Skvarla, III Secretary I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your proposal dated received by DCM on 6/5/2013, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. STRUCTURAL ACCESSWAY EXEMPTED (1) The accessway must not exceed six feet in width and shall provide only pedestrian access to the ocean beach. (2) The accessway must be constructed so as to make negligible alterations to the frontal dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. (3) Construction of the accessway be shall consistent with all other applicable local ordinances and N. C. Building Code standards. (4) The accessway shall not extend beyond the ocean side toe of the frontal dune. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter. It is possible that I mistakenly deleted it so if this is a duplicate, I apologize, but I want to make sure you have received the information from me. Therefore, I am sending this email as well: The Village at Topsail Shores HOA (of which I am president) , and its homeowners (of which I am one of the owners) own the beach access. The address of the HOA is 211-1 Gy Sgt D W Boatman Drive, North Topsail Beach, NC 28460. Any mail to the HOA or myself should be sent to me c/o my home address at 7029 Cedar Bend Ct., Raleigh, NC 27612. The telephone number for the HOA and myself is 919-247-8830. Location of the Work: The crossover is located in Onslow Conty, in North Topsail Beach community between 2070 New River Inlet Rd., North Topsail Beach and the Topsail Reef condo complex on New River Inlet Rd. Dimension of the Crossover: It will be approx 4 ft wide. At the top it will have a landing between 4 and 10 feet long out over the top of the dune and have stairs going down to the beach from there (up to 12 steps). I originally thought the landing would be about 4x4, but the builder thinks it may need to be longer- as much as 10 feet, which is approximately the size of the original structure. I am not sure I understand the exact process from here. Will you issue a permit or other document or simply an email that authorizes the rebuild? Please let me know if ok to proceed with the builder once you authorize. I am sure that you are very busy but obviously we need a crossover as soon as possible and I would appreciate your assistance with this request. Thank you and take care. Jason Dail 15A NCAC 07K .0207 STRUCTURAL ACCESSWAYS OVER FRONTAL DUNES EXEMPTED (a) The N.C. Coastal Resources Commission hereby exempts from the CAMA permit requirement all structural pedestrian accessways over frontal dunes which can be shown to meet the following criteria: (1) The accessway must not exceed six feet in width and must be for private residential or for public access to an ocean beach. This exemption does not apply to accessways for commercial use or for motor -powered vehicular use. (2) The accessway must be constructed so as to make no alterations to the frontal dunes that are not necessary to construct the accessway. This means that wherever possible the accessway must be constructed over the frontal dune without any alteration of the dunes. In no case shall the dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. Driving of pilings into the dune shall not be considered alteration of a frontal dune for the purposes of this Rule. (3) The accessway shall conform with any applicable local or state building code standards. (b) Before beginning any work under this exemption the CAMA local permit officer or Department of Environment, Health, and Natural Resources representative must be notified of the proposed activity to allow on -site review of the proposed accessway. My HOA has a beach access with a crossover stairway, and according to the NTB town hall the stairs were torn off during the winter by a storm. I just discovered the stairs were missing two weeks ago when I visited our house on Gy-Sgt DW Boatman Drive. We of course want to replace the stairs and when I called the NRB town hall today, they referred me to you. Our access is between the Topsail Dunes condos and the round dome house (I think its address is 2070 New River Inlet Rd). Ms Carin Faulkner sent me the attached photo that was taken after the storm which shows where the stairs were located. I understand that we apparently need to get a permit from CAMA to replace the stairs. Since we have several families that use the access, we need to get some new stairs as soon as possible. Could you please give me a call this afternoon? I am here for a few days this week so it would be great if we can get the permit process going. If you need to come out, would it possible to do so tomorrow (Tuesday)? Thank you in advance for your assistance.
