Davis Director August 22, 2012 Exemption Number — NTBEXI2-16 Dee Freeman Secretary RE: EXEMPTED PROJECT (MINOR DEVELOPMENT) ACCESSORY USE (15A NCAC 7K .0209) WITHIN THE ESTUARINE SHORELINE AREA OF ENVIRONMENTAL CONCERN ADJACENT TO OUTSTANDING RESOURCE WATERS (ORW) PROJECT LOCATION/ADDRESS —192 Gull Drive, North Topsail Beach, North Carolina Dear Mr. and Mrs. Smith: I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. After making a site inspection on 8/21 /2012, 1 have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing(s) dated 7/20/2012, and received by our office on 8/17/2012, and it also meets the conditions specified below. If you plans should change and your project will no longer meet these conditions, please contact me before proceeding. Accessory Uses 1. The development must not disturb a land area greater than 200 square feet. 2. The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species. 3. The development must not alter naturally or artificially created surface drainage channels. 4. The development must not alter the land form or vegetation of a frontal dune. 5. The development must not be within 30 feet of the normal high water level. 6. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. ALL MATERIALS FURNISHED AND INSTALLED UNDER THIS CONTRACT SHALL BE NEW, FREE FROM ALL DEFECTS, AND SHALL BE GUARANTEED FOR A PERIOD OF ONE (1) YEAR FROM THE DATE OF ACCEPTANCE OF WORK. SHOULD ANY TROUBLE DEVELOP DURING THIS PERIOD DUE TO DEFECTIVE MATERIAL OR FAULTY WORKMANSHIP, CONTRACTOR SHALL CORRECT THE TROUBLE WITHOUT COST TO THE OWNER. ANY DEFECTS NOTICED AT THE TIME OF INSTALLATION SHALL BE CORRECTED IMMEDIATELY TO THE SATISFACTION OF THE OWNER. 2. THE CONTRACTOR SHALL ADHERE TO THE CONSTRUCTION DOCUMENTS. SHOULD ANY ERROR OR INCONSISTANCY APPEAR REGARDING THE TRUE MEANING AND/OR INTENT OF THE DOCUMENTS, THE CONTRACTOR SHALL IMMEDIATELY REPORT SAME TO THE ARCHITECT WHO WILL MAKE ANY NECESSARY CLARIFICATION/INTERPRETATION, OR REVISIONS AS REQUIRED. 3. CONTRACTOR SHALL PROVIDE ADEQUATE PROTECTION OF WORK, MATERIALS, FIXTURES, ETC. ON SITE FROM LOSS, DAMAGE, FIRE, THEFT, ETC. 4. ALL WORK SHALL CONFORM TO THE REQUIREMENTS OF ALL LOCAL LAWS, RULES AND REGULATIONS OF ALL LEGALLY CONSTITUTED PUBLIC AUTHORITIES HAVING JURISDICTION. IN CASE OF CONFLICT BETWEEN REQUIREMENTS, THE MOST RESTRICTIVE SHALL APPLY. 5. ALL WOOD SHALL BE PRESSURE TREATED SOUTHERN YELLOW PINE #2. 6. FLOOR DECKING SHALL BE 1-1/4" (5/4) S4S NO. 2 GRADE PRESSURE TREATED SOUTHERN YELLOW PINE OR EQUIVALENT ATTACHED WITH 2-8d GALV. NAILS AT EA. JOIST OR APPROVED SCREWS. 7. ALL FASTENERS AND HARDWARE SHALL BE CORROSION RESISTANT HOT —DIPPED GALVANIZED OR STAINLESS STEEL AS REQUIRED BY CODE. 8. GUARDRAILS AND HANDRAILS TO BE CONSTRUCTED IN COMPLIANCE WITH THE NC BUILDING CODE, INCLUDING THE FOLLOWING: A. GUARDRAILS 36" IN HEIGHT SHALL BE REQUIRED FOR DECKS HIGHER THAN 30" ABOVE ADJACENT GRADE. B. RAIL POSTS CANNOT EXCEED 8'-0" SPACING AND SHALL BE ATTACHED WITH 2-3/8" GALV BOLTS WITH NUT & WASHER TO OUTER BANDS. C. RAILINGS WITH VERTICAL PICKETS SHALL BE CONSTRUCTED SO AS TO NOT ALLOW PASSAGE OF A 4" SPHERE. D.
