dated 10/21/19, Sheets 1-4 of 7 all dated "Revised 4/24/20", Sheet 5 of 7 dated 2/3/20, Sheets 6,7 of 7 both dated 1/30/20.
This permit, issued on May 26, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)t tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null ana veto.
Excavation
1) No excavation shall take place outside of the area indicated on the workplan drawings.
2) Excavation shall not exceed -4.5 feet below the normal water level. In no case shall the depth of
excavation exceed the depth of connecting waters.
3) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023

4) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the National
Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
SDoil Disoosal
5) No spoil material shall be placed within 30 feet of the normal water line, except that which will be used
to backfill the area behind the permitted bulkhead, once properly dried.
6) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
7) Spoil from the authorized dredge footprint shall be dewatered before use as backfill. All remaining
backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
8) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
Maintenance Clause
9) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Shoreline Stabilization - Bulkhead
10) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan
drawings.
11) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum of 30 days prior to the new expected start of construction.
12) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.

13) The bulkhead shall be constructed prior to any backfilling activities.

14) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
15) The fill material shall be clean and free of any pollutants except in trace quantities.
16) Unless altered herein, all backfill material shall be obtained from a high ground source and confined
behind the permitted bulkhead.
17) No backfill material is to be placed within 30 feet of the normal water level, except that which will be
used to backfill the area behind the permitted bulkhead.
Sedimentation and Erosion Control
18) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
19) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
20) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
Docking Facility
21) This permit authorizes only the pier and other structures and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this docking facility without permit modification. No non -
water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.
22) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
23) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
24) This permit authorizes a maximum of 2 formalized boat slips.
25) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access.

26) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
As -Built Survey
27) An as -built survey shall be performed for the authorized bulkhead and docking facility, and copies of the
survey provided to the Division of Coastal Management, within 60 days of completion of construction
of these portions of the project.
USACE Conditions
28) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
29) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
30) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
31) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-00588).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20-0446.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

The proposal consisted of dredging out an existing canal of high ground that had sedimented in from the surrounding
high ground to create a basin for Mr. Vann. The dredge footprint was proposed to the limits of the surveyed property
line. The S/D provided a quit claim deeding to each property owner of any volunteered uplands within each property
owners boundary. The resulting dredging and bulkheading would move the 30ft buffer farther onto the adjacent riparian
neighbor (Riggs) which he objected to. After discussions with Jonathan Howell, Ron Renaldi, Robert Corbett and Christy
Goebel. It was determined that the 30ft buffer had moved waterward due to the fact that the volunteered uplands
resulted from sedimentation into the existing canal that had a defined footprint. Riggs had no expectation that the canal
would not be dredged to the previous, original footprint. Therefore, the proposed dredging footprint would place the
30ft buffer in the same location as if the canal were maintained to its original footprint. It was determined that Riggs'
objection is not supported by DCM.

On March 30, 2020, the Division of Water Resources (Division) received your application dated March 27,
2020, requesting a 401 Water Quality Certification from the Division for the subject project. The Division
has determined that your application is incomplete and cannot be processed. The application is on -hold
until all of the following information is received:
1. Submerged Aquatic Vegetation (SAV) Survey
The Major Development Permit application received in this Office states that you are the
owner of subject property located at 2196 Ocean Pearl Road in Corolla, Currituck County.
Please provide a SAV survey to determine the extent of native vs invasive SAV present within
the proposed dredge area of the man-made canal including potential area of impact to SAV
beds from the proposed dredging activity. Pending the result of the SAV survey and proximity
to native SAV beds, the Division may require justification on how to address the ingress/egress
within the canal will be maintained without secondary and cumulative impacts to the SAVs
beds (native) within the canal. [15A NCAC 02H .0506 (6 (f) and (g)) and 15A NCAC

Good morning Gregg,
I just spoke with Anne and Maria about this project. DMF would still prefer that a survey for SAV be
completed in order to know the extent of SAV in this area. However, taking into consideration the previous
permits and work done in the area, DMF does not oppose to the work occurring without a survey, and supports
the comments of other agencies.
Additionally, I may be available later this week or next week to conduct a site visit and SAV survey myself, if
that's not a problem.

Afternoon Jimmy,
DWR recently placed the project on hold with similar concerns. I have recently provided them with information that the
open water portion of the canal has been recently dredged and the proposal includes area of high ground (see
above). In addition SAV in canals is typically looked at differently since it may have volunteered in a man made body of
water that has been dredged out of uplands.
I've attached the GPs for the 2 riparian neighbors that have dredged the area recently. DCM considers the open water
portion of the canal maintenance dredging.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that impact fish and fish
habitats. The proposed project is located at 2196 Ocean Pearl Road, within Currituck
County. The applicant is proposing to: 1) remove all existing and remnant structures along
the shoreline; 2) dredge a 30' by 45' area of the man-made canal to a connecting depth of -
4.5'; 3) excavate a 25' by 50'')area of high ground to form a boat basin that will span the
length of the shoreline, to a depth of -4.5', and will have four sides reinforced by a wooden
bulkhead totaling 105' in length; and 4) construct a 21' by 5' pier inside the proposed boat
basin, with wet slips on the north and south sides of the pier.
The field investigation report mentions that dense patches of rooted milfoil were observed
growing within the project area. Milfoil is one species of submerged aquatic vegetation
(SAV) found within North Carolina waters. SAV is a highly valuable habitat, both
environmentally and economically. These habitats provide nursery, foraging, and/or
spawning areas for various recreationally and commercially important fish and
invertebrate species. Some studies have shown a preference to milfoil by grass shrimp due
to the dense beds providing more cover from predators. Additionally, SAV plays a critical
role in natural erosion control and shoreline stabilization, as well as water quality
enhancement, primary production, and nutrient cycling. Therefore, it is crucial that SAV
habitat be protected, in order to maintain these critical environmental contributions.

The applicant proposes to dredge a man-made canal as well as excavate a 50' x 25' upland boat
basin stabilized by a 105' of bulkheading. The basin will house a 21' x 5' pier with 2 boat slips.
The site of the proposed project is located at 2196 Ocean Pearl Road, Currituck County, adjacent
to a man-made canal which leads to Knotts Island Bay of the Currituck Sound.
The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and
Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H. 0208 Use Standards
Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a) (1) States "Uses which are not water dependent shall not be permitted in coastal
wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels,
hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not

(iii) Excavated material can be removed and placed in a disposal area in accordance with Part
(b)(1)(13) of this Rule without impacting adjacent nursery areas and submerged aquatic

(iv) The original depth and width of a human -made or natural channel shall not be increased to

Paragraph (6) Piers and Docking Facilities
Subparagraph (6) (A) states, "Piers shall not exceed six feet in width. Piers greater than six feet
in width shall be permitted only if the greater width is necessary for safe use, to improve public
access, or to support a water dependent use that cannot otherwise occur;"
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6) (B) states, "The total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a
maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips
shall not be counted in the total. Projects requiring dimensions greater than those stated in this
Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur. Size restrictions
shall not apply to marinas;"
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6) (C) states, "Piers and docking facilities over coastal wetlands shall be no wider
than six feet and shall be elevated at least three feet above any coastal wetland substrate as
measured from the bottom of the decking;"

Subparagraph (6) (D) states, "A boathouse shall not exceed 400 square feet except to
accommodate a documented need for a larger boathouse and shall have sides extending no
farther than one-half the height of the walls and covering only the top half of the walls.
Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses
shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not
apply to marinas;"

Subparagraph (6) (E) states, "The total area enclosed by an individual boat lift shall not exceed
400 square feet except to accommodate a documented need for a larger boat lift;"

Paragraph (7) Bulkheads
Subparagraph (7) (A) states, 'Bulkhead alignment, for the purpose of shoreline stabilization,
shall approximate the location of normal high water or normal water level."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (7) (B) states, `Bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (7) (C) states, 'Bulkhead backfill material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a
part of a permitted project involving excavation from a non -upland source, the material so
obtained may be contained behind the bulkhead."
Consistent: The applicants have indicated that clean fill will be used.
Subparagraph (7) (D) states, `Bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep
grade bank, which will cause the applicant unreasonable hardship under the other provisions of
this Rule;
Consistent: The proposed development is consistent with the intent of this rule.
(ii) the bulkhead alignment extends no further below normal high water or normal water level
than necessary to allow recovery of the area eroded in the year prior to the date of application, to
align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the
unusual geographic or geologic features;
Consistent: The proposed development is consistent with the intent of this rule.
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners;
Consistent: The proposed bulkhead alignment brings NWL landward to the canals original

by the Division of Coastal Management;

(v) the property to be bulkheaded is in a nonoceanfront area."

15A NCAC 07K 0209 Use Standards
Paragraph (d) (1) states "All development projects, proposals, and designs shall preserve natural
barriers to erosion, including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (2) states "All development projects, proposals, and designs shall limit the
construction of impervious surfaces and areas not allowing natural drainage to only so much as is
necessary to service the primary purpose or use for which the lot is to be developed. Impervious
surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can
demonstrate, through innovative design, that the protection provided by the design would be
equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding
the 30 percent impervious surface limitation shall be permitted if impervious areas are not
increased and the applicant designs the project to comply with the rule to the maximum extent
feasible."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (3) states "All development projects, proposals, and designs shall comply with the
following mandatory standards of the North Carolina Sedimentation Pollution Control Act of
1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.

of land shall plant a ground cover sufficient to restrain erosion within 30 working days of
completion of the grading; unless the project involves clearing land for the purpose of forming a
reservoir later to be inundated."

Paragraph (d) (4) states "Development shall not have a significant adverse impact on estuarine
and ocean resources. Significant adverse impacts include development that would directly or

or cause degradation of shellfish beds."

Subparagraph (6) (A) states, "Piers shall not exceed six feet in width. Piers greater than six feet
in width shall be permitted only if the greater width is necessary for safe use, to improve public
access, or to support a water dependent use that cannot otherwise occur;"

approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a

obtained may be contained behind the bulkhead."

Subparagraph (7) (D) states, `Bulkheads shall be permitted below normal high water or normal

(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep
grade bank, which will cause the applicant unreasonable hardship under the other provisions of
this Rule;

15A NCAC 07K 0209 Use Standards
Paragraph (d) (1) states "All development projects, proposals, and designs shall preserve natural
barriers to erosion, including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines."
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (d) (2) states "All development projects, proposals, and designs shall limit the
construction of impervious surfaces and areas not allowing natural drainage to only so much as is
necessary to service the primary purpose or use for which the lot is to be developed. Impervious
surfaces shall not exceed 30 percent of the AEC area of the lot, unless the applicant can
demonstrate, through innovative design, that the protection provided by the design would be
equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding
the 30 percent impervious surface limitation shall be permitted if impervious areas are not
increased and the applicant designs the project to comply with the rule to the maximum extent
feasible."

Paragraph (d) (3) states "All development projects, proposals, and designs shall comply with the
following mandatory standards of the North Carolina Sedimentation Pollution Control Act of
1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water that is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.

that is greater than an angle that can be retained by vegetative cover or other erosion -control
devices or structures.

creation of the upland boat basin which will adversely impact the adjacent riparian properties by

On March 30 2020, the Washington Regional Office of the Division of Energy, Mineral, and
Land Resources received a copy of your CAMA Major application for a project located at 2196 Ocean
Pearl Road near Corolla, NC. This project involves the replacement of an existing boat ramp, pier
and bulkhead. Staff review of the plans and specifications has determined that the project, as
proposed, consists of activities that will not pose surface water quality threats from stormwater
runoff. The Director has determined that projects that are reviewed and approved by the Division
as not posing water quality threats from stormwater runoff should not be subject to the stormwater
management permitting requirements of 1SA NCAC 2H.1000. For this reason, we are informing
you by way of this letter that the current project will not require a State Stormwater management
permit.
The stormwater rules require the Division to permit the common plan of development,
therefore, any future development on the property, regardless of whether a SEC plan or CAMA
Major permit is also required, will require a Stormwater Management Permit application and
permit issuance from the Division of Energy, Mineral, and Land Resources prior to any
construction. Any construction on the subject site, prior to receipt of the required permit, will
constitute a violation of 15A NCAC 21-1.1000 and may result in appropriate enforcement actions by
this Office.

manmade canal and excavate a 25 foot by 50 foot area of highground to form a
boat basin to a connective depth of -4.5 feet below NWL, install 105 linear feet of
bulkhead, and construct a 5 foot wide by 21 foot long pier on a manmade canal
that connects to Knotts Island Bay; on the property at 2196 Ocean Pearl Road, in
the community of Carova Beach, Currituck County.
DATE: April 7, 2020
Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 2006 Core Land Use Plan (LUP) certified by the CRC on
May 18, 2007 as amended through July 2, 2019.
Overview: The .64 acre project site has approximately 45 linear feet of shoreline along a man-
made canal that connects to Knotts Island Bay. The shoreline has a 2 foot erosion escarpment.
Water depths within the project area range from -1 to -4.5 feet and average -2.5 feet below Normal
Water Level (NWL). The property is located outside of a Floodzone, however all properties in this
area are within the Coastal Barrier Resource System (CBRS) zone where federal expenditures
and financial assistance that encourage development, such as federal flood insurance, are
restricted.
Existing site improvements consist of a single family house with attached carport. Existing
shoreline improvements consist of a deck, pier and an 8 foot by 12 foot platform. The deck and
pier are unusable and the platform is aged.
Dredging of a 30 foot by 45 foot area of the manmade canal and excavation of a 25 foot by 50
foot area of highground to form a boat basin to a connective depth of -4.5 feet below NWL,
installation of 105 linear feet of bulkhead, and construction of a 5 foot wide by 21 foot long pier
are proposed. The existing deck, pier and platform will be removed. Dredge spoils will be kept
on site at least 30 feet from NWL. Once dried, they will be used as backfill for the bulkhead and

along the basin at the property line so work does not occur on adjacent properties. The pier will
provide two (2) wet slips.
The waters of the man-made and finger canals connecting to Knotts Island Bay are classified as
SC (fish propagation) and Joint Waters, and are closed to shellfish taking. Dense patches of
rooted milfoil were observed growing within the project area. A review of available information
indicated that no archaeological resources are located on or near the project area.
Anticipated impacts resulting from this project are expected to include: the dredging of 1,350 sq.
ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AECs); the excavation
of 1,250 sq. ft. of High Ground within the Estuarine Shoreline AEC; the disturbance of 3,900 sq.
ft. of High Ground within the Estuarine Shoreline AEC, and; the shading of 105 sq. ft. of Public
Trust Area/Estuarine Waters AEC.
Basis for Determination:
The project area is located within the "Carova Sub -Area" and is designated as "Limited Service
Areas (Areas Preferred for Low Density Development)" on the Currituck County Future Land Use
Map (FLUM); with Areas of Environmental Concern (AECs) designated as "Conservation Areas'
as indicated on Page 11-1.
As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the long-
term management and protection of significant, limited, or irreplaceable areas. Proper
management is needed to conserve the natural, cultural, recreational, scenic or biologically
productive values of these areas. The designation is applied to areas that should not be
developed at all (preserved), or if developed, done so in a very limited manner characterized by
careful planning and cautious attention to the conservation of environmental features.
Land Use Plan policies address the use of vegetated buffers to reduce pollutants and protect
water quality. The project areas contain shoreline along an existing man-made canal and finger
canal with erosion escarpments. Bulkhead will help protect water quality by reducing soil erosion
and sedimentation.
Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or
foster', "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply

The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality for Class SC
Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8
and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions;
(1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this
level due to natural background conditions, the existing turbidity level shall not be increased. [15A

Good morning Gregg,
I just spoke with Anne and Maria about this project. DMF would still prefer that a survey for SAV be
completed in order to know the extent of SAV in this area. However, taking into consideration the previous
permits and work done in the area, DMF does not oppose to the work occurring without a survey, and supports
the comments of other agencies.
Additionally, I may be available later this week or next week to conduct a site visit and SAV survey myself, if
that's not a problem.

Afternoon Jimmy,
DWR recently placed the project on hold with similar concerns. I have recently provided them with information that the
open water portion of the canal has been recently dredged and the proposal includes area of high ground (see
above). In addition SAV in canals is typically looked at differently since it may have volunteered in a man made body of
water that has been dredged out of uplands.
I've attached the GPs for the 2 riparian neighbors that have dredged the area recently. DCM considers the open water
portion of the canal maintenance dredging.

Reference the application of Mr. Kenneth Vann to dredge a 30' x 45' area of a man-made
canal, a 25' x 50' upland boat basin, construct a 105 linear foot boat basin, and a 21' x 5' pier
with associated boat slips, located at 2196 Ocean Pearl Road, adjacent to Knotts Island Bay,
in Currituck County, North Carolina,
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. In order to protect the endangered West Indian manatee (Trichechus manatus) the Permittee shall
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.fws.gov/nc-
es/mammal/manatee_guidelines.pdf.
3. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source, Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
4. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize'temporaiy placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project:
6. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall`be generated fromtan upland gource and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
7. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
8. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
9. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
10. The permittee shall employ all sedimentation and erosion control measures
necessary to prevent an increase in sedimentation or turbidity within waters and wetlands
outside the permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally,
the project must remain in full compliance with all aspects of the Sedimentation Pollution
Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4).
11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, attrtFtU Yd

12. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

We have received notice that DWR & DMF have place the permit application on hold until a SAV survey has been
conducted. To expedite the process I went to the project site yesterday and raked the area and took several pictures of
the SAV within the project location. We have also advised each agency this is a basin of a man made canal and that both
adjacent properties have been dredge previously under a CAMA General Permit. Hopefully with this updated
information provided they will bring the project off of the hold. Once they have removed the hold on the project you will
be notified by our Assistant Major Permit Coordinator Gregg Bodnar (cc'd).
After an intensive review of the site plans we have come across a conundrum where we have 2 conflicting survey plats
showing the property line on the north side of the canal. Both plats are from the same surveyor and both use the
shoreline proportionate method. When we issue a CAMA Major Permit we cannot authorize any work on another
person property without them being an applicant. Form the site plans provided you have the bulkhead on the north side
tying in behind the Cason bulkhead, essentially undermining the bulkhead. The easiest way to solve this issue is for you
to adjust the site plan drawings so that the bulkhead ties into the corner of Cason's Bulkhead instead of behind it. I have
provided an image of this to better explain the situation. If you are fine with this adjustment we will need to have a
revised site plan submitted.
Let me know you thoughts and if you would like to make this adjustment so that we can proceed. I look forward into
hearing back from you.

attention on March 17, 2020 via email and certified mail request has been addressed by the Division of Coastal
Management staff previous general permit issued in the immediate vicinity of your project. The submerged
aquatic vegetation (sea grass) within the canal system is considered habitat for fish and other marine life and
therefore a requested for a survey to determine what species exist was made by Divisions of Water Resources
and Marina Fisheries. The historical general permit information regarding previous permits had not been
provided to the reviewing agencies within the CAMA Major application. At this point, no further information will
be required.

This letter is in response to your correspondence, which was received by the Division of Coastal
Management on August 19, 2019, regarding your concerns about the proposed development by
Kenneth Vann, at 2196 Ocean Perl Rd., in Corolla, Currituck County. The proposed project
consisted of excavation to create a basin, bulkhead and associated pier. The proposed project has
been determined to comply with the Rules of the Coastal Resources Commission and as such, a
permit has been issued to authorize the development. I have enclosed a copy of the permit. I
would like to bring your attention to Condition No. 27 in which an as -built survey is required to
document the location of the authorized development and Condition No. 25 requiring the
authorized pier and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent property owner's area of riparian access.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party
Appeal. The Chairman of the Coastal Resources Commission will consider each case and
determine whether to grant your request to file for a Contested Case Hearing. The hearing
request must be filed with the Director, Division of Coastal Management, in writing and must be
received within twenty (20) days of the disputed permit decision.

1 saw my neighbor. Ken Vann.
I explained that because my lot is not bulklhcaded I didn't want his boat basin along side the property line. tic
said I already signed the adjacent property notification form. I tried explaining what I signed was only for him
to maintenance dredge. Mr. Vann thinks the form was for everything.
1 know when you and I last talked you mentioned at least 10 ft set back for his boat basin. If I read correctly on
the CAMA guidelines the set back can be as much as 15 ft. I would prefer it to be the 15 ft or at least the 10 ft.
I am sure you will be contacted by Mr. Vann and wanted you to know my concerns and that I only signed for
dredging.

8. PROJECT SUMMARY:
The applicant proposes to dredge a man-made canal as well as excavate a 50' x 25'
upland boat basin stabilized by a 105' of bulkheading. The basin will house a 21' x 5'
pier with 2 boat slips.
Project Setting
The site of the proposed project is located at 2196 Ocean Pearl Road, Currituck County,
adjacent to a man-made canal which leads to Knotts Island Bay of the Currituck Sound.
The property is approximately 0.64 acres in size and has approximately 45' of
unhardened shoreline with an erosion escarpment of 2'. Currently on the property is a
single family dwelling with an attached carport. Along the properties shoreline is the
remains of an unusable deck and pier, and an aging platform which is still in use. This
platform hangs slightly over the water and is approximately 12' x 8' in size. According to
the USDA's Natural Resources Conservation Services' Web Soil Survey, the soil on the
property is made up of Newhan-Corolla complex that is vegetated with grasses that are
mowed periodically. Based on available information, there appears to be no
archaeological sites on this property or nearby. The adjacent riparian property to the west
contains a single family dwelling and a bulkheaded shoreline with a pier. The adjacent
riparian property to the south contains a single family dwelling with an unhardened
shoreline and a pier.
The man-made canal which connects to Knotts Island Bay is classified as Joint waters by
agreement with the Marine Fisheries Commission and Wildlife Resources Commission.
The Division of Environmental Management's water quality classification for this area is
SC and it is closed to shellfish taking. Water depths within the project sight range from -
1' to -4.5' and average -2.5'. The bottom substrate within the project area is made up of
muddy sand. Dense patches of rooted milfoil were observed growing within the project
area. The project sight does not contain any wetlands.
Development Proposal
To begin the project, the applicant proposes to remove all existing and remnant structures
along the shoreline. The applicant proposes to dredge a 30' x 45' area of the man-made
canal to a connecting depth of -4.5'. The applicant than proposes to excavate a 25' x 50'
area of high ground to form a boat basin that will span the entire length of the shoreline.
The proposed boat basin will be excavated to a depth of -4.5' and will have 4 sides
reinforced by a wooden bulkhead totaling t105' in length. The 2 walls of the basin that

parallel the property line will not use tiebacks as support. These walls will simply be wood
sheathing so that the work does not cross over onto an adjacent property. All of the spoils
will be kept on the project sight and will be located 30' from NWL. Once dried, the ±460
cubic yards of spoils will remain on the property used as backfill for the bulkhead and
grading of the lot.
Lastly the applicant proposes to construct a 21' x 5' pier inside of the proposed boat basin.
The proposed pier will be located 15' from the adjacent property to the south. The
applicant proposes a wet slip on the north and the south side of the pier.
Anticipated Impacts
• The dredging of the canal will result in the removal of 100 yd' of material within the PTA
and EW AEC
• The excavation of the boat basin will result is the removal of 207 yd3 of material below
NWL as well as the removal of 153 yd' of material above NWL within the ES AEC
• The excavation of the boat basin will bring the CAMA 30' Buffer landward approximately 900
sq ft on the adjacent properties within the ES AEC
• The spoil area for the excavated material will have a disturbance of 2,400 ft' of high ground
within the ES AEC
• The construction of the bulkhead will disturb ±1.000ft2 of high ground within the ES AEC.
• The construction of the pier will shade 105 ft' of open water of the PTA and EW AEC.

The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 03/16/20. Kenneth Vann proposes to
dredge a man-made canal as well as excavate a 50' x 25' upland boat basin stabilized by
a 105' of bulkheading. The basin will house a 21' x 5' pier with 2 boat slips at 2196 Ocean
Pearl Road Corolla in Currituck County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 04/21/20, will be considered
in making the permit decision. Later comments will be considered up to the time of permit

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval to dredge a man-made canal as well as excavate a 50' x 25' upland boat basin
stabilized by a 105' of bulkheading. The basin will house a 21' x 5' pier with 2 boat slips at 2196
Ocean Pearl Road, Corolla in Currituck County.
It was received complete on March 16, 2020 and appears to be adequate for processing at this time.
The projected deadline for making a decision is May 30, 2020. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 16, 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:

Re: CAMA Major Permit Review for 2196 Ocean Pearl Road.
Dear Mr. Vann:
January 23, 2020
On December 6, 2019, the NC Division of Coastal Management acknowledged receipt of your preliminary application
located in Corova Beach, Currituck County. An initial screening of the submittal package was conducted, which
revealed certain deficiencies that required your attention. The entire original application was returned to you, with an
office copy retained for my review.
On January 21, 2020, our office received documents for your re -submittal of the application. My office must receive
the following data before the Major Permit Application can be accepted as complete:
1) On the site plans.
a) As previously requested on December 19, 2019. Please include the current 30' CAMA Buffer as well as the
newly proposed CAMA 30' buffer over the proposed site location as well as on the riparian properties.
b) As previously requested on December 19, 2019. Provide a cross section drawing for the proposed dredging
area.
c) All drawings (including cross -sectionals) need a title block indicating:
i) Name of applicant
ii) Address of the proposed project
iii) Date of drawing
iv) Page # (example 1 of 4)
v) The scale in which it was drawn
d) Show the 75' AEC Line on all drawings
e) Remove the 10' MBL line from all drawings.

8. PROJECT SUMMARY:
The applicant proposes to dredge a man-made canal as well as excavate a 50' x 25'
upland boat basin stabilized by a 105' of bulkheading. The basin will house a 21' x 5'
pier with 2 boat slips.
Proiect Setting
The site of the proposed project is located at 2196 Ocean Pearl Road, Currituck County,
adjacent to a man-made canal which leads to Knotts Island Bay of the Currituck Sound.
The property is approximately 0.64 acres in size and has approximately 45' of
unhardened shoreline with an erosion escarpment of 2'. Currently on the property is a
single family dwelling with an attached carport. Along the properties shoreline is the
remains of an unusable deck and pier, and an aging platform which is still in use. This
platform hangs slightly over the water and is approximately 12' x 8' in size. According to
the USDA's Natural Resources Conservation Services' Web Soil Survey, the soil on the
property is made up of Newhan-Corolla complex that is vegetated with grasses that are
mowed periodically. Based on available information, there appears to be no
archaeological sites on this property or nearby. The adjacent riparian property to the west
contains a single family dwelling and a bulkheaded shoreline with a pier. The adjacent
riparian property to the south contains a single family dwelling with an unhardened
shoreline and a pier.
The man-made canal which connects to Knotts Island Bay is classified as Joint waters by
agreement with the Marine Fisheries Commission and Wildlife Resources Commission.
The Division of Environmental Management's water quality classification for this area is
SC and it is closed to shellfish taking. Water depths within the project sight range from -
1' to -4.5' and average -2.5'. The bottom substrate within the project area is made up of
muddy sand. Dense patches of rooted milfoil were observed growing within the project
area. The project sight does not contain any wetlands.
Development Proposal
To begin the project, the applicant proposes to remove all existing and remnant structures
along the shoreline. The applicant proposes to dredge a 30' x 45' area of the man-made
canal to a connecting depth of 45. The applicant than proposes to excavate a 25' x 50'
area of high ground to form a boat basin that will span the entire length of the shoreline.
The proposed boat basin will be excavated to a depth of 4.5' and will have 4 sides
reinforced by a wooden bulkhead totaling t105' in length. The 2 walls of the basin that

parallel the property line will not use tiebacks as support. These walls will simply be wood
sheathing so that the work does not cross over onto an adjacent property. All of the spoils
will be kept on the project sight and will be located 30' from NWL. Once dried, the ±460
cubic yards of spoils will remain on the property used as backfill for the bulkhead and
grading of the lot.
Lastly the applicant proposes to construct a 21' x 5' pier inside of the proposed boat basin.
The proposed pier will be located 15' from the adjacent property to the south. The
applicant proposes a wet slip on the north and the south side of the pier.
Anticipated Impacts
• The dredging of the canal will result in the removal of 100 yd3 of material within the PTA
and EW AEC
• The excavation of the boat basin will result is the removal of 207 yd3 of material below
NWL as well as the removal of 153 yd3 of material above NWL within the ES AEC
• The excavation of the boat basin will bring the CAMA 30' Buffer landward approximately 900
sq ft on the adjacent properties within the ES AEC
• The spoil area for the excavated material will have a disturbance of 2,400 ftz of high ground
within the ES AEC
• The construction of the bulkhead will disturb t1,000ft' of high ground within the ES AEC.
• The construction of the pier will shade 105 ftz of open water of the PTA and EW AEC.
