Davis Governor Director February 24, 2012 Exemption Number — NTBEX12.08 Wally and Debra Szuba 285 Seashore Drive North Topsail Beach, NC 28460 RE: EXEMPTED PROJECT (MINOR) EXEMPTION ACCESSORY USE - (15A NCAC 7K .0209) — Exemption# NTBEX12-08 285 Seashore Drive, North Topsail Beach, NC AREA OF ENVIRONMENTAL CONCERN — Ocean Hazard AEC Dear Mr. Szuba: Dee Freeman Secretary I have reviewed the information submitted to this office in your inquiry concerning the necessary filing of an application for a minor development permit under the Coastal Area Management Act. After making a site inspection on 2/14/2012, 1 have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated 2/24/2012, and meets the conditions specified below. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. Your project consists of expanding the existing habitable area by adding a new 12' x 13.5' bedroom, and two — 8' x 14' uncovered decks on the second floor of the residential structure. Accessory Uses 1. The development must not disturb a land area greater than 200 square feet. 2. The development must not involve removal, damage, or destruction of threatened or endangered animal or plant species. 3. The development must not alter naturally or artificially created surface drainage channels. 4. The development must not alter the land form or vegetation of a frontal dune. 5. The development must not be within 30 feet of normal high water level or with 60 feet of the First Line of Stable Natural Vegetation (FLSNV). 6. The development must be consistent with all applicable use standards and local land use plans in effect at the time the exemption is granted. 7. The proposed deck expansion, when combined with the existing deck(s), shall not exceed a combined total of 500 square feet. In this case, we are authorizing an additional platform area equal to 100 square feet (5.5' x 18') within the 60' small structure setback. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. North Topsail NC . The home of Wally and Debra Szuba. The project will consist of removing the roof and raising the wall height to 9 ft . instead of slope ceilings. The project will remain within the original footprint of the house. The neighbors at 283 Seashore have already finish their side of the duplex, we intend to match what they have done, and raise the ceilings above there height to create a different profile. Attached are pictures of what the neighbors did and a floor plan of the original layout and the new floor plan. The scope of work is attached along with pictures of the finish product. Your project consists of constructing a 6' x 14' room on second floor (over existing 1st floor) with roof dormer to the existing structure. If your plans should change and your project will no longer meet these conditions, please contact me before proceeding. Accessory Uses that are directly related to the existing dominant use and require no plumbing, electrical or other service connections are exempt from the CAMA minor development permit requirement if they meet the criteria set out below. 1, The development must not disturb a land area greater than 200 square feet. 2.
