This permit, issued on October 7, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facilities
1) This permit authorizes only the rebuild of the existing pier and the construction of the second pier
and two boat lifts, and kayak launch, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating
or stationary, shall become a permanent part of these docking facilities without permit modification.
No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters
without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facilities. Any sewage discharge at the docking facilities shall be considered a violation of
this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for. compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit authorizes 2 additional formalized boat lift slips at the second docking facility for a
maximum of 4 formalized boat slips at these docking facilities.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
Shoreline Stabilization — Rip Rap
7) The alignment of the toe of rip rap sections shall not exceed the alignment as depicted in the attached
permit application and workplan drawings.
8) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
9) The alignment of the authorized rip rap sections shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum of 30 days prior to the new expected start of construction.
10) The rip rap shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or
broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by
wave or current action.
General
11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
12) All debris associated with the removal or construction of the permitted development shall be contained
within the authorized project area and removed to an appropriate upland location
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

ADDITIONAL CONDITIONS
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2020-01273).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0946.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations
in place at the time of such development
NOTE: An application processing fee of $400 was received by DCM for this project.

MEMORANDUM
Marshall Taylor has submitted a CAMA Major Permit application for his property
located off SR 1110 at 190 Freshwater Drive near Blounts Creek, NC in Beaufort County, North
Carolina. The applicant proposes to install two sections of riprap with a 5 ft. base totaling 600'
linear feet of shoreline. The applicant also proposes to rebuild an existing 90 ft. pier and install a
new 100 ft. pier upstream of the existing, with as 8x16 ft. floating dock at the end with two 13X13
ft. boat lifts. This would give Mr. Marshall a total of 4 slips.
I have reviewed the proposed project with regard to rules found in Subchapter 7H
concerning development in a Public Trust Area. It is staffs recommendation that the
proposed project is consistent with 15A NCAC 07H .0208 as described below.
This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B)
which states in part that "The total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with
a maximum of 2,000 square feet" The applicant has +-3500 linear feet of shoreline which
provides a maximum shaded impact of 2,000 ft2. The applicant is proposing a total 1128 ft'
of shaded impact, excluding the existing pier.
This office also feels the placement of the riprap is consistent with 15A
NCAC .07H.1105 (g) which states "Construction design for riprap revetments shall take into
consideration the height of the area to protect and the alignment shall allow for a slope no
flatter than three feet horizontal per one -foot vertical and no steeper than 11h feet horizontal
per one foot vertical".

1. No attempt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land development and
land use activities comply with the requirements of the Tar -Pamlico Buffer Rule, unless located in the
exempted or allowed areas (see policy 2.1.5), and that development meets the Beaufort County Flood
Damage Prevention Ordinance (see policy 2.2.3).
Overview: The project location is 190 Freshwater Dr., Blounts Creek, Beaufort Co. The parcel is
approximately 168-acre site has approximately 5,000' of shoreline along Blounts Creek. One single family
dwelling is located within the high ground area of the property, along with barns and fencing. The majority
of the lot is in various hardwood trees, pines, shrubs and lawn. Most of the property is+- 25' above normal
water level (NWL). There is an existing 90' pier, with 2 wet slips, that leads to a gazebo. The water depth
and the end of the pier is approximately -5.5' below NWL. The shoreline to the north of the pier is
stabilized by an existing+- 200' bulkhead. There is an area of shoreline approximately 400' in length, being
undercut south or upstream of the existing pier.
The proposed project includes rebuilding the existing 90' pier leading to the gazebo, as well as build a new
pier upstream and parallel of the existing pier. The new pier is proposed to be 100' X 6' with (2)13'X 13'
uncovered boat lifts off each side at the end. A 16'X8' floating pier will be attached landward of the lifts.
The project also includes two sections of riprap with a 5' max base. One area is a 400' section waterward
of the eroding section of shoreline upstream of the pier. The other section is 200' and proposed to be
waterward of the existing bulkhead.
AECs involved include: Public Trust Area and Public Trust Shoreline. The project is located within in Tar -
Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. Blounts Creek is classified as C; SW NSW,

is not a Primary Nursery Area, and is closed to shellfishing. There was no SAV observed onsite. The site is
in Special Flood Hazard Area AE (EL5.2) according to the Beaufort County FIRM (Map # 3720660000K Panel
6600). A review of 404/Costal Wetlands and archaeological/cultural resources in the area was not
provided.
Anticipated impacts resulting from this project are expected to include: the filling of ±3,000 ft2 of non -
vegetated wetlands, creek bottom and shading of ±1,066 ft' of non -vegetated wetlands, creek bottom.
The installation of the pier, boat lifts and riprap will create localized turbidity.
Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Transition, Conservation I (water protected by Tar -Pam Buffer), and
Conservation 11 (100-year flood plain).
The following LUP policies may be applicable to this request:
2.1 Conservation I
2.1.3 Only development and land/water use activities that are consistent with the use standards for
coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this
classification. Permitted extractive uses in the Aurora area will continue.
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259).
2.2 Conservation II
2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the
public trust shoreline AEC (15A NCAC 07H .0209(d) is allowed.
2.2.3 Development in any flood hazard zone delineated on a Beaufort County FIRM or in an area that is
subject to storm inundation as illustrated on Beaufort County storm surge maps must meet the location
and construction requirements of the Beaufort County Flood Damage Prevention Ordinance.

Reference the application of Marshall C. Taylor for a Department of the Army permit to
install riprap material, replace an existing pier, and add new boat lifts, on property located at 190
Freshwater Drive, adjacent to Blounts Creek, near the Community of Blounts Creek, in Beaufort
County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
3. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
4. The permittee shall require its contractors and/or agents to comply with the terms and

conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
5. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
6. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.

You have our approval for the impacts listed below for the purpose described in your application received by the Division of Water Resources
(Division) on July 21, 2020. These impacts are covered by the attached Water Quality General Certification Number 4175 and the conditions
listed below. This certification is associated with the use of Regional General Permit Number 291 once it is issued to you by the U.S. Army Corps
of Engineers. Please note that you should get any other federal, state or local permits before proceeding with your project, including those
required by (but not limited to) CAMA Major, Sediment and Erosion Control, Non -Discharge, and Water Supply Watershed regulations.

3. No Waste, Spoil. Solids or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in
the Buffer Authorization Application. All forestry operations activities shall be performed so that no violations of state water quality
standards, statutes, or rules occur 115A NCAC 02H .0502 and .0502).
4. The Permittee shall replant the vegetation within temporarily disturbed areas associated with this project in an "in kind" manner
immediately following construction. (Example: Disturbed areas with pre-existing grassed lawns must be replanted with grass. Disturbed
areas with pre-existing trees or woody vegetation must be replanted with trees and woody vegetation. Disturbed areas with pre-
existing forest vegetation must be replanted with forest vegetation including at least two different native hardwood tree species at a
density sufficient to provide 260 trees per acre at maturity. This density can usually be achieved by planting approximately 360 (11 x 11
spacing) to 538 (9 x 9 spacing) trees per acre.) Restoration of trees/shrubs/forest must be completed by the first subsequent planting
season (November 1 through March 30), Note, if the tree plantings do not survive, they will need to be replaced such that the density is
sufficient to provide 320 trees per acre at maturity. [35A NCAC 02H .0507 (c), 15A NCAC 02H .0506 (b)(3), and 15A NCAC 0213.0714 (6)]

The permittee shall report to the Washington Regional Office any noncompliance with this certification, any violation of stream or
wetland standards [35A NCAC 02B .0200) including but not limited to sediment Impacts, and any violation of state regulated
riparian buffer rules (15A NCAC 02B .0200]. Information shall be provided orally within 24 hours (or the next business day if a
weekend or holiday) from the time the applicant became aware of the circumstances. A written submission shall also be
provided within 5 business days of the time the applicant becomes aware of the circumstances. The written submission shall
contain a description of the noncompliance, and its causes; the period of noncompliance, including exact dates and times, if the
noncompliance has not been corrected, the anticipated time compliance is expected to continue; and steps taken or planned to
reduce, eliminate, and prevent reoccurrence of the noncompliance. The Division may waive the written submission requirement
on a case -by -case basis.
7. This approval and their conditions are final and binding unless contested. [G.S.143-215.5]
These Certifications can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a written petition for an administrative

Mr. Taylor has submitted a CAMA Major Permit request for shore line development on his
property located at 190 Freshwater Dr. on Blounts Creek in Blounts Creek, NC., Beaufort Co. The Lot
consist of+- 168 contiguous acres with approximately 5000' of shoreline along Blounts Creek. One single
family dwelling is located within the high ground area of the property, along with barns and fencing. The
majority of the lot is in various hardwood trees, pines, shrubs and lawn. Most of the property is +- 25'
above normal water level (NWL). There is an existing 90' pier, with 2 wet slips, that leads to a gazebo.
The water depth and the end of the pier is approximately -5.5' below NWL. The shoreline to the north of
the pier is stabilized by an existing +- 200' bulkhead. There is an area of shoreline approximately 400' in
length, being undercut south or upstream of the existing pier.
Adjacent downstream property is undeveloped woodland and farmland. The adjacent property
upstream is an undeveloped wooded subdivision lot.
Blounts Creek is classified as C; SW NSW by the Environmental Management Commission.
Blounts Creek is designated as inland waters and is in the Tar -Pam River Basin. No SAV was observed on
the site visit on July 9, 2020.
Project description:
The applicant proposes to install two sections of riprap with a 5' max base. One area is a 400'
section waterward of the eroding section of shoreline upstream of the pier. The other section is 200'
and proposed to be waterward of the existing bulkhead. The applicant also proposes to rebuild the
existing 90' pier leading to the gazebo, as well as build a new pier upstream and parallel of the existing
pier. The new pier is proposed to be 100' X 6' with (2)13'X 13' uncovered boat lifts off each side at the
end. A 16'X8' floating pier will be attached landward of the lifts.
Anticipated impact:
The project will create localized turbidity from installing the pier and boatlift pilings. The project
will have a total platform square footage of 728 square feet and 338 square feet of boat lift area. The
existing pier has 400 square feet of platform in the gazebo. New platform total after installation of
second pier will be 1128 square feet. The installation of the 2 boatlifts will bring the total number of
slips to four (4). Riprap installation will also produce localized turbidity and impact approximately 3000
square feet of shallow bottom.

2. Build new 100 ft. by 6 ft. wide pier with 13 ft. by 13 ft. boat lifts on either side at the
end ... eastward and parallel to the existing pier.
3. Floating pier (8 ft. by 16ft.) inland from the boat lifts.
4. Rip Rap
a. Westward at the base of the existing bulkhead ((-200 ft.)
b. Southward along the undermined shore line (#400 ft.)
All structures will be for the exclusive use of the Taylor family. The construction method
will be traditional marine construction. Equipment used will be backhoe, excavator with
vibratory hammer on barge.

The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval for development of your property located off SR 1110 at 190 Freshwater
Drive in Blounts Creek in Beaufort County, North Carolina. It was received on 23 June 2020,
and appears to be adequate for processing at this time. The projected deadline for making a
decision is 06 September 2020. An additional 75-day review period is provided by law when
such time is necessary to complete the review. Ifyou have not been notified of a final action
by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day. Kent Vaughan, Field
Representative for the Division of Coastal Management is responsible for processing your

If this agency does not render a permit decision within 70 days from 23 June 2020, you
may request a meeting with the Director of the Division of Coastal Management and permit

developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, orat a pointalong the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. 113A-I 19(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 23 June 2020. According to the said application submitted by Marshall Taylor
proposes to replace existing pier, add a new pier adjacent to existing boatlifts and install riprap.
A copy of the entire application may be examined or copied at the office of Kelly Spivey,
District Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC,
during normal business hours. Public comments received by 14 August 2020 will be considered.
Later comments will be accepted and considered up to the time of permit decision. Project
modifications may occur based on further review and comments. Notice of the permit decision in
this matter will be provided upon written request.

Permit Number
Issued to Marshall C. Taylor, authorizing development In the Estuarine Shoreline (AEC) at a property located
off SR1110 adjacent to the Freshwater Subdivision In Beaufort County, as requested in the permittee's
application, dated 15 March 2005. This permit, Issued on 7 April 2005, is subject to compliance with the
application and site drawing (where consistent with the permit), all applicable regulations and special
conditions and notes set forth below. Any violation of these terms may subject permittee to a fine,
imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Marshall C. Taylor to reduce the site elevation from t25' down to tl5' along t233' of
shoreline and create a slope down to the existing bulkhead to stabilize the lot to provide a suitable building site
on the property.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 7 April 2005.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal
regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-
evaluation and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 252-948-3950 for a final
inspection at completion of work. The issuance of a Certificate of Occupancy is dependent upon satisfactory
completion of a final inspection.
(5) An unconsolidated material resulting from associated grading and landscaping shall be retained on site by
effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of
filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until
such time as the area has been properly stabilized with a vegetative cover.
(6) Any proposed for grading within the 30' buffer from the Normal Water Level must be contoured to prevent
additional storm water runoff to the adjacent marsh. This area shall be immediately vegetadely stabilized, and
must remain in a vegetated state.
(7) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
This permit action may be appealed by the pennlltee or
other qualified persons within twenty (20) days of the issuing date.
From the date of an appeal, any work conducted under this permit
must cease until the appeal is resolved.
This permit must be on the project site and accessible to
the permit officer when the project Is inspected for compliance. Any
maintenance work or project modification not covered under this
permit, require further written permit approval. All work must cease
when this permit expires on
7 APRIL 2008,
In Issuing this permit it is agreed that this project is
consistent with the local Land Use Plan and all applicable
ordinances. This permit may riot be transferred to another party
without the written approval of the Division of Coastal Management.
