Skvarla, III Governor Director Secretary March 13, 2013 Exemption Number — NTBEXI3-27 Becky Stevens-Grobbelaar PO Box 2092 Clayton, GA 30525 RE: EXEMPTED PROJECT (MINOR) EXEMPTION Maintenance and Repair and Accessory Use / Structure - (15A NCAC 7K .0103 and .0209) — Exemption# NTBEXI3-27 3938 River Road, North Topsail Beach, NC AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard AEC Dear Ms. Grobbelaar: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received by DCM on 3/13/2013, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. ACCESSORY USE 1. The development must not disturb a land area greater than 200 square feet. 2. The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species. 3. The development must not alter naturally or artificially created surface drainage channels. 4. The development must not alter the land form or vegetation of a frontal dune. 5. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. 6. The amount of open, uncovered decking shall not exceed 500 square feet within 60' from the First Line of Stable Natural Vegetation (FLSNV). MAINTENANCE AND REPAIR Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible. The repairs are limited to 50% of the physical value of the existing structure and the following specific conditions. (1) The project consists of repairing the ocean side deck and stair case, as shown on the attached drawing. (2) The development must not disturb a land area of greater than 200 square feet on a slope of greater than 10 percent; (3) The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species; (4) The development must not alter naturally or artificially created surface drainage channels; (5) The development must not alter the land form or vegetation of a frontal dune; 127 Cardinal Drive Ext., Wilmington, NC 28405 Phone: 910-796-72151FAX: 910-395-3964 Internet: www.nccoastalmanagement.net Ms. Grobbelaar Page Two 6) The development must not be within 30 feet of normal water level or normal high water level; and :7) The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. Fhis exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization.
