consistent with the perm%it), all applicable regulations, special coriditions'and.notes set forth below. Any violation
or tnese terms may oe subject to nnes,.impnsonment or crvu action; or may cause Inc permit to. be null and void
Docking Facility Expansion .
1) This permit authorizes only the floating platform, boatlift, and other structures and uses located in or
over the water that are expressly and;specifically set forth in the permit application. No other
structure, whether floating or stationary, shall, become a permanent part of this docking facility
without permit modification. No non -water dependent uses of structures,shall be conducted on, in or
over. Public Trust waters without permit modification.
2) The peririttee-shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard„through regulation or'otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached.to the structure in order to make it more visible during hours of
darkness or•inclement-weather.

qualifed persons within twenty (20) days of the issuing date..
This permit must- be • accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered

December 31, 2023

ADDITIONAL CONDITIONS,
3) No sewage, whether treated or untreated,• shall be,discharged at any time from any boats using the
docking facility: Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
4) No attempt shall be made by' the permittee-to prevent the full and•free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The authorized structures and associated aetivity'shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings;.
6) This permit -authorizes three (3) additional formalized boat slips for a maximum of five (5) formalized.

9) This permit shall not be assigned, transferred; sold,, or otherwise disposed of to, a tliird party without- the,
written. "approval of the Division'o€Coastal�lvlanagement.
10) The permittee shall maintain the authorized work in.good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this, requirement if he or she abandons the
permitted activity,without having it transferred to a third party.,
11) JEe permittee and/or his or hercontractor shall meet with a representative of the Division prior to
project initiation.. _
12) All`debris associated with tbc-removal or construction of the permitted docking facility shall be
contained within the authorized project area and 'removed'to an, appropriate'upland location.
.NOT This -permit does not eliminate the need to obtain, any additional state, federal or local permits,.
approvals or authorizations that maybe required.

The total square footage of the proposed docking facility was calculated as follows:
Shoreline length =194 ft x 8 sq. ft =1,552 sq. ft allowable
Existing platform = 200 sq. ft. (10' x 20')
Existing floating dock = (6' x 20') 120 sq. ft. (6' x 20')
Proposed floating dock expansion = 160 sq. ft (8' x 20')
Proposed boatlift =10' x 15'- not included in square footage calculation
Total = —480 sq. ft (existing and proposed)
It is the staffs recommendation that the proposal to construct a docking facility is
CONSISTENT with the Rules of 15 NCAC 711.0206 (d) Use Standards for Estuarine Waters,
Rules of 15 NCAC 711.0207 (d) Use Standards for Public Trust Areas.
This office has no objection to the proposed work, provided it is consistent with state and
federal permitting requirements are met. Any permit issued should include standard
conditions for docking facilities.

This project is consistent with the Pender County Comprehensive Land Use Plan Update.
The applicant proposes to expand an existing two -slip docking facility creating up to five
(5) slips. The project is located at 435 Hughes Road in Hampstead, Pender County.
I have reviewed this proposal for consistency with the Pender County Comprehensive
Land Use Plan and offer the following comments.
The general area of the project is classified as Resource Protection and Conservation.
Waters at the project site are classified as SA and are not open to the harvesting of
shellfish. The area is not a Primary Nursery area. Areas of Environmental Concern are
PT and EW.
Pender County allows development in Resource Protection and Conservation classified
AECs, which is consistent with the State's minimum use standards. The Pender County
Comprehensive Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these policies appear to be applicable to this
project.
This project appears to be consistent with the Pender County Comprehensive Land
Use Plan Update.

The Division of Water Resources (DWR) has received a copy of your CAMA major permit
application request dated received by this office on October 21, 2020. The application proposes
to expand an existing residential docking facility. As proposed, the docking facility expansion
would consist of an extension of the existing floating dock and installation of a boatlift to provide
dockage for up to five (5) vessels. The docking facility would be located in the waters of Mill
Creek which are classified as SA:HQW by the DWR. The DWR issues approval in the form of a
Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and General
Permit(s) 19800291 or 197800056 issued by the US Army Corps of Engineers (USACE). This
Certification allows you to use the CAMA Permit when issued by the Division of Coastal
Management.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at htto:/twww.ncoah.com/
or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A

Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly
adhere to all requirements therein. The guidelines can be found at

If any change in your work is required because of unforeseen or altered conditions or for

9. PROJECT DESCRIPTION
The project site is located at 435 Hughes Road, adjacent to Mill Creek, in Hampstead, Pender
County. To get to the site from Wilmington take US Hwy 17 N to Hughes Road (approximately 0.55
miles south of the intersection of Highway 17 and 210 in Hampstead). Turn right onto Hughes Road
and travel approximately 1.5 miles. The applicant's property is located on the left hand side of
Hughes Road at house number 435.
The subject property is approximately .48 acres in size (20,900 sq. ft.) with roughly 194 linear feet
of shoreline. Existing man-made features on the property include a residential dwelling, retaining
wall, private pier and two -slip docking facility. The high ground portion is elevated approximately
6-8 feet above Normal High Water (NHW). Vegetation on the tract consists of scrub brush, Long leaf
pines, Oaks and ornamental landscaping. The highground transitions to Coastal Wetlands along the
eastern shore. In this location, Black Needlerush (luncus roemerianus) extends approximately T-10'
beyond the edge of the bank before transitioning to a 15'-20' wide area of Smooth Cordgrass
(Spartina Al terniflora).
The existing pier and platform located along the eastern property line was authorized by CAMA
General Permit #64716 on 7/14/2015. The existing pier (6' x 56') extends in an easterly direction,
and terminates approximately 30 feet beyond the edge of the marsh. A 10' x 20' fixed platform
exists along the northern side of the existing pier near the terminal end. Additionally, an
approximate 6' x 20' floating dock exists along the southern side of the existing pier, which runs
parallel to the channel and shoreline. The width of the waterbody in this area of Mill Creek ranges
from 95' to 105' feet, as measured from the edge of marsh to edge of marsh. Current water depths
around the existing facility range from approximately -2.0 to -4.0% relative to Normal Low Water
(NLW).
Pender County's Land Use Plan (LUP) classifies the local area as Resource Protection and
Conservation. The waters of Mill Creek, adjacent to the project site, are classified as SA by the North
Carolina Division of Water Quality. They ARE NOT designated as a Primary Nursery Area (PNA) by
the North Carolina Division of Marine Fisheries, and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
According to the project narrative and application package, the applicant proposes to expand the
existing two -slip docking facility creating up to five (5) slips. Although the applicant has specified
only three (3) slips are being proposed under this application, there is the potential to dock up to
five (5) vessels at this location based on the orientation of the existing and proposed dock(s).
Under the current proposal, the applicant seeks to install a 10' x 15' boatlift along the northern side
of the existing platform. Based on the site plan drawing submitted with the application package, the
outer pilings (waterward most pilings) would be located in alignment with the existing fixed
platform, meaning no additional encroachment would occur outboard of the existing pier -head line.
Similarly, the proposed 8' x 20' floating dock addition would be connected to the existing 6' x 20'
floating dock, and would extend in a southerly direction. The proposed dock would also be located
in alignment with the existing dock meaning no portion of the proposed structure would extend

outboard of the existing dock alignment According to the application package, water depths in the
vicinity of the proposed boat lift and floating dock range from -2.0' to -4.0' (@NLW).
The site plan submitted with the application package indicates the proposed development would
occur within the applicant's area of riparian access with no encroachment into neither riparian
corridor setback. Additionally, the site plan shows a separation of approximately 153' from the
riparian corridor bordering the property owner to the north and approximately 40' from the
property owner to the south. In the location of the proposed project, the shoreline is irregular and
there does not appear to be an established "pier -head" alignment
Washington Acres Owners Association has an active CAMA Major Permit (No.175-07), authorizing
maintenance excavation of the adjacent channel. In the location of the project, the dredge channel
width measured approximately 25' in width and based on the major permit drawings, the proposed
dock would not encroach beyond the near shore edge of the channel.
10. ANTICIPATED IMPACTS
The proposed project would include the incorporation of 310 sq. ft of open water area as a result of
the proposed boat lift installation and floating dock expansion. This work would occur within Public
Trust and Estuarine Waters. As proposed, the project would conform to the x/4 width requirement
and would not encroach beyond the near shore edge of the dredge channel. Additionally, the
proposed work would not encroach within the 15' setback of either adjacent riparian property.
Minor increases in turbidity should be expected; however, no long-term impacts are anticipated.

Narrative on Major CAMA permit
I am requesting a permit to increase the size of my current floating dock from a 6 by 20 ft long floating
dock to a 6 by 40 ft long floating dock. The new dock will be joined onto the current dock end and will be
constructed of wood and Styrofoam floats; just as the current dock is. The new floating dock will be
attached on the south eastern side by a new pile at the end. This will allow me to property dock my 25
ft boat, and give room forvisitors. This new floater will not extend out into the creek any more than my
current floater. The floater will have 6 ft to 8ft of water at NLW on the outside and.2 to 4 ft on the
inside.
I am also requesting the addition of a boat lift beside the fixed pier on the NW side of the fixed pier. It
too will be inside the line from the floating dock and on the other side of the fixed pier. The lift will have
4 ft at NLW in the center. The new lift will consist of four new piles, two which will contact the current
fixed pier and two about 10 ft off the pier to allow for the 10,000 lb boat lift frame to be attached. This
will actually improve the passage on the creek by having a boat outside the channel.

development of the subject property located at 435 Hughes Road, in Hampstead, Pender County. It was received as
complete on October 8, 2020 and appears to be adequate for processing at this time. The projected deadline for
making a decision is December 22, 2020. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 8, 2020, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road rigbt-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.

convey the Property and that the Property is unencumbered, except for mcumbranum of record. Borrower warrants and will
defend generally the fide to the Property against all claims and demands, subject to my encumbrances of record.
THIS SECURITY INSTRUMENT combines uniform covenants for national use and nonurdmrm covenants with limited
variations by jurisdiction to constitute a uniform security instrument covering real property.
Uniform Covenants. Borrower and Lender covenant and agree as follows:
1. Payment of Principal, Interest, Escrow Items, Prepayment Charges, and Late Charges. Borrower
shall pay when due the principal of, and interest on, the debt evidenced by the Note end my prepayment charges

payments due under the Note and this Security Instrument or performing the covenants and agreements secured by
this Security Instrument
Application of Payments or Proceeds. Except as otherwise described in this Section 2, all payments accepted
and applied by Lender shall be applied in the following order of priority: (a) interest due under the Note; (b) principal
due under the Note; (c) amounts due under Section 3. Such payments shall be applied to each Periodic Payment in
the order in which it became due. Any remaining 'moats shall be applied fast to late charges, second to any other
amounts due under this Security Instrument and than an reduce the principal balance of the Note.
If Lender receives a payment from Borrower for a delinquent Periodic Payment which includes a sufficient amount to
pay any late charge due, the payment may be applied to the delinquent payment and the late charge. If more than one
Periodic Payment is outstanding, Lender may apply any payment received from Borrower to the repayment of the
Periodic Payments if, and to the extent that, each payment can he paid in full. To the extent that any excess exists
after the payment is applied to the full payment of one or more Periodic Payments, such excess may be applied to any
late charges due. Voluntary prepayments shall be applied fast to any prepayment charges and than as described in
the Note.
Any application of payments, insurance proceeds, or Miscellaneous Proceeds to principal due under the Note shall
not extend or postpone the due date, or change thu amount, of the Periodic Payments.
Funds for Escrow Items. Borrower shall pay to Lender on the day Periodic Payments are due under the Note, until
the Note is paid in full, a sum (the "Fonds") te provide for payment of amounts due for: (a) taxes and assessments
and other items which can attain priority over this Security Instrument as a lien or encumbrance on the Property; (b)
leasehold payments or ground rents on the Property, if any; (c) premiums for any and all insurance required by
Lender ad" Section 5; and (d) Mortgage Insurance premiums, if any, or any arms payable by Borrower to Lender in
lieu of the payment of Mortgage Insurance premiums in accordance with the provisions of Section 10. These items
we called "Escrow Items.' At origination or at any time during the term of the Low, Lender may require that
Community Association Dues, Fees, and Assessments, if my, be escrowed by Borrower, and such does, fees and
assessments shall be an Escrow Item. Borrower shall promptly famish to Lender all notices of amounts to be paid
under this Section. Borrower shall pay Lender the Funds for Escrow Items unless Lender waives Borrowees
obligation to pay the Funds for my or all Escrow Items. Lender may waive Borrowers obligation to pay to Lender
Funds for my or all Escrow Items at my time. Any such waiver may only be in writing. In the event of such waiver,
Borrower shall pay directly, when and where payable, the amounts due for my Escrow Items for which payment of
Funds has been waived by Lender and, if Lender requires, shall furnish to Lender receipts evidencing Such payment
within such timeperiod u Lender may require. Borrower's obligation to make such payments and to provide receipts
shall for all purposes be dens ed to be a covenwl and agreement contained in this Severity Instrument, as the phrase
"covenant and agreement" is used in Section 9. If Borrower is obligated to pay Escrow Items directly, pursuant to a
waiver, and Borrower fails to pay the amount due for an Escrow Item, Lender may exercise its rights under Section 9
and pay such amount and Borrower shall then be obligated under Section 9 to repay to Lender my such amount.
Lender may revoke the waiver as to my or all Escrow Items at my time by a notice given in accordance with Section
15 and, upon such revocation, Borrower shall pay to Lender all Fads, and in such amounts, that we then required
under this Section 3.
Lender may, at my time, collect and hold Fads in an =car (a) sufficient in permit Lender to apply the Funds st the
time specified under RESPA, and (h) not to exceed the maximum amount a lander can require under RESPA. Lender
shall estimate the amount of Funds due on the basis of current data and reasonable estimates of expenditures of
future Escrow Items or otherwise in accordance with Applicable Law.
The Funds shall be held in an institution whose deposits are insured by a federal agency, insumncmality, or entity
(including Lender, if Lender is an institution whose deposits are so insured) or in my Federal Home Loan Bank.
Lender shall apply the Funds to pay the Escrow Items w later than the time specified under RESPA. Lender shell not
charge Borrower for holding and applying the Funds, annually analyzing the escrow account, or verifying the Pscrow
Items, unless Lender pays Borrower interest on the Fads and Applicable Law permits"Lender to make such a charge.
Unless an agreement is made in writing or Applicable Lew requires interest to be paid on the Funds, Lender shall not
be required to pay Borrower my interest or earnings on the Funds. Borrower and Lender can agree in writing,
however, that interest shall be paid on the Fads. Lender shall give to Borrower, without charge, an annual

If then is a surplus of Funds held in escrow, m defined under RFSPA, Lender shall account m Borrower for the
excess funds in accordance with RESPA. If there is a shortage of Funds held in escrow, as defined under RESPA,
Lender shall notify Borrower as required by RESPA, and Borrower shall pay to Lender the meant necessary to make
up the shortage in acdordance with RESPA, but in no more than 12 monthly payments. If there is a deficiency of
Funds held in ®crow, as defined under RESPA, Lender shall notify Borrower as required by RESPA, and Borrower
shall pay to Lender the amount necessary to makeup the deficiency in accordance with RESPA, but in no more than
12 monthly payments.
Upon payment in fall of all sums secured by this Security Instrument, Lender shall promptly refund to Borrower any
Funds held by Lender.
Charges; Liens. Borrower shall pay all taxes, assessments, charges, fines, and impositions attributable to the
Property which can attain priority over this Security Instmmenl, leasehold payments or ground rents on the Property,
if my, and Community Association Dues, Fees, and Assessments, if any. To the extent that these items we Escrow
Items, Borrower shall pay them in the manner provided in Section 7.
Borrower shall promptly discharge any lien which has priority over this Security Instrument unless Borrower: (a)
agrees in writing to the payment of the obligation secured by the lien in a manner acceptable to Lender, but only so
long a9 Borrower is performing such agreement; (b) contests the lien in good faith by, or defends against
enfmrcemcnt of the lien in, legal proceedings which in Lenders opinion operate to prevent the enforcement of the lien
while those proceedings are pending but only until such proceedings are concluded; or (c) secures from the holder
of the lien an agreement satisfactory to l.endw subordinating the lint to this Security Instrument. If Lender
determines that any part of the Property is subject to a lien which can attain priority over this Security Instrument,
Lender may give Borrower a notice identifying the lien. Within 10 days of the date on which that notice is given,
Borrower shall satisfy the lien or take one or more of the actions set forth above in this Section 4.
Lender may require Borrower to pay acne -time charge for a real estate tax verification and/or reporting service used
by Lender in connection with this Loan.
Property Insurance. Borrower shall keep the improvements now existing or hereafter erected on the Property
insured against loss by fire, hazards included within the term "extended coverage," and any other hazards including,
but tat limited to, earthquakes and floods, for which Lender requires insurance. This insurance shall be maintained in
the amounts (including deductible levels) and for the period& that Lender requires. What Lender requires pursuant to
the preceding sentences can change during the term of the Loam The insurance carrier providing the insurance shall
be chosen by Borrower subject to Lenders right to disapprove Borrowers choice, which right shall not be exercised
unreasonably. Lender may require Borrower to pay, in connection with this Loan, either: (a) a one-time charge for
flood zone determination, certification and tracking services; car (b) a one-time charge fir flood zone detemlinetion
and certification services and subsequent charges each time minappings or similarchanges occur which reasonably
might affect such determination or certification. Borrower shall also be responsible for the payment of any fees
imposed by the Federal Emergency Management Agency in connection with the review of any flood zone
determination resulting from an objection by Borrower.
If Borrower fails to maintain my of the coverages described above, Lender may obtain insurance coverage, at
L andds option and Borrower's expense. Lender is under an obligation to purchase my particular type or amount of
covemge. Therefore, such coverage shall cover Lender, but might or might not protect •Borrower, Borrowers equity in
the Property, or the contents of the Property, against any risk, hazard or liability and might provide greater or loser
coverage than was previously in effect Borrower acknowledges that the cost of the insurance coverage an obtained
might significantly exceed the cast of insurance that Borrower could have obtained. Any amounts disbursed by
Lender under this Section 5 shall become additional debt of Borrower secured by this Security Instrument. These
amounts shall bear interest at the Note rate from the date of disbursement and shall be payable, with such interest,
upon notice from Lender to Borrower requesting payment
All insurance policies required by Lender and renewals of such policies shall be subject in Lenders right to
disapprove such policies, shall include a standard mortgage clause, and shell name Lender as mortgagee and/or as an
additional loss payce. Lender shell have the right to hold the policies and renewal certificates. If Lender requires,
Borrower shall promptly give to Lender all receipts of paid premiums and mrmwal notices. If Borrower obtains any
forth of insurance coverage, not otherwise required by Lender, for damage in, or destruction oi: the Property, such
policy shall include a standard mortgage clause and shall namme Lend" as; mortgagee and/or as an additional loss
