I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor
development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity
you propose is exempt from needing a minor development permit as long as it remains consistent with your repair plan dated and
received by DCM on 4/18/2013, and meets the conditions specified below. If your plans should change and your project will no longer
meet these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR
Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible.
The repairs are limited to 50% of the physical value of the existing structure and the following specific conditions.
(1) Specifically, this exemption provides authorization to repair the primary structure's foundation supports by
"sistering" pilings to those damaged and/or in need of supportJrepair. This exempti n also authorizes the placement
of timber deck boards beneath and within the footprint of the residence following rtoval of the existing broken and
deteriorated concrete slab. Additionally, this exemption authorizes the placement of compatible beach fill material
beneath and within the confines of the primary structures footprint. The fill material MUST be approved by a
representative of the Division of Coastal Management (DCM) prior to placement on the subject property. A sample of
the fill material may be taken and provided to the appropriate DCM representative.
(2) The development must not involve removal, damage, or destruction of threatened or endangered animal or
plant species;
(3) The development must not alter naturally or artificially created surface drainage channels;
(4) The development must not alter the land form or vegetation of a frontal dune;
(5) The development must not be within 30 feet of normal water level or normal high water level; and

(6) The development must be consistent with all applicable use standards and local land use plans in effect at the time the
exemption is granted.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local
authorization. This exemption expires 90 days from the date of the letter.
