (AEC) with 143 linear feet within the 30' Coastal Shoreline
Buffer. The applicant proposes to replace the existing boat ramp with a 16' wide by 50' long fixed elevated
covered platform within the same footprint. Impervious surface area within the 75'AEC is proposed to decrease by
approximately 580 sq. ft. associated with the removal of the existing 20' by 80' concrete boat ramp by an
excavator. As proposed, a 16' by 29' section of the 16' by 50' covered platform would be within the 30' buffer.
The proposed 16' by 50' fixed covered platform would connect to a 16' wide by 22' long fixed covered platform
located almost entirely within the existing boat ramp footprint and completely over open water. The applicant
states that the covered platforms would serve as a waiting area for patrons of future fishing charter ventures.
Extending east from the proposed 16' by 22' fixed covered platform and crossing the property line at 1224
Riverview Dr. would be a 6' wide by 160' long fixed pier aligned parallel with the channel. The proposed pier
would have a 10' section raised 6' above NHW to allow for public access to a small slough. The fixed pier would
serve as a new docking facility and would accommodate up to five (5) vessels with a water depth of -4.5' at MLW
(See Sheet No. 4, 7, and 9 of 9). Pilings for the pier would not exceed the US Army Corps channel setback.
At the 1224 Riverview Dr. project location, the applicant proposes to make improvements which include removing
an existing boat ramp and fixed deck and constructing a new pier, two (2) covered platforms, and a twelve (12) slip
floating marina. Impervious surface area within the 75'AEC is proposed to reduce by approximately 90 sq. ft.
associated with the removal of the existing 10' wide by 52' long concrete boat ramp by excavator. The applicant
proposes to construct a fixed 6' wide by 34' long access pier aligned perpendicular to the channel within footprint
of the existing boat ramp. At the waterward end of the pier would be a 16' wide by 22' long fixed covered
platform that would connect directly to the proposed 6' by 160' fixed pier. The platform would be located entirely
over open water. Along the shoreline at the middle of the property, the applicant proposes to remove the existing

22' wide by 29' long dilapidated deck and replace it with a new 22' wide by 29' long fixed covered platform. The
platform would extend waterward of NHW and would be within the footprint of the existing deck. A new 4' wide by
16' long ramp would lead from the middle of the platform and provide access to a new twelve (12) slip marina. The
marina would consist of a 6' wide by 8' long float that would act as a landing for the ramp and a 6' wide by 148' long
floating spine aligned parallel to the channel. The floating spine would have six (6) floating docks each measuring 4'
wide by 20' long and one (1) floating dock measuring 4' wide by 18' long (See Sheet No. 4 of 9). According to the
applicant the finger piers would be 20' apart and aligned perpendicular to the channel. The new marina would
accommodate a total of twelve (12) vessels with a water depth of -5.5' at MLW (See Sheet No. 6 of 9). Pilings for the
pier would not exceed the US Army Corps channel setback.
10. ANTICIPATED IMPACTS:
According to the application, the proposed upland development at 9887 Oak St. would decrease the total impervious
surface area located within the 75' AEC by approximately 580 sq. ft. Of the 1,950sq. ft. of open decking for the
proposed walkway, approximately 858 sq. ft. would be within the 30' Coastal Shoreline buffer. Approximately 464sq.
ft. of the proposed 16' by 50' covered platform would also be within the 30' buffer. The proposed improvements to the
existing docking facility consisting of covered platform extensions and finger piers would incorporate approximately
1,112sq. ft. within Estuarine Waters and Public Trust Area. New construction over open water consisting of two
covered platform waiting areas and a fixed pier would incorporate approximately 1,648sq. ft. within Estuarine Waters
and Public Trust Area.
Proposed upland development at 1224 Riverview Dr. would decrease total impervious surface area located within the
75' AEC by approximately 90sq. ft. The applicant proposes 80sq. ft. of new open decking for the proposed pier within
the 30' buffer. The proposed pier, covered decks, and floats would incorporate approximately 4,964sq. ft. within
Estuarine Waters and Public Trust Area.
No Coastal Wetland shading is proposed for this project. The facilities as proposed would not exceed the U.S. Army
Corps of Engineers Federal Channel Setback and would extend no more than 40' into a waterbody which measures
approximately 160' across, which would comply with the'/4 width distance. A waiver was obtained for the proposed
10' encroachment into the 15' Adjacent Riparian Setback Requirement to the west. The proposed marinas and docking
facility would accommodate up to 30 vessels in water depths measuring approximately 4.5' to -6.5' at MLW which are
closed to the harvest of shellfish. Minor increases in turbidity should be expected during construction. Increases in
highground disturbance and erosion should be expected during construction.

waterfront. The western 4.4-acre property, located at 9887 Oak Street, currently functions as a restaurant
(Captain John's Seafood House) with commercial and charter fishing businesses. There is a gravel parking area
and access drive to a concrete boat ramp, existing fixed pier with an enclosed building and roofed structure
along with side -to dockage. The eastern 1.7-acre property, located at 1224 Riverview Drive, contains a vacant
commercial building with an asphalt parking area and an abandoned concrete boat ramp. Each property has 3
bathrooms available, one male, one female and one handicap. (See Appendix A, Sheet 1).
4.1.2 Proposed Action
There is no new impervious built upon area or disturbed area proposed. A 6'-wide wooden slatted walkway is
proposed from the fixed pier starting at the existing concrete boat ramp and extending approximately 325' to
the existing parking area for Captain John's Seafood House.
Waterward work consists of improving the existing enclosed building and roofed structure on the fixed pier,
including adding a 16' x 5' covered platform to the north of the building and 16' x 7' roof over the existing pier
to the south of the building and another 8' x 12' covered platform on the eastern existing fixed access pier. No
portion of the platforms will extend over coastal wetlands. Construction of 4 new 3'-wide fixed piers (2 at 18'
long, 1 at 16' long and 1 at 12' long) are proposed along the western portion of the existing fixed pier. The
westernmost finger pier is within the 15' setback and a waiver is included in Appendix B.
The existing concrete boat ramp will be removed and a 50' long by 16'-wide fixed covered access platform will
lead out to a 16' x 22' covered gazebo and a 160' x 6' fixed pier for side -to dockage. The 16' x 50' covered access
platform will serve as a covered loading area for the charter fishing and head boats. The fixed pier will have a
30'-long section between pilings that is elevated at least 6' above MHW to allow for access behind the structure.
Slips 13 and 14 are shown longer than 25' due to the location of the elevated section on the fixed pier.
An additional 34' x 6' fixed pier and 16' x 22' covered gazebo will be located at the existing concrete ramp on
the eastern property to provide another access point to the 160' fixed pier. The existing abandoned boat ramp
and concrete slab at this location will be removed.
A 22' x 29' fixed covered platform with a 4' x 16' ramp is proposed to provide access to a 13-slip floating docking
facility. The floating docking facility is comprised of a 8' x 6' ramp landing dock, a 148' x 6' access dock parallel
to the shoreline, five 4' x 20' finger piers and one 4' x 18' finger pier.
None of the proposed structures extend into the USACE navigation channel setback or beyond the % waterbody
width. Piling positions will be set by the contractor and none will be located within the USACE setback. The
existing concrete boat ramps will be pulled up and removed with an excavator. The concrete will be hauled off
site. Any existing pilings will be removed or relocated if useable for the proposed structures. See Appendix A,

The Division of Coastal Management hereby acknowledges receipt of your application for State approval,
acting as agent for Frink Investments, Inc. for development of the property located at 9887 Oak St. and
1224 Riverview Dr. adjacent to the Calabash River in the Town of Calabash, Brunswick County. The
application was originally received by our office on June 18, 2018. An additional information request was
sent to you, the agent, on August 2, 2018. Additional application information was received by our office
on October 11, 2018. The application appears to be adequate for processing at this time. The projected
deadline for making a decision is December 25, 2018. An additional 75-day review period is provided by
law when such time is necessary to complete the review. If you have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 11, 2018, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status
of your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your

Proposing to perform agitation dredging February 18 thru 21 at Buckeye Terminal on the Cape Fear River. We
chose to wait til the February spring tide with high tides in the morning to comply falling tide work period &
desire to have work performed during spring tides. Work was not pursued in January due to concern of potential
conflict with Corps maintenance dredging. NOAA predicting the following tides.

Dear Mr. Finch:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on October 11, 2018. Processing of the
application is ongoing. However, it has been determined that additional information will be
required prior to the Division taking final action on your application. These required items are
summarized below:
1) Notification of the adjacent riparian property owner to the east, which Brunswick County
lists as Bennie Wakley Graham. If a signed statement of no objection can be obtained, the
project shall be taken off hold upon receipt. However, if the signed statement of no
objection cannot be obtained, the project will remain on hold until a period of 30 days has
elapsed from the date of certified mail delivery of the application package to Bennie
Wakley Graham.
If you can provide to this office a copy of the requested information within five working days
from the date of this letter, DCM staff will continue processing of the application and the
processing clock will not be suspended. If the required information is not received in this office
within the specified timeframe, processing of the application will be suspended in accordance
with 15A NCAC 07J.0204(d) until such time as the requested information is provided as detailed
above.

SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for
Captain Johns Seafood House, Inc./Frink Investments, Inc.
Dear Mr. Finch:
This letter is in response the above -referenced Coastal Area Management Act (CAMA) permit
application, which was accepted as complete on October 11, 2018.On December 13, 2018,
processing of this application was placed on hold pending receipt of proof of notification to the
adjacent riparian property owner to the east. This office received an email from you with proof
of that notification attempt on January 8, 2019, which appears to satisfy the request for
notification. Therefore, processing of the permit application has officially resumed as of January
8, 2019. The revised projected 75-day deadline for making a decision is January 18, 2019.
