This permit, issued on December 17, 2020 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)i tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Expansion
1) This permit authorizes only the demolition of the existing docking facility and the construction of the
docks, piers, boat lifts, and other structures and uses located in or over the water that are expressly
and specifically set forth in the permit application. No other structure, whether floating or stationary,
shall become a permanent part of this docking facility without permit modification. No non -water
dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit authorizes a maximum of four (4) formalized boat slips.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
7) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
8) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity
of the permitted structure and the safety of moored boats. The permittee shall not hold the state of North
Carolina or the United States liable for any such damage.
9) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the
federally maintained AIWW channel.
10) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee shall be required,
upon.due notice from the Corps of Engineers, to remove, relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.
USACE Conditions
11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

13) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2001-01065).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1675.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal high water level unless specifically
exempted by Environmental Management Commission's (EMC) Neuse River buffer
regulations in place at the time of such development.
NOTE: An application processing fee of $250 was received by DCM for this project.

proposal incorporates 3,744 square feet of Public Trust waters. The proposal is adjacent to a Federal Channel.
These waters of the Adams Creek ICW are closed to shellfish harvest. This waterbody is not a Primary Nursery
Area. This area is subject to the Neuse River Basin Riparian Buffer Rules. Assuming other state and federal
agencies concur, the Morehead City District staff recommends that the project be authorized with the
following conditions:
1) This permit authorizes only the docks, piers, and other strictures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, may become a permanent part of this marina/docking facility without permit
modification. No non -water dependent uses of strictures may be conducted on, in or over public trust
waters without permit modification.
2) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee will not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
3) This permit authorizes a maximum of four boat slips. At no time shall more than four vessels be moored
or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel types,
including but not limited to motorboats, sailing vessels and personal watercraft.
4) It is possible that the authorized structure may be damaged by wave wash from passing vessels. The
issuance of this permit does not relieve the permittee from taking all proper steps to ensure the integrity
of the permitted structure and the safety of moored boats. The permittee shall not hold the United States
liable for any such damage.
5) Approval of the structure was based on a determination that there would be no obstruction to navigation.
Under conditions existing within the AIWW, a possibility exists that the structure may be damaged by

wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required
because such an action would tend to nullify the navigational benefits on which the AIWW was
justified. Issuance of this permit should not be construed as relieving the permittee of tatting proper
steps to ensure the structure and moored boats will not be damaged by wave wash normally to be
expected in the AIWW. The permittee shall not hold the United States liable for any such damage.
6) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required,
upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or
obstructions caused thereby, without expense to the United States or the state of North Carolina. No
claim shall be made against the United States or the state of North Carolina on account of any such
removal or alteration.

Consistency Determination: The request is consistent with/not in conflict with the Carteret County Land
Use Plan certified by the CRC on December 20, 2010.
Overview: The property is located adjacent to the Adams Creek ICW at 786 Sea Gate Drive near Newport,
Carteret County. This property is currently developed with a bulkhead, docking facility, rip rap, and a
residential dwelling. This property is located within the Neuse River basin. The elevation of the adjacent
high ground of the parcel is approximately 15' above the normal water level (NWL). Vegetation on the
parcel mainly consists of lawn grasses. There are no Coastal Wetlands within the project area. The parcel
has 199' of continuous shoreline along Adams Creek. Immediate offshore water depths adjacent to the
parcel range from -3' to -11' normal water level (NWL). The subaqueous substrate is firm with shell.
Areas of Environmental Concern (AECs) in the project area are Estuarine Waters, and Public Trust Areas.
The project is located adjacent to Adams Creek ICW and is approximately 470' across at this location.
This project is located near a Federal Channel, approximately 21' landward of the ICW channel setback.
The waterbody is classified as SA; HOW; Nutrient Sensitive Waters, is not a Primary Nursery Area and is
closed to shellfish harvest. Submerged aquatic vegetation was not observed and there are no cultural
resources. This parcel is subject to the Neuse River Riparian Buffer Rules.
The applicant is proposing to expand an existing private docking facility by replacing the existing 2-slip
docking facility with a 4-slip docking facility. This expanded docking facility would extend 52' waterward
of the shoreline. The proposed pier access would be 6' by 24' and would connect to a 12' by 32' floating
platform that would be parallel.to the'shoreline. Two 6' by 32' finger piers would be on either end of the
floating platform, also parallel to shore. Each finger pier would support access to boat lifts on each side,
totaling four proposed boat slips. A 4'6" wide and 14' long platform connecting to an 8' by 32' platform

is proposed to encompass the southeastern boat lift. The applicant is also proposing a separate,
stand-alone 5' by 20' gangway connected to the top of the existing bulkhead and leading to a 10' by 12'
floating platform just north of the proposed 4-slip docking facility.
Anticipated impacts
This proposal is 21' landward of a Federal Channel setback, and would not be a hazard to navigation
along this shoreline. The proposed docking facility would usurp 3,744 square feet of Public Trust Area.
Traditional marine construction methodology will be utilized during the construction of this project.
Turbidity impacts are not anticipated during the construction activities in Adams Creek.
Basis for Determination:
The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan
Update. The Future Land Use Map (FLUM) designates the site as Rural and Conservation due to the sites
location in AECs, and non -coastal wetlands.
In the Conservation land use category, the county states:
"Uses allowed by Carteret County in AECs are those that are consistent with the State's minimum use
standards, except when the policies contained in this plan are more restrictive than State standards" (pg.
94). Regarding non -coastal wetlands, the county "accepts applicable state and federal regulations
regarding development activity in non -coastal wetland areas, with the exception of Land Use
Compatibility Policy 2.1.5 which exceeds state and federal standards" (pg. 94).
The "Rural" land use category is defined as:
"Areas included within the rural classification include lands that are appropriate for or presently used for
agriculture, forestry, mineral extraction, and other uses that should be located in a relatively isolated and
undeveloped area. The predominant land uses are agricultural and residential. However, public facilities,
health care facilities, and scattered industrial and commercial uses are allowed. Areas classified as rural
are usually served by individual wells and septic systems. No central water service is anticipated during
the planning period".
Residential densities average two dwelling units per acre, with a minimum lot size of 20,000 square feet
(2.2 units per acre). Extensive portions of the Down East area are classified as rural, as are areas in
northwest Carteret County.
Within areas depicted as Conservation on the Future Land Use Map, there may be high -ground areas that
are suitable for development. These high -ground areas shall be considered as Rural and development
shall be consistent with densities and requirements contained in the Rural classification description,
policies contained in the Land Use Plan, and applicable local, state, and federal regulations.

1. Carteret County will only allow development activities in estuarine and public trust waters that
are associated with water -dependent uses, consistent with state and federal standards, and

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit application, Field Investigation Report and BioReport
for the subject project. The attached notice requests federal agency comments on this project by December 5, 2020.
The site is located within waters adjacent to Adams Creek, at 786 Sea Gate Drive, in Newport, Carteret County, North
Carolina. Coordinates are 34.852992 N,-76.690862 W. The applicant is proposing to replace an existing 2-slip docking

likely adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service. The waters within the project area are not designated as PNA by the
Division of Marine Fisheries, are classified as SA; HQW; Nutrient Sensitive Waters by the Division of Water Resources,

Specifically, the applicant proposes to replace an existing 2-slip docking facility with a 4-
slip docking facility. The expanded docking facility would extend 52' waterward of the shoreline.
The proposed pier access would be 6' by 24' and would connect to a 12' by 32' floating platform
that would be parallel to the shoreline. Two 6' by 32' finger piers would be on either end of the

The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report. We recommend that the following conditions be
included in the modification to the State authorization:
1. In order to further protect the endangered West Indian Manatee, Trichechus manatus,
the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manatee euidelines.pdf.
2. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.

3. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
4. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or [phone] and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
8. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
9.The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
10. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt fencing or
similar appropriate devices around all areas subject to soil disturbance or the movement of
earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project
must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of
1973 (North Carolina General Statutes Chapter 113A Article 4). RECEIVED

11. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
12. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct,
restore the water or wetland to its pre -project condition.
13. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

The Division of Water Resources (DWR) has received a copy of your CAMA Major permit
application request dated received by this office on October 23, 2020. The application proposes
to expand an existing docking facility. As proposed, the docking facility expansion would consist
of reconstruction of the docking facility, including platforms, finger piers, boatlifts and a floating
dock to provide dockage for up to four (4) vessels. The docking facility would be located in the
waters of Adams Creek Canal which are classified as SA:HQW:NSW by the DWR. The DWR
issues approval in the form of a Water Quality Certification (WQC) in conjunction with the CAMA
Major Permit and General Permit(s) 19800291 or 197800056 issued by the US Army Corps of
Engineers (USACE). This Certification allows you to use the CAMA Permit when issued by the
Division of Coastal Management.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at hfp://www.ncoah.com/
or by calling the OAH Clerk's Office at [phone] for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH

Narrative Description:
The property is located adjacent to the Adams Creek ICW at 786 Sea Gate Drive near Newport,
Carteret County. This property is currently developed with a bulkhead, docking facility, rip rap, and a
residential dwelling. This property is located within the Neuse River basin. The adjacent riparian
properties are similarly developed.
The elevation of the adjacent high ground of the parcel is approximately 15' above the normal water
level (NWL). Vegetation on the parcel mainly consists of lawn grasses. There are no Coastal
Wetlands within the project area. The parcel has 199' of continuous shoreline along Adams Creek.
Immediate offshore water depths adjacent to the parcel range from —3' to —1 l' normal water level
(NWL). The subaqueous substrate is firm with shell.
This proposal is located near a Federal Channel, approximately 21' landward of the ICW channel
setback. There is not a cultural resource in the project area. This waterbody is approximately 470'
across at this location. These estuarine waters are not classified as a Primary Nursery Area.
Submerged aquatic vegetation was not observed at this location. This area is closed to shellfish
harvest and is classified as SA; HQW; Nutrient Sensitive Waters. This parcel is subject to the Neuse
River Riparian Buffer Rules.
Proposed Development:
The applicant proposes to expand an existing private docking facility adjacent to the Adams Creek
ICW, northwest of Beaufort. The proposed development would take place adjacent to 786 Sea Gate
Drive, Carteret County. This proposal is for private use adjacent to a residential dwelling.
The applicant is proposing to replace the existing 2-slip docking facility with a 4-slip docking facility.
This expanded docking facility would extend 52' waterward of the shoreline. The proposed pier
access would be 6' by 24' and would connect to a 12' by 32' floating platform that would be parallel
to the shoreline. Two 6' by 32' finger piers would be on either end of the floating platform, also
parallel to shore. Each finger pier would support access to boat lifts on each side, -totaling four
proposed boat slips. A 4'6" wide and 14' long platform connecting to a 8' by 32' platform is
proposed to encompass the southeastern boat lift. The applicant is also proposing a separate, stand-
alone 5' by 20' gangway connected to the top of the existing bulkhead and leading to a 10' by 12'
floating platform just north of the proposed 4-slip docking facility.
Anticipated Impacts:
This proposal is 21' landward of a Federal Channel setback. This proposal would not be a hazard
to navigation along this shoreline. The proposed docking facility would usurp 3,744 square feet
of of Public Trust Area. Traditional marine construction methodology will be utilized during the
constractioff-of this -project: Tarliidity impacts are not anticipated duringgnhe construction
activities in Adams Creek.

Dear Adjacent Riparian Property Owner:
Margaret Taylor is applying for a CAMA Major Permit to remove an existing dock, platform and wetslip
layout with a floating dock and reconstruct to an orientation that is parallel with the waterway along
with adding a 10x12 floating dock, located at 786 Sea Gate Drive, Newport, NC 28570, and adjacent to
the Intracoastal Waterway/Adams Creek, Carteret County, North Carolina. The specifics of the
proposed work are on the enclosed drawing.
As the adjacent riparian property owner to the aforementioned project, I am required to notify you of
the development in order to give you the opportunity to comment on the project. Please review the
attached drawing, applications and narrative.
Should you have any objections to this proposal, please send your written comments to Roy
Brownlow, District Manager, at 400 Commerce Avenue, Morehead City, NC 28557, within 30 days of
your receipt of this notice. Such comments will be considered by the Department in reaching a final

Dear Ms. Taylor:
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located adjacent to the Adams Creek ICW at
786 Sea Gate Drive near Newport, Carteret County. It was received on October 13, 2020, and
appears to be adequate for processing at this time. The projected deadline for making a decision
is December 27, 2020. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 13, 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at
a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-
of-way fronting your property, or at a point along the road right-of-way where a private road
would lead one into your property. Failure to post this notice could result in an incomplete
application.

The Department of Environment and Natural Resources hereby gives public notice as required by
NCGS 113A-119(b) that application for a development permit in an Area of Environmental Concern as
designated under the CAMA was received on October 13, 2020. According to said application, Ms.
Margaret Taylor proposes to make construct a 4-slip docking facility adjacent to the Adams Creek ICW, at
786 Sea Gate Drive near Newport, Carteret County. A copy of the entire application may be examined or
copied at the office of Brad Connell, NC Division of Coastal Management, located at 400 Commerce

Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
