AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard AEC
Dear Mr. Sperr:
I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor
development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity
you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received
by DCM on 2/12/2013, and meets the conditions specified below. If your plans should change and your project will no longer meet
these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR
Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible.
The repairs are limited to 50% of the physical value of the existing structure and the following specific conditions.
(1) The project consists of removing the dilapidated ground level concrete pad and repairing/replacing with level decking.
(2) The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species;
(3) The development must not alter naturally or artificially created surface drainage channels;
(4) The development must not alter the land form or vegetation of a frontal dune;
(5) The development must not be within 30 feet of normal water level or normal high water level; and
(6) The development must be consistent with all applicable use standards and local land use plans in effect at the time the
exemption is granted.
(7) Should fill material be transported to the site to maintain the integrity of the foundation, it shall be compatible with native beach
material. Additionally, all fill material shall be confined to the footprint of the house. No other fill activities shall take place on -
site without prior approval from the Division of Coastal Management.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local
authorization. This exemption expires 90 days from the date of the letter.

Good morning sunshine.... I have attached a copy of the proposed site plan for deck re -installation at the subject
residence. The work consists of installing a 6' x 34' ground level deck along the ocean side of the residence, beneath the
existing deck. According to Bud Owens, no new pilings will be driven to complete the job and the work will remain within
the footprint of the existing deck(s).
We are incorporating this work in the exemption that was previously issued to maintain and repair the ground level
parking and storage areas (Exemption number NTBEXI3-13, issued on 2/13/13). If you have any questions, please feel
free to call.
