Coiniock, NC 27923 Authorizing development in Currituck County at adi. to AIWW, at 305, 311, 345 & 357 Waterlily Rd., in Coiniock as requested in the permittee's application dated 4/3/19, incl. att. workplan drawings (9) Drawings 1-6 of 6 dated "Revised 4/1/19" and Detail Sheets 1-3 of 3 dated 4/2/19. This permit, issued on June 26, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation rf these terms may be subject to Imes, imprisonment or civil action; or may cause me permit to De null ana vola. Shoreline Stabilization — Rip Rau and Backfill 1) The rip rap shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved rip rap alignment. 3) The alignment of the authorized rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee New Coinjock Investors of NC, LLC. & Louis & Wendy Davis Permit No. 53-19 Page 2 of 3 ADDITIONAL CONDITIONS 4) The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 5) The rip rap shall be constructed prior to any backfilling activities. 6) The rip rap shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) All backfill material shall be obtained from a high ground source and confined behind the permitted rip rap alignment. 9) All fill material to be placed below normal water level shall be confined behind the permitted rip rap alignment. -Sedimentation and Erosion Control 10) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the rip rap alignment immediately following completion of backfilling activities. Marina Expansion 11) This permit authorizes only the docks other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 14) This permit authorizes an additional 6 formalized boat slips for a maximum of 30 formalized boat slips. 15) The marina shall display a sign showing the location of the on -site pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier. New Coinjock Investors of NC, LLC. & Louis & Wendy Davis Permit No. 53-19 Page 3 of 3 ADDITIONAL CONDITIONS 16) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 17) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. Upland Development 18) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the wooden boardwalk, all as expressly and specifically set forth in the attached permit application and workplan drawings. General 19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 20) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 21) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW- 2019-06768) issued 6/6/19. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-0578. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. The site of the proposed development is located at 305, 311, 345 & 357 Waterlily Road (SR#1142), Coinjock, Currituck County, adjacent to the Atlantic Intracoastal Waterway (AIWW)• The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, RECEIVED MAY 30 2019 North Carolina Department of Environmental Quality I Division of Coastal Management DCM-MHD CITY Elizabeth City Office 1 401 South Griffin Street, Suite 301 1 Elizabeth City. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(D) states that development shall not increase siltation. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(E) states that development shall not create stagnant water bodies. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (5) Marinas, (6) Piers and Docking Facilities and (7) Bulkheads pertain to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (5) Marinas Subparagraph (5)(A) states that Marinas shall be sited in non -wetland areas or in deep waters (areas not requiring dredging) and shall not disturb shellfish resources, submerged aquatic vegetation as defined by the MFC, or wetland habitats, except for dredging necessary for access to high -ground sites. Consistent: The proposed development is consistent with the intent of this rule. Consistent: The existing marina is for transient boat traffic and dry storage is not feasible. Subparagraph (5)(D) states that marinas developed in waters subject to public trust rights (other than those created by dredging upland basins or canals) for the purpose of providing docking for residential developments shall be allowed no more than 27 square feet of public trust areas for every one linear foot of shoreline adjacent to these public trust areas for construction of docks and mooring facilities. Consistent: The marina is not associated with any residential developments. Subparagraph (5)(E) states that to protect water quality in shellfishing areas, marinas shall not be located within areas where shellfish harvesting for human consumption is a significant existing use or adjacent to such areas if shellfish harvest closure is anticipated to result from the location of the marina. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (5)(H) states that marinas shall be designed so that the capability of the waters to be used for navigation or for other public trust rights in estuarine or public trust waters are not jeopardized while allowing the applicant access to deep waters. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (5)(I) states that marinas shall be located and constructed so as to avoid adverse impacts on navigation throughout all federally maintained channels and their boundaries as designated by the US Army Corps of Engineers. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (5)(J) states that open water marinas shall not be enclosed within breakwaters that preclude circulation sufficient to maintain water quality. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (5)(L) states that marina design shall comply with all applicable EMC requirements for management of stormwater runoff. Stormwater management systems shall not be located within the 30-foot buffer area outlined in 15A NCAC 07H .0209(d) Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (5)(M) states that marinas shall post a notice prohibiting the discharge of �CEIVED waste from boat toilets and listing the availability of local pump -out services MAY 3 0 2019 Consistent: A pump -out sign currently exists. Consistent: The marina does not provide this service. Subparagraph (5)(0) states that all marinas shall comply with all applicable standards for docks, and piers, shoreline stabilization, dredging and dredged material disposal of this Rule Consistent: The proposed development is consistent with the intent of this rule. Paragraph (6) Piers and Docking Facilities Subparagraph (6)(A) states that piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions do not apply to marinas. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(F) states that piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(G) states that pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: The proposed development is consistent with the intent of this rule. (ii) not extending into the channel portion of the water body; Consistent: The proposed development is consistent with the intent of this rule. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation does not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (6)(I) states that piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (7) Bulkheads Subparagraph (7)(E) states that where possible, sloping rip -rap, gabions, or vegetation shall be used rather than bulkheads. Consistent: The proposed development is consistent with the intent of this rule. 15A NCAC 07H.0209 Coastal Shorelines (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Development shall be compatible with the following standards: (1) All development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development is consistent with the intent of this rule. Impervious surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. Consistent: The proposed development is consistent with the intent of this rule. (3) All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. Consistent: The proposed development is consistent with the intent of this rule. (B) No development project proposal or design shall permit an angle for graded slopes or fill which is greater than an angle which can be retained by vegetative cover or other erosion -control devices or structures. Consistent: The proposed development is consistent with the intent of this rule. (C) All development projects, proposals, and designs which involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; provided that this shall not apply to clearing land for the purpose of forming a reservoir later to be inundated. Consistent: The proposed development is consistent with the intent of this rule. (4) Development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Consistent: The proposed development is consistent with the intent of this rule. (5) Development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. Consistent: The proposed development is consistent with the intent of this rule. Consistent: The proposed development is consistent with the intent of this rule. (8) Established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the intended use of the accessways. Consistent: The proposed development is consistent with the intent of this rule. (10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new development shall be located a distance of 30 feet landward of the normal water level or normal high-water level, with the exception of the following: (A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section; Consistent: The proposed development is consistent with the intent of this rule. Based on my review of the applicable subsections of the North Carolina Administrative Code, the permit application and plans, I recommend a permit be issued to Louis & Wendy Davis (New Coinjock Investors of NC, LLC) for the development as proposed. DATE: May 15, 2019 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 as amended through June 24, 2009. Overview: The 4.76 acre subject property consists of four (4) parcels under common ownership with approximately 1,490 liner feet of shoreline along the Coinjock Canal/Atlantic Intracoastal Waterway (AIWW). The AIWW is approximately 230 feet to 250 feet wide at this location. Water depths range from .5 feet below Normal Water Level (NWL) adjacent to the shoreline and steadily drop to a depth of 14 feet below NWL. Site elevations range from at NWL to 3 feet above NWL. The property is mainly vegetated with yard grasses, ornamental shrubs and upland trees. The property is located within a floodzone. The subject property is primarily operated as the Coinjock Marina and Restaurant. Existing site improvements consist of three (3) residential structures, a marina store, a restaurant with wooden deck, gravel parking and remnant asphalt road. Existing shoreline improvements consist of 1,287 linear feet of combined bulkhead and riprap stabilization, a 1,082 foot long dock paralleling the shoreline adjacent to 345 Waterlily Road that measures between 11 and 12 feet wide, an 8 foot wide by 110 foot long dock paralleling the shoreline adjacent to 357 Waterlily Road, fuel pumps, water and electric hookups, and a pumpout station. The two (2) docks provide twenty-four (24) transient boat slips. Removal of 250 feet of bulkhead and placement of 430 linear feet of riprap was authorized under CAMA General Permit #312251 in January 2002 and replacement of 657 linear feet of dock, 265 linear feet of riprap and 92 linear feet of bulkhead was authorized in November 2004. Remnant pier materials are also located along the shoreline. Installation of 203 linear feet of riprap, a 6 foot wide by 100 foot long boardwalk, two (2) docks totaling 196 feet in length with associated light, water and electric hookups, and a 12 foot by 14 foot wooden access ramp is proposed. Remnant pier materials will be removed. Riprap will be placed along the two (2) sections of unstabilized shoreline. Riprap alignment will average 6 feet waterward of NWL with a maximum distance of 8 feet and will tie into existing bulkhead returns and riprap alignment. Dock widths will vary from 8 to 12 feet and tie into existing improvements. The proposed dock sections will result in six (6) additional boat slips for a total of thirty (30) boat slips. The waters of the Coinjock Canal/AIWW in this area are classified as Class SC waters and Joint Waters and are closed to shellfish taking. Submerged Aquatic Vegetation (SAV) was not observed in the project area. Based on available information, there are no archaeological sites on the property. Anticioated Impacts resulting from this project are expected to include: the filling of 1,218 sq. ft. of Public TrusUEstuarine Waters Areas of Environmental Concern (AEC) and 406 sq. ft. of Estuarine Shoreline AEC; the shading of 2,218 sq. ft. of Public Trust/Estuarine Waters AEC and 600 sq. ft. of Estuarine Shoreline AEC, and; the disturbance of 584 sq. ft. of Estuarine R1,50*0 AEC. Basis for Determination: MAY 2 © 2019 O'CAq- 40 C17. y The property is located within the °Aydlett-Waterlily/Churches Island" subarea and is designated as "Limited Service Areas (Areas Preferred for Low Density Development)" on the Currituck County Future Land Use Map (FLUM). Areas of Environmental Concern (AECs) are designated as "Conservation Areas" as indicated on Page 11-1. As indicated on the top of Page 11-3, with respect to non-residential uses in Limited Service Areas, it is essential that the existing community character be preserved. Businesses designed to serve the tourist industry should not be prohibited provided the character and intensity of the use is in keeping with the character of the surrounding area. The purpose of the Conservation class is to provide for the long-term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The Conservation class is applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and cautious attention to the conservation of environmental features. PROJECT SUMMARY: At two separate areas of the marina, the applicants are proposing to stabilize ±203' of shoreline with riprap, construct ±196' of additional dock, create 6 additional slips and construct ±100' of boardwalk. Proiect Setting The applicants own a 2.4-acre restaurant/marina complex under an LLC known as New Coinjock Investors, LLC along the east side of the AIWW addressed as 345 Waterlily Road (SR#1142), Coinjock, Currituck County. Additionally, the applicants own properties adjacent to the marina addressed as 305, 311, & 357 Waterlily Road under their personal names. The proposed development is located at two separate sections located along the shoreline of these four properties. To access the site, turn off of US-158 onto Waterlily Road (located ±.5 miles south of the AIWW) and follow the road for ±1.1 miles to the site, which is designated by the Coinjock Marina Restaurant sign. The elevation of the site ranges from Normal Water Level (NWL) to±3' above NWL. Man-made features within the highground area include three residential homes, a ship store, a restaurant, a large wooden deck adjacent to the restaurant, gravel parking areas and a remnant asphalt road. The highground area is mainly vegetated with yard grasses, ornamental shrubs and upland trees. Based on available information, there appears to be no archaeological sites on this property. The shoreline of the four properties total ±1,490' in length, of which ±1,287' has been stabilized through a combination of bulkheading and riprap. Two separate areas totaling ±203' have not been stabilized or were minimally riprapped and now exhibit a ±2.5' erosion escarpment. Additional man-made structures along the shoreline include two separate docks that provide 24 transient slips, fuel pumps, water & electric hookups and a pumpout station. The first dock parallels the shoreline adjacent to 345 Waterlily Road and measures ±1,082' with a width that measures 11' at the south end and 12' at the north end. A second ±110' x 8' section of dock parallels the shoreline adjacent to the 357 Waterlily Road. Wetlands were not observed within the project area. The adjacent riparian property to the north is residential in nature with a single-family dwelling and a bulkheaded shoreline. This property has a similar dock that runs parallel to the shoreline as the one located at 357 Waterlily Road. The adjacent riparian property to the south is also residential in nature with a single-family dwelling, a bulkheaded shoreline and a small ±22'x4' dock. The waters of the AIWW are classified as SC by the Environmental Management Commission and are not open to shellfish taking. These waters are also classified as Joint Fishing Waters by the NC Marine Fisheries Commission and NC Wildlife Resources Commission. Water depths adjacent to the shoreline are ±0.5' below NWL and steadily drop to a depth of ±14' below NWL on the waterward side of the existing docks. The AIWW ranges from ±230' to 250' in width at the project areas and the bottom substrate is made up of fine sands. Development Proposal At two separate areas of the marina, the applicants are proposing to stabilize ±203' of shoreline with riprap, construct ±196' of additional dock, create 6 additional slips and construct a 100' boardwalk. Davis, manager and part-owner of Coinjock Marina, LLC, in order to accomplish two things: stabilize eroding shoreline in two areas of the marina, and construct and install new dockage between two areas of existing dockage. This cover letter and narrative will discuss and give details of each part of the proposed construction project. Coinjock Marina is the only operating public -accessible marina located on Coinjock Canal in Coinjock, NC in Currituck County. The marina is located on the Intracoastal Waterway and serves boaters traveling north and south on the Waterway as well as the local boating public. The marina provides fuel, fresh water, food at the Marina Restaurant, laundry facilities, septage pump -out, and power for limited overnight stays. The next closest marinas on the Intracoastal Waterway are located 37 miles north in Chesapeake, VA or 36 miles south at the mouth of Alligator River in Columbia, NC. Coinjock Marina and Restaurant have been a vital stop for travelers on the Intracoastal Waterway since 1978. Comparison between current site surveys and historical aerial photography measurements show that erosion in these two areas from passing boat traffic is causing a loss of 0.93 to 0.84 inches per year of soil shoreline. On the north end of the dockage facility, the applicant proposes to fill in the 58-ft long section of eroding shoreline with riprap rock that will connect with existing riprap on the south end of this section and existing wooden bulkhead on the north end of this section. The operator will install permeable geotextile filter fabric against the waterward bank along the 58-foot length of eroded shoreline to prevent further erosion, and then place riprap down the shoreline. On the south end of the dockage facility, the applicant proposes to fill in the 145-ft long section of eroding shoreline with riprap rock after first filling in one 83 square foot section and one 70 square foot section in order to straighten the two sharply eroding areas (see site plan drawing #5). The fill soil required for the two sections will total approximately 14.2 cubic yards and will be brought in from offsite by a permitted supplier. Once the fill has been placed and compacted, the operator will install non -woven geotextile filter fabric against the waterward fill bank and along the remaining full-length eroded shoreline, totaling 145 feet. The applicant will then place riprap against the filter fabric and down the shoreline. The new riprap will connect with existing riprap on the north end of this section and existing wooden bulkhead on the south end of this section. On both north and south construction areas, the applicant plans to utilize standard 5" to 17" granite riprap (average 10", NCDOT Class 1), installed with a 1.5:1 slope along the shoreline. The toe of the riprap slope will be approximately 6-8 feet from the existing shoreline depending on water depth at that point, average depth 3 feet. This will require approximately 0.67 cubic yards of granite riprap per linear foot, totaling ±97 cubic yards for the south construction area shoreline and ±39 cubic yards for the north construction area shoreline. Dockage Construction New dock construction is proposed along the same two areas of shoreline as the above shoreline stabilization; one 54-ft long by 12-ft wide section at the north end of the dockage facility and one 142-ft long by 11-ft wide section on the south end. On the north end, the applicant proposes to construct a 54-ft long by 12-ft wide wooden dock that will join with existing 12-ft wide wooden dockage on the north and south ends of this section. As with the existing dockage, the applicant will construct tie pilings attached to the dock every 10 feet and install water and electric hookups for boating customers. The new dockage will extend no further out into Coinjock Canal than the existing marina dockage on each side of the new construction. All construction will be a minimum of 57 feet from the edge of the Coinjock Canal navigation channel. On the south end, the applicant proposes to construct a 142-ft long by 11-ft wide wooden dock that will join with existing 11-ft wide wooden dockage on the north end of this section, and with existing wooden bulkhead on the south end of this section. The new dockage will extend no further out into Coinjock Canal than the existing marina dockage on the north end of this section. This new dockage will be replacing old existing broken and degraded dockage materials which will be removed during construction of the new dockage and riprap. On the south end of this section, the new 11-ft wide dock construction will extend along the shoreline 130 feet and then turn south to transition and connect with the existing wooden bulkhead at 305 Waterlily Road. The transition dockage will be constructed 8 feet wide at this point. Starting at the northern corner of the existing bulkhead at 305 Waterlily Road where the new dock will join the bulkhead, the applicant proposes to construct a 6-ft wide wooden ground -level walkway on land, traveling 100 feet south along the shoreline bulkhead, until reaching the parcel line at 301 Waterlily Road.
