This permit, issued on February 5, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Observation Pier and Platform 1) This permit authorizes only the pier and platform, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this observation pier and platform without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) Any portion of the permitted observation pier and platform built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee 0 1 Jason Yeomans ADDITIONAL CONDITIONS Permit No. 18-20 Page 2 of 3 3) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit does not authorize any formalized boat slips. In order to ensure compliance with this condition, no cleats, tie piles or other formal mooring structures shall be constructed on any portion of the observation pier and platform. Any vessel or mooring structures that would result in the designation of a formalized boat slip without permit modification shall be considered a violation of this permit. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. General 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 197800056 (Action ID SAW-2019-02419). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2007-1367 v8. PROJECT SUMMARY: The project is for a pier and platform at 1819 Olde Farm Road in the Mariners Point s/d. As a requirement of the original major permit for the s/d each lot would be required to apply for a major permit if individual docks were requested. Field Investigation Report: Yeomans 1819 Olde Farm Rd Mariners Point S/D Page 02 9. Narrative Description: The project is located at 1819 Olde farm Road off Oglesby Rd which is part of the existing Mariners Point subdivision. Mariners Point was permitted through major permit # 167-07 for infrastructure, 149 lots and a docking facility. Oglesby Rd. is found by turning right off of N. 20' St. in Morehead City in the area locally known as Crab Point. Dill Creek borders this site to the east and north. 1819 Olde farm Road is .5 acres (22,OOOsf) in its entirety and is an average of 4' above NHW and has 100' of shoreline along the normal high water contour. There is an expanse (approximately 100' x 60') of Coastal Wetlands present along the shore adjacent to, Dill Creek. This coastal wetland area contains Smooth Cordgrass (Spartina alterniflora). There are also sporadic coastal wetlands lumpos that extedn beyond this area to the main creek channel which is approximately 180' to the north. There are typical lawn grasses, scrub oaks and trees (above NHW) along the high ground portion of the property. The lot to the east has an existing dock. The water depths within the tributary of Dill Creek are shallow (less than -2'nlw), and according to the applicant, reach—.5' NLW within the proposed platform area. Extensive field work confirms the soundings. The substrate in this area is thick organic mud. This section of Dill Creek is a Primary Nursery Area as designated by the Division of Marine Fisheries and the Division of Water Quality classifies it as SA/HQW waters. The area in which the proposed project would take place is closed to the taking of shellfish. Morehead City's Land Use Plan dated 2007 classifies this area as Low Density Residential and Conservation within the AECs. 10. Project Description: The applicant is proposing a 6' x 15' access over high ground, a 6' x 60' pier section over coastal wetlands and a 6' x 25' pier section over open water. The pier would intersect with a 12' x 20' T- head platform. The platform would remain over open water within an area void of wetland vegetation. They are not proposing any upland development at this time. The proposed pier would cross high ground for 15', coastal wetlands for approximately 60' and would then intersect a 12' x 20' platform area. The platform would be located over an open water section void of wetland vegetation. The most waterward section of the proposed platform would be 182' landward of the edge of the coastal wetlands along the channel area. There are no slips proposed. The water depths along the platform area is-.5'n1w. The channel within this area of Dills creek is located 130' waterward of the proposed platform. The pier and platform would be located 16' from the west riparian access line and 15' from the east riparian access line and would be for private residential use only. The riparian access lines where determined on the previous original major permit submittal for the subdivision in addition to field visits and aerial photography. The riparian access line is drawn perpendicular to the channel location that runs east to west. All water depths as well as the outermost limit of the coastal wetlands, channel location and water body width have been field verified by DCM staff. Anticipated Impacts: The proposed pier as would incorporate 90 ft2 of high ground while shading and incorporating 360 ft2 of coastal wetlands. A total 390 ftz of open water of would be shaded and incorporated by the platform. There are no oyster beds containing healthy populations existing along the shoreline and therefore should not be disturbed during the construction process. There is the potential for temporary turbidity during piling placement. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7/12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the proposed pier and platform being located 130' landward of the channel edge. Since no formalized slips are proposed, there should be no turbidity or impacts from prop scarring. The proposal is for the construction of an observation pier with an T-head platform. The water depths within this area range from -.25 to -.5 nlw. The proposed development is consistent with 15A NCAC 7H.0208. The Morehead City District office recommends the project be authorized as proposed on plats dated received 11/18/19 contingent upon all applicable general conditions and the following standard conditions: The pier and platform should not exceed a maximum distance of 85' waterward of NHW or a max of 39' from the waterward edge of the coastal wetland section along the southern portion of the property. No more than 6' of platform shall extend over coastal wetlands. All portions of the pier over coastal wetlands shall be a minimum of 3' above marsh substrate. No formalized docking spaces or slips are authorized by this permit. Anticipated impacts The proposed pier as would incorporate 90 ftZ of high ground while shading and incorporating 360 ftZ of coastal wetlands. A total 390 ftZ of open water of would be shaded and incorporated by the platform. There is the potential for temporary turbidity during piling placement. Since no formalized slips are proposed, there should be no turbidity or impacts from prop scaring. The Division of Land Resources approved the Sedimentation and Erosion control plan (CARTE-2006-440) on 6/19/06 with the DWQ Stormwater permit #SW8060625 issued on 7 /12/06 for the existing s/d. Based on the determination of the water body widths by the Division and the District, the structure should not cause a hindrance to navigation due to the location of the proposed pier and platform being located 130' landward of the channel edge. Basis for Determination: The project site is in the Town of Morehead City and is subject to the 2007 Town of Morehead City Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site, as "Low Density Residential" and "Conservation/Open Space" (due to the sites location in Coastal Wetlands, Estuarine Waters and Public Trust Area AECs). The following LUP policies may be applicable to this request: 4.2.6 Areas of Environmental Concern Policy 1, pg. 94: The Town of Morehead City supports state and federal law regarding land use and development in AECs. The project site is located at 1819 Okle Farm Road within the Mariners Point Subdivision in Morehead City, NC adjacent Dill Creek. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A- 100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq-). The applicant proposes a 6' by 15' access over highground, a 6' by 60 `pier over coastal wetlands, and a 6' by 25' pier over open water. The pier would terminate with a 12' by 20' T-head platform built over an area void of wetland vegetation. Water depths at the platform are -0.5' NLW. The platform is stated to not be used for vessel use. No upland development is proposed at this time. Due to resource concerns during the original subdivision development (Cox 14 September 2007), each lot must apply for a major permit for individual docks. Dill Creek is classified SA HQW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). The NCWRC has reviewed the permit application and does not have immediate concerns with the structure as long as it is not used for auv vessel use. A more narrow pier or reduced size T-head could be installed to minimize shading impacts and could be sufficient since the pier is to be used for observation and not boating. To deter vessel use, rails should be installed around the pier / T-head. We support any recommendations presented by NCDMF to minimize impacts to the shallow water habitat of a PNA.
