After making a site inspection on 4/19/2012, 1 have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated 4/19/2012, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. Specifically, your project consists of constructing a single-family residential structure, with amenities, within the High Hazard Flood Area of Environmental Concern (AEC). SINGLE FAMILY RESIDENCES WITHIN THE HIGH HAZARD FLOOD AREA OF ENVIRONMENTAL CONCERN EXEMPTED - All single family residences, including associated infrastructure, accessory structures or structural additions to an existing single family structure, constructed within the High Hazard Flood Area of Environmental Concern are exempt from the CAMA Minor Permit requirements provided the development is consistent with all other applicable CAMA permit standards and local land use plans and/or rules in effect at the time the exemption is granted including the following conditions and limitations: Development shall not be located within the Ocean Erodible or the Inlet Hazard AEC. Any building shall be constructed on pilings and comply with the North Carolina Building Codes and the local flood damage ordinances, as required by National Flood Insurance Program (NFIP). The development does not require any permission, licensing, approval, certification, authorization or approval from any state or federal agency. A signed AEC hazard notice indicating that the property owner is aware of the special risks and conditions associated with development in this area. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires one (1) year from the date of the letter. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfzont setbacks and dune alterations are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. Permits issued in the Ocean Hazard Area of Environmental Concern include the condition that structures be relocated or dismantled if they become imminently threatened by changes in shoreline configuration. The structure(5) must be relocated or dismantled within two (2) years of becoming imminently threatened, and in any case upon its collapse or subsidence. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual long-term average ocep4 erosion rate for the area where your property is located is _ '— feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years, S also indicate that the shoreline could move as much as feet landward in a major storm. °tv ters in a major storm are predicted to be about Feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary sand bags may be authorized under certain conditions. The applicant must acknowledge this information and requirements by signing this notice in the space below. Without the proper signature, the application will not be complete Property Owner n tutturalj Date SPECIAL NOTE: This hazard notice is required for development in areas subject to sudden and massive storms and erosion. Permits issued for development in this area expire on December 31 of the third year following the year in which the permit was issued. Shortly before work begins on the project site, the Local Permit Officer must be contacted to determine the vegetation line and setback distance at your site. If the property has seen little change since the time of permit issuance, and the proposed development can still meet the setback requiremem, the LPO will inform you that you may begin work. Substantial progress on the project must be made within 60 days of this setback determination, or the setback roust be re -measured. Also, the occurrence of a major shoreline change as the result of a storm within the 60-day period will necessitate rr measvrement of the setback. It is important that you cheek with the LPO before the permit expires for official approval to continue the work after the permit has expired. Generally, if foundation pilings have been placed and substantial progress is continuing, permit renewal can be authorized. It is unlawful to continue work afterpermit expiration. (b) Prior to commencing any work under this exemption, the Department of Environment and Natural Resources (DENR) representative or local CAMA permitting officer must be notified of the proposed activity to allow on -site review. Notification shall be given in person or in writing. Notification must include: (1) the name, address and telephone number of the landowner and the location of the work, including the county, nearest community and water body closest to the development; (2) the dimensions of the proposed house, driveway, landscaping or other accessory developments proposed on the property; and (3) a signed AEC hazard notice indicating the property owner is aware of the special risks and conditions associated with development in this area. The DENR representative or local CAMA permitting officer shall provide the applicable notice form to the landowner. (c) The applicant for a permit exemption must submit with the request a check or money order payable to the Department of Environment and Natural Resources (DENR) or local permitting authority in the sum of fifty dollars ($50.00).
