Based on the information provided, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received by DCM on 11/12/2013, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. Accessory Uses 1. The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species. 2. The development must not alter naturally or artificially created surface drainage channels. 3. The development must not alter the land form or vegetation of a frontal dune. 4. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. 5. The proposed development shall remain consistent with the attached work plan drawings. 6. This exemption authorizes only the proposals detailed in the site drawing prepared by Charles F. Riggs and Associates, Inc. and dated revised by CFR on10/28/13. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter. I discussed your concerns with Debra Wilson, and based on the information we have, it appears the initial development plan (which included a residence and driveway) was never identified as being non -compliant or non- conforming, post construction. Because of this, and due to the fact that the addition is located over existing impervious coverage, we (DCM) are not going to suspend or withdraw our authorization for the approved accessory structure. A survey by Charles F. Riggs & Associates, Inc. dated April 10, 2014, indicates the existing built upon area is 34.1%, which exceeds the maximum of 30% authorized. Based upon my review of permits on file and a site inspection conducted 4/11/2014, it is my opinion that the concrete under the front deck was unauthorized, therefore resulting in the current violation of the permit issued in 2002 for the original development.
