Docking Facility 1) This permit authorizes only the dock, pier, canoe launch and boat lift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. General 6) The permittee is advised that no development or land -disturbing activity that is considered non -water dependent shall occur within 30 feet of the normal water level. 7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 8) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Existing structures along the shoreline of Baycliff include a community fishing pier with a gazebo/T-head platform, boat ramp, breakwaters, mooring buoy, four tie pilings, five bird nesting poles, and four private piers with associated platforms and/or boatlifts. The applicants' proposal is to construct a 120'x6' pier with a 20'x20' T-head platform, a 12'x4' lower kayak/canoe launch platform, a 14'x14' boatlift, and a 60'x6' walkway that will extend from the pier to the lower deck of the residence. The development involves the Estuarine Waters (EW) and Public Trust Area (PTA) AECs. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this proposal, and my findings are as follows: 15A NCAC 071-1.0206 ESTUARINE WATERS (d) Use Standards. Suitable land/water uses shall be those consistent with the management objectives in this Rule. Highest priority of use shall be allocated to the conservation of estuarine waters and their vital components. Second priority of estuarine waters use shall be given to those types of development activities that require water access and use which cannot function elsewhere such as simple access channels; structures to prevent erosion; navigation channels; boat docks, marinas, piers, wharfs, and mooring pilings. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. North Carolina 27909 252264.3901 Recommendations for Baycliff HOA; Chad & Colette Walker a May 8, 2019 15A NCAC 07H .0207 PUBLIC TRUST AREAS (c) Management Objective. To protect public rights for navigation and recreation and to conserve and manage the public trust areas so as to safeguard and perpetuate their biological, economic and aesthetic value. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. The request is consistent with the intent of this rule. 15A NCAC 07H .0208 USE STANDARDS (b) Specific Use Standards (6) Piers and Docking Facilities. (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; The request is consistent with the intent of this rule. (B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot (Ift) of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: The proposed T-head platform and lower platform will total 448 sf. The shaded impact for existing platforms is approximately 1,284 sf. The total sf of shading impact will be 1,732 after the project is complete. (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: The pier will be 6' in width, and will not be located over any coastal wetlands. (E) The total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift; `' Consistent: The boat lift proposed will total 196 sf. They may be roofed but shall not be designed to allow second story use; Consistent: No roof or 2nd story use is proposed. (G) Pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); (11) not extending into the channel portion of the water body; and (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. Consistent: The proposed pier meets the intent of these rules. (1) Piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's areas of riparian access. The line of division of areas of riparian access shall be established by drawing a line along the channel or deep water in front of the properties, then drawing a line perpendicular to the line of the channel so that it intersects with the shore at the point the upland property line meets the water's edge. The minimum setback provided in the rule may be waived by the written agreement of the adjacent riparian owner(s) or when two adjoining riparian owners are cc applicants... Consistent: The residents of Baycliff HOA are not riparian property owners, as their ownership is limited to the square footage of the lots upon which their houses are built. BayCliff HOA retains full ownership of the common area, which includes the shoreline adjacent to the Albemarle Sound. The riparian property owner to the left of the Baycliff subdivision is over 800' away from the project area. The riparian property owner to the right is over 300' away from the project area. The proposed pier is outside of the 15' riparian corridor. (J) Applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. Consistent: No shellfish franchisellease is involved. Based on my review of the applicable subsections of the North Carolina Administrative Code, the permit application and plans to construct a docking facility along the shoreline of Baycliff HOA meet the intent of the rules of the CRC. DATE: April 1, 2019 Consistency Determination: The request is consistent with/not in conflict with the Dare County 2009 Land Use Plan certified by the CRC on February 24, 2011. Overview: The subject properties consist of the Baycliff Homeowners Association's 14.83 acre common area which has approximately 1,214 linear feet of shoreline along the Albemarle Sound and the 2,000 sq. ft. house lot at 134 Sally Crab Court that is located approximately 40 feet from the shoreline. Water depths in the sound range from -.5 feet to -3 feet approximately 120 feet from the shoreline. The properties have an elevation of approximately 10 feet above Normal Water Level (NWL). Shoreline common area and the house lot are in the AE (8) Floodzone. The Baycliff community consists of approximately seventy-two (72) single-family residential house -only lots surrounded by common property controlled by the Baycliff Homeowner's Association. Existing site improvements consist of a gatehouse, roadway, single-family houses, driveways, a clubhouse and a swimming pool. A two-story elevated house with parking underneath and associated deck area is located on the lot at 134 Sally Crab Court. Existing shoreline improvements consist of a community fishing pier with a terminus platform and gazebo, four (4) additional piers with terminus platforms, a boat ramp, twelve (12) breakwaters, a mooring buoy, four (4) tie pilings, and five (5) bird nesting poles. The square footage of shading over the sound for existing platform, pier and walkway improvements is approximately 5,592 sq. ft. CAMA General Permits were issued for the shoreline improvements. The water depth at the terminus platform and boat lift is approximately -3 feet. The waters of the Albemarle Sound in this area are designated as SB and are closed to shellfishing. There appear to be no known areas of archaeological significance on the properties. There were no SAVs noted in the project area at the time of the field investigation site visit. Anticipated Impacts resulting from this project are expected to include: the shading of 1,364 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and 360 sq. ft. of Estuarine Shoreline AEC. Basis for Determination: The Dare County Land Classification Map identifies the subject property as "Community Residential". As indicated on Page 214 for the "Community Residential" designation, "...(I)and disturbing activities that alter or remove vast amounts of vegetation, alter natural drainage patterns, or which divert storm water into surface waters are considered incompatible with this sub -classification". The following LUP policies may be applicable to this request. Public Access: Policy PA#1, Page 142. "Dare County supports the preservation and protection of the public's right to access and use of the public trust areas and waters" Land Use Compatibility: Policy LUC#15, Page 159. MAR 2 0 2019 DCM,MMHD CITY BayCliff/Walker Field Investigation Report Page 2 Proiect Settin The development site is located at 134 Sally Crab Court in the BayCliff subdivision, which is in the Colington District outside of the Town limits of Kill Devil Hills, in Dare County. BayCliff Homeowners Association (HOA) is a 14.83-acre private community with approximately 72, 2,000 sf lots dedicated for single-family residences. The residences are surrounded by Association common property, which include a gatehouse, fishing pier, gazebo, clubhouse with swimming pool, and boat ramp. The property has an elevation of approximately 10' above normal water level (NWL). The common area also includes the 1,214-foot shoreline adjacent the Albemarle Sound, and has approximately a dozen breakwaters, as well as 1 mooring buoy, 4 tie pilings and 5 bird nesting poles along the shoreline. There are two properties off Baycliff Trail that do not have breakwaters along a portion of shoreline and have a high -ground escarpment that resulted from Tropical Storm Michael. The vegetation noted on this tract were live oaks (Quercus virginiana), loblolly pines (Pins taeda), landscaping plants, catbrier, eastern red cedar (Juniperus virginiana), redbay (Persea borbonia), American holly (ilex opaca), Phragmites australis, and black needlerush (Juncus roemerianus). Previous permits for the shoreline of the BayCliff Homeowners were obtained through general permits. In addition to the community fishing pier with a gazebo/T-head platform, there are 4 other piers along the Association's shoreline. The pier in front of Lot 160 has a gazebo/T-head platform with a U-shaped finger pier, and a boatlift. The pier in front of Lot 154 has a T-head platform and a slip with a damaged lift. The pier in front of Lot 148 has an existing T-head platform with a lower damaged platform, as well as an L-shaped finger pier and boatlift. The square footage of shading for the existing platforms is approximately 1,284 sf. Due to damages by Tropical Storm Michael, Lot 138 only has a pier extending over the breakwater, with remnant pilings for 2 platforms. The riparian property to the north is an undeveloped, vacant parcel of land. The riparian property to the south is developed with a single-family residence, a walkway to the shore, an upland retaining wall, and a riprap revetment along the shoreline. The water classification for the Albemarle Sound is SB, and the area is closed to shellfishing. The water depths range from -0.5' to 4 NWL in the project area, and the bottom is a sandy material. The descriptive boundary is designated as Coastal Waters and is in the Pasquotank River Basin. There were no SAVs noted in the project area at the time of the site visit. There appears to be no known archeological sites on the property. RECEIVED MAR 2 0 DCM-MHD CITY BayCliff/Walker Field Investigation Report Page 3 Development Proposal The applicants are requesting authorization to construct a 120'x6' pier with a 20'x20' T- head platform, a 12'x4' lower kayak/canoe launch platform, a 14'x14' boatlift, and a 60'x6' walkway that will extend from the pier to the lower deck of the residence. The proposed docking facility is no longer than the pier head line established by the adjacent piers and docking facilities. The water depth at the proposed pier head and boatlift is noted as -3' NWL. The width of the waterbody is approximately 6.49 miles. The residents of BayCliff HOA are not riparian property owners, as their ownership is limited to the square footage of the lots upon which their houses are built. BayCliff HOA retains full ownership of the common area, which includes the shoreline. Under our General Permit (GP) rule 07H.1205(e), "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 800 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total." The square footage of shading for the existing platforms (which include T- heads/gazebos, lower platforms, and finger piers) is approximately 1,284 sf and the square footage of shading for existing piers/walkways is approximately 4,308 sf., With the existing square footage of piers and platforms that have been constructed along BayCliff's shoreline, our rules would not allow a permit through the GP process. The development site is private property; therefore, the applicants' request was elevated for major permit review. It is noted that the proposed docking facility will not be crossing over any wetland vegetation. Anticipated Impacts The proposed development will result in the following impacts: • The pier will shade 720 sf of Estuarine Waters (EW) and Public Trust Area (PTA) AECs. • The T-head and lower platform will shade 448 sf of EW and PTA AECs. • The boatlift will shade approximately 196 sf of EW/PTA AECs when boat is moored. • The walkway will shade approximately 360 sf of Estuarine Shoreline and Public Trust Shoreline AECs. The additional square footage of proposed platforms would bring the total sf of shading to approximately 1,732. It appears that the Mr. Walker has had his engineer redraw the site plan for the pier which shifts it slightly to the south from the previous location. However, it appears that it has only be altered by roughly ten (10) feet or so which still leaves the proposed pier and boat lift location still directly in front of my residence and the common area between our houses, which I strongly objected to in my original letter. From the email I received today from Ms. Carver about the new site plan, it appears that Mr. George Wood is the designer of this pier project for Mr. Walker. Mr. Wood came to me a little over a year ago and informed me that I should stringently object to this pier in this location. He stated to me that I have a right to object to this pier location as it would breach my property line and the buffer that lies between the houses. He stated that this was not allowed unless I signed over my property rights, which I have not. He also informed me it would prevent me from ever having an opportunity to have a pier at my residence as Mr. Walker's pier would now be located in the area where my potential pier would have to be located so that it does not breach the adjacent owner's property line. I now find this very strange that Mr. Wood would now be designing a site plan for a pier for which he adamantly encouraged me to object to a little more than a year ago. Mr. Wood stated to me in 2018 that an ordinance prevents Mr. Walker from having his pier in front of his residence as it would encroach on the remnants of an old pier to the south of him. Mr. Walker also told me that this ordinance is the reason for his pier being located in front of my residence, not his. However, Ms. Carver informed me that this is not completely true but there are some restrictions. So, if this ordinance does not exist, why does he continue to plan on this location? What gives him the right to encroach on my property boundaries for his benefit when the adjacent homeowners' pier is given full respect of their riparian setback. All of the piers in this subdivision extend directly out from their respective property boundaries. Why does this one have to extend in front of my house? I'm very concerned that this will eliminate any opportunity for a pier to be constructed at my residence and restrict my rights as a property owner. In closing, I am again asking that Mr. Walker's request for a permit to construct this pier be denied as it encroaches on my property, restricts my views and jeopardizes any possibility of constructing a pier at this residence. If his pier would be designed to respect my 15ft riparian rights and and confirm to the same manner in which all other sub -division piers have been built, my objections and concerns would greatly diminish. I am the adjoining property owner.(132 Sally Crab Ct.) and have very serious concerns about this proposed pier. When Mr. Walker approachedme about his intentions in 2018, I strongly objected then to the pier extending out in front of my residence. The proposedplan at that time extended not only in front of my residence but even further to the north past my residence. I indicated to him at that time that I had.no issues with him building a pier'just as long as it did.not extend in front of my residence as this would prevent me from possibly constructing a pier in the future and would also block my views of the sound. I told him that I would not sign away of my rights to allow for this pier. He stated to me at that time that he would redraw the pier so that it would not extend past my property line and would only be in front of his residence. However, the newly proposed 2019 plan for this pier still extends in front of my residence. The proposed pier has been adjusted slightly so that the initial portion is in front of his residence. However, this is only for a short distance. It then takes a sharp turn towards the northwest before it even reaches the water. This extends it roughly the same distance out in front of my residence as the 2018 proposal. The 2019 proposal also contains a boat lift which further extends it in front of my residence. This proposal is not acceptable to me and I object just -as strongly now as I did in 201=8. The location of this pier will prevent me from ever being able to construct a pier for my residence. My residence is currently for sale. The listing includes a provision that construction of a pier is possible. This proposed pier, if allowed, will not only eliminate this provision but cost me financially as well as the provision would have to be removed. In closing, I am asking that Mr. Walker's request for a permit to construct this pier be denied as it encroaches on my property along with preventing any possibility of constructing a pier of my own. Indicates the presence of any 404 or Coastal Wetland Marsh in or adjacent area of proposed work (information on plat needs to be updated to show other pockets of Juncus/black needlerush). Under Project Notes you gave sf of proposed pier of 828 sf and listed TeeHead = 400 sf; please note that the canoe launch is an additional platform = 48 sf. You also listed total TeeHead platforms as 1,188 sf. It is noted that you are not including lower platforms/canoe launches/finger piers in your total platform calculations. ■ Narrative: your narrative addresses the full activities of the project; however, you have not provided an accurate calculation of the total platform square footage that exists along the shoreline of BayCliff HOA, as you only listed the `tee heads'. You referenced the provisions listed under 07H.0208(b)(6) regarding 8 square feet per linear foot of shoreline, with a 2000 sf maximum. T-heads, L-heads, floating docks, kayak/canoe launches, lower platforms, and finger piers all count toward the total square footage of platforms. This factor would change your calculation of existing sf and proposed sf. To expedite our response to your permitting request, we will commence the detailed review of your application for a permit pending the receipt of the additional information requested above.
