This permit, issued on May 2, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Stormwater Outfall
1) The authorized force main shall not extend more than 78' waterward of normal high water as
depicted on the workplan drawings.
2) The permittee shall install and maintain at his expense appropriate signage and/or signals at the end
of the force main. At a minimum, the end of the force main shall be marked with permanent
reflectors extending at least 3' above normal high water.
NOTE: Plans and specifications, including separations requirements, may need to be submitted and
approved by Public Water Supply Section prior to construction. Please contact Public Water
Supply at [phone].

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
this permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolineragrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The authorized rip rap shall be constructed in the same alignment as depicted on the attached workplan
drawings.
4) No excavation or filling of any vegetated wetlands or open water outside of the alignment of the fill area
indicated on the workplan drawings is authorized by this permit.
5) No backfill material shall be placed within 30 feet of the normal high water line, except the stockpiled
material that will be utilized to re -fill the excavated trenches.
6) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not
authorized with the exception of the stockpiled material that will be utilized to re -fill the excavated
trenches.
Sedimentation and Erosion Control
7) In order to protect water quality, runoff from construction shall not visibly. increase the amount of
suspended sediments in adjacent waters.
8) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence: shall be properly installed
immediately landward of the rip rap immediately following completion of construction.
Upland Development
9) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the pump station, pipes,
roads, and other associated infrastructure, all as- expressly and specifically set forth in the attached
permit application and workplan drawings.
General
10) The perrnittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Nationwide
Permit 18 (Action ID No. SAW-2018-00184), which was issued on 05/02/19.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2019-
0045.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The applicant proposes to install a new force main stormwater outfall system with a lift
station and HDPE discharge pressure piping with rip rap extending into the Carolina
Beach Yacht Basin. The project is located in the Delaware Avenue ROW in Carolina
Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW, ES, CW and
PTA. The Waters at the project site are classified as SB and are not open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Carolina Beach Land Use Plan and
offer the following comments.
The AECs impacted by the work are classified as Residential-2.
In general, the Town of Carolina Beach allows development in Residential-2 classified
AECs which is consistent with the State's minimum use standards. The Town of
Carolina Beach Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the Town of Carolina Beach Land Use Plan.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Parvin,
You have our approval, in accordance with the attached conditions and those listed below, to
impact 0.01 acres of 404 wetlands and 0.02 acres of open waters in order to construct a new force
main stormwater outfall system as described in the application received by the N.C. Division of
Water Resources (DWR) on January 8, 2019. After reviewing your application, we have decided
that the impacts are covered by General Water Quality Certification Number 4175 (GC4175).
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 Permit. This Certification can also be found on line at:

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and

the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the

The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If
you change your project, you must notify the Division and you may be required to submit
a new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification an 1s response e
for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name { 15A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded
as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices
must be used to meet this standard. Turbidity curtains shall be used as appropriate. Please
notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
7. The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other apprF06aGFANi nts

being met, including failure to sustain a designated or achieved use, or that State or Federal
law is being violated, or that further conditions are necessary to assure compliance, than
the Division may reevaluate and modify this General Water Quality Certification. [15A
NCAC 02H .0507(d)]
8. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional
Office at 910.796.7215 and after hours and on weekends call [phone].
Management of such spills shall comply with provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and
(c)(3), 15A NCAC 02B .0200 (3)(f), and GS 143 Article 21A].
9. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
10. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
11. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database, indicates
that there are no records for rare species, important natural communities, natural areas, and/or
conservation/managed areas within the proposed project boundary. Please note that although there
may be no documentation of natural heritage elements within the project boundary, it does not

The current proposed stabilization method for the dual force main discharge at
Delaware Ave is to use Riprap and fabric for the 820 square feet of impacts (+/-
61.7' x 13.3') over the underlain discharge pipes. This method was identified to
ensure stabilization of the bank and slope due to erosion from storms, boat traffic
and tidal action. Alternative methods of replanting vegetation or slope mitigation
(limited grade) were considered however; these would be less efficient and would
require significant maintenance effort even in the best of circumstances.
After consideration of available alternatives, it was determined that the riprap
method was the most stable and provided the greatest degree of integrity for the
force mains and for the bank/slope itself. It should be noted that this area has
experienced significant erosion in the past and the current material in place includes
a various types of material including waste concrete, asphalt and sand. Due to the
apparent success of this material mixture we have a high level of confidence in the
riprap stabilization method.
As the Engineer of Record, I cannot recommend or support an alternative method.

Recommendations for State Permit — Town of CB North Stormwater Updates
Shoreline length = 44 linear ft
It is staffs recommendation that the proposal appears to be CONSISTENT with the use standards set forth in
NCAC 07H .0205(b)(d), which states that secondary priority of coastal wetlands shall be given to those types of
development activities that require water access and cannot function elsewhere. The proposed stormwater
discharge pipes are replacing an old non-functioning stormwater system that discharged into the Yacht Basin.
The proposed excavation within estuarine waters appears to be CONSISTENT with15 NCAC 07H.0206 (d),
which states that second priority of use shall be given to those types of development activities that require
water access and use which cannot function elsewhere. It is the opinion of this office that the area for the
proposed discharge pipes is an extension of an area that has been historically impacted for stormwater
discharge.
The Rip Rap proposed within Coastal Wetland Areas appears to be INCONSISTENT with NCAC 07H
.0205(b)(d) and it is unclear as to the necessity for rip rap in this area since the pipe will be buried 6 ft. beneath
the substrate.
This office has no objection to the proposed work, other than the proposed rip rap placement within coastal
wetlands, provided that it is consistent with all other state and federal permitting requirements and appropriate
erosion and turbidity control is utilized during any filling or excavating. Any permit issued should include
conditions for coastal wetland impacts and open water dredge and fill activities.

The current project site is located at the Delaware Avenue Street End, adjacent t aroline Beach
Yacht Basin, in Carolina Beach, New Hanover County. To locate the project site from the WiRO take
US-132 S/ S. College Rd. for approximately 7 miles. Continue on US-421 S/Carolina beach Rd for an
additional 7 miles to the Snows Cut Bridge that leads into Carolina Beach. Turn left onto Carl Winner
Drive in approximately 1 mile and turn left onto Canal Drive at the stoplight. Travel 1.3 miles on Canal
Drive and turn left onto Florida Avenue. Delaware Avenue and the project site will be located on the
left-hand side of the road at the first intersection.
The property is a Town owned Right of Way which is located at the street end of Delaware Avenue and
extends into the Carolina Beach Yacht Basin (see Narrative for historical stormwater information). The
basin is approximately 591 ft. wide in this area. The high ground portion of the property is developed
into a gravel parking lot with a relic gravity fed stormwater system. The shoreline is not stabilized, but a
mound of material has been pushed up at the end of the roadway adjacent to Coastal Wetlands.
Upland vegetation consists of sparse lawn grass. The property is approximately .24 acres in size and
has an average elevation of approximately 1 ft. above mean sea level. The entire project site has
approximately 44 linear feet of shoreline frontage. The high ground area transitions to Coastal
Wetlands consisting mainly of Salt Marsh Cordgrass (Spartina altemiflora), Salt Grass (Distichlis
spicata) and Salt Meadow Grass (Spartina patens). This portion of Carolina Beach is mostly residential.
The USACE Federal Channel extends throughout the Yacht Basin. Both adjacent residential properties
have private docking facilities.
According to the application, there is an existing 24 ft. gravity fed stormwater pipe and a relic chamber
system on the high ground at the Delaware Avenue outfall, but the location of the chamber system and
discharge pipe is unknown. No DCM permit history was found for stormwater projects in the Town of
Carolina Beach.
The Town of Carolina Beach Land Use Plan classifies the adjacent waters and high ground area as
Residential 2 and the water portions as Conservation. There are no known archaeological sites located
in the project vicinity. The waters of the Yacht Basin are classified SB by the Division of Water
Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine
Fisheries and they are CLOSED to the harvest of shellfish.
10. PROPOSED PROJECT:
The applicant proposes to install a new Force Main Stormwater Outfall System with lift station and
HDPE discharge pressure piping, including rip rap, extending into the Carolina beach Yacht Basin. The
proposed project is part of a larger stormwater update project that also includes Florida, Georgia,
Maryland and Virginia Avenues. State Stormwater permit No. SWG040105 (attached) was issued to
Carolina Beach for North End Water and Sewer Improvements on July 27, 2018 and includes the
Delaware Avenue Outfall. The proposed stormwater updates include construction of a force main pump
house and installation of two outfall pipes that extend through coastal wetlands to the Carolina Beach
Yacht Basin.
According to the applicant the force main outfall system will consist of a storm water 5000 gpm duplex
lift station, two parallel HDPE discharge pressure pipes, rip rap for stabilization and two terminal pilings
at the water ward ends of the discharge pipes. The application states that installation of the pipes will
result in excavation of 330 sq. ft. of coastal wetlands (Spartina altemitlora), with 210 sq. ft. of impact
above Normal High Water (NHW) and 120 sq. ft. of impact below NHW. An additional 686 sq. ft of
open water will also be excavated. All of these areas will be subsequently filled with the excavated
material once the pipes are installed and subsequently filled with rip rap that will ultimately incorporate
the entire impacted area plus an additional 52 sq. ft. Rip Rap placement in this area will measure
approximately 61 ft. in length by 13 ft. in width for a total of 811 sq ft extending 33 ft. below NHW. The
amount of rip rap to be placed below NHW is 448 sq. ft.�including 120 sq. ft. of Coastal Wetland Impact.

The amount of rip rap to be placed above NHW is approximately 363 sq. ft. with 210 sq. ft. of that within
the impacted coastal wetland area.
The discharge pipes, (14" and 16") would extend 73 ft. below NHW into the Yacht Basin running
perpendicular to the shoreline and will be buried to a maximum of 6 ft (see Sheet 1). The stormwater
discharge area is described as at least -2.5 ft. below Normal Low Water (NLW). Two pilings would be
installed at the terminal end of the piping system for stabilization and for submerged pipeline sign
placement 3 ft. above NHW. According to the application water depths at the waterward end of the
discharge pipes is -6.5 ft. at NLW. The adjacent docking facilities are 17.5 ft. and 20.5 ft. from the
proposed discharge pipes. The structures, as proposed, would not encroach into either 15 ft. adjacent
riparian setback.
Proposed upland development consists of a 2,298 sq. ft. forcemain pumphouse, 2, 282 sq. ft. of asphalt
(in an area measuring 163 ft. long by 14 ft. wide) installation of the discharge pipes, rip rap and grading
for a total of 7,689 sq. ft. of disturbance, a portion of which falls into the 75 ft. AEC. A wet well would
also be installed outside of the 75 ft. AEC on the property. The discharge pipes extend a total of 163
linear ft. from the wet well to open water. The application states that the total impervious surface within
the 75 ft. Coastal Shoreline AEC would be 13.5%.
11. ANTICIPATED IMPACTS:
High ground disturbance would impact approximately 7,689 sq. ft. of area adjacent to the Yacht Basin.
The proposed excavation and subsequent filling would impact approximately 330 sq. ft. of Coastal
Wetlands and 686 sq. ft. of open water within the applicant's area of riparian access and within Y. of the
width of the waterbody. The proposed discharge pipes would not encroach into either 15 ft. adjacent
riparian setback. Increases in turbidity should be expected during construction and a turbidity curtain
may need to be utilized during construction.

The Town of Carolina Beach is in the process of updating their storm water system
in the northern part of Carolina Beach. The streets to be affected are Delaware,
Florida, Georgia, Maryland and Virginia Avenues. A CAMA major is requested to
replace the current gravity feed out fall system on Delaware Avenue with a duel
pipe force main system.
The site is a 10,398 square feet right of way that belongs to the Town of Carolina
Beach. There is 4,920 sq. ft. of impervious surface, 0.196 acres of coastal wetlands
and 0.0485 acres of non -wetland waters. The right away is used by the adjacent
owners to exit the property.
Currently and existing 24' gravity feed storm water pipe is located at Delaware Ave.
The pipe connects into an unknown chamber system before discharging into the
Carolina Beach Yacht Basin. The discharge pipe has not been located and has likely
been buried under the sediment over the years.
A wetland delineation was conducted on 1/18/17. A signed PJD was issued on
8/16/18 by the USACE (See Attached). Coastal wetland line was verified by CAMA
on 11/8/18. On July 27, 2018 Stormwater Permit CDC No. SWG040105 was issued.
A force main storm water out fall system is being installed to facilitate the drainage
of the new storm water system that is being implemented along the Delaware,
Florida, Georgia, Maryland and Virginia Avenues. Converting from a gravity feed
system to a force main will provide more adequate removal of the storm water in the
area.
Proposed Improvement
The project requires the construction of a storm water 5000gpm duplex lift station
(adjacent to the SSLS and utilizing the common structure and electrical components)
with parallel dedicated fused HDPE discharge pressure piping discharging into the
yacht basin in the town right of way at Delaware Avenue.

Two discharge pipes (one 16" and one 14") will be buried below ground and extend
163 feet from the wet well out to open water. The pipes will discharge 2.5 feet below
mean low water and approximately 73' feet water ward of normal high water. At the
end of the pipe pilings will be installed to hold the pipe in place and signage installed
accordingly to notify others that there is a submerged pipe. The end of the pipe will
also be fitted with directional flow valve to prevent back flow during high tide events.
The pipe will be covered with existing sediment and 820 sgft of rip rap for slope
protection.
A total of 330 sgft of coastal wetlands will be excavated and 252 sgft filled with the
excavated relic material and the two outfall pipes. A total of 330 sgft of riprap will be
placed over the 252 sgft of fill for slope stabilization. All excess material will be used
for grading on site. No additional off site fill will be used.

the Town of Carolina Beach, for State approval for development of property located at the Delaware Avenue Street
End located in Carolina Beach, New Hanover County. It was received as complete on January 2, 2019 and appears
to be adequate for processing at this time. The projected deadline for making a decision is March 18, 2019. An
additional 75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from January 2, 2019 you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and shall
include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one
into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and nofify me in writing if you wish

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject

individual permit) or undertaking any activity in reliance on any form of Corps permit

waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be"waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review

other lawful standards and regulations promulgated and adopted by the North Carolina
Environmental Management Commission, and 15A NCAC 2H.1000, the Stormwater rules,

is hereby authorized to redevelop the existing compacted gravel and asphalt built -upon areas
at the end of Delaware Avenue incidental to the proposed pump station and utility line
installation located at
North End Water & Sewer Improvements
Canal, Flonda, Georgia, Virgins, Delaware and Maryland Avenues
Carolina Beach, New Hanover County
and to discharge stormwater to receiving waters designated as the Intracoastal Waterway,
class SA waters in the White Oak River Basin, in accordance with the provisions of the
General Permit for a Linear Utility Line, No.SWG040000, the definition of redevelopment, and
the approved stormwater management plans and specifications, and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land
Resources and considered a part of this permit for the subject project.
This Certificate of Coverage shall become effective as of the signature date below.

All owners or developers of projects where either a CAMA Major Permit or a Sedimentation
Erosion Control Plan approval is required, and that involve the construction of utility lines such
as water, sewer, gas, telephone and electric, with incidental built -upon area as herein defined, are
hereby authorized to construct such utility lines and incidental built -upon areas in compliance
with the General Permit conditions and the provisions of 15A NCAC 2H .1000, S.L. 2006-246,
and S.L. 2008-211 (hereafter referred to as the "stor+nwater rules"), the approved stormwater
management plans and specifications, and other supporting data as attached and on file with and
approved by the Division of Water Quality and considered a part of this general permit.
The General Permit shall become effective on July 1, 2010.

PERMITTED ACTIVITIES
Until this permit is modified or rescinded, permittees are authorized to construct such incidental
built -upon area directly associated with the installation of a water line, sewer line, gas line,
telephone conduit, electric line, or other linear utility project, subject to the following standards.
All Stormwater runoff from these projects shall be in accordance with the attached schedules as
follows.
Section A — Final Limitation and Controls for Stormwater Discharges
Section B — Schedule of Compliance
Section C -- General Conditions
STANDARD CONDITIONS FOR GENERAL PERMITS
This permit covers only Stormwater discharges. Any other discharge to surface waters of the
state is prohibited unless covered by another permit, authorization or approval.
This General Permit does not relieve the permittee from responsibility for compliance with any
other applicable federal, state, or local law, rule, standard, ordinance, order, judgement, or
decree.
GENERAL PERMIT COVERAGE
All persons desiring to be covered by this General Permit must register with the DWQ by the
filing of a Notice of Intent (NOI) and applicable fees. The NOT shall be submitted and a
certificate of coverage issued prior to the installation of utility lines and prior to the construction
of any incidental built -upon area.
Any owner or developer not wishing to be covered or limited by this General Permit may make
application for an individual Stormwater Management Permit in accordance with the Stormwater
rules, stating the reasons supporting the request. Any application for an individual permit should
be made at least 90 days prior to the time the permit is needed.
This General Permit does not cover activities or discharges covered by an individual permit. Any
person conducting an activity covered by an individual permit but which could be covered by'
this General Permit may request that the individual permit be rescinded and coverage under this
General Permit be provided.
The definition of any word or phrase in this General Permit shall be the same as given in Article RECEIV
21, Chapter 143 of the General Statutes of North Carolina, as amended. Other words and phrases ED
used in the General Permit are defined in the stormwater rules.
SECTION A: TLNAL LI-'MITATIONS AND CONTROLS JAN 0 9 2019
During the period beginning on the effective date of the general permit, the Permittee is DCM-MHD CITY
authorized to clear and grade a proposed site. Stormwater runoff from the site shall be in
accordance with the following conditions:

3. Approved plans and specifications for projects covered by this permit are incorporated by
reference and are enforceable parts of the permit
A vegetated buffer/setback is required to be maintained between all impervious surfaces
and surface waters. Minimum required buffer/setback widths shall be provided as per
Table 1.

5. No new stormwater piping shall be allowed except that minimum amount necessary to
direct runoff beneath an impervious surface such as a road and that minimum amount
needed under driveways to provide access to lots, or that amount as shown on the
approved plans.
6. The only runoff conveyance systems allowed will be vegetated conveyances such as
swales with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and
approved by the Division.
The approved Site & Grading plan for the incidental built -upon area shall contain the
following items:
a. A clear vicinity map showing the direction and distance to the nearest town or
city, street name, street number and the nearest intersection of two major roads.
b. The receiving waters.
C. The site drawn to scale showing all proposed built -upon surfaces.
d. All existing and proposed contours and spot elevations.
e. A legend of all symbols used on the site plan.
f. A delineation of the property and/or easement lines with bearings and distances.
g. A delineation of jurisdictional 401/404 wetlands and coastal wetlands, or a note
on the plans stating that none exist. (Note: only a person trained to identify
wetlands can make this determination.)
h. A delineation of the 575' ORW AEC area as applicable.
i. A delineation of the buffer/setback area.
j. A calculation of the proposed amount of built -upon area.
k. Dimensions for all proposed built -upon area.
SECTION B: SCHEDULE OF COMPLIANCE
The permittee shall at all times provide adequate stabilization measures in conformance
with the approved Site & Grading Plan and Erosion Control Plan.

3. The permittee shall submit to the Director and shall have received approval for revised
plans. specifications. and calculations prior to construction, including. but not limited to,
the following items:
a. Any revision to the approved plans, regardless of size
b. Project name change.
C. Transfer of ownership.
d. Any changes in the location of, layout of, regrading of, addition to. or deletion of
the approved amount of incidental built -upon area; regardless of size.
e. Further subdivision or sale of the project area, in whole or in part.
f. Alteration of the proposed drainage.
4. The Director may determine that revisions to the project will require a modification to
permit coverage.
5 The Director may notify the permittee when the permitted site does not meet one or more
of the minimum requirements of the General Permit. Within the time frame specified in
the notice, the permittee shall submit a written time schedule to the Director for
modifying the site to meet minimum requirements. The permittee shall provide copies of
revised plans and certification in writing to the Director that the changes have been made.
SECTION C: GENERAL CONDITIONS
1. Failure to abide by the conditions and limitations contained in the General Permit is
considered a violation of the stormwater rules, and is grounds for enforcement action in
accordance with North Carolina General Statutes 143-215.6A to 143-215.6C, or for
certificate of coverage termination, revocation and reissuance, or modification in
accordance with NCGS 143-215.1.
2. The certificate of coverage is not transferable except after notice to and approval by the
Director. In the event of an ownership change, the Director may require a separate NOI
and certificate of coverage. The approval of this request will be considered on its merits,
and may or may not be approved. The permittee is responsible for compliance with all
permit conditions until such time as the Director approves the transfer.
3. The issuance of this general permit does not prohibit the Director from reopening and
modifying the general permit, revoking and reissuing the general permit, or terminating
the general permit as allowed by the laws, rules, and regulations contained in NCGS 143-
215.1 and the stormwater rules.
4. The certificate of coverage is issued in accordance with this general permit and may be RECEIV modified, revoked and reissued, or terminated for cause. The notification of planned ED
modifications or non-compliance does not stay any general permit condition.
5. Upon the presentation of proper credentials, and during normal business hours, the JAN 0 9 2019
permittee shall allow the Director, an authorized representative of the Director, or DENRg,�
staff, to enter the property, inspect the project for compliance with the permit, and samplb'CM-MHD CITY
or monitor for water quality.
6. The permittee shall notify the Division of any name, ownership or mailing address
changes within 30 days.

1) The Corps of Engineers believes that there may be jurisdictional aquatic resources in
the review area, and the requestor of this PJD is hereby advised of his or her option
to request and obtain an approved JD (AJD) for that review area based on an
informed decision after having discussed the various types of JDs and their
characteristics and circumstances when they may be appropriate.
2) In any circumstance where a permit applicant obtains an individual permit, or a
Nationwide General Permit (NWP) or other general permit verification requiring "pre -
construction notification" (PCN), or requests verification for a non -reporting NWP or
other general permit, and the permit applicant has not requested an AJD for the
activity, the permit applicant is hereby made aware that: (1) the permit applicant has
elected to seek a permit authorization based on a PJD, which does not make an
official determination of jurisdictional aquatic resources; (2) the applicant has the
option to request an AJD before accepting the terms and conditions of the permit
authorization, and that basing a permit authorization on an AJD could possibly result
in less compensatory mitigation being required or different special conditions; (3) the
applicant has the right to request an individual permit rather than accepting the terms
and conditions of the NWP or other general permit authorization; (4) the applicant can
accept a permit authorization and thereby agree to comply with all the terms and
conditions of that permit, including whatever mitigation requirements the Corps has
determined to be necessary; (5) undertaking any activity in reliance upon the subject
permit authorization without requesting an AJD constitutes the applicant's acceptance
of the use of the PJD; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps permit
authorization based on a PJD constitutes agreement that all aquatic resources in the
review area affected in any way by that activity will be treated as jurisdictional, and
waives any challenge to such jurisdiction in any administrative or judicial compliance
or enforcement action, or in any administrative appeal or in any Federal court; and (7)
whether the applicant elects to use either an AJD or a PJD, the JD will be processed
as soon as practicable. Further, an AJD, a proffered individual permit (and all terms
and conditions contained therein), or individual permit denial can be administratively
appealed pursuant to 33 C.F.R. Part 331. If, during an administrative appeal, it
becomes appropriate to make an official determination whether geographic
jurisdiction exists over aquatic resources in the review area, or to provide an official
delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds
that there "may be"waters of the U.S. and/or that there "may be" navigable waters of
the U.S. on the subject review area, and identifies all aquatic features in the review
area that could be affected by the proposed activity, based on the following

Dear Mr. Quinn:
Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to renew the work associated with your Department of the Army (DA)
permit that was originally issued on August 21, 2015 to perform new dredging in a 42-foot by
42-foot area surrounding a previously authorized docking facility, in navigable waters of the
United States, in Topsail Sound, at 804 Channel Boulevard, in Topsail Beach, Pender County,
North Carolina. The property currently has an existing residential home, bulkhead, pier,
platform and floating dock. The plans propose to excavate approximately 1,764 square feet of
shallow bottom habitat to a final depth of -4.0, relative to normal low water (NLW) and will
begin approximately 8-10 feet from the existing bulkhead and span westerly towards Banks
Channel and dispose of the dredged material in uplands located at 916 South Anderson Street in
Topsail Beach, North Carolina.
Your proposal continues to be consistent with the provisions and objectives of general
permit 198000291 (copy enclosed). The permit is hereby renewed. It is understood that all
conditions of your original Corps' authorization (attached) remain applicable, and that the
expiration date of your DA permit is December 31, 2021.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.
