After making a site inspection on 1/31/2012,1 have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing(s) dated 1/20/2012, and received by our office on 1/24/2012, and it also meets the conditions specified below. If you plans should change and your project will no longer meet these conditions, please contact me before proceeding. SINGLE FAMILY RESIDENCES WITHIN THE ESTAARINE SHORELINE AREA OF ENVIRONMENTAL CONCERN EXEMPTED 1. All development shall be located at least 40 feet of the mean high water mark or normal water level from waters classified as ORW. 2. No ground disturbance or land disturbing activity shall occur within 40 feet of the mean high water mark or normal water level from waters classified as ORW. 3. The development may not exceed a 25% built upon area within 575 feet of the mean high water mark or normal water level of waters classified as ORW, and shall not include any stormwater collection system. 4. The development shall be consistent with all other applicable CAMA permit standards, North Carolina Building Code standards, local ordinances and local land use plans in effect at the time the exemption is granted. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. PDF Good morning Mr. Hedgepeth: I received the CAMA minor permit application package you submitted for development at 101 Phil Harris Lane, North Topsail Beach, NC. However, in order for the Division of Coastal Management to process your request for development, there are some additional items that need to be addressed/added. They are as follows: 1) On the site plan drawing(s), we need to see the following: - The Area of Environmental Concern at this location of North Topsail Beach is 575', as measured from the Normal High Water line. Please provide an overhead/ top view drawing of the property showing the location of Normal High Water, the Coastal Wetlands boundary and any other wetlands (Federal wetlands), the 30' Coastal Shoreline Buffer and the 575' AEC. - Please show the names of adjacent property owners. - Please label all drawings and include the name, project address, date and drawing scale. - Please give the property dimensions and show the location of all existing and proposed structures. - Please label and show the adjacent waterbody (in this case, Stump Sound). - The percent of impervious coverage allowed by our Rule is limited to 25%; however, the NC Division of Water Quality has a cap of 12% impervious coverage for all development adjacent to Outstanding Resource Waters (ORW), which is what you have adjacent to your property. In this case, any proposal to add more impervious coverage needs to equal or be less than 12% for the area of the lot above (landward) of the Coastal Wetland boundary. - Please provide the dimensions of the proposed addition. 2) Please provide a certificate of elevation for the property. 3) Also, depending on the location of the addition, we may need a wetland delineation map from the US Army Corps of Engineers, verifying the location of any/all federal wetlands. I doubt this will be an issue, but there's not enough information in the package for me to make this determination. Hopefully, once you've submitted the revisions, I can eliminate this concern. Once you have provided the Division of Coastal Management the information requested above, we will resume processing your application for development. In the mean time, if you have any questions, please feel free to give me a call. One more thing, I'm attaching a copy of a generic site plan as a reference for what we're looking for. The rules of the Coastal Resources Commission require that you receive an AEC Hazard Notice and acknowledge that notice in writing before a permit for development can be issued. The Commission's rules on building standards, oceanfront setbacks and dune alterations are designed to minimize, but not eliminate, property loss from hazards. By granting permits, the Coastal Resources Commission does not guarantee the safety of the development and assumes no liability for future damage to the development. Permits issued in the Ocean Hazard Area of Environmental Concern include the condition that structures be relocated or dismantled ifthey become imminently threatened by changes in shoreline configuration. The structure(s) must. be relocated or dismantled within two (2) years of becoming imminently threatened, .and .in any. case -upon its collapse or subsidence. The best available information, as accepted by the Coastal Resources Commission, indicates that the annual long-term average ocean erosion rate for the area where your property is located is feet per year. The rate was established by careful analysis of aerial photographs of the coastline taken over the past 50 years. Studies also indicate that the shoreline could move as much as feet landward in a major storm. The flood waters in a major storm are predicted to be about feet deep in this area. Preferred oceanfront protection measures are beach nourishment and relocation of threatened structures. Hard erosion control structures such as bulkheads, seawalls, revetments, groins, jetties and breakwaters are prohibited. Temporary sand bags may be authorized under certain conditions. The applicant must acknowledge this information and requirements by signing this notice in the space below. Without the proper signature, the application will not be mplete. IFM SPECIAL NOTE: This hazard notice is required for developmen in areas subject to sudden and massive storms and erosion. Permit issued for development in this area expire on December 31 of th, third year following the year in which the permit was issued Shortly before work begins on the project site, the Local Permi Officer must be contacted to determine the vegetation line ani setback distance at your site. If the property has seen little (hang, since the time of permit issuance, and the proposed developmen can still meet the setback requirement, the LPO will inform yoi that you may begin work. Substantial progress on the projec must be made within 60 days of this setback determination, o the setback must be remeasured. Also, the occurrence of a majo shoreline change as the result of a storm within the 60-day perio, will necessitate remeasurement of the setback. Along with requiring special care by those who build and develop, the General Assembly directed the Coastal Resources Commission (CRC) to implement clear regulations that minimize the burden on the applicant. This application for a minor development permit under CAMA is part of the Commission's elTort to meet the spirit and intent of the General Assembly. It has been designed to be straightforward and require no more time or effort than necessary from the applicant. Please go over this folder with the Local Permit Officer (LPO) for the locality in which you plan to build to be certain that you understand N+hat information he or she needs before you apply. Under CAMA regulations, the minor permit is to be issued within 25 days once a complete application is in hand. Often less time is needed if the project is simple. The process generally takes about 18 days. The LPO will assign a permit application number and check the AEC in which the property is located. In the general information section, the applicant and future permittee is always the Land Owner, although an agent, such as a contractor or realtor, may obtain the permit for the property owner. The Size of Building Footprint and Other Impervious✓ Surfaces/Built-Upon Surfaces in the Coastal Shoreline AEC is calculated by totaling all of the impervious surfaces within the applicable distance (30 ft., 75 ft. or 575 ft.) from Normal High Water (NHW) or Normal Water Level (NWL). Sometime the impervious surfaces that are allowed on an individual lot are further limite y the conditions of the subdivision's State Stormwater Management Permit. The applicant should insert the amount of impervious coverage that is allocated to their lot under their subdivision's State Stormwater Permit. This number is usually found on the property deed or subdivision covenants. Typically, any subdivision that was developed after January 1,1988, will have a State Stormwater Plan. On the second page of the application, the section entitled Statement of Ownership is completed by the applicant using information from the property deed. The applicant must check one of the three options and fill in the appropriate information. Make sure that adjacent riparian pro�perty owners have been listed in the Notification of Adjacent Property Owners section and that they have been contacted by the applicant, either in person or by certified mail. Copies of the completed letters and certified mail receipts, if required, should accompany the application.
