Dear Mr. Sochin:
I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor
development permit under the Coastal Area Management Act. Based on the information provided, I have determined that the activity
you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received
by DCM on 1/28/2013, and meets the conditions specified below. If your plans should change and your project will no longer meet
these conditions, please contact me before proceeding.
MAINTENANCE AND REPAIR
Structures may be repaired in a similar manner, size and location as the original structure. No expansions or additions are permissible.
The repairs are limited to 50% of the physical value of the existing structure and the following specific conditions.
(1) The project consists of repairing the ocean side deck and stair case, as shown on the attached drawing.
(2) The development must not disturb a land area of greater than 200 square feet on a slope of greater than 10
percent;
(3) The development must not involve removal, damage, or destruction of threatened or endangered animal or
plant species;
(4) The development must not alter naturally or artificially created surface drainage channels;
(5) The development must not alter the land form or vegetation of a frontal dune;
(6) The development must not be within 30 feet of normal water level or normal high water level; and
(7) The development must be consistent with all applicable use standards and local land use plans in effect at
the time the exemption is granted.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local
authorization. This exemption expires 90 days from the date of the letter.

as authorized by the State of North Carolina, Department of Environment,
and Natural Resources and the Coastal Resources Commission for development
In an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Jonathan Sochin & Nancy Frantz authorizing development in Ocean Hazard Area of Environmental Concern
(AEC) at 2364 New River Inlet Road, in North Topsail Beach, Onslow County as requested in the permittee's
application, dated December 19, 2012, and received by DCM on December 21, 2012. This permit, issued on January
22, 2013, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a
fine, imprisonment or civil action, or may cause the permit to be null and void,
This permit authorizes: The placement of compatible fill material on the subject property.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on December 21, 2012.
(2) All construction must conform to the N.C, Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 766-7221 for a final inspection at
completion of work.
(5) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed
of to a third -party.

within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:
December 31, 2016
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management,

(6) Any new dunes established shall be aligned to the greatest extent possible with existing adjacent dune ridges and
shall be of the same general configuration as adjacent natural dunes.
(7) Any fill material placed within the confines of the subject property shall be compatible with the existing grain size
and type found on the adjacent beach.

By way of this email, the Division of Coastal Management (DCM) is authorizing your request to
perform the proposed work (as presented on your work plan drawings dated received by DCM
3/12/2013 and 3/13/2013) under CAMA Exemption NTB13-06, which was issued on January 30, 2013
and amended on 3/13/2013. The approved work involves sistering and/or replacing an 8 x 8
piling for structural support along the ocean side of the residence, as well as installing an
area of decking beneath the structure (within the footprint of the house for
storage/parking). Additionally, we are authorizing repair work associated with the existing
driveway and parking area, which includes the installation of timber decking in the footprint
of the previous driveway/parking pad. The proposed driveway/parking area decking shall be
confined to the dimensions of that which existed prior to the destruction due to Hurricane
Irene and Hurricane Sandy. No expansion within those areas (i.e. footprint) is authorized
under this amended exemption. No new work (i.e. that not considered maintenance and repair)
may be performed on -site without prior approval from the Division of Coastal Management.
Again, this authorization coincides with CAMA Exemption NTB13-06, and allows for the above
referenced items only.

Drive, North Topsail Beach.

Jason this is Jon Sochin responding to your need for information, the attached photo shows
the driveway and garage door as it existed prior to Irene. I am asking for a wooded deck
access to front and garage areas of my home. The proposed deck in the garage area is to
replace the washed out concrete so that I might have storage for tools etc. This deck will
take up part of the preexisting driveway but still leaves me plenty of room for
parking for my renters. This will be similar to what John Matthews has
done in front of his house at 2376 NRIR.
The addition of an 8x8 piling in the rear of the house is to correct a structural concern
with the existing piling, nothing new will be constructed there.
Please advise, if you need anything else please let me know.
I am using Terrie's computer as I do not have one down currently with me.
