This permit, issued on November 12, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
Ir mese terms may ne subject to tines, Imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the additional boatlift and uses located in or over the water that are
expressly and specifically set forth in the permit application. No other structure, whether floating or
stationary, shall become a permanent part of this docking facility expansion without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) This permit authorizes 1 additional formalized boat slip for a maximum of 5 formalized boat slips.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
7) Should the property to the east of the applicant be sold prior to the initiation of construction of the
docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the
minimum setback, and authorizing to construct of a portion of the docking facility within the property
owner's riparian setback, and submit this authorization to the Division of Coastal Management prior to
initiating construction of the docking facility.
General
8) This permit shall not be'assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) The pennittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
11) All debris associated with this development must be contained within the authorized project area. The
permittee shall be responsible for the immediate removal of any displaced debris, trash, or litter
associated with the project site.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2020-01633).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1668.

RECOMMENDATIONS FOR 11 Point Place, Alex Thorpe 9111/2020
It is the staffs recommendation that the applicant's proposal to build a new boat lift at 11 Point Place is CONSISTENT with
the standards set forth in 15A NCAC 07H. 1200.
Shoreline length = 60' x 8' = 480 ft2 (maximum allowable)
Pier = 6' x 46' = 276 ft2 (credit)
Fixed platform =10' x 16' =160 ft2
Floating dock = 8' x 40' = 320 ft2
Boatlift = 13' x 13' = 169 ft2 (not counted)
Proposed boatlift = 8' x 8' =64 ft2 (not counted)
TOTAL = 480 ft2
The proposed construction will result in 64 ft2 in additional incorporated waters but will not count towards additional platform
space.
It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the
pierhead line, the eight -square foot rule and the pier width rule. This office has no objection to the proposed work, provided
it is consistent with all other local, state, and federal permitting requirements. Any permit issued should include standard
conditions for private docking facilities.

Special Condition: In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant
must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The
guidelines can be found at http://www.fws.gov/ne-es/mammal/manatee_guidelines.pdE

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
permit application and drawings dated August 10, 2020. Any violation of the attached conditions or deviation from your
submitted plans may subject the permittee to a stop work order, a restoration order, a Class I administrative penalty, and/or
appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide and/or regional general permit
authorization is modified, suspended or revoked. If, prior to the expiration date identified below, the nationwide and/or regional
general permit authorization is reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or regional general permit
authorization expires or is suspended, revoked, or is modified, such that the activity would no longer comply with the terns and
conditions of the nationwide permit, activities which have commenced (i.e., are under construction) or are under contract to
commence in reliance upon the nationwide and/or regional general permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide and/or regional general permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case -by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You

A. Determination of Jurisdiction:
1. ❑ There are waters, including wetlands, on the above described project area that may be subject to Section 404 of the Clean
Water Act (CWA) (33 USC § 1344) and/or Section 10 of the Rivers and Harbors Act (RHA) (33 USC § 403). This preliminary
determination is not an appealable action under the Regulatory Program Administrative Appeal Process (Reference 33 CFR Part
331). However, you may request an approved JD, which is an appealable action, by contacting the Corps district for further
instruction. Please note, if work is authorized by either a general or nationwide permit, and you wish to request an appeal of an
approved JD, the appeal must be received by the Corps and the appeal process concluded prior to the commencement of any
work in waters of the United States and prior to any work that could alter the hydrology of waters of the United States.

This project is consistent with the Wrightsville Beach Land Use Plan Update.
The applicant proposes to expand an existing docking facility by installing an 8 ft. x 8 ft.
boat lift on the east side of the existing docking facility for a total of 5 boat slips. The
project is located at I I Point Place Drive in Wrightsville Beach.
Areas of Environmental Concern (AEC's) impacted by the proposal are PT and EW.
Waters at the project site are classified as SB and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Wrightsville Beach Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Low Density Residential.
In general, the Wrightsville Beach Land Use Plan contains policies, which allows
development in Low Density Residential classified AECs, which is consistent with the
State's minimum use standards. The Wrightsville Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards. However, none of these
policies appear to be applicable to this project.
This project is consistent with the Wrightsville Beach Land Use Plan Update.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application request
dated received by this office on September 16, 2020. DWR issues approval in the form of a Water
Quality Certification (WQC) in conjunction with the CAMA Major Permit and General Permit(s)
198000291 or 197800056 issued by the US Army Corps of Engineers (USACE). This Certification
allows you to use the CAMA Major Permit when the Division of Coastal Management issues it
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply with
any other federal, state and local requirements before you go ahead with your project including (but
not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby
known as OAH). A petition form may be obtained from the OAH at http://www.ncoah.com/ or by

9. PROJECT DESCRIPTION
The project site is located at 11 Point Place, on Motts Channel, in the town of Wrightsville Beach, in New Hanover
County. To locate the project site from the Wilmington Regional Office (WiRO), travel east approximately 3.0 miles
on Eastwood Rd towards Wrightsville Beach. Cross the drawbridge and take a right at Live Oak Drive before
crossing the bridge over Banks Channel. Travel approximately 0.27 miles through the traffic circle, turn left onto
S.Channel Drive, in approximately 125 feet take a right onto Point Place, the property is the second home on the
right.
Currently, the property has a 4-slip private docking facility and bulkhead. The normal high water (NHW) boundary
comes up to the existing bulkhead which is approximately 60 feet in length and ties into existing bulkheads at both
the eastern and western neighboring properties. The existing docking facility consists of a 6' by 30' access pier
extending waterward to the southwest from the edge of the bulkhead. The 30' pier section terminates at a 16' by 16'
(256 sgft) L-head platform. A ramp extends from the 16' by 16' platform to an 8' by 40' floating dock, oriented
perpendicular to the shoreline with an existing 13' by 13' boat lift located on the western side with water depths of
approximately -7 ft. mean low water (MLW) at the waterward end of the existing structure (see Sheet 1 of 2).
A docking facility at this property was authorized on June 1, 1972 by the Town of Wrightsville Beach. The docking
facility in the current configuration was permitted under General Permit No.15779 on January 24,1996. In 2007 the
construction of a new bulkhead waterward of the existing bulkhead was authorized by General Permit No. 51931 on
December 4, 2007. Various exemptions to replace/repair docking components have been issued in recent years.
Elevation at the site averages approximately 5'-8' above normal high water (NHW)The high ground portion of the
property contains ornamental grasses and landscaping up to the existing bulkhead that extends directly into open
water. The Town of Wrightsville Beach Land Use Plan classifies the area in the vicinity of the project area as Low
Density Residential. The waters in the project area are classified as SB by the N.C. Division of Water Resources.
They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are
closed to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to install an 8ft. by 8ft. boat lift on the east side of the existing docking facility for a total of 5
boat slips. The new boat lift would be installed adjacent to the fixed platform, approximately 38 ft, waterward of the
existing bulkhead, within the applicant's riparian corridor (see Sheet 1 of 2).
10. ANTICIPATED IMPACTS
As proposed, the new boat lift would result in the incorporation of approximately an additional 64 ft2 of Public Trust
Area and Estuarine Waters. The project area consists of open water, and there would be no impact to vegetated
wetlands or to the high ground area. The application states that the constructed features encroach approximately
three feet into the adjacent 15' riparian corridor setback from the property to the east, 9 Point Place. A waiver was
provided by the applicant signed by the property owner of 9 Point Place waiving the 15' setback requirement. No
encroachment of the15' riparian set back from the property to the west is anticipated. Additionally, no aQQ�d,r,,b
beyond established pierhead line is proposed. There appear to be no SAV present in the project area. Mlnor�lu
increases in turbidity should be expected during project construction.

Thorpe, for State approval for development of the subject property located at 11 Point Place, adjacent to Motts
Channel, in Wrightsville Beach, in New Hanover County. It was received as complete on September 8, 2020 and
appears to be adequate for processing at this time. The projected deadline for making a decision is November 22,
2020. An additional 75-clay review period is provided by law when such time is necessary to complete the review. If
you have not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 8, 2020, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
