Taylor, 218 Riverside Dr., Washington, NC 27889 Authorizing development in Beaufort County at adj. to Blounts Creek, at 190 Freshwater Dr.. in Blounts Creek , as requested in the permittee's application dated 6/23/20, including attached workplan drawings (4), Pages 1-4 of 4 all dated 6/23/20. This permit, issued on October 7, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facilities 1) This permit authorizes only the rebuild of the existing pier and the construction of the second pier and two boat lifts, and kayak launch, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of these docking facilities without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facilities. Any sewage discharge at the docking facilities shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for. compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Taylor ADDITIONAL CONDITIONS Permit No. 99-20 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes 2 additional formalized boat lift slips at the second docking facility for a maximum of 4 formalized boat slips at these docking facilities. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Shoreline Stabilization — Rip Rap 7) The alignment of the toe of rip rap sections shall not exceed the alignment as depicted in the attached permit application and workplan drawings. 8) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 9) The alignment of the authorized rip rap sections shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within a maximum of 30 days prior to the new expected start of construction. 10) The rip rap shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. General 11) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 12) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. yww Marshall C. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0946. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico River buffer regulations in place at the time of such development NOTE: An application processing fee of $400 was received by DCM for this project. It is staffs recommendation that the proposed project is consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a maximum of 2,000 square feet" The applicant has +-3500 linear feet of shoreline which provides a maximum shaded impact of 2,000 ft2. Overview: The project location is 190 Freshwater Dr., Blounts Creek, Beaufort Co. The parcel is approximately 168-acre site has approximately 5,000' of shoreline along Blounts Creek. One single family dwelling is located within the high ground area of the property, along with barns and fencing. The majority of the lot is in various hardwood trees, pines, shrubs and lawn. Most of the property is+- 25' above normal water level (NWL). There is an existing 90' pier, with 2 wet slips, that leads to a gazebo. The water depth and the end of the pier is approximately -5.5' below NWL. The shoreline to the north of the pier is stabilized by an existing+- 200' bulkhead. There is an area of shoreline approximately 400' in length, being undercut south or upstream of the existing pier. The proposed project includes rebuilding the existing 90' pier leading to the gazebo, as well as build a new pier upstream and parallel of the existing pier. The new pier is proposed to be 100' X 6' with (2)13'X 13' uncovered boat lifts off each side at the end. A 16'X8' floating pier will be attached landward of the lifts. The project also includes two sections of riprap with a 5' max base. One area is a 400' section waterward of the eroding section of shoreline upstream of the pier. The other section is 200' and proposed to be waterward of the existing bulkhead. AECs involved include: Public Trust Area and Public Trust Shoreline. The project is located within in Tar - Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. Anticipated impacts resulting from this project are expected to include: the filling of ±3,000 ft2 of non - vegetated wetlands, creek bottom and shading of ±1,066 ft' of non -vegetated wetlands, creek bottom. The installation of the pier, boat lifts and riprap will create localized turbidity. Basis for Determination: The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land Use Map (FLUM) classifies the site as Transition, Conservation I (water protected by Tar -Pam Buffer), and Conservation 11 (100-year flood plain). The following LUP policies may be applicable to this request: 2.1 Conservation I 2.1.3 Only development and land/water use activities that are consistent with the use standards for coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this classification. Project settin¢: Mr. Taylor has submitted a CAMA Major Permit request for shore line development on his property located at 190 Freshwater Dr. on Blounts Creek in Blounts Creek, NC., Beaufort Co. The Lot consist of+- 168 contiguous acres with approximately 5000' of shoreline along Blounts Creek. One single family dwelling is located within the high ground area of the property, along with barns and fencing. The majority of the lot is in various hardwood trees, pines, shrubs and lawn. Most of the property is +- 25' above normal water level (NWL). There is an existing 90' pier, with 2 wet slips, that leads to a gazebo. The water depth and the end of the pier is approximately -5.5' below NWL. The shoreline to the north of the pier is stabilized by an existing +- 200' bulkhead. There is an area of shoreline approximately 400' in length, being undercut south or upstream of the existing pier. Adjacent downstream property is undeveloped woodland and farmland. The adjacent property upstream is an undeveloped wooded subdivision lot. Blounts Creek is classified as C; SW NSW by the Environmental Management Commission. Blounts Creek is designated as inland waters and is in the Tar -Pam River Basin. No SAV was observed on the site visit on July 9, 2020. Project description: The applicant proposes to install two sections of riprap with a 5' max base. One area is a 400' section waterward of the eroding section of shoreline upstream of the pier. The other section is 200' and proposed to be waterward of the existing bulkhead. The applicant also proposes to rebuild the existing 90' pier leading to the gazebo, as well as build a new pier upstream and parallel of the existing pier. The new pier is proposed to be 100' X 6' with (2)13'X 13' uncovered boat lifts off each side at the end. A 16'X8' floating pier will be attached landward of the lifts. Anticipated impact: The project will create localized turbidity from installing the pier and boatlift pilings. The project will have a total platform square footage of 728 square feet and 338 square feet of boat lift area. The existing pier has 400 square feet of platform in the gazebo. New platform total after installation of second pier will be 1128 square feet. The installation of the 2 boatlifts will bring the total number of slips to four (4). Riprap installation will also produce localized turbidity and impact approximately 3000 square feet of shallow bottom.
