Permit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission N' Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A.-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Stuart and Nanette Wall,111 Sheffield St., LaGrange, NC 28551 Permit Number 64-20 Authorizing development in Pamlico County at adi. to the Neuse River, at 30 East North Shore Lane, in Arapahoe as requested in the permittee's application dated 11/25/19 (MP-1) and 2/24/20 (MP-2,4), including attached workplan drawings (6), all dated "Received DCM-WARD 2/27/20". This permit, issued on June 2, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Stuart and Nanette Wall Permit No. 64-20 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 9) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 10) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately. landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility 11) This permit authorizes only the platform, boathouse and stepdown, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, Whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. , 12) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 13) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 14) This permit authorizes a maximum of 1 formalized boat slip. 15) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 16) The authorized boathouse shall be single story and shall not be designed to allow for second story use. Stuart and Nanette Wall ADDITIONAL CONDITIONS Permit No. 64-20 Page 3 of 3 17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 18) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. USACE Conditions 19) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at ham://www.fws.gov/nc-es/mammal/manatee guidelines.odf. General 20) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 21) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-00930) issued 6/2/20. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 20-0338. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Neuse River buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Overview: The applicant is proposing to construct a 150ft x 6ft pier with a Sift x 30ft platform, 15ft x 24ft boathouse, and a 5ft x 10 ft. stepdown for personal use; and replace a failed bulkhead with a 104 ft. long bulkhead 11 ft. waterward of NWL along the Neuse River. The subject parcel is 18,006 sq. ft. and is located at 30 East North Shore Lane, Arapahoe, Pamlico County. The property is currently undeveloped with a septic system and failed bulkhead. Areas of Environmental Concern affected include: Coastal Wetlands (CW), Estuarine Shoreline (ES), Estuarine Waters (EW) and Public Trust Areas (PTA). The Neuse River is approximately 3.8 miles at this location, and is classified as SB;SW;NSW. The site is not classified as a Primary Nursery Area, and is closed to shellfishing. Submerged Aquatic vegetation (SAV) is not present at this location. The project is subject to the Neuse River Riparian Buffer Rules. The presence of Coastal Wetlands, non -coastal wetlands, and cultural resources was not indicated in the field report. Anticipated impacts resulting from this project are expected to include: increase in localized turbidity due the construction of the bulkhead and pier. The bulkhead and backfill will fill 1,064 sq. ft. of river bottom and the pier will shade 1,580 sq. ft. of open water. There will be approximately 1,000 sq. ft. of temporary impacts to the high ground during construction. construction of this project. The Future Land Use Map (FLUM) classifies the site as "Rural with Services", "Conservation I" (due to Estuarine Waters AEC), "Conservation 11" (due to the properties shoreline that border Estuarine Waters and Primary Nursery Area). Three of the four conservation land use designations defer to CAMA use standards. • Conservation I - "The purpose of this classification is to protect and to assist in the long- term management of the county's estuarine and public trust waters.... The counties primary goal is to "(1) to allow only those water uses and land uses in this classification that are consistent with conservation of these waters; and (2) to protect the public's rights to access, navigation and recreation. The county also allows development activities in this classification that require water access and that cannot function elsewhere, if these uses are designed, developed, and operated in a manner that is consistent with the primary goal. Examples of these uses include erosion control structures, docks and piers, marinas, and mooring pilings. • Conservation II - "establishes a permanent conservation zone for all land within 75 feet of the natural mean high water level for all shorelines bordering primary nursery areas, estuarine waters, and public trust waters. Man-made ditches, canals, and basins are excluded from this classification ...... All construction activities are prohibited in this zone, exceptforthose permitted underthe CAMA use standards for estuarine waters and coastal wetlands". The following LUP policies may be applicable to this request: 2.0 Land Use Compatibility 2.1 Pamlico County strongly discourages any uses in estuarine waters that are not compatible with protection and conservation of their biological and community values. 2.1.1 Only development associated with water -dependent uses is allowed. Examples of appropriate development may include public access facilities, docks and piers, erosion control structures, or other uses that are permitted by CAMA use standards' NCAC TISA: 07H.0708. 2.1.2 In all cases, the design of facilities or activities will ensure that any negative impacts on estuarine waters, during both construction and operation, are minimized and that they comply with all local policies and the policies of CAMA use standards. 2.3 The county strongly supports management of development in its estuarine shoreline to protect water quality and the aesthetics of the waterfront. 2.3.1 The county supports the CAMA use standards' ICACT15A:o]H. The policy is not intended to apply to forestry operations that comply with "best management practices." 2.3.3.3 The conservation zone applies to all subdivisions of land after January 26, 1990, regardless of the intended use, and to all divisions of land after the certification of this plan. 5.0 Water Quality 5.1 The county recognizes the importance of water quality to preserving the life-style and economic well being of its residents and property owners and will implement measures to address both point -source and non -point source discharges in order to protect and restore water quality. 5.1.1 The county will continue to enforce a 75-foot permanent conservation zone along its water bodies. The 1800sq ft lot is located at 30 East North Shore Lane, Arapahoe, Pamlico County off NC 306. The property is currently undeveloped with a failed bulkhead. The lots to the West and East of the subject property are single family residences that have bulkheads and piers. The bulkheads on the adjacent lots are approximately loft waterward of the subject property's failed bulkhead. The piers on the adjacent lots are approximately 40ft to the east and west. There are no wetlands on the project site. The Neuse River is classified as SB, SW, NSW by the Environmental Management Commission and as Coastal and closed to Shell fishing by the North Carolina Marine Fisheries Commission. The Neuse River is approximately 3.8 miles wide as the project site. The property is subject to the Neuse Riparian Buffer Rules enforced by the North Carolina Division of Water Resources. At the time of the application no submerged aquatic Vegetation was present. The water depths at the proposed boathouse and pier are approximately -5' below NWL. PROJECT DESCRIPTION The applicant proposes to replace an existing bulkhead with a 10411 bulkhead 1 lft waterward of NWL filling approximately 1,064 sq ft of open water that is between -1 ft and -2ft below NWL. The bulkhead would be replacing a bulkhead that failed during Hurricane Florence in 2018 and would connect to the two adjacent bulkheads making a straight bulkhead between the three properties. The original bulkhead failed resulting in a loss of approximately 8' of shoreline. The plan is to construct a new vinyl bulkhead that will start at the eastern corner of the adjacent property of Mr. Ballard and continues over to the opposite corner of the Wall property to the western corner of the Suggs property's corner. A mini excavator will be use to set and hammer the vinyl into the water bottom at a depth of 6'. The span of the bulkhead will be approximately 100' with an additional 4' wing to butt up to the adjoining property of Mr. Suggs. The wall will have two whalers, one halfway up the wall from the mean highwater line and the other to be placed just under the cap board that will be placed on top of the vinyl. An 8" butt pole will be placed every 5' along the outside of the wall. Galvanized tiebacks will run back to the existing deadmen from the original wooden bulkhead. It Is our Intent to leave what Is left of the wooden wall in place. The deadmen from the new wall will be placed to align with the poles from the old wall. Backfill will be brought in using a ten wheel International dump truck to reclaim the property lost from the damaged wooden wall. Mats will be used across the property to protect the soil and vegetation. The soil will be landscaped using the mini excavator at a gradual slope to the new wall. The new wall will act as a barrier to protect any discharge or spills into the Neuse River. The plan is also to construct a personal pier (150' x 6') with a 9' x 30' and 5' x 10' platform and a 15' x 24' boathouse.
