Permit Class Permit Number NEW 18-19 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 RECEIVED X Excavation and/or filling pursuant to NCGS 113-229 MAR 2 6 2019 Issued to Willard Buffkin, 229 Gazebo Court, Wilmington NC 28409 nCM-MHD CITY Authorizing development in - New Hanover County at adj. to AIWW/Iylvrtle Grove Sound. at 238 Inlet Point Drive, Wilmington , as requested in the permittee's application dated 8/14/18 (MP-1) and 8/28/18 (MP-2 & MP-4) including attached workplan drawings 1-2 of 3 dated 8/14/18 and 3 of 3 dated 11/6/18 This permit, issued on March 25, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) i ms permit acnon may oe appealec by the peimittee or oth qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Willard Buffkiu ADDITIONAL CONDITIONS Permit No. 18-19 Page 2 of 3 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access to the east, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) Should the property to the west be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15 foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 7) This permit authorizes a maximum of three (3) formalized boat slips. 8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six (6) feet in width and shall be elevated a minimum of three (3) feet over the wetland substrate as measured from the bottom of the decking. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Bulkhead 10) The authorized bulkhead shall be constructed in the same alignment as depicted on the attached workplan drawings. 11) No backfill material shall be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 12) The temporary placement or double handling of fill materials within waters or vegetated wetlands is not authorized. 13) The bulkhead shall be constructed prior to any backfilling activities. 14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 16) All backfill material shall be clean and free of any pollutants except in trace quantities. Willard Buffkin ADDITIONAL CONDITIONS Sedimentation and Erosion Control Permit No. 18-19 Page 3 of 3 17) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on, cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 19) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 22) No filling of any vegetated wetlands outside of the alignment of the fill area indicated on the workplan drawings is authorized by this.permit. NOTE: Future development of the permittee,s property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2018-01740), which was issued on 3/22/19. NOTE: The N.C. Division -of Water Resources assigned the proposed project DWR Project No. 2018- 00380. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. On the subject property, at 238 Inlet Point Drive, there is a thin band of coastal wetlands located along the shoreline, followed by phragmites and pennywort, and then the vegetation switches over to ornamental lawn grass. Here's an excerpt from the bio for the property: As proposed, the new bulkhead would disturb approximately 100 ft2 of estuarine shoreline, fill approximately 160ft2 of Coastal Wetlands (consisting primarily of Smooth Cordgrass (Spartina alterniflora)), and disturb approximately 2000 ft2 of high ground with tie back anchor installation and backfill (including the entire limit of disturbance). A majority of the fill! ng/i ncorporation of Coastal Wetlands would occur on the eastern side of the proposed fixed platform in one large 90- 100 f:2 area, and the remaining impact would be on smaller, thin bands (1-3') of Coastal Wetlands on the western side of the fixed platform. The thin bands of Coastal Wetlands that would be impacted are surrounded and/or intermixed with Common Reed (Phragmites Australis) and several upland species, including Pennywort (Hydrocotyle bonariensis), Southern Dewberry (Rubus trivialis), and other native grasses. I have not been trained in 404 delineation, but those are the species I noted. I'm happy to swing over there and take some photos if you would like to see what's on site. The applicant proposes to construct a new vinyl bulkhead, a new fixed platform, boatlift and floating dock. The general area of the project is classified as Developed while the AECs impacted by the work are classified as Resource Protection. In general, New Hanover County allows development in Resource Protection classified AECs, which is consistent with the State's minimum use standards. The New Hanover County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. The applicant is proposing to install a new bulkhead and expand an existing docking facility located at 238 Inlet Point Road, Wilmington. The applicant will connect two adjacent bulkheads resulting in 160 square feet of fill. The applicant is also proposing to add a floating platform to an existing docking facility. This floating dock is 8' x 64' and will be oriented parallel to the shoreline. According to submitted drawings, the depths underneath the platform range from -0.5' to -1.5' at normal low water (NLW). The project is located in Inlet Point Canal, a manmade canal and basin attached to the Atlantic Intracoastal Waterway (AIWW) just to the south of Carolina Beach Inlet. The waters are classified as SA by the NC Division of Water Resources and designated as a primary nursery area (PNA) by the NCDMF. PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. DMF has concerns with a floating platform in less than 18" of water at NLW. Floating docks repeatedly resting on the bottom can kill aquatic vegetation or shellfish beds, create anoxia in the sediment which can kill benthic invertebrates, and reduce the availability of shallow bottom habitat during low tide. In addition, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to the PNA. This particular property is one of the few with remaining transitional coastal wetlands along the shoreline. Coastal wetlands are considered among the most productive ecosystems in the world (NCDEQ 2015). Coastal wetlands are a productive detritus based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. Recent research indicates that even narrow fringes of wetlands are essential factors for fish utilization and erosion control. The proposed alignment would tie into the existing bulkheads to the north and south. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. Any permit issued should include the following conditions: 1. The alignment of the authorized bulkhead must be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions will require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 2. The bulkhead must be constructed prior to any backfilling activities. 3. The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the structure. 4. The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wail, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 5. The fill material will be clean and free of any pollutants except in trace quantities. Metal products, organic materials, or unsightly debris will not be used. 6. All backfill material will be obtained from a high ground source and confined behind the permitted bulkhead. 7. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. 8. To locate the property from Market Street travel south on College Road (NC Hwy 132) and continue south for approximately 5 miles on Carolina Beach Rd. (NC Hwy 421). Along the NHW, and 1-3 ft above the NHW, there is a band of Coastal Wetlands consisting primarily of Smooth Cordgrass (Spartina alternii fora), along which the substrate is currently being undermined due to the active erosion. The elevation on the property ranges from 0 to 9 ft above NHW, and from 0 to 5 ft above NHW at the project location. The Inlet Point Canal is manmade and the area surrounding it is a developed residential neighborhood, bordered by homes to the north and south. Existing structures on the project site include a single-family residence and a private docking facility, which includes an access pier (-10'x 10'), floating dock (-8' x 16'), and a boat lift (-12' x 12'). The existing docking facility was authorized under CAMA General Permit No. 45811-D, which was issued on 06/28/2006, and CAMA General Permit No. 54588-D, which was issued on 7/6/2010. At the project site, the canal is approximately 112' wide, and runs into the AIWW approximately 400' to the east. The New Hanover County Land Use Plan classifies the adjacent waters as Conservation and the adjacent high ground portion as Developed. The waters of Inlet Point Canal and Myrtle Grove Sound are classified as SA by the NC Division of Water Resources. These waters are designated as PNA by the NC Division of Marine Fisheries and are closed to the harvest of shellfish. 19'ITO ZIM DI 17 8 [ZIAI xoi i The applicant is proposing to construct a new vinyl bulkhead, a new fixed platform, boatlift and floating dock (increasing the slip count from two existing to three total). The applicant is proposing to construct a vinyl bulkhead approximately 100' in length, running across the property in an east/west direction, tying into neighboring bulkheads on either side of the property. The applicant hopes to secure the property from suffering further erosion. The applicant also proposes to reconfigure the docking facility, increasing the number of slips from 2 to 3, installing a larger fixed platform and larger floating dock, and removing the preexisting docking structures. The applicant proposes to construct a fixed platform on the eastern side of the property, extending waterward. The platform would be 6' x 6' initially extending south from the bulkhead as it crosses coastal wetlands, and then extend outwards to 12' by 14'. From the platform, a ramp would extend to the west, landing on a 8'x 64' floating dock extending to the west. To the immediate south of the proposed ramp and floating dock, the applicant proposes to construct a 12.5' by 14' boat lift. ANTICIPATED IMPACTS pCM yy As proposed, the new bulkhead would disturb approximately 100 ft of estuarine shoreline, fill approximately 160ft of Coastal Wetlands (consisting primarily of Smooth Cordgrass (Spartina alternii fora)), and disturb approximately 2000 ft of high ground with tie back anchor installation and backfill (including the entire limit of disturbance). A majority of the filling/incorporation of Coastal Wetlands would occur on the eastern side of the proposed fixed platform in one large 90-100 ft2 area, and the remaining impact would be on smaller, thin bands (1-3') of Coastal Wetlands on the western side of the fixed platform. The thin bands of Coastal Wetlands that would be impacted are surrounded and/or intermixed with Common Reed (Phragmites Australis) and several upland species, including Pennywort (Hydrocotyle bonariensis), Southern Dewberry (Rubus trivialis), and other native grasses. The proposed docking facility would shade roughly 36fF of Coastal Wetlands and incorporate 855ft2 of open water. As the facility is proposed, at its point of furthest extension the proposed structures would extend approximately 28' waterward in an area where the water body is approximately 112' wide, meeting compliance with the Y< width rule. As proposed, the location of the facility would also be consistent with the neighboring pier head line. As proposed, the facility would encroach into the adjacent 15' riparian corridor setback on the western side but the applicant has obtained the necessary waiver from the property owner at that location (Carter). As proposed, the facility would not encroach in the adjacent setback on the eastern side. The proposed structures would be located approximately 44' feet away from neighboring docking facilities to the west, and approximately 68' away from neighboring docking facilities to the east.
