This permit, issued on December 17, 2020 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )i tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the demolition of the existing docking facility and the construction of the docks, piers, boat lifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Margaret Taylor ADDITIONAL CONDITIONS Permit No. 120-20 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes a maximum of four (4) formalized boat slips. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 8) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity of the permitted structure and the safety of moored boats. The permittee shall not hold the state of North Carolina or the United States liable for any such damage. 9) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. 10) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required, upon.due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. USACE Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. General 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Margaret Taylor ADDITIONAL CONDITIONS Permit No. 120-20 Page 3 of 3 13) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2001-01065). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1675. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal high water level unless specifically exempted by Environmental Management Commission's (EMC) Neuse River buffer regulations in place at the time of such development. DAVIS Director SUBJECT: Comments and Recommendations - CAMA Major Permit —Margaret Taylor, Carteret County The following is my assessment and consequent recommendations of the above referenced proposal: This proposal incorporates 3,744 square feet of Public Trust waters. The proposal is adjacent to a Federal Channel. These waters of the Adams Creek ICW are closed to shellfish harvest. This waterbody is not a Primary Nursery Area. This area is subject to the Neuse River Basin Riparian Buffer Rules. Assuming other state and federal agencies concur, the Morehead City District staff recommends that the project be authorized with the following conditions: 1) This permit authorizes only the docks, piers, and other strictures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this marina/docking facility without permit modification. No non -water dependent uses of strictures may be conducted on, in or over public trust waters without permit modification. 2) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee will not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 3) This permit authorizes a maximum of four boat slips. At no time shall more than four vessels be moored or docked at the facility. Overview: The property is located adjacent to the Adams Creek ICW at 786 Sea Gate Drive near Newport, Carteret County. This property is currently developed with a bulkhead, docking facility, rip rap, and a residential dwelling. This property is located within the Neuse River basin. The elevation of the adjacent high ground of the parcel is approximately 15' above the normal water level (NWL). Vegetation on the parcel mainly consists of lawn grasses. There are no Coastal Wetlands within the project area. The parcel has 199' of continuous shoreline along Adams Creek. Immediate offshore water depths adjacent to the parcel range from -3' to -11' normal water level (NWL). The subaqueous substrate is firm with shell. Areas of Environmental Concern (AECs) in the project area are Estuarine Waters, and Public Trust Areas. The project is located adjacent to Adams Creek ICW and is approximately 470' across at this location. This project is located near a Federal Channel, approximately 21' landward of the ICW channel setback. The waterbody is classified as SA; HOW; Nutrient Sensitive Waters, is not a Primary Nursery Area and is closed to shellfish harvest. Submerged aquatic vegetation was not observed and there are no cultural resources. This parcel is subject to the Neuse River Riparian Buffer Rules. The applicant is proposing to expand an existing private docking facility by replacing the existing 2-slip docking facility with a 4-slip docking facility. This expanded docking facility would extend 52' waterward of the shoreline. The proposed pier access would be 6' by 24' and would connect to a 12' by 32' floating platform that would be parallel.to the'shoreline. Two 6' by 32' finger piers would be on either end of the floating platform, also parallel to shore. Each finger pier would support access to boat lifts on each side, totaling four proposed boat slips. The proposed docking facility would usurp 3,744 square feet of Public Trust Area. Traditional marine construction methodology will be utilized during the construction of this project. Turbidity impacts are not anticipated during the construction activities in Adams Creek. Basis for Determination: The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as Rural and Conservation due to the sites location in AECs, and non -coastal wetlands. In the Conservation land use category, the county states: "Uses allowed by Carteret County in AECs are those that are consistent with the State's minimum use standards, except when the policies contained in this plan are more restrictive than State standards" (pg. 94). Regarding non -coastal wetlands, the county "accepts applicable state and federal regulations regarding development activity in non -coastal wetland areas, with the exception of Land Use Compatibility Policy 2.1.5 which exceeds state and federal standards" (pg. 94). The "Rural" land use category is defined as: "Areas included within the rural classification include lands that are appropriate for or presently used for agriculture, forestry, mineral extraction, and other uses that should be located in a relatively isolated and undeveloped area. The predominant land uses are agricultural and residential. However, public facilities, health care facilities, and scattered industrial and commercial uses are allowed. Areas classified as rural are usually served by individual wells and septic systems. No central water service is anticipated during the planning period". Residential densities average two dwelling units per acre, with a minimum lot size of 20,000 square feet (2.2 units per acre). Extensive portions of the Down East area are classified as rural, as are areas in northwest Carteret County. Within areas depicted as Conservation on the Future Land Use Map, there may be high -ground areas that are suitable for development. These high -ground areas shall be considered as Rural and development shall be consistent with densities and requirements contained in the Rural classification description, policies contained in the Land Use Plan, and applicable local, state, and federal regulations. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. Proposed Development: The applicant proposes to expand an existing private docking facility adjacent to the Adams Creek ICW, northwest of Beaufort. The proposed development would take place adjacent to 786 Sea Gate Drive, Carteret County. This proposal is for private use adjacent to a residential dwelling. The applicant is proposing to replace the existing 2-slip docking facility with a 4-slip docking facility. This expanded docking facility would extend 52' waterward of the shoreline. The proposed pier access would be 6' by 24' and would connect to a 12' by 32' floating platform that would be parallel to the shoreline. Two 6' by 32' finger piers would be on either end of the floating platform, also parallel to shore. Each finger pier would support access to boat lifts on each side, -totaling four proposed boat slips. A 4'6" wide and 14' long platform connecting to a 8' by 32' platform is proposed to encompass the southeastern boat lift. The applicant is also proposing a separate, stand- alone 5' by 20' gangway connected to the top of the existing bulkhead and leading to a 10' by 12' floating platform just north of the proposed 4-slip docking facility. Anticipated Impacts: This proposal is 21' landward of a Federal Channel setback. This proposal would not be a hazard to navigation along this shoreline.
