Authorizing development in Brunswick County at man-made canals (#14-17 21 21A, 22-23) between Causeway Dr.
& Concord St., & entrance canals (#S. 3) ad'. to the AIWW, in Ocean Isle Beach, as requested in the permittee's application
dated 10/31/19 (MP-1 2) and 11/12/19 (MP-4), including attached workplan drawings (11), all dated "Revised 10/23/19".
This permit, issued on April 9, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Excavation
1) In order to protect juvenile shrimp and ftnfish populations, no excavation or filling shall be permitted
between April 1 and November 15 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -7 feet below the mean low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding
waters, even temporarily.
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C.
Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North
Carolina Oil Pollution and Hazardous Substances Control Act will be followed.
NOTE: The permittee's contractor is advised to contact the U.S. Coast Guard to discuss operations and
appropriate lighting, markers, etc. for all dredge equipment.
Spoil Disposal
7) No spoil material shall be placed within 30 feet of the mean high-water line.
8) All excavated materials shall be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
9) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond
the mean low water level to prevent gully erosion and unnecessary siltation, and to avoid shellfish and
SAV habitat.
10) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike
and a maximum distance from spillways to allow settlement of suspended sediments.
11) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance
with water quality standards.
12) The diked disposal area shall be constructed a sufficient distance from the mean high-water level or any
marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters.
13) The effluent pipe and associated activity shall not cause an unacceptable interference with navigation.
14) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
15) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material
removed from disposal site AIW_U_0303 is properly contained during transport to the upland disposal
site, and that all the proper coordination has taken place with the local or state governments to ensure
that any damage to public streets caused by transport of the spoil material has been addressed.

16) In order to protect waters adjacent to the designated dredge spoil disposal site, the permittee shall
provide the Division of Marine Fisheries — Shellfish Sanitation Section the dredge plan and, the location
of the spoil disposal site prior to any dredging activity, so a swimming advisory or shellfish closure
determination can be made, and documentation of this coordination provided to the Division of Coastal
Management.
17) If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
Maintenance Clause
18) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Stormwater Management
19) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require
a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from
DEMLR prior to the initiation of any construction. Any violation of the permit approved by DEMLR
shall be considered a violation of this CAMA permit.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal
Drive Extension, Wilmington, NC 28405.
20) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
21) The permitted activity shall be conducted in such a manner as to prevent a significant increase in
turbidity outside of the area of construction or construction -related discharge. Increases s�ch that the
turbidity in the waterbody is 25 NTU's or less in all saltwater classes are not considered significant.

Easement
22) An Easement from the Department of Administration's State Property Office may be required under
N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of
construction of any structures over state-owned submerged lands to determine if such an easement will
be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal
Management, prior to the construction of any new boat slips or other docking facilities authorized under
this permit.
USACE Conditions
23) The applicant has a consent agreement with the U.S. Army Corp of Engineers for the use of disposal
basin AIW_U_0303 to dispose of material from the proposed dredging operation. The spoil island has
been previously divided into thirds with an earthen dam separating the eastern two thirds that is
proposed to be used for this project. The applicant is required to pre -excavate this portion of the
disposal basin to remove 50 percent more volume than what is proposed to be disposed here from the
dredging operation. The applicant proposes to remove 86,382 cubic yards of material via dump truck to
a pre -approved off -site location. This off -site area has not yet been identified. The applicant is required
to identify this site and receive consent to sue this site from the Army Corp of Engineers (Corps) prior to
work occurring under this Nationwide Permit 35.
24) The applicant is required to receive consent from the Corp's Navigation Branch to remove material from
the AIW_U_0303 disposal basin as well as consent to place the project's dredged material on this basin.
These consents must be provided to Corps for approval prior to conducting the work.
25) An As -built dredging survey must be provided the U.S. Army Corp of Engineers office within 2 weeks
of the completion of the dredging operation. This survey must include the location and width and depth
of the areas that has been dredged.
26) Subject to approval by the Navigation Branch, the placement of the discharge pipe shall be extended to
deeper water sufficient to avoid shellfish and SAV habitat areas.
27) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

General
28) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
29) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 35
(Action ID SAW-2008-02610) issued 4/8/20.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2008-1373 v2.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Purpose of the project is to provide sufficient water depths for small vessel passage into community canals by year-round as
well as seasonal residences.

Maintenance dredging will utilize a hydraulic dredge to remove dredge material from the canals and place material in an
existing disposal basin as shown on the attached maps in accordace with all conditions issued as part of the permit.

discharge pipe with a new structure. Vertical spillway riser will consist of a guyed
84" dia. CMP half sphere weir with 36" dia. CMP stubout with anti -seep collar and

Location description: The gronosed project is located within canals located in the Town of Ocean Isle Beach and within
entrance channels connected to the AIW W adjacent to the town. The Town of Ocean Isle Beach is located in Brunswick
County, North Carolina.
Description of project area and activity: The applicant is proposing to dredge eight (8) man-made finger canals and two (2) inlet
canals all of which are connected to the AIWW, at an average of 40 feet wide and to a depth of seven (7) feet below Mean Low
Water Level. Thus. 16.7 acres of the canal system will be dredged resultine in approximately 47, 215 cubic yards of material
removed.

SPECIAL CONDITIONS
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USAGE) prior to implementation.
2. "Off -site Disposal Area"
a) The applicant has a consent agreement with the US Army Corps of Engineers for the
use of disposal basin AIW_U_0303 to dispose of material from the proposed dredging
operation. The spoil island has been previously divided into thirds with an earthen dam
separating the eastern two thirds that is proposed to be used for this project. The
applicant is required to pre -excavate this portion of the disposal basin to remove 50
percent more volume than what is proposed to be disposed here from the dredging
operation. The applicant proposes to remove 86,382 cubic yards of this material via
dump truck to a pre -approved off -site location. This off -site area has not yet been
identified. The applicant is required to identify this site and receive consent to use
this site from the Army Corps of Engineers (Corps) prior to work occurring under
this Nationwide Permit 35.
3. Disposal Basin AIW _U_0303_
a) The applicant is required to receive consent from the Corps' Navigation Branch to
remove the material from the AIW_U_0303 disposal basin as well as consent to place
the project's dredged material on this basin. These consents must be provided to Corps
Regulatory Office prior to undertaking any project construction.
b) No wetlands or waters shall be impacted during the improvements of the dike system
or the construction of the discharge / outfall pipe. Dike improvement designs must be
provided to the Corps for approval prior to conducting the work.
c) Subject to approval by the Navigation Branch, the placement of the discharge pipe
shall be extended to deeper water sufficient to avoid shellfish and SAV habitat areas.
d) The discharge pipe must be installed in a manner to prevent a hazard to navigation in
accordance with Navigation Branch instruction and U.S. Coast Guard regulations.
4. Except as authorized by this permit or any USACE approved modification to this permit,
no dredge, fill, or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project within waters outside the designated permitted
boundary. This permit does not authorize temporary placement or double handling of
excavated or fill material within waters outside the permitted area.

5. Work in wetlands are prohibited during the dredging, placement of pipeline, or use of the
disposal island, or any other aspect of work associated with this project.
6. All dredging will be conducted by hydrauliceline (cutter) dredge and must take place
between November 16 and April 30. 4Y 17, V 1 S
7. All pipeline locations must be located by GPS and submitted to USACE office prior to
installation.
8. No attempt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at, or adjacent to, the authorized work for reason other than safety. No
activity may cause a hazard to navigation.
9. An As -built dredging survey must be provided to our office within 2 weeks of the
completion of the dredging operation. This survey must include the location and width and
depth of the areas that has been dredged.
10. Permittee shall provide a construction schedule to the USACE office (2) weeks in
advance of starting work.
11. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
12. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including all
conditions, shall be available at the project site during construction and maintenance of this
project.
13. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing
or similar appropriate devices around all areas subject to soil disturbance or the movement
of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973.

14. The activity must be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout
waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or
less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout
waters, are not considered significant.
15. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and

Recommendations for State Permit — Town of Ocean Isle Beach
The applicant's proposal to hydraulically dredge approximately 47,215 square feet of shallow bottom in
the Ocean Isle Beach canal system appears to be CONSISTENT with Rules NCAC 07H .0208 (b)(2)
Specific Use Standards for Hydraulic Dredging. This office has no objections to the proposed project.
The spoil disposal site is located adjacent to waters that are open to the harvest of shellfish. Therefore, a

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the
CAMA Major Permit application for proposed actions that impact fish and fish habitats. The Town
of Ocean Isle is proposing to perform maintenance dredging along the canals off of the Intracoastal
Waterway. The total linear footage of the dredging would be 16,562 linear feet and the final dredge
volume would be 47,215 cubic yards of soft bottom sediment. The current average depth is -4 feet
at mean low water (MLW) and the final dredge depth will be -7 feet at M LW. The waters in the area
are classified as SA be the N.C. Division of Water Resources. The area within the dredge footprint
are not classified as primary nursery area (PNA) by the N.C. Division of Marine Fisheries, however,
immediately adjacent to the ends of the canals are designated as PNA. The shorelines of the
"natural canal" areas are connected to coastal wetlands and shellfish habitat. The waters within the
canals are closed to the harvest of shellfish.
PNAs are estuarine waters where initial post -larval development occurs. Species within this area
are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs
because they afford food, protection, and proper environmental conditions during vulnerable
periods of their life history, thus protection of these areas are imperative. Increased sedimentation
raises concern for shellfish and shellfish habitat by either the direct burial of oyster beds or
reductions in filtration efficiency, respiration rates, and/or reproduction and settlement. Larval
oysters require a clean hard bottom for attachment and sedimentation as little as 1 or 2 mm may
inhibit settlement. Duration of sedimentation suspension and water quality degradation has been
shown to result in juvenile oyster mortality. Coastal wetlands are considered among the most
productive ecosystems in the world (NCDEQ 2015). Coastal wetlands are a productive detritus -
based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate
wave and storm action, provides a barrier to flood damage, and provide nursery functions and
support fish production.
For the above -mentioned reasons, the N.C. Division of Marine Fisheries would request that a
moratorium on in -water work, to include dredging, from 1 April to 30 September is recommended
to reduce the negative effects on critical fish life history activities, to include spawning migrations
and nursery functions.

The applicant proposes to perform maintenance dredging on 8 man-made canals and 2
associated entrance channels off of the AI W W to a final depth of -7'@ MLW. The
canals are located in the Town of Ocean Isle Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Ocean Isle Land Use Plan
and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation. ,
In general, the Town of Ocean Isle Beach allows development in Conservation classified
AECs, which is consistent with the State's minimum use standards. The Town of Ocean
Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the Town of Ocean Isle Beach Land Use Plan.

County, North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located between
Causeway Drive and Concord Street as well as between Union Street and Moore Street adjacent to the
AI W W in Ocean Isle Beach, NC. Our comments are provided in accordance with provisions of the
Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of
the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended;
16 U.S.C. 661 et seq.).
The applicant proposes to maintenance dredge the canals between Causeway Drive and Concord Street
and the entrance channels to Union Street and Moore Street. These eight channels have been previously
dredged and are proposed to be dredged to a -7' MLW depth. The average existing depth is -4' MLW for
the 16,562' of canals. The entrance channels are proposed to be dredged to a width of 40' for -7' MLW.
The average existing depth is -5.4' MLW for approximately 1,658'. Material would be mechanically
dredged and placed within 213 of disposal basin AIW_U_0303 per an agreement with the USACE. This
agreement addresses moratoria and management needs. These canals are classified SA HQW by the
Environmental Management Commission. The AIW W in this area is designated a primary nursery area
(PNA) by the NC Division of Marine Fisheries (NCDMF) and is open to shellfish harvesting.
The NCWRC has reviewed the permit application and is familiar with the proposal. Our agency
participated in a NCDEQ seeping meeting where the applicant presented the proposal and received
technical guidance from agencies such as USACE, NCDMF, and Shellfish Sanitation. Therefore, we
understand measures have been taken to minimize impacts to environmental resources for this
maintenance activity and do not object to permit issuance. We support any moratoria and methodologies

Dear Ms. Ivey:
You have our approval, in accordance with the attached conditions and those listed below to
perform maintenance dredging activities in the eight existing man-made canals and the
corresponding entrance channels impacting approximately 1.08 acres of shallow bottom habitat,
as described in your CAMA Major Development Permit application, which was received by the
Division of Water Resources (Division) on December 10, 2019. After reviewing your application,
we have decided that the impacts are covered by General Water Quality Certification Number
4175 (GC 4175).
This Certification allows you to use the General Permit No. 198000291 when issued by the US
Army Corps of Engineers and the CAMA Major Permit when issued by the Division of Coastal
Management. In addition, you should obtain or otherwise comply with any other required federal,
state or local permits before you go ahead with your project including (but not limited to) Erosion
and Sediment Control, Non -discharge, Water Supply Watershed, and stormwater regulations.
Also, this approval to proceed with your proposed impacts or to conduct impacts to waters
as depicted in your application shall expire upon expiration of the 404 or CAMA Permit.
This approval requires you to follow the conditions listed in the attached certification and any
additional conditions listed on the following pages.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee.
2. The applicant shall require his contractors (and/or agents) to comply with all of the
terms of this Certification, and shall provide each of its contractors (and/or agents) a copy
of this Certification.

3. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the Certification
for a speck project shall remain in effect for the life of the project, regardless of the expiration of
this Certification.
4. The applicanUpermitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of State
and Federal law. If the Division determines that such standards or laws are not being met,
including failure to sustain a designated or achieved use, or that State or Federal law is being
violated, or that further conditions are necessary to assure compliance, than the Division may
reevaluate and modify this General Water Quality Certification.
5. All mechanized equipment operated near surface waters shall be inspected and
maintained regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic
fluids, or other toxic materials. Construction shall be staged in order to minimize the exposure
of equipment to surface waters to the maximum extent practicable. Fueling, lubrication and
general equipment maintenance shall be performed in a manner to prevent, to the maximum
extent practicable, contamination of surface waters by fuels and oils. [15A NCAC
02H .0506(b)(3) and (c)(3) and 15A NCAC 02B .0211 (12)]
6. The permittee shall report to the Wilmington Regional Office at (910) 796-7215 (after
hours and on weekends call 800.858-0368) any noncompliance with this certification, any
violation of stream or wetland standards [15A NCAC 02B .0200] including but not limited to
sediment impacts [15A NCAC 02B .0200]. Information shall be provided orally within 24 hours
(or the next business day if a weekend or holiday) from the time the applicant became aware of
the circumstances. A written submission shall also be provided within 5 business days of the
time the applicant becomes aware of the circumstances. The written submission shall contain a
description of the noncompliance, and its causes; the period of noncompliance, including exact
dates and times, if the noncompliance has not been corrected, the anticipated time compliance
is expected to continue; and steps taken or planned to reduce, eliminate, and prevent
reoccurrence of the noncompliance. The Division may waive the written submission
requirement on a case -by -case basis.
Moratoriums
You will comply with any moratoriums per the NC Division of Marine Fisheries and the
NC Wildlife Resources Commission. Dredging moratoriums shall be observed as required
by the NC Division of Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and
National Marine Fisheries. If such activities should take place during periods of high biological
activity (e.g. anadromous species and shorebirds), biological monitoring may be required at the
request of other state and federal agencies and coordinated with these dredging activities.
8. The Permittee shall adhere specially to 15A NCAC 02B .0221 Tidal Salt Water Quality for
Class SA Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range
between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of
natural conditions; (1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; If
turbidity exceeds this level due to natural background conditions, the existing turbidity
level shall not be increased. [15A NCAC 02B .0221]

9. Dredging shall not cause Shellfish Closures. The effluent water from the dredge spoil should
not be released into open shellfish waters. Marine Fisheries Shellfish Sanitation Section and
the Division of Water Resources must be notified if this is to occur.
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable
Buffer Rules, and any subsequent modifications, the applicant and/or authorized agent is required
to return the enclosed certificate of completion form to the NCDENR DWR 401 and Buffers Unit
North Carolina Division of Water Resources, 1617 Mail Service Center, Raleigh, NC, 27699 within
ten days of project completion (the certification of completion is also available at:
hftps:Hedocs.deg.nc.gov/Forms/Certificate-of-Completion).
Violations of any condition herein set forth may result in revocation of this Certification
and may result in criminal and/or civil penalties. The authorization to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application and as
authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested. This Certification can be
contested as provided in Articles 3 and 4 of General Statute 150B by filing a written petition for
an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A
petition form may be obtained from the OAH at htti)://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A

The Corps is likely to process the above permit application under Nationwide Permit No. 35. The Corps (USACE) is
requesting federal agency comments on this permit application by March 2, 2020.
The project site is located within the Town of Ocean Isle Beach just east of the Ocean Isle Bridge, between Causeway
Drive and Concord Street, in Brunswick County, North Carolina. (N 33.889407 W-78.55551).
The applicant is proposing to perform maintenance dredging by a hydraulic dredge on eight (8) man-made canals and
two (2) associated entrance channels off the AIWW to a final depth of-7.0'@MLW. The dredging width in these canal
will be 40 feet wide from center. The total length of dredged canals will be 18, 220 feet. Dredging within the canals does
appear to extend to within the AIWW.
No wetlands are indicated within the limits of the proposed dredging.
The dredged material will be pumped to a Corps disposal spoil island area adjacent to the AIWW called AIW-U-303. The
spoil island has been previously divided into thirds with an earthen dam separating the eastern two-thirds that is
proposed to be used for this project. Due to the current moratorium from using USACE Disposal Areas, the applicant will
be required to pre -excavate the disposal basin to remove 50% more volume than would be anticipated from the
maintenance dredging. The applicant proposes to remove 86,382 cubic yards of high ground material via dump truck to
a pre -approved off -site location that has yet to be determined.
Please see the attached application request, plans dated October 23, 2019, and a location map for more detailed
information concerning the proposed project.
EFH:
This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but is not
likely to adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service.

9. PROJECT DESCRIPTION
The project site consists of eight man-made, "natural" canals and the corresponding entrance channels,
which connect to the Atlantic Intracoastal Waterway (AIWW). The proposed project is located just east
of the Ocean Isle Beach Bridge, between Causeway Drive and Concord Street, in Brunswick County. To
get to the site from Wilmington take US Hwy 17 South approximately 28 miles to Ocean Isle Beach
Road SW. Turn left onto Ocean Isle Beach Road and travel approximately 4 miles to Ocean Isle Beach.
The project site is located on the east side of the NC Highway 904 Causeway as it enters Ocean Isle
Beach from the high-rise bridge crossing of the AIWW.
The high ground surrounding the canal system with the exception of Canal #22, is composed of single-
family residential properties. The high ground adjacent to Canal #22, which is located adjacent to
Causeway Drive, is predominately commercial development. The properties are vegetated primarily with
ornamental plants and lawn grasses. The majority of the shoreline of the canal system is stabilized with
wooded bulkheads with the exception of the entrance channels, which are stabilized with sloped concrete
bulkheads. The majority of the property owners along the canal system have constructed private docking
facilities. The six main canals (Canals # 14-17, #21, #22), each measure approximately 80' to 110' in width
and range from approximately 2000' to 2500' in length and are oriented in a north -south direction running
perpendicular to the AIWW. There are two smaller canals, (Canal #23 & #21A) which measure
approximately 350' in length and run parallel (east -west) to the AIWW, connecting the main portion of
Canal #21 to the "Commercial Canal" (Canal #22). The entrance channel for Canal #8, which measures
approximately 830' in length is located between Union Street and Raeford Street and the entrance channel
for Canal #3, which measures approximately 850' in length is located between Moore Street and
Cumberland Street. Both entrance channels run perpendicular (north -south) to the AIWW and connect the
AIWW to the concrete canals. The average depth of the entrance canals is approximately -5.4' @ MLW
and the remainder of the canals average approximately -4.0' @ MLW. There are coastal wetlands,
predominantly Smooth Cordgrass (Spartina alternii fora), located adjacent to the majority of bulkheads in
the canal system however, they are not within the indicated limits of the proposed dredging project. These
marsh fringes range in width from approximately 0-20'. These canals were originally constructed in the
1960's and previous maintenance dredging permits (State Permit #38-01, #59-96, #133-96, #4-94, #192-
07, and #158-08) have been issued for all areas. The last maintenance dredging of the "natural" canals
was performed in 2012/2013 under CAMA Major Permit # 158-08. This permit expired on December 31,
2014.
The waters of the man-made canals have been classified as SA by the N.C. Division of Water Quality.
The area is not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries
and is Closed to the harvest of shellfish. However, the adjoining waters of the Atlantic Intracoastal
Water is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is
Closed to the harvest of shellfish except for the waters adjacent to the proposed discharge pipe location
into the AIWW which are Open to the harvest of shellfish.
PROPOSEI) PROJECT:
The applicant is proposing to perform maintenance dredging on 8 man-made canals and 2 associated
entrance channels off of the Intracoastal Waterway to a final depth of -7.0' @ MLW.
The Town of Ocean Isle Beach is proposing to dredge the 8 man-made "natural" canals an average of
40' wide from center and an average depth of-7.0' @ MLW. The application states that the average
existing water depth of the 8 "natural" canals is approximately -4.0' @ MLW and the total linear
footage dredged in these canals would be approximately 16,562'. The applicant also proposes to perform
additional maintenance dredging in the two entrance channels. The applicant proposes to dredge the

entrance channels an approximate width of 40' and approximate depth of -7.0' @ MLW. The
application states that the average existing water depth of the entrance canals is approximately -5.4' @
MLW and the total linear footage dredged in the entrance canals would be approximately 1658'.
As proposed, the total combined length of the canals to be excavated is approximately 18,220 linear feet
and would result in approximately 47,215 cubic yards of spoil material. The project would be
accomplished by using a hydraulic dredge and the spoil material would be pumped to the eastern two
thirds of the existing diked spoil disposal area located at the end of Lee Street. The Town has a consent
agreement with the US Army Corps of Engineers for the use of disposal basin AIW_U_0303. The spoil
island has been previously divided into thirds with an earthen dam separating the eastern two thirds that
is proposed to be used in this project. This 2/3 portion of the spoil island designated for use is
approximately 12 acres in size. As proposed, there would be a single discharge pipe located at the
northeastern end of the disposal site. As proposed, the discharge pipe would be discharging into currently
OPEN shellfish waters of the AIW W. Due to the current moratorium for using USACE Disposal Areas,
the applicant would be required to pre -excavate the disposal basin to remove 50% more volume than
would be anticipated for the proposed maintenance dredging. The applicant proposes to remove 86,382
cubic yards of high ground material via dump truck to a preapproved off site location that has yet to be
determined.
10. ANTICIPATED IMPACTS
Approximately 47,215 square feet of shallow bottom in the Ocean Isle Beach canal system would be
dredged as a result of this project. The dredging would result in temporary increased turbidity in the project
area. Provided the work is done in the winter during a lower biological activity period, no other long term
adverse impacts would be expected.
Approximately 525,000 square feet (approximately 12.052 acres) of high ground would be filled within
an existing spoil site. Sediment control devices would be necessary around the spoil disposal area until
disturbed areas have been stabilized with vegetation sufficient for erosion control.

Background
The small boat access "natural" canals, located off of the AIWW, the entrance canals to the "concrete"
canals from the AIWW and the commercial canal & residential "natural" canals, located to the east of
the causeway in the Town of Ocean Isle Beach, NC ("Town") and which were created in the 1960's,
have shoaled since their previous maintenance dredging was performed in 2012/2013, especially in
the heads of these canals as well as at the entrance canals where normal traversing tides flow across
the mouths and have deposited materials.
Over the years since the previous dredge cycle, moderate shoaling has occurred due to the low tidal
flow within the canals along with some surface runoff, resulting in inadequate draft depths in areas
along these canals. This project proposes to accomplish maintenance dredging in these canals in the
same footprint of the previously CAMA Major permitted maintenance dredging events.
The Town has an established special tax district for continued dredging of their "concrete" and
"natural" canal systems, performed on a 5-year maintenance dredge cycle.
The last maintenance dredging of these canals was performed in 2012/2013 under CAMA Major
Permit #158-08, which had an extended expiration date of December 31, 2014.
Project Description
The maintenance dredging project proposes to use a hydraulic pipeline dredge to remove
approximately 47,215 CY of dredge spoil material from approximately 19,260 linear feet of the above
referenced canals as shown on the maps contained in this application package. Canals are proposed
to have a project dredge depth of -6.0 MLW and a permitted dredge depth of -7.0 MLW to allow for no
more than 12" of overcut.
All materials excavated will be pumped to the western two thirds of the USACE's existing dredge
disposal area (DA 303), located at the end of Lee Street, which was last utilized during maintenance
dredge events in 1996/1997 and 2001/2002. Previous maintenance dredge events in 2007/2008
and in 2012/2013 utilized the USACE's disposal area DA 306, located west of the bridge.
Pipeline corridors will be established to ensure that no marsh areas or sensitive vegetation is
disturbed. Also, dredge prisms have been shown based on the previously shown permits and notes
are on drawings to bring any possibly affected marsh areas or sensitive vegetation within the dredge
prism to the attention of the Contractor and Engineer. All dredging will be performed during the months
of November thru March when biological life in the surrounding waters will be at a minimum.
An updated bathymetric survey was performed In April of 2019 in order to ensure accurate
maintenance dredge volume quantities for the project.

Due to the current moratorium for using USACE Disposal Areas, the Town has successfully negotiated
the use of DA 303, which would involve pre -excavation of DA303 prior to maintenance dredging to
remove 50% more volume than is anticipated for this maintenance dredging project. The CAMA Major
permit along with the USACE's initial Consent Agreement would be used to perform this pre -excavating
& disposal of the existing material in DA303 in an off -site, high -ground disposal area. Installation of a
new effluent discharge structure would also be performed at this time.
Contingent upon post -excavation surveys, a USACE Consent Agreement along with the requested CAMA
Major permit would be issued for the normal maintenance dredging of the "natural" canals as with
past projects.
Environmental Impacts
Since the maintenance dredging will be performed during minimal activities of biological life, it is our
professional opinion that environmental impacts resulting from the dredging activities proposed in this
project, in general, will be relatively minimal. All of the canal bottoms consist of sand, sediment and
detritus and have had maintenance dredging performed during the years as stated above as well as
earlier dates. With this maintenance project being directly related to previously approved CAMA Major
Permits as far as meeting the permit requirements as well as performed within limitations of previously
approved contract documents, this project is in compliance with the North Carolina Environmental
Policy Act.
Adjacent Riparian Property Owners Notification
All property owners adjacent to the canals in the maintenance dredging project will be notified by the
Town of Ocean Isle Beach about the maintenance dredging project and an application will be on file
for their review and comment at the Town Hall.

All materials excavated will be pumped to the western two-thirds of the USACE's existing dredge disposal area
(DA 303), located at the end of Lee Street, which was last utilized during maintenance dredge events in
1996/1997 and 2001/2002.
Pipeline corridors will be established to ensure that no marsh areas or sensitive vegetation is disturbed. All
dredging will be performed during the winter season when biological life in the surrounding waters will be at a
minimum.
It is our opinion that any environmental impacts, resulting from the dredging activities proposed in this
maintenance dredging project, should be relatively minimal, since the dredgingwill be performed during minimal
activities of biological life. Much of the canal bottoms to be dredge consist of sand, sediment and detritus and
have been previously dredged.

This letter of consent is to request permission to use the dredge disposal area USACE AIW U 0303
for our 2019-2020 Maintenance Dredging Project of the "Natural" Canal located north of Lee Street.
As part of our Consent Agreement with the US Army Corps of Engineers who possesses easement
rights for the upland area, we are required to obtain permission from the property owner(s) of the
underlying area.
As an underlying property owner for the US Army Corps of Engineer's Disposal basin, we hereby
request your consent to utilize these disposal areas for our project. In the event that the bulkhead
along the above -referenced parcel is directly damaged by the removal and disposal of material, we
agree to be responsible for the repairs to said bulkhead necessitated by said project.
Due to US Army Corps of Engineer's moratorium on additional disposal at this site, we are first
proposing the removal of existing material from this disposal area. With approximately 150% of the
anticipated dredged material removed, the newly dredged material will then be disposed of at this
location. Once the dredge material has decanted, this material will then be removed, leaving an
overall decrease of material.
Please indicate your acceptance below and return in the envelope provided. We thank you for your
time and permission regarding this project.

Dear Mr. Troutman:
The Division of Coastal Management hereby acknowledges receipt of your application, acting as
agent for the Town of Ocean Isle Beach for State approval for maintenance dredging of canals,
adjacent to the Atlantic Intracoastal Waterway, in Ocean Isle Beach, Brunswick County, NC. It
was received complete on November 12, 2019 and appears to be adequate for processing at this
time. The projected deadline for making a decision is January 26, 2020. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 12, 2019 you
may request a meeting with the Director of the Division of Coastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days from
the receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
