Crocker, 5006 Churchill Falls Place, Apex, NC 27539 Authorizing development in Carteret County at adi. to Bogue Sound, at 191 Sea Trace Lane, in Newport , as requested in the permittee's application dated 3/19/19, including attached workplan drawings (2) both dated 3/19/19. This permit, issued on May 21, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the mooring pilings and uses located in or over the water that are expressly and specifically set forth in this permit. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent or commercial uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. USACE Condition 4) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at htto://www.fws.gov/nc-es/mammal/manatee Quidelines.pdf. General 5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 6) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of General Permit 197800056 (Action ID SAW-2018-2293) issued 5/8/19. NOTE: The N.C. Division of Water Resources has assigned the project DWR Project No. 2019-0463. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. Crocker, 191 Sea Trace Lane, Newport, Carteret County The following is my assessment and consequent recommendations of the above referenced proposal: There is currently a pier, uncovered platform, covered platform, finger pier and 2 slips with boatlifts along Bogue Sound on the southern portion of this property. Per the applicant, due to the difficulty of maneuvering on and off the existing boatlifts during a SW wind event, they are proposing to construct a 12' x 30' wet -slip are with three mooring pilings along the west side of the existing platform. This proposed slip area would be for temporary mooring during the SW wind events. There would be a total of three slips (2 existing and 1 proposed) along this parcel. The proposed slip and mooring pilings would not extend more than 382' waterward of the edge of marsh and no farther than a maximum of 386' from NHW (within the existing docking facility length). All portions of the development would be landward approximately 539' of the ICW channel setback and 266' from the historical channel within this area. The proposed slip area would also be located approximately 80 to 100 waterward of any SAV. The development conforms to the guidelines set forth under 15A NCAC 07H .0208. Assuming that state and federal agencies concur with the proposal, the District -recommends the project be authorized as proposed, contingent upon the following conditions: The total number of slips shall not exceed a maximum of 3. Crocker Date: April 16, 2019 RECEIVED APR 2 2 2019 PAP SECTION MHD Consistency Determination: The request is consistent with/not in conflict with Carteret County Land Use Plan certified by the CRC on December 20, 2010. Overview: The applicant wishes to add a third 12' x 30' wet -slip area that is designated by three mooring pilings along the west side of the existing 2-slip docking facility. The property is project is located at 191 Sea Trace Lane along Hwy 24 Newport, Carteret County. The residential property is .743 acres (32,365 so in its entirety, and existing development onsite includes a house, driveway, pier and platform, bulkhead and riprap. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. Bogue Sound runs along the south side of the property, and there is a 15' x 100' section of coastal wetlands (Juncus roemerianus) along the 100' of shoreline on Bogue Sound. AECs onsite include Estuarine Waters and Public Trust Areas. The surface water classifications are SA (Market Shellfishing, Salt Water) and HQW (High Quality Water). The ICW channel would be located approximately 539' from all proposed development with the historical channel located approximately 266' waterward of the proposed development. The site is found by following highway 24 east past the Gales Creek Bridge. It is approximately 11,250' (2.1 miles) east of the gales creek bridge. You will turn south (right) onto Bogue Sound Drive off Hwy 24 and continue for approximately 2000'. Turn Right onto Sea Trace Lane and follow for approximately 200'. The property will be located on the left. The residential property is .743 acres (32,365 sf) in its entirety and 10' above nhw. Bogue Sound runs along the south side of the property. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. There is a 15' x 100' section of coastal wetlands (Juncus roemerianus) along the 100' of shoreline on Bogue Sound. The waters of Bogue Sound have approximately 2.5'to 3' lunar tidal amplitude. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The Carteret County Land Use Plan classifies this area as Limited Transition with Conservation within the AECs. According to Google Earth spacial data, the IC W W is located approximately 539' waterward (south) of the proposed slip area with pilings approximately 358' from the edge of coastal wetlands. The ICW channel would be located approximately 539' from all proposed development with the historical channel located approximately 266' waterward of the proposed development. Water depths within this project location are-3.5'nlw/mlw to -4' nlw/mlw. The bottom substrate is sand and no SAV were observed within the proposed slip area. Bogue Sound is approximately 2.6 miles wide at this location. 10) Proposed Development: The applicant wishes to add a third slip area that is designated by three mooring pilings along the west side of the existing 2-slip docking facility. There is an existing pier, platforms, finger pier and boatlifts along the southern portion of the property. The applicants wish to install three mooring pilings along the west side of the existing covered platform to delineate a third 12' x 30' wet -slip. They wish to use this proposed slip area on a temporary basis during SW wind events. Per the applicant this will help to accommodate the difficulty of maneuvering on and off the existing boatlifts along the east side during the SW wind events. This area is approximately 80' to 100' waterward of SAV habitat. The water depths are -3.5' nlw to -4' nlw within the proposed slip area. Field Investigation Report William D. All parts of the docking facility would be landward of the ICWW channel (approximately 539' landward) and a minimum of 25' from the western riparian corridor and 50' from the eastern riparian corridor. There would be a total of three slips (2 existing with boatlifts and one proposed wet slip with 3 mooring pilings). The water depths within the slip area is 3.5' nlw to 4' nlw/mlw with connecting water depths of -4' plus nlw/mlw. 11. Anticipated Impacts: The proposed wet slip addition with mooring pilings incorporate 370 ft' of shallow bottom habitat. The development would increase the number of slips to a maximum of three with 3 mooring pilings for the proposed third slip. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The location of the proposed slip addition should not be a hindrance to navigation due to the fact all portions would be located landward of the historical channel (266') and a distance of 539' from the ICW.
