Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Lattice is specifically excluded from being used under this authorization. 7) The roof of the covered gazebo shall not be designed for second story use. 8) This permit authorizes a maximum of ten (10) formalized boat slips. 9) The authorized structures and associated activity shall not cause an unacceptable interference with navigation, and shall not exceed the footprint as depicted in the attached workplandrawings. 10) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed six feet in width and shall be elevated,a minimum of three feet over the wetland substrate as measured from the bottom of the decking. The proposed structures would be located entirely over open water and would not encroach into either adjacent 15' riparian corridor setback area. This office has no objection to the proposed work, provided it is consistent with all other local, state, and federal permitting requirements. The applicant proposes construct a 10-slip private docking facility. The project is located at 1332 Saint Joseph Street, adjacent to Carolina Beach Yacht Basin and Myrtle Grove Sound and the AIWW Carolina Beach. Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA. Waters at the project site are classified as SB and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Carolina Beach Land Use Plan and offer the following comments. The AECs impacted by the work are classified as Developed. In general, the Town of Carolina Beach allows development in Developed classified AECs which is consistent with the State's minimum use standards. The Town of Carolina Beach Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. PROJECT DESCRIPTION: The project site is located at 1332 Saint Joseph Street, adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound, in Carolina Beach, New Hanover County. The project site consists of one upland lot. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington into Carolina Beach on Carolina Beach Road (NC Hwy 421) for approximately 12 miles south. Continue over Snows Cut Bridge for approximately 1 mile south until you reach Lewis Drive and turn left. Lewis Drive immediately turns in a northerly direction (almost a U- turn from Carolina Beach Road). Turn right to stay on Lewis Drive for 0.4 miles and the property of interest will be at the terminus of Lewis Drive, just as it becomes Saint Joseph Street. The areas adjacent to the project site are developed with residential properties and docking facilities. The properties to the north and south of the project site are developed with single- family residences and existing private docking facilities. The facility to the north is approximately 71' from the proposed docking facility and the facility to the south is approximately 20' from the proposed docking facility. Existing structures on the highground portion of the site consist of a single-family residence with associated parking. The lot is approximately 0.58 acres and averages seven (7) feet above normal high water (NHW) with approximately 116' of shoreline at NHW. Upland vegetation on the lot consists of lawn grass with native trees and shrubs. The eastern shoreline of the property borders the Carolina Beach Yacht Basin/Myrtle Grove Sound and vegetation along the eastern boundaries of the property parcel consists primarily of Smooth Cordgrass (Spartina altemiflora). No permitting history could be located for the subject property. No SAV or shellfish resources were observed in the project area. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin/Myrtle Grove Sound are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division ptMiMMEEIsheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: AUG 2 2 2019 JF#D CITY The applicant proposes to construct a new ten (10) slip private dockingi axed pier measuring 125' by 6' would extend from the southern edge of the applicant's riparian corridor area at a slight southeasterly angle. A second section of fixed pier measuring approximately 138' by 6' would extend perpendicular to the channel and follow the southern edge of the riparian corridor setback area. Approximately 10' from the terminus of the fixed pier would be a 16' by 25' gazebo extending in a northerly direction. At the terminus of the fixed pier would be a, ramp extending toward Carolina Beach Yacht Basin, perpendicular to the channel, which would provide access to a 72' by 6' floating dock, extending perpendicular to the channel. From the landward edge of the floating dock, there would be a second section of floating dock, measuring approximately 56' by 6' in a north -south orientation, parallel to the channel. At the northern end of the second section of floating dock, there would be a third section of floating Execucorp, LLC c/o Brad Parker Page 3 dock extending in an easterly direction, perpendicular to the channel, measuring approximately 32' by 6' (see Sheet 3 of 5). The floating docks would create a 'Ll-shape' configuration and would create ten (10) slips. ANTICIPATED IMPACTS: As proposed the facility along the eastern shoreline would extend approximately 235' into a waterbody measuring approximately 1,000' across, meeting the % width distance. The facility would also be approximately 75' landward of the existing Town of Carolina Beach Pierhead Line and the Federal AIWW channel setback. The proposed pier would be approximately 71' away from the docking facility to the north, and 20' away from the facility to the south. There would be no encroachment into either adjacent 15' riparian corridor setback area. The proposed facility would provide dockage for approximately ten (10) vessels. There appears to be no shellfish resource or SAV present in the project area. Minor increases in turbidity should be expected during project construction. The site is partially cleared with existing vegetation comprised of a mix of native trees, shrubs and grasses. Remnants of a previous pier and docking facility are located along the southern riparian corridor line. The Carolina Beach Boat Basin is classified as SB waters, is not open to shellfishing and is not designated as a primary nursery area. No SAV or significant shellfish resources are present. DCM staff conducted a site visit and subsequently verified the coastal wetland and normal high-water lines on May 23, 2019. See email confirmation in Appendix B. 3.1.2 Proposed Action The applicant (Execucorp, LLC) proposes to construct one 263' long by 6' wide fixed pier extending from the existing porch on the residence eastward and out to a 10-slip floating docking facility in water depths of -6' to - 13' MLW. The end of the docking facility is 75' from the Town of Carolina Beach pierhead line and USACE channel setback. The fixed pier will have one covered gazebo with a 16' x 31' roofline. A 16' x 4' ramp will lead to a 72' long by 6' wide floating dock to support 4 wet slips. The western portion of the floating dock will extend northward to a 56' long by 6' wide floating dock to support 4 wet slips.
