HomeMy WebLinkAbout96-20 Williams Landing Enterprises LLCNEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Permit Number 96-20 Issued to Williams Landing Enterprises LLC., 275 Landing Rd., Swan Quarter, NC 27885 Authorizing development in Hyde County at adi. to a man-made canal off Fodrey Creek. at 275 Landing Rd., in Swan Quarter as requested in the permittee's application dated 4/6/20, including attached workplan drawings (2), both dated 4/l/20. This permit, issued on September 29, 2020 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation A these terms may be subject to tines, imprisonment or civil action; or may cause rite permit to be null ana voia. In -Water Work Moratorium 1) In order to protect juvenile shrimp and finfish populations, no in -water work shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. Excavation 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3) Excavation shall not exceed -7 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 96-20 Page 2 of 5 ADDITIONAL CONDITIONS 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5) No excavated or fill material shall be placed at any time in any vegetated wetlands/marsh or surrounding waters outside of the alignment of the fill area indicated on the workplan drawings. 6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. Spoil Disposal 7) No spoil material shall be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead, once properly dried. 8) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 9) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause 10) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Shoreline Stabilization —Basin Bulkhead 11) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 12) No vegetated wetlands shall be excavated or filled, even temporarily. 13) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. ms Landing Enterprises LLC. Permit No. 96-20 Page 3 of 5 ADDITIONAL CONDITIONS 14) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. 15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 16) The bulkhead shall be constructed prior to any backfilling activities. 17) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 18) The fill material shall be clean and free of any pollutants except in trace quantities. 19) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 20) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 21) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Marina 22) ' This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 23) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 24) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 25) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 26) This permit authorizes a maximum of 31 formalized boat slips. ADDITIONAL CONDITIONS Permit No. 96 20 A' Page 4 of 5 27) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed in an easily accessible location and maintained in operable condition for the life of the marina. 28) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 29) The marina shall display a sign showing the location of the on -site pumpout facility, including other appropriate waste disposal information, at regular intervals throughout the marina. 30) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 31) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Upland Development 32) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the basin walkway, travel lift and concrete maintenance bay pad, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. Sedimentation and Erosion Control 33) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 34) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 35) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 36) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 37) All debris associated with the removal or construction of the•permitted development shall be contained within the authorized project area and removed to an appropriate upland location. 38) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. Permit No. 96-20 Page 5 of 5 ADDITIONAL CONDITIONS NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00085). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0602. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 948-6841 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Avoidance and Minimization of Impacts to the Tar -Pamlico River Basin Buffer a) The plans show Slips 1-4 located on the peninsula near an upland area. It is not clear if vegetation removal is necessary for the establishment of these slips, particularly Slips 1 and 2. Consideration should be given to removal of the end slip(s) to insure impacts to the riparian buffer do not occur initially and that encroachment does not occur into the buffers or wetlands overtime. b) It is not clear from the application if you are requesting any sort of authorization or variance from the Tar -Pamlico Riparian Buffer Rules for the proposed impervious surfaces associated with the wash -down pad that would be placed in the relocated buffer, but if so, then please provide justification for how these impacts cannot practically be avoided or minimized, as well as a table with the proposed square footages of impact within the buffer. NCG190000 for Marina Plan: Based on a review of your application, the Division will require documentation that a NCG190000 application has been submitted to the Division of Energy, Mining, and Land Resources [15A NCAC 02H .0506(b)(3)]. An Operations and Maintenance (O&M) Plan for the facility may be required and should be submitted to DWR for review. Pursuant to 15A NCAC 2H. 0506 (6)(f) and Title 15A NCAC 02H .0506 (6)(g), the applicant shall furnish all of the above requested information for the proper consideration of the application. If all of the requested information is not received in writing within 30 calendar days of receipt of this letter, the Division will be unable to approve the application and it will be returned. Project Overview: The 12.57-acre project site is located at 275 Landing Rd, adjacent to a manmade canal off of Fodery Creek in the Town of Swan Quarter, Hyde County, North Carolina. The property and surrounding properties are predominately used for commercial fishing activities. Existing development includes a gravel parking lot and drive access for a boat ramp. The uplands consist of grasses, shrubs, and trees along with graveled impervious areas and a boat ramp. The site also includes a large area of coastal wetlands along a peninsula west of the existing boat ramp consisting primarily of black needlerush and giant cordgrass; all of the new proposed developments are on the opposite shore of the property from the coastal wetlands. The proposed development is for the maintenance of commercial fishing vessels with an upland basin, travel lift and concrete washdown pad as well as dockage for those vessels with a 31 slips docking facility on the eastern portion of the property. The docking facility will consist of an 1,885' long and 6' wide pier/boardwalk running parallel to the shore just waterward of NWL starting on the shoreline north of the existing boat ramp and extending around the shoreline to the east where a portion of the pier/boardwalk will be located over land due to the narrower width of the canal on the eastern side of the property. Each of the proposed slips will be 50' in length providing side -to docking. No slips are proposed on the peninsula of land on the west side of the property due to access and parking concerns impacting the Tar -Pam buffer. Excavation of 25' x 28' area of canal bottom to a depth of -7' @NWL is proposed to access the high ground basin, connecting water depths in the area are approximately -7.5' a NWL. At the landward end of the basin a 70' long and 28' wide concrete pad with raised concrete apron in proposed for vessel maintenance to include powerwashing, grit blasting and painting. The wash basin will slope to a centrally located drain to collect waste waterwhich will be treated offsite by the Swan Quarter Sanitary District. All spoils from the upland and canal excavation will be disposed of on -site in a 120' x 60' wide area centrally located on the uplands. There have been previous proposals to develop the property including LAMA Major Permit 75- 07 issued in May of 2007 which included condominiums and docking facilities which was modified in 2008 for additional finger piers and moorings and then modified again in 2010 changing the development from condominiums to RV campsites. All of these permits have expired with no development having taken place. The project is located in the following Areas of Environmental Concern (AEC): Estuarine Waters (EW), Public Trust Area (PTA) and Public Trust Shoreline (PTS). Fodrey Creek and the manmade canals are designated as SA (Market Shellfishing, Salt Water) and ORW (Outstanding Resource Waters) by the EMC and Primary Nursery Areas (PNA) by the MFC, and is closed to shellfishing. Wetlands on the project site consist of a Coastal Wetlands marsh vegetated with black needle rush and cordgrass. A review of SAV, historic, and archaeological resources was not provided. Anticioated impacts The project as proposed would result in the permanent shading of canal bottom and shoreline for the docking facility, excavation of 700ft2 of canal bottom, creation of open water with the excavation of 1500ft2 of uplands, as well as create new impervious surfaces adjacent to the canal and basin with the concrete washdown pad. Localized noise and turbidity is expected during construction as well as continued increased boating use after completion. Basis for Determination: The 2008 Hyde County CAMA Core Land Use Plan Future Land Use Map (FLUM) designates the project site on land as "Residential", "Mixed Use", and "Agricultural/Low Density Residential", and all AECs as "Unbuildable Land", which limits development to 15A NCAC 7H use standards. P.19 Hyde County supports industrial development which complies with all local, state, and federal requirements, including 15A NCAC 7H. P.30 Residential, commercial, and industrial development which meets 15A NCAC 7H use standards will be allowed in estuarine shoreline, estuarine water, and public trust areas. The dredging quantity is what would be allowable for work within the moratorium. However, the project is within PNA and the in -water work is more than minimal (such as driving a few piles for a small structure), which would likely be grounds for DMF not granting moratorium relief. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 275 Landing Road adjacent a manmade canal off Fodrey Creek in Swanquarter, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to establish a marine service business on a previously disturbed site, a 12.57-acre parcel that includes a large peninsula with coastal wetlands and manmade canals around the perimeter of the property with water depths between -3.5' to -T NWL. The current proposal includes a 1,885' by 6' pier/boardwalk to create 31 slips, 700 ftof canal bottom excavation, excavation of a 60' by 25' upland basin stabilized by a 172' steel sheetpile bulkhead to create a travel lift access, and a 70' by 28' concrete washdown pad with raised apron and collection basin. The 31 slips will be 50' in length and begin along the peninsula near the boat ramp, snaking along the waterward edge of the property toward the Town of Swanquarter. The travel lift, basin, and wash down are located opposite the main canal, facing Fodrey Creek. The wash down area would receive power washing, grit blasting, and painting waste. The wash basin will slope to a centrally located drain to collect wastewater that will be treated offsite by the Swanquarter Sanitary District. All spoils from the upland and canal excavation would be disposed onsite in a 120' by 60' wide location. Impervious surface percentages are likely to increase, though stormwater treatment information was not detailed in the application. Staff with the NCWRC have reviewed the current proposal and have also reviewed and commented on previous development proposals for this property in 2007, 2008, and 2010 (Dunn 21 November 2007). These proposals as well as a January 23, 2020 scoping meeting have provided great familiarity with the project area. Acing the 2020 scoping meeting, a design proposal was submitted that included slips along the length of the peninsula NCWRC raised concern regarding this proposal during the 2007 review of die project as well as during the current iteration. The peninsula exhibits coastal wetlands along the back side of the property. The development of slips along the peninsula would likely impact these habitats as well as the NCDWR Tam -Pamlico buffer. Both of these habitats provide important water quality functions and habitat opportunities to the adjacent PNA waters; therefore, impacts should be minimized to the greatest extent practicable. Recommendations by the NCWRC presented during both scopmg meetings included the relocation of slips to areas previously impacted, further into the canal system and off the peninsula. This not only limits disturbance along the shoreline, NCDWR buffers, and coastal wetlands, but reduces congestion in the canal that provides access to the facility. These recommendations were incorporated into the design and presented by the applicant in this submittal. The NCWRC appreciates the applicant's incorporation of design recommendations in the project proposal. To further minimize impacts to wildlife and aquatic resources, we recommend the following: • Information within the permit application stated wastewater generated from the facility would be sent to the Swanquarter Sanitary District. PROJECT SUMMARY: The applicant proposes 1,885' x 6' pier/boardwalk creating 31-slips, excavation of 700ft2 of canal bottom, excavation of 60' x 25' upland basin with 172' steel sheetpile bulkhead, 70' x 28' concrete washdown pad with raised apron and collection basin, and travel lift. RECEIVED MAY 0 5 2020 DCM-MHD CITY Williams Landing Marina Docking Facilities, Haul -out and Washdown Facility Swan Quarter, Hyde County Project Setting The subject property is a 12.57-acre parcel of land located adjacent to a manmade canal off Fodrey Creek on Landing Road in Swan Quarter, Hyde County, North Carolina. The subject property and surrounding properties are predominately used for commercial fishing activities. The tract of land for the proposed development includes uplands consisting of grasses, shrubs, and trees along with graveled impervious areas and a boat ramp. The site also includes a large area of coastal wetlands along a peninsula west of the existing boat ramp consisting primarily of black needlerush and giant cordgrass; all of the new proposed developments are on the opposite shore of the property from the coastal wetlands. Manmade canals with water depths from approximately -3.5' to -7.0' @ NWL surround the majority of the property. Fodrey Creek and the manmade canals adjacent to the property are classified as coastal fishing waters, primary nursery areas by the Marine Fisheries Commission and are closed the harvest of shellfish. The waters adjacent to the proposed development are classified SA-ORW by the Environmental Management Commission. There have been previous proposals to develop the property including CAMA Major Permit 75- 07 issued in May of 2007 which included condominiums and docking facilities which was modified in 2008 for additional finger piers and moorings and then modified again in 2010 changing the development from condominiums to RV campsites. All of these permits have expired with no development having taken place. Project Development The applicant proposes to develop the property for maintenance of commercial fishing vessels with an upland basin, travel lift and concrete washdown pad as well as dockage for those vessels with a 31 slips docking facility on the eastern portion of the property and a. The docking facility will consist of an 1,885' long and 6' wide pier/boardwalk running parallel to the shore just waterward of NWL starting on the shoreline north of the existing boat ramp and extending around the shoreline to the east where a portion of the pier/boardwalk will be located over land due to the narrower width of the canal on the eastern side of the property. Each of the proposed slips will be 50' in length providing side -to docking. No slips are proposed on the peninsula of land on the west side of the property due to access and parking concerns impacting the Tar -Pam buffer. The travel lift, basin, and washdown portion of the project located opposite the main canal access to the property would consist of a basin 60' long and 25' wide excavated into existing high ground to -7' @NWL and stabilized with a steel sheetpile bulkhead 172' in length with a concrete cap for the travel lift to ride on. Excavation of 25' x 28' area of canal bottom to a depth of -7' @NWL is proposed to access the high ground basin, connecting water depths in the area are approximately -7.5' a NWL. At the landward end of the basin a 70' long and 28' wide concrete pad with raised concrete apron in proposed for vessel maintenance to include RECEIVED MAY 0 5 2020 DCM-MHD CITY powerwashing, grit blasting and painting. The wash basin will slope to a centrally located drain to collect waste water which will be treated offsite by the Swan Quarter Sanitary District. All spoils from the upland and canal excavation will be disposed of on -site in a 120' x 60' wide area centrally located on the uplands. Anticipated Impacts The project as proposed would result in the permanent shading of canal bottom and shoreline for the docking facility, excavation of 700ft2 of canal bottom, creation of open water with the excavation of 1500ft2 of uplands, as well as create new impervious surfaces adjacent to the canal and basin with the concrete washdown pad. Localized noise and turbidity is expected during construction as well as continued increased boating use after completion. The property is owned by Williams Landing Enterprises, I.I.C. The owners address is Hobo Seafood, LLC, Attention: Lee and Madge Williams, 275 Landing Road, Swan Quarter, NC 27885. Attached with this narrative are DCM Forms MP-1, 2, 3, and 4 and two plan sheets, one showing full site development and one providing travel lift area detail, accurately depicting the proposed project. I further reference the January 23, 2020 Interagency Scoping Meeting in Washington. Comments and suggestions by agencies at that meeting have been discussed with the owners and are incorporated into the enclosed application. The project as currently configured proposes a 28' x 61.5' (25' wide x 60' long clearance after construction) travel lift basin excavated in existing uplands that will be protected by steel sheet piling and timber piles with a concrete cap (3' wide). Adjacent to the landward side of the lift is a proposed concrete maintenance bay that is 31' wide x 78' long including a raised concrete apron around the perimeter. A mobile travel lift will be used to haul vessels from the basin to the maintenance bay for power washing, grit blasting, and application of bottom paint. The maintenance bay will be sloped to the center where there will be a catch basin and collection system for water and solids respectively. The wastewater will be routed to the Swan Quarter Sanitary District (SQSD) wastewater collection and treatment system. All solids and residual materials trapped by the infiltration system will be place in a holding tank and properly disposed of at an approved offsite location or landfill. A valve will be in place to avoid any rainwater from entering the wastewater collection system. This will only be open during maintenance activities. I further reference Major LAMA Permit Number 75-07 that was issued for the subject property under the ownership of Swan Quarter Landing, LLC in 2007. The project included condominium development with associated water dependent amenities including a boat ramp, docks and slips. Associated State permit were obtained including a State Stormwater Permit and a Sedimentation of Erosion Control Permit. The permit was amended In 2008 and 2010 to include finger piers, mooring pilings and changes in upland development. While the project was not built, the permit history does provide an Indication of the type of development that has been proposed and permitted on the site. North Carolina 285571 2S2.808.2608 Williams Landing Marina Docking Facilities, Haul -out and Washdown Facility Swan Quarter, Hyde County Project Setting The subject property is a 12.57-acre parcel of land located adjacent to a manmade canal off Fodrey Creek on Landing Road in Swan Quarter, Hyde County, North Carolina. The subject property and surrounding properties are predominately used for commercial fishing activities. The tract of land for the proposed development includes uplands consisting of grasses, shrubs, and trees along with graveled impervious areas and a boat ramp. The site also includes a large area of coastal wetlands along a peninsula west of the existing boat ramp consisting primarily of black needlerush and giant cordgrass; all of the new proposed developments are on the opposite shore of the property from the coastal wetlands. Manmade canals with water depths from approximately -3.5' to -7.0' @ NWL surround the majority of the property. Fodrey Creek and the manmade canals adjacent to the property are classified as coastal fishing waters, primary nursery areas by the Marine Fisheries Commission and are closed the harvest of shellfish. The waters adjacent to the proposed development are classified SA-ORW by the Environmental Management Commission. There have been previous proposals to develop the property including CAMA Major Permit 75- 07 issued in May of 2007 which included condominiums and docking facilities which was modified in 2008 for additional finger piers and moorings and then modified again in 2010 changing the development from condominiums to RV campsites. All of these permits have expired with no development having taken place. Project Development The applicant proposes to develop the property for maintenance of commercial fishing vessels with an upland basin, travel lift and concrete washdown pad as well as dockage for those vessels with a 31 slips docking facility on the eastern portion of the property and a. The docking facility will consist of an 1,885' long and 6' wide pier/boardwalk running parallel to the shore just waterward of NWL starting on the shoreline north of the existing boat ramp and extending around the shoreline to the east where a portion of the pier/boardwalk will be located over land due to the narrower width of the canal on the eastern side of the property. Each of the proposed slips will be 50' in length providing side -to docking. No slips are proposed on the peninsula of land on the west side of the property due to access and parking concerns impacting the Tar -Pam buffer. The travel lift, basin, and washdown portion of the project located opposite the main canal access to the property would consist of a basin 60' long and 25' wide excavated into existing high ground to -7' @NWL and stabilized with a steel sheetpile bulkhead 172' in length with a concrete cap for the travel lift to ride on. Excavation of 25' x 28' area of canal bottom to a depth of -7' @NWL is proposed to access the high ground basin, connecting water depths in the area are approximately -7.5' a NWL. At the landward end of the basin a 70' long and 28' wide concrete pad with raised concrete apron in proposed for vessel maintenance to include powerwashing, grit blasting and painting. The wash basin will slope to a centrally located drain to collect waste water which will be treated offsite by the Swan Quarter Sanitary District. All spoils from the upland and canal excavation will be disposed of on -site in a 120' x 60' wide area centrally located on the uplands. Anticipated Impacts The project as proposed would result in the permanent shading of canal bottom and shoreline for the docking facility, excavation of 700ft2z of canal bottom, creation of open water with the excavation of 1500ft2 of uplands, as well as create new impervious surfaces adjacent to the canal and basin with the concrete washdown pad. Localized noise and turbidity is expected during construction as well as continued increased boating use after completion. I further reference the January 23, 2020 Interagency Scoping Meeting in Washington. Comments and suggestions by agencies at that meeting have been discussed with the owners and are incorporated into the enclosed application. The project as currently configured proposes a 28' x 61.5' (25' wide x 60' long clearance after construction) travel lift basin excavated in existing uplands that will be protected by steel sheet piling and timber piles with a concrete cap (3' wide). Adjacent to the landward side of the lift is a proposed concrete maintenance bay that is 31' wide x 78' long including a raised concrete apron around the perimeter. A mobile travel lift will be used to haul vessels from the basin to the maintenance bay for power washing, grit blasting, and application of bottom paint. The maintenance bay will be sloped to the center where there will be a catch basin and collection system for water and solids respectively. The wastewater will be routed to the Swan Quarter Sanitary District (SQSD) wastewater collection and treatment system. All solids and residual materials trapped by the infiltration system will be place in a holding tank and properly disposed of at an approved offsite location or landfill. A valve will be in place to avoid any rainwater from entering the wastewater collection system. This will only be open during maintenance activities. 1 further reference Major CAMA Permit Number 75-07 that was issued for the subject property under the ownership of Swan Quarter Landing, LLC in 2007. The project included condominium development with associated water dependent amenities including a boat ramp, docks and slips. Associated State permit were obtained including a State Stormwater Permit and a Sedimentation of Erosion Control Permit.
