This permit, issued on June 26, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Wetland Fill
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the fill of
2,000ft2 of Section 404 wetlands, all as expressly and specifically set forth in the attached permit
application and workplan drawings.
2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved fill alignment.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DEQ and the Chair
of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) The alignment of the authorized fill shall be staked by the permittee and verified by a representative of
the Division of Coastal Management within a maximum of 30 days prior to the start of construction.
Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions,
shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30
days prior to the new expected start of construction.
4) The fill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
5) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
6) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
General
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
10) In order to ensure compliance with the conditions of this Permit, the permittee and his contractor shall
schedule a pre -construction conference with the Division of Coastal Management prior to the initiation
of any mobilization activities associated with the authorized activity.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW- 2019-00729) issued 6/19/19.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-0557.

NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in
place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project.

Enclosed is a Major CAMA permit application submitted by Katerina Braman to further
develop her property located off HWY 45 adjacent the Ben Martin canal off Fodery Creek and
Swan Quarter Bay in the Town of Swan Quarter, Hyde County, North Carolina. The applicant
proposes to fill 2,000 ft' of 404 wetlands in the Estuarine Shoreline AEC for the purpose of
increasing the available uplands to support ongoing fishing and boat activities. I was fortunate to
have a pre -application meeting at the project site with Anthony Scarbmugh with the Division of
Water Resources and Raleigh Bland with the USACOE and both agencies were supportive of the
project moving forward. When reviewing this project proposal against the development standards
in the Estuarine Shoreline AEC, it is important to take note of the past disturbances to the wetland
as well as ongoing impacts from drainage and boat use in the canal. DCM staff has reviewed the
development standards for the Estuarine Shoreline found in NCAC 7H.0209 and have found the
project proposal consistent, therefore recommend issuance of the permit with the standard
conditions for erosion and sedimentation control and a note requesting a preconstruction meeting
prior to project initiation.

Consistency Determination: The request is consistent with/not in conflict with the 2008 Hyde County
CAMA Core Land Use Plan certified by the CRC on March 28, 2008.
Project Overview: The 4.5-acre project site is located at 19 NC HWY 45 adjacent the Ben Martin canal off
Fodery Creek in the Town of Swan Quarter, Hyde County, North Carolina. The current and historic use of
this property has been for boat dockage and spoil deposition during maintenance of the Ben Martin canal.
The applicant proposes to expand the upland area adjacent the existing dock by filling an area of 404
wetlands 20' wide x 1 00' long parallel to the canal. The purpose of the fill is to support the ongoing uses
of parking and staging fishing gear.
Existing site improvements include an upland spoil bank and an area of uplands ±SO' wide x 95' long just
off HWY 45, created when the Ben Martin canal on this property was excavated. There is a 6' wide x 95
long dock along the shoreline at this location. The area of uplands adjacent the dock is used for parking
and staging of fishing gear.
The project is located in the following Areas of Environmental Concern (AEC): Estuarine Shoreline (ES) and
Public Trust Shoreline. The project is located on the Ben Martin Canal that is designated as SA (Market
Shellfishing, Salt Water) and ORW (Outstanding Resource Waters) by the EMC and Primary Nursery Areas
(PNA) by the MFC, and is closed to shellfishing.
Wetlands on the project site consist of a Coastal Wetlands marsh vegetated with black needle rush (Juncus
roemerianus), salt grass (Distichlis spicato) and salt meadow hay (Spartina patens). The wetlands
immediately adjacent the upland area used for parking and next to HWY 45 are in a zone of transitioning

wetland types which has resulted in a shift in the vegetation community from Coastal Wetland marsh
grass species to a homogenous stand of common reed (Phragmites sp.) with scattered woody vegetation
such as groundsel bush (Bacchoris angstifolia), red cedar (Juniperus viriniona) and wax myrtle (Myrica
cerifera). This area was delineated as a 404 wetland by the US Army Corps of Engineers regulatory staff
bdt not as a Coastal Wetland marsh by NC Division of Coastal Management staff. A review of SAV, historic,
and archaeological resources was not provided.
Anticipated impacts The proposed filling activities will result in the permanent loss of 2,000 ft2 of 404
wetlands. The proposed development will increase the use of the upland area adjacent Ben Martin canal
and the associated impacts from increased boat and vehicular traffic.
Basis for Determination:
The 2008 Hyde County CAMA Core Land Use Plan Future Land Use Map (FLUM) designates the project site
on land as "Residential' and "Agricultural/Low Density Residential', and all AECs as "Unbuildable Land",
which limits development to 15A NCAC 7H use standards.
Policies - Conservation
P.30 Residential, commercial, and industrial development which meets 15A NCAC 7H use standards will
be allowed in estuarine shoreline, estuarine water, and public trust areas. In all other areas, development
will be allowed that is consistent with applicable local, state, and federal regulations.

On April 26, 2019, the Washington Regional Office of the Division of Energy, Mineral, and
Land Resources received a copy of your CAMA Major application for the subject project. The
proposed project involves the placement of fill in a 404 wetland adjacent to an existing dock facility
near Swanquarter, NC. Staff review of the plans and specifications has determined that the project,
as proposed, consists of activities that will not pose surface water quality threats from stormwater
runoff. The Director has determined that projects that are reviewed and approved by the Division
as not posing water quality threats from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 21-1.1000. Forthis reason, we are informing
you by way of this letter that the current project will not require a State Stormwater management
permit.
The stormwater rules require the Division to permit the common plan of development,
therefore, any future development on the property, regardless of whether a SEC plan or CAMA
Major permit is also required, will require a Stormwater Management Permit application and
permit issuance from the Division of Energy, Mineral, and Land Resources prior to any
construction. Any construction on the subject site, prior to receipt of the required permit, will
constitute a violation of 15A NCAC 21-1.1000 and may result in appropriate enforcement actions by
this Office.
Please keep in mind that this determination does not affect your legal obligation to obtain
other permits and approvals, which may be required by Federal, State, or local government

Dear Mr. Huggett:
Reference the application of the Equity Trust Company (Katerina Braman) for a
Department of the Army permit to place fill material within freshwater wetlands and expand an
existing building pad, on property located at 519 NC Highway 45, adjacent to Ben Martin Canal
and Fodrey Creek, in Swan Quarter, Hyde County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
3. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
4. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
5. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
6. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
7. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

should not take place within 50 feet of a waterbody or wetlands to prevent contamination by fuel and
oils. [35A NCAC 02H .0506 (b)(3) and (c)(3) and SSA NCAC 028 .0200 (3)(f)]

No Impacts other than those approved herein shall occur to Zones 1 and 2 of the protected riparian

otherwise approved by the Division.
5. The permittee shall report to the Washington Regional Office any noncompliance with this certification,
any violation of stream or wetland standards [15A NCAC 02B .0200] including but not limited to
sediment impacts, and any violation of state regulated riparian buffer rules [15A NCAC 02B
.0200). Information shall be provided orally within 24 hours (or the next business day If a weekend or
holiday) from the time the applicant became aware of the circumstances. A written submission shall
also be provided within 5 business days of the time the applicant becomes aware of the circumstances.
The written submission shall contain a description of the noncompliance, and its causes; the period of
noncompliance, including exact dates and times, if the noncompliance has not been corrected, the
anticipated time compliance is expected to continue; and steps taken or planned to reduce, eliminate,
and prevent reoccurrence of the noncompliance. The Division may waive the written submission
requirement on a case -by -case basis.
6. This approval and their conditions are final and binding unless contested. [G.S. 143-215.5]
These Certifications can be contested as provided In Articles 3 and 4 of General Statute 150B by filing a written
petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A petition

If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 1'50B with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact Department personnel at any time for assistance. By

The 4.5-acre project site is located off HWY 45 adjacent the Ben Martin canal off Fodery
Creek and Swan Quarter Bay in the Town of Swan Quarter, Hyde County, North Carolina. The
Swan Quarter Flood prevention dike exist in this location as a fiberglass sheet and concrete barrier
wall in close proximity to the edge of pavement on the south side of HWY 45. There is a driveway
crossing of the adjacent roadside/borrow ditch to an area of cleared upland spoil bank. The tract
has 1,180' of shoreline adjacent the Ben Martin canal. The primary purpose of the Ben Martin
canal was agriculture drainage. There is an electric mechanical drainage pump located in the Ben
Martin canal t100' upstream of HWY 45. The current and historic use of this property has been
for boat dockage and spoil deposition during maintenance of the Ben Martin canal. The Ben
Martin canal on this property was excavated in wetlands which resulted in an upland spoil bank
and an area of uplands ±50' wide x 95' long just off HWY 45. There is a 6' wide x 95 long dock
along the shoreline at this location. The area of uplands adjacent the dock is used for parking and
staging of fishing gear. The upland area adjacent the dock is clear of woody vegetation, vegetated
in maintained (regularly mowed) upland grasses. The spoil bank for a distance of ±277'
downstream of the parking/staging area was recently cleared to facilitate maintenance excavation
in the canal to a max final depth of minus 6' below the normal water level (NWL) where spoil was
placed on the upland bank while maintaining two existing t20' long breaks in spoil deposition to
allow for surface water exchange with the adjacent wetlands and canal. The maintenance
excavation was undertaken in January 2019 and was authorized by CAMA/Dredge and Fill general
permit no. 72936 issued on 13 December 2019. CAMA General permit no. 68909 issued 15
December 2017 authorized replacement of the existing dock.
The wetlands on the project site consist of a Coastal Wetlands marsh vegetated with black
needle rush (Juncus roemerianus), salt grass (Distichlis snicata) and salt meadow hay (Spartina
patens . The wetlands immediately adjacent the upland area used for parking and next to HWY
45 have been impacted by the historical development of the Ben Martin canal and HWY 45. This
area of wetlands is also in a zone of transitioning wetland types which has resulted in a shift in the
vegetation community from Coastal Wetland marsh grass species to a homogenous stand of
common reed (Phragmites W.) with scattered woody vegetation such as groundsel bush (Baccharis.
an sti olia), red cedar (Juniperus viriniana) and wax myrtle M rica cert era). This area was
delineated as a 404 wetland by the US Army Corps of Engineers regulatory staff but not as a
Coastal Wetland marsh by NC Division of Coastal Management staff.
Water depths in the Ben Martin canal range from minus 7' below the NWLnear it's
confluence with Fodery Creek to minus 6' adjacent the project site. The Ben Martin canal is
designated as a primary nursery area and Coastal Waters by the Marine Fisheries Commission and
SA ORW by the Environmental Commission and is closed to shellfishing. RECEIVED

Project Description
The applicant proposes to expand the upland area adjacent the existing dock by filling an
area of 404 wetlands 20' wide x 100' long parallel to the canal. The purpose of the fill is to support
the ongoing uses of parking and staging fishing gear. Fill dirt will be trucked to the site, dumped
on uplands then pushed into the wetland by a rubber tire backhoe. A fill slope of 2':1' will be
maintained with a silt fence placed at the toe of the slope. A grass seed mixture will be spread on
the fill to promote stabilization of the fill dirt.
Anticipated Impacts
The proposed filling activities will result in the permanent loss of 2,000 ft' of 404 wetlands.
The proposed development will increase the use of the upland area adjacent Ben Martin canal and
the associated impacts from increased boat and vehicular traffic.

pertaining to the location of the Tar/Pamlico River Basin Buffer, the applicant resubmited sheet 1
(Plan View) of the Major CAMA permit application package for 404 wetland fill within the
Estuarine Shoreline AEC onsite the applicant's property located off HWY 45 in the Town of Swan
Quarter adjacent the Ben Martin canal off Fodery Creek and Swan Quarter Bay in Hyde County,
North Carolina. Anthony Scarbraugh has indicated that the Tar/Pam Buffer on the original

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 15 April 2019. According to the said application submitted by Katerina Braman,
applicant proposes to fill an area delineated as 404 wetland 20' wide by 100' long to enlarge the
existing upland spoil bank to support ongoing uses associated with the existing boat dock. Project
site is located at 519 NC Hwy 45 adjacent the Ben Martin canal off Fodery Creek in the Town of
Swan Quarter, Hyde County, North Carolina.
A copy of the entire application may be examined or copied at the office of Jonathan R.
Howell, District Manager, Washington Regional Office, 943 Washington Square Mall,
Washington, NC, during normal business hours. Public comments received by 18 May 2019 will
be considered. Later comments will be accepted and considered up to the time of permit decision.
Project modifications may occur based on further review and comments. Notice of the permit
decision in this matter will be provided upon written request.

Martin canal off Fodery Creek in the Town of Swan Quarter, Hyde County, North Carolina. It
was received on 15 April 2019, and appears to be adequate for processing at this time. The
projected deadline for making a decision is 29 June 2019. An additional 75-day review
period is provided by law when such time is necessary to complete the review. if you have
not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the 75th

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
