REGAN Secretary BRAXTON C. DAVIS Director MEMORANDUM DATE: May 29, 2019 TO: Gregg Bodnar THRU: Roy Brownlow FROM: Heather M. Styron NORTH CAROLINA Environmental Quality SUBJECT: Comments and Recommendations - CAMA Major Permit —Edward and Rachel Cozart, 205 Lands End Road, Morehead City, Carteret County The following is my assessment and consequent recommendations of the above referenced proposal: There was an old dilapidated pier (no slips) along this property that was affected by Hurricane Florence, so the applicant applied for a CAMA general permit which was issued for a 2-slip docking facility in January of 2019. Per the applicant any remnants of the old pier would be removed and as of the 5/21/19 site visit the permitted pier had not been constructed yet. The previously issued general permit expired on 5/28/19. Per the applicant, because of the SAV limits and access to deeper water depths they are proposing to construct a longer docking facility (maximum of 581' from NHW) with a total of 5 slips (3 have boatlifts), three mooring pilings, one fixed platform and 2 floating platforms. There would be a total of five slips (5 proposed) along this parcel. The proposed docking facility would not extend more than 535' waterward of the edge of marsh and, no farther than a maximum of 581' from NHW and would remain within pier head length within this area. All portions of the development would be landward approximately 410' of the ICW channel setback. The'proposed floating platforms and slip areas would also be located approximately 35' to 160' waterward of any SAV depending on location. The development conforms to the guidelines set forth under 15A NCAC 07H .0208 except for 15A NCAC 07H .0208(b)(6)(H). The water depths beyond 400' are not adhering to a rate of 1' of fall beyond 400', however the additional length would help achieve slightly more water depth and would maintain all slip areas and floating platforms outside of the extent of SAV habitat. Project Summary: The proposed project is for the construction of a pier, fixed platform, two floating platforms, 3 lifts, 3 mooring pilings and a total of 5 slips within Bogue Sound. A CAMA general permit was issued for a 2-slip docking facility previously (1/28/19) for a maximum of 400 feet from NHW, however the applicant wants to extend to a maximum of 58l' from NHW. 9. Narrative Description: The Edward and Rachel Cozart project is located at 205 Lands End Road along Hwy 24 Morehead City, Carteret County. The site is found by following highway 24 into the Morehead City town limits. Turn right at the stop lights adjacent to the Walmart shopping center (Harbor Drive) and follow to the stop sign then turn right onto Lands End Road. The property will be immediately on the left (approximately 245'from the stop sign). The residential property is .638 acres (27,782 sf) in its entirety and an average of 9' above nhw. Bogue Sound runs along the south side of the property. The upland vegetation mainly consists of lawn grasses, shrubs, and a few trees. There is a 50' x 105' section of coastal wetlands (Spartina altemiflora) and (Juncus roemerianus) along the 105' of shoreline on Bogue Sound. The waters of Bogue Sound have approximately 2.5'to 3' lunar tidal amplitude. The Division of Water Resources classifies this area as HQW/SA Waters. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. The Morehead City Land Use Plan classifies this area as Medium Density Residential with Conservation within the AECs. According to Google Earth spacial data, the ICW W is located approximately 410' waterward (south) of the most southern proposed platforms and the most southern proposed slips (3&4). Water depths within this project location are-2.5'nlw/mlw to - 3.l' nlw/mlw. The bottom substrate is sand and no SAV were observed within the proposed slip areas and floating platform areas. Bogue Sound is approximately 1.6 miles wide at this location. There are SAV within this location approximately 400' from NHW. No SAV were observed beyond this point. 10) Proposed Development: The applicant was issued a CAMA general permit on 1/28/19 for a 2-slip docking facility but wishes to add 3 more slips (total of 5 slips), 2 floating platforms, one fixed platform, three tie pilings, three boatlifts and extend to a maximum of 58l' from NHW to achieve deeper water depths and remain outside of any SAV habitat. They feel this will help ensure the SAV are not disturbed and will also achieve deeper water depths. There was an old dilapidated pier that was damaged during Hurricane Florence but has not been replaced at this time and will be torn down if not already done so. The current proposal is for a 6' x 30' access above NHW that would extend to a 6' x 565' pier (a 6' x 360' portion of the pier would be over SAV habitat). It would intersect a 16' x 24' fixed t-head platform. There would be a 15' x 15' boatlift (slip #2) along the east side Field Investigation Report Edward and Rachel Cozart 205 Lands End Road Page 3 of 3 of the fixed platform with a floating 10' x 16' floating platform along the west side of the fixed pier and a 16' x 16' wet slip ( slip # 3) with two mooring pilings along the west side of the floating platform. They are also proposing a to a 10' x 10' boatlift ( slip # 1) along the east side of the pier (50' landward of the fixed platform), a 6' x 10' jet -ski lift (sip # 4) along the west side of the pier (app. 23' landward of the fixed platform) and a 10' x 11' wet slip ( slip # 5) with one tie piling immediately landward of the jet -ski lift along the west side. The final portion of the proposal is the placement of the second 10' x 16' floating platform along the west side of the pier approximately 100' landward of the proposed fixed platform at the end of the docking facility. The closest "section of the proposed platforms and boatlifts are approximately 35' waterward of the edge of SAV habitat. The most waterward portion of the proposed docking facility would not exceed a maximum of 581' from NHW and 535' from the edge of coastal wetlands. All parts of the docking facility would be landward of the ICWW channel (approximately 410' landward) and a minimum of 20.19' from the western riparian corridor and 15.44' from the eastern riparian corridor. There would be a total of five slips (2 boatlifts, one jet ski lift, and two wet slips with three mooring pilings with a boat size of 20' to 37' and an open runabout design. The water depths within the slips and floating platform areas are -2.1' nlw to 3.0' nlw/mlw depending on location, with connecting water depths of -3.1' plus nlw/mlw. The water depths beyond 400' only fall an additional .7 from 400' to 500' and an additional .4 from 500' to 600' however the additional length will allow for slightly deeper water access and would help any slip areas remain outside of the SAV habitat. This should help reduce any prop scarring within the SAV area. There is currently a property line dispute along the west side, however the current proposal will meet the 15' setback in either instance. 11. Anticipated Impacts: The proposed pier would shade and incorporate 180 112 of coastal wetlands above NHW and 264 ftz of coastal wetlands below NHW. The pier portion waterward of the edge of marsh would also shade and incorporate 2160 ft2 of SAV habitat. The platforms, wet slip additions with mooring pilings and boatlifts would incorporate 2600 ft2 of shallow bottom habitat while shading 1634 ft2 of the shallow bottom habitat. The development would increase the number of slips from zero to five. The increase in suspended sediment and turbidity levels from the piling placement would be temporary, occur while the piling placement is taking place and should be minimal given the bottom composition. The proposed docking facility should not be a hindrance to navigation due to the fact all portions would be located landward 410' from the ICW. The propose docking facility would also meet the minimum 15' setback from the riparian access lines. No SAV where observed within the proposed platform and slip areas. Name: Heather M. MURPHEY nberwr MEMORANDUM: TO: Gregg Bodnar, DCM Assistant Major Permit Coordinator FROM: Shane Staples, DMF Fisheries Resource Specialist THROUGH: Anne Deaton, DMF Habitat Assessment Manager SUBJECT: Edward and Rachel Cozart DATE: 6/26/19 The CAMA application has been reviewed by a fisheries resources specialist for the NCDMF for impacts that may affect fisheries resources of the state. The applicant proposes to construct a new pier and docking facility with a total of 5 slips with Bogue Sound. The pier is proposed to be 565'x6' (360' of which will be spanning SAV beds) and terminate in a 16'x24' T-head platform with a 15'x15' boat lift on the east side and a floating 10'x16' platform of the west side. Along the sides of the pier a 10'x10' boatlift is proposed 50' landward of the floating platform, a 6'x10' jet-skf lift is proposed 23' landward of the platform, and a 10'x16' floating platform 100' landward of the T-head. The water depth at the most landward platform in approximately -2.1' @NLW and the depths at the boat lift and floating platform at the terminus of the pier are in approximately -3.0' @NLW. NCDMF does not object to the project as proposed as the impacts to SAV are limited to the shading of the pier and unlikely to be impacted by use of the lifts or floating platforms in the currently proposed alignment. There are opportunities to design a shorter pier with the same number of slips that could potentially reduce overall bottom impacts. If any redesign were to be completed NCDMF would recommend that no lifts or platforms be placed landward of the location where the 10'x16' floating platform is proposed alongside the pier which is approximately 35-45' waterward of the edge of existing SAV beds. This will ensure efforts already made to avoid SAV are preserved as well as keep all boat facilities in water depths of -2'@NLW or greater. All boat lifts should be placed in water depths sufficient to prevent incidental bottom scour of shallow soft bottom habitat. On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act of 1899. Your work is authorized provided it is accomplished in strict accordance with your submitted plans, the enclosed general conditions, and the following special conditions. The expiration date of your DA permit is December 31, 2021. 1. All work authorized by this permit must be performed in strict compliance with the plans that were revised and emailed on June 26, 2019, which are a part of this permit. 2. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The area is thoroughly covered by SAV. 3) The size of the proposed project takes up an inordinate area of public bottom. This public bottom is used year round for recreational clamming, scalloping, "conching", fishing, crab dip netting and shrimp seining. It is bottom that is commercially clammed, scalloped in season, and "conched". 4) The scope of the project will impact use of public bottom through an easement granted over 50 years ago by Ms. Osteen's father to residents of Spooners Creek subdivision. This access and use of the public waters have existed since a park for residents was in the original plat. Copy is available if needed. There are 60+ households in Spooners Creek and many of those residents utilize that public bottom for water related recreation. 5) The total number of planned watercraft in and over the water approaches "mini -marina" size and is a potential pollutant source from petroleum, oil, lubricants, and holding tank waste discharges. 6) Applicant states project will berth a 37' vessel, but not sure where on the pier that will take place. Such a vessel will need more than 2 ft depth at MLW to maneuver which will lead to "bottom kicking" in SAV areas to get to and from berth and reach the AIWW channel. Eure, Jr. 207 Lands End Rd Morehead City, NC 252-726-6498 Concerning Application for Cozart Property Dock In reviewing application for permit to build a pier for the property just to the east of our property, we have the following questions and concerns: 1. The owner of the adjoining property to the east of the proposed property is Mary Lynn Osteen, not Catherine Styron, as listed. 2. The proposed project dedicates the majority of the Sound bottom within the property lines to permanant structures and does not allow for full watercraft utilization without encroaching upon the adjacent property riparian rights. Simply stated, the project property shoreline is not sufficient to support a project of this magnitude. 3. The existing pier, as referred in application to be repaired and improved, has been removed. Piers adjacent to project are much smaller. 4. The typical boats to be served (j) are listed as open runabout, which does not appear to be consistent with (k) typical boat length of 37' and 20'. 5. What, if any, regulations/restrictions exist concerning the amount of night time lighting allowed. 6.What, if any, regulations/restrictions exist concerning fish cleaning station waste. 1 ftECENEO APR 0 9 20'O DCM,MHp CITY r i s l v l` a I 7. Charles M. Cullipher, PE, PLS MAY 6 2019 151-A Hwy 24 Morehead City, NC 28557 (252)773-0090 DCM-MHD CITY The Cullipher Group, P.A. is requesting a CAMA Major Permit for an approximately 581 linear foot pier construction on Lot 1 of Spooner's Creek Harbor Subdivision. The address for the project is 205 Lands End Road, Morehead City, NC 28557. The property's upland shoreline is 105 LF along coastal wetlands that are part of Bogue Sound, Stream Index #: 20-36-(8.5); Class SA;HQW. The lot has an existing single family dwelling outside of the 75' AEC and an existing pier that has been damaged, is unusable and will be removed. The owner received a CAMA General Permit#: 73420 on January 28, 2019 for construction of a 400 LF pier with two boat lifts, a T-head platform and two floating platforms. The owner is requesting a CAMA Major to construct this pier approximately 581 linear foot to avoid impacts to sub -aquatic vegetation (SAV) and to achieve greater water depth (approximately 10.5") for its furthest boat lift. The SAV have been located with aerial photography and extend from the shoreline to approximately 404 LF from the shore. If construction were to occur in accordance with the General Permit, all of the boat lifts and floating platforms will potentially impact the SAV in this area. The Cullipher Group performed a hydrographic survey to determine NLW depths for the length of the proposed pier as well as locate existing piers near to the property in order to establish a pierhead line (please see plansheet 1— colored aerial). The proposed pier has an access structure on highground that is 6' in width and approximately 30' in length. It will be constructed with wooden planks or other slotted material and raised in order to meet the minimum clearance once over wetlands. The waterward pier is 6' in width with one 24'x16' fixed platform (384 sf) at the end. There are also two 16'x10' floating platforms (160 sf each) and a 2'x6' cantilevered fish cleaning station (12 sf) proposed for a total shaded platform area of 716 sf. There are three lifts proposed. A 15'x5' lift and a 10'x10' lift are proposed for two boats and a 10'x6' lift for a jet ski. There are three additional tie piles proposed. Two are at the end of the pier for visiting boaters to tie to and one is located 40' north of the fixed platform for tying a jetski. Considering the three proposed lifts and the tie poles used for temporary mooring there are five total wet slips proposed with this application. There are no oyster rocks or SAV in the vicinity of the proposed platforms or lifts. The platforms are beyond the extent of the coastal wetlands near shore. Dredging is not part of the proposed application and it is understood by the Owner that it will not be allowed. There is currently a property boundary dispute ongoing with this property and its adjoining owner to the west. Two separate property corners have been installed by two separate surveyors. The outcome of this dispute has yet to be determined. However, both property corners, riparian lines and 15' riparian setback lines are shown on plan sheet 2 with the proposed pier encroaching into neither setback. The lot has an existing single family dwelling outside of the 75' AEC and an existing pier that has been damaged and is unusable. The owner received a CAMA General Permit for construction of a 400 LF pier with two boat lifts, a T-head platform and two floating docks. The owner is requesting a CAMA Major to construct this pier approximately 581 linear foot to achieve greater water depth for its furthest boat lift. The Cullipher Group performed a hydrographic survey to determine NLW depths for the length of the proposed pier as well as locate existing piers near to the property in order to establish a pierhead line. The proposed pier is 6' in width with two fixed platforms at the end, 16'x12' to the east and 16'x6' to the west. There are also two 16'x10' floating platforms and a 2'x6' cantilevered fish cleaning station proposed for a total shaded platform area of 620 sf. There are three lifts proposed. A 15'x5' lift and a 30'x10' lift are proposed for two boats and a 10'x6' lift for a jet ski. \ \111111 - ti •.y RECEIVED ;a SEAL 7. 037378 - APR 0 S Z019 ti'•.F Q- ti 9P•NNEF.,\Q\.
