HomeMy WebLinkAbout67-19 Carlisle, MaryPermit Class NEW Permit Number 67-19 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 _ Excavation and/or filling pursuant to NCGS 113-229 Issued to Mary Carlisle, 905 Blenheim Drive, Raleigh, NC 27612 Authorizing development in New Hanover County at adi. to the Cane Fear River, at 8000 River Road, Wilmington, as requested in the permittee's application dated 04/06/19, including attached workplan drawings (3), Sheets 1 of 3 dated 11/06/19 and Sheets 2-3 of 3 both dated 04/06/19. This permit, issued on Aueust 22, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may Dockina Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. K Signature of Permittee Mary Carlisle Permit No. 67-19 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the' authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandon_ s the permitted activity without having it transferred to a third party. 4) The permittee shall. install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of three (3) formalized boat slips and four (4) formalized jet -ski slips. 6) The boathouse shall not be completely enclosed or have side coverage more thanone half the height of the side, from the roof waterward. Footprint of the boathouse shall not exceed 868 square feet. 7) The authorized boathouse and covered platform shall be single story, and shall not be designed to allow for second story use. 8) The, authorized structures and associated activity shall not cause an unacceptable interference with navigation. 9) The authorized project is located within a primary nursery area (PNA). Therefore; in accordance with T15A:07H.0208 of the Rules of the Coastal Resources. Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 10) In order to further protect the endangered West lndian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fWs.gov%nc-es/mammal/niaiiatee auidelines.pdf General 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. Mary Carlisle Permit No. 67-19 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high (later level. NOTE: This permit does not convey any rights, either in real estate or material. The attached workplan drawings depict a deed line extending waterward of normal high water. The permittee is advised that the State of North Carolina claims title to most lands falling below the normal high water. NOTE: NOTE: t NOTE: NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit 291 (Action ID No. SAW-2019-00878). The N.C. Division of Water Resources authorized the proposed project by way of General Certification 4175 and assigned DWR Project No. 2019-0761. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A- 121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150E with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you plan to have the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the yellow Notice Card just prior to work Initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. The applicant is proposing to expand an existing private docking facility. The project is located at 8000 River Road, adjacent to the Cape Fear River in New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT. Waters at the project site are classified as SC and are not open to the harvesting of shellfish. The area is a Primary Nursery Area. I have reviewed this proposal for consistency with the New Hanover County Comprehensive Land Use Plan and offer the following comments. The general area of the project is classified as Residential. In general, New Hanover County allows development in Residential classified AECs, which is consistent with the State's minimum use standards. The New Hanover County Comprehensive Land Use Plan contains some policies which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. The Federal agencies have completed review of the proposal as presented in the modification request and your field investigation report. We recommend that the following conditions be included in the State authorization 1. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the U.S. Army Corps of Engineers, Wilmington District (USAGE) prior to implementation. 2. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 3. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other haRIyED waste, the permittee shall immediately report it to the N.C. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 6. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 7. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to USACE within 24 hours of the permittee's discovery of the violation. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The proposed construction site is located on an approximate 18.7 acre site, of which only 1.66 acre is high ground. There is approximately 2,865 If of shoreline within the property along the Cape Fear River, in Wilmington, New Hanover County, North Carolina. Coordinates are 34.085542 N,-77.923235 W. The applicant proposes to expand and restore the existing private docking facility. The applicant proposes to extend the fixed pier an additional 10' waterward, and on the southern side of the pier, construct a fixed platform (15' x 14% with a ramp extending in a southerly direction, landing on a floating platform (24' x 8') that would extend in a westerly direction towards the main body of the river. The applicant also proposes to construct a covered boathouse (31' x 28') that would cover two (2) platform boatlifts (each 27' x 12% which would be separated by a fixed platform (27' x 6') in the center. The applicant is proposing these two floating platform lifts to accommodate four jet skis on one lift, and one 27' vessel on the other lift. The facility would result in a total of three boat slips and accommodate 4 jet skis. The applicant states that the docking configuration would provide water depths of approximately -4' to -4' 4" at NLW. The docking facility would extend approximately 180' into a water body (from edge of marsh) which measures approximately1800' + across at this location. The structures would incorporate approximately 1330 SF of additional Estuarine Waters and Public Trust Area. The proposed structures would extend approximately 180' into a waterbody which measures approximately 1800' across at this location. This distance would conform to the X width distance rule. The proposed structures would allow the existing docking facility to accommodate up to three (3) vessels and 4 jet skis in water depths of approximately -4' at MLW. Minor increases in turbidity should be expected during construction. Dredging is not proposed as a part of this project. EFH: This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but not likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. Impacts are expected to be minimal due to temporary nature of sedimentation impacts during the reconstruction of the docking facility. The waters within the project area ARE designated as PNA by the Division of Marine Fisheries, are classified as SC by the Division of Water Resources, and are closed to shell fishing. SAV is not present and there are no shellfish resources within the project area. Average water depth within the project area is 4 MLW within the proposed slip areas. ESA: The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project may affect, but is not likely to adversely affect the West Indian Manatee. The use of Manatee Guidelines may be required'as a permit condition. The project would have No Effect on any other federally listed species. NHPA 106: Pursuant to Section 106 of the National Historic Preservation Act (NHPA) of 1966, Appendix C of 33 CFR Part 325, and the 2005 Revised Interim Guidance for Implementing Appendix C, the District Engineer consulted district files and records and the latest published version of the National Register of Historic Places and initially determines that no historic properties, nor properties eligible for inclusion in the National Register, are present within the Corps' permit area: therefore, there will be no historic properties affected. PROJECT SUMMARY: The applicant proposes to expand an existing private docking facility. Mary Carlisle Page 2 9. PROJECT DESCRIPTION The project site is located at 8000 River Road, adjacent to the Cape Fear River, in New Hanover County. To locate the property of interest from the Wilmington Regional Office (WiRO) travel south approximately 9.0 miles on College Road South. Turn right (west) onto Sanders Road and continue traveling west approximately 0.9 miles until the road terminates at River Road. Turn left onto River Road and travel south approximately 3.0 miles until you reach the property of interest which will be located on the right. The entire property is approximately 18.7 acres in size, however, only approximately 1.66 acres is high ground. There is approximately 2,865 linear feet of shoreline along the Cape Fear River. High ground vegetation at the site consists of Live Oak, Laurel Oak, Magnolia, Pine, Maple, Cedar and Sweet Gum. Understory vegetation consists of Red Cedar, Wax Myrtle and Marsh Elder. The upland portions of the property are bordered by either "404" or Coastal Wetlands, which include: Smooth Cordgrass (Spartina alternijlora), Black Needle Rush (Juncus roemarfanus), and Salt Meadow Grass (Spartina patens). Review of recent aerial photography shows a dilapidated pier and hexagonal platform. No permit history could be located for the previous docking facility, however, from staff review of aerial photography it appears the previous docking facility was constructed sometime prior to 1993. On the property there is an existing access pier under construction (400' x 6'), and platforms under construction, permitted under GP 73547D (issued 5/20/19). The pier under construction spans roughly 260' of Coastal Wetlands, and bridges a navigable slough, 6' above NHW. Approximately 255' from the landward edge of the access pier there is an uncovered fixed platform (20' x 6') on the south side of the access pier, and a covered fixed platform (21' x 21') on the northern side of the access pier. At the time of this permit application, the applicant is awaiting USACE approval/delineation for the construction of a bulkhead measuring 500 LF, sited immediately landward of the 404 delineation (pending GP 73541D), partially encircling the high ground portion of the property where the residence is located. The waters of the Cape Fear River are classified SC by the Division of Water Resources. They are designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to expand the existing private docking facility. The applicant proposes to extend the fixed pier an additional 10' waterward, and on the southern side of the pier, construct a fixed platform (15' x 14'), with a ramp extending in a southerly direction, landing on a floating platform (24' x 8') that would extend in a westerly direction towards the main body of the river. The applicant also proposes to construct a covered boathouse (31' x 28') that would cover two (2) platform boatlifts (each 27' x 12'), which would be separated by a fixed platform (27' x 6') in the center. The applicant is proposing these two floating platform lifts to accommodate four jet skis on one lift, and one 27' vessel on the other lift. The facility would result in a total of three boat slips and accommodate 4 jet skis. The applicant states that the docking configuration would provide water depths of approximately -4' to -4'4" at NLW. The docking facility would extend approximately 180' into a waterbody (from edge of marsh) which measures approximately 1800' + across at this location. The proposed structures would extend approximately 180' into a waterbody which measures approximately 1800' across at this location. This distance would conform to the Y4 width distance rule. The proposed structures would allow the existing docking facility to accommodate up to three (3) vessels and 4 jet skis in water depths of approximately -4' at NLW. May28, 2019 Office: Wilmington RECEIVED JUN I 1 2M DCM-MHD CITY Mary Stewart Carlisle Bulkhead and Pier Project Narrative Project Address: 8000 River Road, Wilmington, NC My client, Mary Stewart Carlisle, at 8000 River Road, Wilmington, NC would like to construct a bulkhead approx. 5 ft. tall and no more than 500 ft. long around the west side point of her property in order to order to bring the grade up for the installation of her pool. She would like to remove the old nonconforming pier and replace it with a new one in the location proposed on the drawings. The pier will start from the same elevation as the bulkhead heading west. We will have to bridge over the creek which will be a minimum of 6ft. above MHW in the creek. The pier will extend over roughly 230 R of marsh before extending into the Cape Fear River 180 ft. The pier will have a covered sitting area 20 ft. X 20ft. with overhang of 1 ft. around it. The sitting area will be on the north side of the pier opposite the sitting area on the South side of the pier will be a 6 X 20 sun deck for sun bathing. From the sitting area extending 100 ft. out to the west in the Cape Fear River will be 2 boat lifts. On the north side with a 6ft. wide finger pier between them. The lifts are a platform style lift which enables my clients to walk all around their boats and jet skis. The name of the lift is No Profile Boadifts. One lift will be for a 27 ft. boat and one lift will be used for 4 jet skis. My client would like to cover the 2 lifts and the 6 ft. walkway with a roof in order to keep their boat and jet skis from being exposed to the harsh sun and weather conditions throughout the year. Increased exposure would increase the oxidation of the gel coat and fading of the paint and leather on the seats along with increase wear and tear on the boats and jet skis. Opposite the lifts on the south side of pier will be a 15 X 14 fishing platform that will have a ramp to an 8 X 24 floating dock. There will be 2 mooring piles to the south of the floating dock approximately 15 ft. from the floating dock and one to the north of the floating dock.
