This permit, issued on March 13, 2019 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
ri rnese terms may oe suoiect to rmes, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the pier and boat lift, and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this docking facility expansion without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2022
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) This permit authorizes a maximum of 1 formalized boat slip.
4) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's areas of riparian access.
5) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
General
6) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management:
7) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: -The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-00222).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 2019-0122.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations
in place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project.

The enclosed permit constitutes authorization under the Coastal Area Management Act,
and where applicable, the State Dredge and Fill Law, for you to proceed with your project
proposal. The original (buff -colored form) is retained by you and it must be available on site
when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

The facility is a commercial use and the business is in the Towne of Bath General Business District. The project is
requiring a Major Permit because of the commercial aspect. The business is a convenience store with a boat ramp, docks
with marine gas pumps located on a dock around the perimeter of the building. The applicant is proposing 180 square
feet of pier and a 13' by 13' uncovered boatlift which will usurp 169 square feet of public trust area for his personal use
at his place of business. Currently there is 1,190 sq. feet of platform with 180 sq. ft. proposed for a total of 1,370 sq. ft.
This is consistent with 07H .0208(b)(6)(B), the maximum allowed for this property is 1,696 sq. ft. Currently there are no
formalized boat slips, only transient side -to dockage for the patrons of the facility. The non -water dependent structure
over the water has been there for many years and the most recent LAMA Major permit no. 13-11, issued on 27 January
2011 permitted replacement of the bulkhead and the three piers as well as expanding the dock around the perimeter of
the building and the construction of steps to a second story deck. The permit was modified on 27 May 2014 to construct
a roof over the second story deck. This development was authorized under the Urban Waterfront Rules found in 7H
.0209(g)(1)&(4)(B). Mr. Tankards document appears to have been signed by his attorney in fact, Mr. Keith Tankard,
although in the incorrect place. It however was not dated. I will contact Mr. Boyd and instruct him to have Mr. Tankard
resubmit the document. I hope this answers your questions. Call me if you have any additional questions.

Can you give me some additional information on the square footage calculations. Mr. Boyd identifies everything as
personal/private use, and the non -water dependent structure over water makes it interesting.
The riparian notifications, specifically Mr. Tankard, isn't signed or dated. Can we get that corrected?

Mr. Boyd has submitted a CAMA Major Permit request for the construction of a 45' x
4' pier and a ±13' x ±13' uncovered boatlift at the Quarterdeck located adjacent NC 92 at 503
Carteret Street on Back Creek in the Town of Bath in Beaufort County, North Carolina.
Staff has reviewed the proposed project regarding rules found in Subchapter 7H
concerning development in Estuarine Water and Public Trust Areas. It is staffs
recommendation that the proposed project appears consistent
with the use standards for piers and docks found in 15A NCAC 07H .0208(b)(6).
Staff recommends the following conditions be included if the project is permitted.
1. No attempt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work.
2. This permit authorizes only the structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures may be conducted on, in or over
public trust waters without permit modification.

Consistency Determination: The request is consistent with/not in conflict with the Town of Bath CAMA
Workbook Land Use Plan certified by the CRC on July 27, 2007.
Overview: The applicant is requesting to construct a 45' x 4' pier and a ± 13' x ± 13' uncovered boatlift.
The project site is .4-acres and is located at 503 Carteret Street, Town of Bath, Beaufort County. This site
is a commercial property; existing site improvements include a convenience store, bathrooms, boat ramp
with launch piers, dock -around the store with marine gas pumps, pier and the shoreline is stabilized with
a vertical bulkhead. The store was constructed on pilings many years ago and is partially located above
the Public Trust Area of Back Creek.
AECs involved include Public Trust Areas. The Back Creek is classified as SB (Primary Recreation, Salt
Water)/NSW Nutrient Sensitive Waters). The creek is designated as a Primary Nursery Area and is closed
to the taking of shellfish. The property is subject the Tar -Pamlico Riparian Buffer rules enforced by the
N.C. Division of Water Resources. A review of Submerged Aquatic Vegetation (SAV), wetlands, shellfish
resources, historic resources and archaeological resources was not provided. The Creek is designated as
a Primary Nursery Area by the NC Wildlife Resources Commission. The Creek is closed to shell fishing in
this area.
Anticipated impacts resulting from this project are expected to include: the shading of approximately 180
ft2 of open water and usurpation of 169 ftZ of open water Public Trust Area.

Basis for Determination:
The Town of Bath CAMA Workbook Plan Future Land Use Map (FLUM) designates the land as "Commercial"
and the water as "Conservation Area". Additionally, the FLUM indicates that there is a public access on
the site. The public access site is further expanded on in the plan:
While not 'public access" in the technical sense of the term, access to public trust waters
is also provided by two private marinas in the Town. The Harbor Motel and Marina on
Bath Creek and the Quarterdeck on Back Creek do, for a fee, provide boat docking and
launching facilities. The public at large may for a fee obtain access to public trust water
at both sites. Users do have parking and bathroom facilities. Some limited products and
services are available: ship store, boat launching and docking, etc. (pg. 16).
The following LUP policies may be applicable to this request:

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide
information about natural heritage resources for the project referenced above.
Based on the project area mapped with your request, a query of the NCNHP database, indicates

The Division of Water Resources (DWR) has received a copy of your application request. DWR issues
approval in the form of a Water Quality Certification (WQC) in conjunction with the Regional General
Permit 291 issued by the US Army Corps of Engineers (USACE). This Certification allows you to use the
Regional General Permit when the US Army Corps of Engineers issues it.
In accordance with the attached General Certification #4175 (GC4175), the impacts described in your
application do not require written authorization to utilize GC 4175. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at http://www.ncoah.comL or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received
in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding
official state holidays).

The project site is located adjacent NC 92 at 503 Carteret Street on Back Creek in the Town of Bath in
Beaufort County, North Carolina. The property is a 0.4-acre tract with t212' of shoreline.
The site is a commercial property with a convenience store, bathrooms, boat ramp with launch piers, dock
around the store with marine gas pumps, pier and the shoreline is stabilized with a vertical bulkhead. The
store was constructed on pilings many years ago and is partially located above the Public Trust Area of Back
Creek.
CAMA Major Permit no. 13-11 was issued on 27 January 2011 to a previous owner to replace the bulkhead
and three piers as well as expand the dock around the perimeter of the building and construct steps to a
second story deck. The permit was modified on 27 May 2014 to construct a roof over the second story deck.
All of the permitted work was completed by the previous owner of the property.
The property is located in the Town's B-2 General Business District and falls within the Town of Bath's
zoning requirements. The property is bordered on the upstream side by NC 92 and on the downstream side
by a developed single family lot with a dwelling, basin and pier. Both of the adjacent properties are
vegetated with yard grass similarly to the applicants. The water depth at the end of the piers is approximately
-5.0' below normal water level (NWL).
Back Creek is classified as SB NSW by the Environmental Management Commission at the project site. The
Creek is designated as a Primary Nursery Area by the NC Wildlife Resources Commission. The Creek is
closed to shell fishing in this area. The property is subject the Tar -Pamlico Riparian Buffer rules enforced by
the N.C. Division of Water Resources.
Proiect description
The applicant proposes to construct a 45' x 4' pier and a t 13' x f 13' uncovered boatlift. This pier does not
extend beyond the piers on adjacent property and conforms to the quarter width rule. No portion of the pier
is proposed within the 15' riparian setback. This docking facility currently has no fixed slips, only transient
dockage, with one slip proposed.
Anticipated impacts
The project will result in the shading of approximately 180 ft' of open water and usurpation of 169 ftz of
open water Public Trust Area.

on the Back Creek near Bath in Beaufort County, North Carolina. It was received on 28
December 2018, and appears to be adequate for processing at this time. The projected
deadline for making a decision is 13 March 2019. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.

must be posted at the property of your proposed development You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
