2) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require
a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from
DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral
and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405.
Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit.
Sedimentation and Erosion Control
3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
General
5) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
6) This Minor Modification shall be attached to the original Permit No. 76-20, which was issued on
6/29/20, and copies of all documents must be readily available on site when Division personnel inspect
the project for compliance.
7) All conditions and stipulations of the active permit remain in force unless specifically altered herein.

Major CAMA Permit #76-20 Minor Modification Request
Project Narrative
July 1, 2020
Carteret Community College (CCC) is located adjacent Bogue Sound at 3505 Arendell Street (US
Highway 70) in Morehead City, Carteret County. The highway comprises the northern limits of the
campus, with the southern boundary being the normal high-water level of Bogue Sound. The adjacent
riparian property owner to the east of the campus is the NC Division of Marine Fisheries. The adjacent
riparian property owners to the west of the campus are Albert and Marie Libby.
CCC is requesting a minor modification to major CAMA permit #76-20 for authorization to construct a
greenhouse and associated sidewalk as shown on the enclosed site plan. Grading and stormwater
improvements associated with the project are also proposed.
The college urgently needs to construct the greenhouse in support of the recently re-established
Horticulture Technology Program. College staff indicates that the future of this program may be
dependent upon the greenhouse being constructed for use during the Fall 2020 semester.
The proposed greenhouse and concrete sidewalk will measure 72.17' x 24.67' (1,780.4 tt2) and 9.78' x 5'
(48.9 ) respectively, for a total of 1,829.3 ft . The new section of sidewalk will connect to an existing
sidewalk, as shown on the project site plan. Land disturbance associated with the project is anticipated to
be approximately 2,500 W.
Previous shoreline delineations did not place the proposed greenhouse in a CAMA Area of Environmental
Concern (AEC). However, a landward migration of the normal high-water line was recently identified by
surveyors, thus placing the project site within the coastal shoreline AEC. The proposed construction is
located entirely out of the CAMA buffer, with the exception of grading associated with the work.
There is no wetland disturbance proposed. While coastal wetlands are found intermittently along the
shoreline of the f 42 acre campus, none will be impacted by the current project. There is also no proposed
disturbance of non -coastal wetlands. Tom Charles with the US Army Corps of Engineers has provided the
attached email dated June 4, 2020 verifying that the project site is not within the Corps' jurisdiction.
No stormwater infrastructure will be located within the CAMA buffer. Stormwater improvements will
consist of rainwater harvesting in accordance with the NC Department of Environmental Quality
(NCDEQ) Stormwater Design Manual. The collected stormwater will be used for 12-month greenhouse
watering of plants and evaporative cooling of the structure. An above -ground cistern is proposed for
installation at the southern end of the greenhouse.
The proposed project will create additional impervious surfaces beyond what is currently identified or
permitted under existing state stormwater management permits. Therefore, a state stormwater permit
modification (SW8 960424) is also being requested. The stormwater modification has been accepted for
express review by NCDEQ staff in the Wilmington Regional Office. The express stormwater submittal
meeting with staff of the Division of Energy, Mining, and Land Resources is scheduled for August 4,
2020.

Hi Tom,
1 hope you are doing well. Carteret Community College has asked us to pursue express CAMA and stormwater permits
for construction of a campus greenhouse for use with the recently re-established Horticulture Technology Program at
the college. The greenhouse needs to be constructed in time for use with the upcoming fall semester. According to
staff, the future of the horticulture program is dependent upon the greenhouse being in place. We have submitted
requests to NCDEQ for express CAMA and stormwater permit reviews.
Carteret Community College has just recently become aware that the greenhouse project site is located in a CAMA AEC.
A recent survey showed that normal high water has moved landward and that the site is located within the 75-foot
coastal shoreline AEC, but outside of the CAMA 30-foot buffer.
Project engineers and surveyors have advised that non -coastal wetlands may exist in locations on the +/- 42-acre
campus. Coastal wetlands are found intermittently along the shoreline. However they believe there are no coastal or
non -coastal wetlands at the proposed greenhouse project location, and that no wetlands will be impacted by the work.
We are working with CAMA staff to confirm the location of coastal wetlands.
NCDEQ Staff has advised that in order to expedite the process we should contact the Corps to confirm that no non -
coastal wetlands exist at the site. Would it be possible for you to visit the campus and confirm no wetlands in the project
area? I can send maps and can also meet you onsite.
If you are not the appropriate person at the Corps, can you advise who I should contact? Please let me know if you need
additional information at this point.

watering of plants and evaporative cooling of the structure. An above -ground cistern is proposed for
installation at the southern end of the greenhouse.
The proposed project will create additional impervious surfaces beyond what is currently identified or
permitted under existing state stormwater management permits. Therefore, a state stormwater permit .
modification (SW8 960424) is also being requested. The stormwater modification has been accepted for
express review by NCDEQ staff in the Wilmington Regional Office. The express stormwater submittal
meeting with staff of the Division of Energy, Mining, and Land Resources is scheduled for August 4,
2020.

By copy of this memo, DCM staff are requesting that a modification to CAMA Major Permit #76.20
on the proposed project to construct a greenhouse, associated sidewalk, and grading as needed for
site preparations as described in the applicant's request and narrative dated July 1, 1020.
Please find correspondence enclosed dated 07/01/2020 from Coastal Planning Services, LLC, c/o Kathy
Vinson as authorized agent for the Carteret Community College, requesting a permit modification. State
Permit No. 76-20 was issued on 06/29/2020 for the shoreline stabilization structures, a living shoreline
structure, and upland land disturbances in and adjacent to Bogue Sound, Carteret County. The permit
expires on December 31, 2023.
The College officials have indicated that the future of the recently re-established Horticulture Technology
Program is dependent upon the greenhouse being in place by next spring. The need for a CAMA permit
modification was just recently identified, based on a recently completed survey done for stormwater
permitting purposes. The recent survey showed that normal high water at the site has moved landward,
thus placing the greenhouse location in the coastal Estuarine Shoreline AEC. The greenhouse is not
located in the buffer. DCM staff and the Corps has ensured there are no wetland impacts.
The greenhouse project requires a stormwater modification permit, which has already received verbal
acceptance for express review in August of 2020 under DEMLR permit SW8960424. It is recommended
that the modification to CAMA Major Permit No. 76-20 include a condition that no increase in built upon
area associated with the greenhouse project commence until such stormwater permit modification is
authorized by DEMLR.
A check (#9062338), received on 07/01/2020, in the amount of $100 has been received to process the

1 hope you are doing well. Carteret Community College has asked us to pursue express CAMA and stormwater permits
for construction of a campus greenhouse for use with the recently re-established Horticulture Technology Program at
the college. The greenhouse needs to be constructed in time for use with the upcoming fall semester. According to
staff, the future of the horticulture program is dependent upon the greenhouse being in place. We have submitted
requests to NCDEQ for express LAMA and stormwater permit reviews. I
Carteret Community College has just recently become aware that the greenhouse project site is located in a CAMA AEC.
A recent survey showed that normal high water has moved landward and that the site is located within the 75-foot
coastal shoreline AEC, but outside of the CAMA 30-foot buffer.
Project engineers and surveyors have advised that non -coastal wetlands may exist in locations on the +/- 42-acre
campus. Coastal wetlands are found intermittently along the shoreline. However they believe there are no coastal or
non -coastal wetlands at the proposed greenhouse project location, and that no wetlands will be impacted by the work.
We are working with CAMA staff to confirm the location of coastal wetlands.
NCDEQ Staff has advised that in order to expedite the process we should contact the Corps to confirm that no non -
coastal wetlands exist at the site. Would it be possible for you to visit the campus and confirm no wetlands in the project
area? 1 can send maps and can also meet you onsite.
If you are not the appropriate person at the Corps, can you advise who I should contact? Please let me know if you need
additional information at this point.

Project Narrative
Carteret Community College (CCC) is located adjacent Bogue Sound at 3505 Arendell Street (US
Highway 70) in Morehead City, Carteret County. The highway comprises the northern limits of the
campus, with the southern boundary being the normal high-water level of Bogue Sound. The adjacent
riparian property owner to the east of the campus is the NC Division of Marine Fisheries. The adjacent
riparian property owners to the west of the campus are Albert and Marie Libby.
CCC is requesting CAMA authorization to construct a greenhouse and associated sidewalk as shown on
the enclosed site plan. Grading associated with the project is also proposed.
The college urgently needs to construct the greenhouse in support of the recently re-established
Horticulture Technology Program. College staff indicates that the future of this program may be
dependent upon the greenhouse being constructed in time for use during the Fall 2020 semester.
The pro used greenhouse and concrete sidewalk will measure 72.17' x 24.67' (1,780.4 ft) and 9.78' x 5'
(48.9 ft) respectively, for a total of 1,829.3 fe. The new section of sidewalk will connect to an existing
sidewalk, as shown on the project site plan. Land disturbance associated with the project is anticipated to
be approximately 2,500 fe.
Previous shoreline delineations did not place the proposed greenhouse in a CAMA Area of Environmental
Concern (AEC). However, a landward migration of the normal high-water line was recently identified by
surveyors, thus placing the project site within the coastal shoreline AEC. The proposed construction is
located entirely out of the CAMA buffer, with the exception of grading associated with the work.
There is no wetland disturbance proposed. While coastal wetlands are found intermittently along the
shoreline of the 142 acre campus, none will be impacted by the current project. There is also no proposed
disturbance of non -coastal wetlands. Tom Charles with the US Army Corps of Engineers has visited the
site and determined that the project area is not within the Corps' jurisdiction.
No stormwater infrastructure will be located within the CAMA buffer. The proposed project will create
additional impervious surfaces beyond what is currently identified or permitted and��rr�e, ' t state

riparian property owner to the east of the campus is the NC Division of Marine Fisheries. The adjacent
riparian property owners to the west of the campus are Albert and Marie Libby.
CCC is requesting a minor modification to major CAMA permit #76-20 for authorization to construct a
greenhouse and associated sidewalk as shown on the enclosed site plan. Grading and stormwater
improvements associated with the project are also proposed.

attached email dated June 4, 2020 verifying that the project site is not within the Corps' jurisdiction.
No stormwater infrastructure will be located within the CAMA buffer. Stormwater improvements will
consist of rainwater harvesting in accordance with the NC Department of Environmental Quality
(NCDEQ) Stormwater Design Manual. The collected stormwater will be used for 12-month greenhouse
watering of plants and evaporative cooling of the structure. An above -ground cistern is proposed for
installation at the southern end of the greenhouse.
The proposed project will create additional impervious surfaces beyond what is currently identified or
permitted under existing state stormwater management permits. Therefore, a state stormwater permit
modification (SW8 960424) is also being requested. The stormwater modification has been accepted for
express review by NCDEQ staff in the Wilmington Regional Office. The express stormwater submittal
meeting with staff of the Division of Energy, Mining, and Land Resources is scheduled for August 4,
2020.

I hope you are doing well. Carteret Community College has asked us to pursue express CAMA and stormwater permits
for construction of a campus greenhouse for use with the recently re-established Horticulture Technology Program at
the college. The greenhouse needs to be constructed in time for use with the upcoming fall semester. According to
staff, the future of the horticulture program is dependent upon the greenhouse being in place. We have submitted
requests to NCDEQ for express CAMA and stormwater permit reviews.
Carteret Community College has just recently become aware that the greenhouse project site is located in a CAMA AEC.
A recent survey showed that normal high water has moved landward and that the site is located within the 75-foot
coastal shoreline AEC, but outside of the CAMA 30-foot buffer.
Project engineers and surveyors have advised that non -coastal wetlands may exist in locations on the +/- 42-acre
campus. Coastal wetlands are found intermittently along the shoreline. However they believe there are no coastal or
non -coastal wetlands at the proposed greenhouse project location, and that no wetlands will be impacted by the work.
We are working with CAMA staff to confirm the location of coastal wetlands.
NCDEQ Staff has advised that in order to expedite the process we should contact the Corps to confirm that no non -
coastal wetlands exist at the site. Would it be possible for you to visit the campus and confirm no wetlands in the project
area? I can send maps and can also meet you onsite.
If you are not the appropriate person at the Corps, can you advise who I should contact? Please let me know if you need
additional information at this point.

On September 31, 2020, the Wilmington Regional Office of the Division of Energy, Mineral and Land Resources
received and accepted a complete minor modification application for changes to the approved plans for
Stormwater Management Permit Number SW8 960424. It has been determined that the nature of the proposed
change meets the definition of a minor modification in that it does not result in an increase in the size of the
permitted stormwater control measure (SCM) and does not increase the amount of built -upon area. Please refer to
Attachment C for a detailed description of the current proposed minor modification and a list of all the past
modifications approved during the effective period of the permit. We are forwarding you an approved copy of the
modified plans for your files. Please add the attached plans to the previously approved plan set. Please replace the
previously issued permit with the revised permit, dated September 16'", 2020, attached. This revised permit does
not impose new or different terms; it merely restates and clarifies some of the previous terms to provide you with
a better understanding of your obligations under the permit.
Please be aware that all terms and conditions of the permit issued on February 231, 2018 and modified as
attached, remain in full force and effect. Please also understand that the approval of this minor modification to
the subject State Stormwater Permit is done on a case -by -case basis. Any other changes to this project must be
approved through this Office prior to construction. The approval of this minor modification does not preclude the
permittee from complying with all other applicable statutes, rules, regulations or ordinances which may have
jurisdiction over the proposed activity, and obtaining a permit or approval prior to construction.

construction, operation and maintenance for one (1) area of redevelopment (the "redevelopment area"),
for an Alternative Design consisting of one (1) Wet Detention Pond used for pre-treatment of 1.5" of runoff
prior to a final polishing in Infiltration Pond, and one (1) infiltration system alone, in compliance with the
provisions of 15A NCAC 2H .1000, effective September 1, 1995 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral and Land Resources (DEMLR)
and considered an enforceable part of this permit.
This permit shall be effective from the date of issuance until July 16, 2022 and shall be subject to the
following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the nature and volume of stormwater described in the
application and other supporting data.
2. The redevelopment portion of this project is exempt from State Stormwater permitting requirements
under the following conditions:
a. The project must be constructed as shown on the plans submitted to this Office.
b. The redevelopment area proposes 2,400 square feet of BUA, which does not exceed the
existing BUA of 2,400 square feet. This permit does not provide any allocation of BUA for
future development within this redevelopment area.
c. The proposed stormwater controls of vegetated sheet flow and rainwater harvesting
provides equal protection of surface waters as the existing stormwater control of vegetated
sheet flow.
3. This stormwater system has been approved for the management of stormwater runoff as described
in the Project Data Sheets of this permit. The stormwater controls have been designed to handle
the runoff from a total of 121,100 square feet of impervious area.
4. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
5. The tract will be limited to the amount of built -upon area indicated in this permit, and per the
approved plans.

6. The permittee is responsible for verifying that the proposed built -upon area does not exceed the
allowable built -upon area.
The following items will require a modification to the permit (In addition, the Director may determine
that other revisions to the project should require a modification to the permit.):
a. Any revision to the approved plans, regardless of size.
b. Project name change.
c. Transfer of ownership.
d. Redesign or addition to the approved amount of built -upon area.
e. Further subdivision of the project area.
f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan.
g. The construction of permeable pavement for impervious area credit.
8. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements. The permittee shall provide copies of revised plans and certification in writing to the
Director that the changes have been made.

Cistern Requirements:
1. The Rainwater Harvesting System must consist of the following major components:
a. A collection system;
b. A pre-treatment device to minimize gross and coarse solids collection in the tank;
c. A cistem or other storage device;
d. An overflow; and
e. A distribution system.
2. Fate of Captured Water: Captured stormwater shall be used or discharged as follows:
a. Use to meet a water demand. The usage, type, volume, frequency, and seasonality of
water demand shall be established and justified;
b. Discharge through a passive drawdown device to a vegetated infiltration area or another
SCM; or
c. A combination of use and passive discharge.
3. Sizing: The Rainwater Harvesting System shall be considered as a primary SCM because the
system is sized and water demand and passive discharge for 85 percent of the total annual
runoff volume as demonstrated through water balance calculations.
4. Water Balance Calculations: The system has been designed using the NCSU Rainwater
Harvester model.
5. Distribution System: The distribution system shall be tested for functionality prior to the
completion of the rainwater harvesting system.
6. Signage: All harvested rainwater outlets such as spigots and hose bibs, and appurtenances shall
be labeled as "Non -Potable Water" to wam the public and others that the water is not intended for
drinking. Passive drawdown devices, when employed, shall be marked with identifying signage or
labels that are visible to owners and maintenance personnel.
7. Setbacks: The concrete basins located in the buffer are necessary to bring seawater into the
system, and have therefore been determined to be water -dependent structures which are allowed
per. 1 003(4)(d)(ii), effective January 1, 2017.

II. SCHEDULE OF COMPLIANCE
The permittee will comply with the following schedule for construction and maintenance of the
stormwater management system:
a. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface except
roads.
b. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
c. All connections into the permitted system from future areas shall be made such that short-
circuiting of the system does not occur.
2. The permittee shall at all times provide the operation and maintenance necessary to assure the
permitted stormwater system functions at the design condition. The approved Operation and
Maintenance Plan must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of side slopes.
d. Immediate repair of eroded areas.
e. Maintenance of side slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of outlet structure, orifice device and catch basins and
piping.
g. Access to the outlet structure must be available at all times.
h. Check the ability of the infiltration systems to drawdown within 5 days.
3. Records of maintenance activities must be kept and made available upon request to authorized
personnel of DEQ. The records will indicate the date, activity, name of person performing the work
and what actions were taken.
4. The facilities shall be constructed, operated and maintained in accordance with the provisions of
this permit, the approved plans and specifications, and the supporting documents attached to this
permit and on file with the Division.
5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to
operation of this permitted facility, a certification must be received from an appropriate designer for
the system installed certifying that the permitted facility has been installed in accordance with this
permit, the approved plans and specifications, and other supporting documentation. Any deviations
from the approved plans and specifications must be noted on the Certification. A modification may
be required for those deviations.
6. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the
date of the recording. The recorded copy must be signed by the permittee, dated, stamped with the
deed book number and page, and bear the stamp of the Register of Deeds.
7. A copy of the approved plans and specifications shall be maintained on file by the Permittee for a
minimum of ten years from the date of the completion of construction.
8. Decorative spray fountains will be allowed in the stormwater treatment system if calculations are
provided documenting the permanent pool volume is greater than 30,000 cubic feet.

9. No person or entity, including the permittee, shall alter any component shown in the approved
plans and specifications. Prior to the construction of any modification to the approved plans,
the permittee shall submit to the Director, and shall have received approval for modified plans,
specifications, and calculations including, but not limited to, those listed below. For changes to
the project or SCM that impact the certifications, a new or updated certification(s), as
applicable, will be required and a copy must be submitted to the appropriate DEQ regional
office upon completion of the modification.
a. Any modification to the approved plans and specifications, regardless of size including
the SCM(s), BUA, details, etc.
b. Redesign or addition to the approved amount of BUA or to the drainage area.
c. Further development, subdivision, acquisition, lease or sale of any, all or part of the
project and/or property area as reported in the approved plans and specifications.
d. Altering, modifying, removing, relocating, redirecting, regrading, or resizing of any
component of the approved SCM(s), the stormwater collection system and/or
vegetative conveyance shown on the approved plan.
e. The construction of any allocated future BUA.
f. The construction of any permeable pavement, #57 stone area, public trails, or
landscaping material to be considered a permeable surface that were not included in
the approved plans and specifications.
g. Other modifications as determined by the Director.
III. GENERAL CONDITIONS
Permit Transfer: This permit is not transferable to any person or entity except after notice to
and approval by the Director. The permittee shall submit a completed and signed "Permit
Transfer Application Form" (available on the Division website) accompanied by the required
fee and supporting documentation as listed on the form, to the Division at least 60 days prior
to any one or more of the following events:
a. The sale or conveyance of the project area in whole or in part, except in the case of an
individual lot sale that is made subject to the recorded deed restrictions and protective
covenants;
b. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-05 or
NCGS 57D-6-07 and 08;
c. Bankruptcy;
d. Foreclosure, subject to the requirements of Session Law 2013-121;
2. Current Permittee Name or Address Changes: The permittee shall submit a completed
"Permit Information Update Application Form" (available on the Division website) to the
Division within 30 days to making any one or more of the following changes:
a. A name change of the current permittee;
b. A name change of the project;
c. A mailing address change of the permittee;
3. Any individual or entity found to be in noncompliance with the provisions of this stormwater
management permit or the requirements of the Stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21.
4. The issuance of this permit does not preclude the Permittee from complying with any and all
statutes, rules, regulations, or ordinances which may be imposed by other government agencies
(local, state, and federal) which have jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance
conditions, the Permittee shall take immediate corrective action, including those as may be required
by this Division, such as the construction of additional or replacement stormwater management
systems.
6. The permittee grants DEQ Staff permission to enter the property for the purpose of inspecting all
components of the permitted stormwater management facility.
7. The permit issued shall continue in force and effect until the permittee files a request with the
Division for a permit modification, transfer, renewal, or rescission; however, these actions do not
stay any permit conditions.

8. The permittee is responsible for compliance with all permit conditions until such time as the Division
approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance
of common area to a third party constitutes an approved transfer of the stormwater permit.
10. A permit renewal request must be submitted at least 180 days prior to the expiration date of
this permit. The renewal request must include the appropriate application, documentation and
the processing fee as outlined in Title 15A NCAC 02H.1045(3).
