This permit, issued on September 15, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility Expansion
1) This permit authorizes only the boatlift and uses located in or over the water that are expressly and
specifically set forth in the permit application. No other structure, whether floating or stationary, shall
become a permanent part of this docking facility expansion without permit modification. No non -
water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023

3) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor.
4) This permit does not authorize any additional boat slips.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource
agencies, physical stops shall be placed on the boat lift at a minimum height of 18" above the bottom
substrate to prevent the boat lift from disturbing the bottom substrate. The physical stops shall remain in
place for the life of the permitted docking facility.
7) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
8) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation, and shall not exceed the established pier head line.

General
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2020-01214).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0911.

NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

Recommendations for State Permit — Stroupe Boatlift
The square footage of the proposed docking facility is calculated as follows:
Shoreline length = 82 ft. x 8 sq. ft. = 656 sq. ft. allowable.

The proposed development would provide docking space for one vessel. As proposed, the project would be
CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the established pier -head
line, the eight square foot shading Wile, and the 400 square foot per component rule. The docking facility would
be located entirely over open water. Despite the project meeting the specific use guidelines in estuarine waters,
there are still concerns about water depths and the impact of the proposed boatlift in a Primary Nursery Area.

SUBJECT: CAMA Dredge/Fill Permit Application for Dean Stroupe, Brunswick County,
North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with regard to impacts on fish and wildlife resources. The project site is
located at 720 Waterway Drive adjacent to the AIWW in Sunset Beach, NC. Our comments are
provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100
through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and
the Fish and Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to install a boatlift with stops on the west side of an existing fixed pier to
establish one slip. The 12' by 12' lift would have -0.7' NLW depths on the landward edge and
-0.9' NLW depths at the waterward edge of the slip. A 4' tidal amplitude exists between NLW
and NEW. The AIW W in this area is classified SA by the Environmental Management
Commission and is designated a Primary Nursery Area (PNA) by the NC Division of Marine
Fisheries (NCDMF).
The NCWRC has reviewed the permit application and would like to state support for any
recommendations presented by the NCDMF to protect marine resources within the PNA. PNAs
are defined as those areas inhabited by the embryonic, larval or juvenile life stages of marine or
estuarine fish or crustacean species due to favorable physical, chemical or biological factors. As
a designated PNA, the shallow water habitats of the AIW W provide important rearing areas for
this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats.

Boating activity within the shallow depths of the proposed slip may create a continued source of
chronic sediment disruption and elevated turbidity if use of the lift occurs during low water
events. It is, however, recognized that numerous piers are in the area and that impacts from
boating likely already occurs at the existing facility.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the
CAMA Major Permit application for proposed actions that impact fish and fish habitats. The
applicant is proposing to install a boatlift with stops on the west side of an existing fixed pier for a
total of one boatslip. The proposed project is located on the Atlantic Intracoastal Waterway (AIWW)
at 720 Waterway Drive, on the mainland side of Sunset Beach, Brunswick County. The waters of the
AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery
Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
Based on visual observations made by DCM staff during the June 2020 site visit, there appears to be
NO Submerged Aquatic Vegetation (SAV) in the surrounding waters.
PNAs are estuarine waters where initial post -larval development occurs. Species within this area
are early post -larval to juvenile and include finfish, crabs, and shrimp. Shallow soft bottom is an
important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and
cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom
habitat is used to some extent by most native coastal fish species in North Carolina. The habitat is
particularly productive and, by providing refuge from predators, is an important nursery area.
Species dependent on shallow soft bottom include clams, crabs, flounder, spot, Atlantic croaker, sea
mullet, and rays. Many benthic predators are highly associated with the shallow soft bottom
habitat, including flounders, weakfish, red drum, sturgeon and coastal sharks, although almost all
fish will forage on microalgae, infauna, or epifauna on the soft bottom.
The proposed boatlift would be located over an area of shallow water (-0.7' NLW to -0.9' NLW) in a
Primary Nursery Area. The installation of stops located 18" above the substrate would theoretically
reduce impacts to soft bottom habitat and limit usage to periods of mid to high tides. Despite using
stops to physically limit the cradle height above the substrate, prop scouring in critical habitat is
still a concern during ingress and egress. However, due to the short distance to the Atlantic
Intracoastal Waterway (AIWW) right-of-way DMF has no objection.

This project is consistent with the Sunset Beach Land Use Plan Update.
The applicant proposes to install a boatlift with stops on the west side of an existing fixed
pier for a total of one boat slip. The project is located at 720 Waterway Drive in Sunset
Beach, Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are CW, and PT.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Sunset Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Mainland Residential, while the AECs
impacted by the work are classified as Conservation.
In general, the Town of Sunset Beach allows development in Conservation classified
AECs which is consistent with the State's minimum use standards. The Town of Sunset
Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the Town of Sunset Beach Land Use Plan.

Dear Mr. Stroupe:
You have our approval, in accordance with the attached conditions and those listed below for the installation
of a boadift with stops 18" above the substrate on an existing docking facility located on the Atlantic
Intracoastal Waterway (AIWW) for a total of one (1) boatslip, as described in your CAMA Major
Development Permit application, which was received by the Division of Water Resources (Division) on
July 10, 2020. After reviewing your application, we have decided that the impacts are covered by General
Water Quality Certification Number 4175 (GC 4175). Please be aware that this facility is located within a
Primary Nursery Area (PNA). New dredging within a PNA is prohibited under 15A NCAC 02B .0221.
This Certification allows you to use the General Permit No. 198000291 when issued by the US Army Corps
of Engineers and the CAMA Major Permit when issued by the Division of Coastal Management. In
addition, you should obtain or otherwise comply with any other required federal, state or local permits
before you go ahead with your project including (but not limited to) Erosion and Sediment Control, Non -
discharge, Water Supply Watershed, and stormwater regulations. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAMA Permit.
This approval requires you to follow the conditions listed in the attached certification and any additional
conditions listed on the following pages.
The Additional Conditions of the Certification are.
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you change your
project, you must notify the Division and you may be required to submit a new application package with
the appropriate fee.

3. This General Certification shall expire on the same day as the expiration date of the corresponding
r General Permit. The conditions in effect on the date of issuance of the Certification for a specific project
shall remain in effect for the life of the project, regardless of the expiration of this Certification.
4. The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from compliance with
303(d) of the Clean Water Act), and any other appropriate requirements of State and Federal law. If the
Division determines that such standards or laws are not being met, including failure to sustain a designated
or achieved use, or that State or Federal law is being violated, or that further conditions are necessary to
assure compliance, than the Division may reevaluate and modify this General Water Quality Certification.
5. All mechanized equipment operated near surface waters shall be inspected and maintained
regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or other toxic
materials. Construction shall be staged in order to minimize the exposure of equipment to surface waters
to the maximum extent practicable. Fueling, lubrication and general equipment maintenance shall be
performed in a manner to prevent, to the maximum extent practicable, contamination of surface waters by
fuels and oils. [15A NCAC 02H .0506(b)(3) and (c)(3) and 15A NCAC 02B .0211 (12)]
6. The permittee shall report to the Wilmington Regional Office at (910) 796-7215 (after hours and
on weekends call 800-858-0368) any noncompliance with this certification, any violation of stream or
wetland standards [15A NCAC 02B .0200] including but not limited to sediment impacts [15A NCAC
02B .0200]. Information shall be provided orally within 24 hours (or the next business day if a weekend
or holiday) from the time the applicant became aware of the circumstances. A written submission shall
also be provided within 5 business days of the time the applicant becomes aware of the circumstances.
The written submission shall contain a description of the noncompliance, and its causes; the period of
noncompliance, including exact dates and times, if the noncompliance has not been corrected, the
anticipated time compliance is expected to continue; and steps taken or planned to reduce, eliminate, and
prevent reoccurrence of the noncompliance. The Division may waive the written submission requirement
on a case -by -case basis.
7. Please understand that the waters around your project area have been identified by the Division of
Marine Fisheries as Primary Nursery Area (PNA). Should the need for dredging within the proposed
project area arise in the future, please be aware that new dredging within a PNA is not allowed under 15A
NCAC 02B .0221 and is a degradation of water quality standards and therefore considered a water quality
violation. [15A NCAC 02B .0221].
8. The Permittee shall adhere specially to 15A NCAC 02B .0221 Tidal Salt Water Quality for Class
SA Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8 and
8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; (1)
Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this level
due to natural background conditions, the existing turbidity level shall not be increased. [15A

9. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant and/or authorized agent is required to return the

The proposed project is located on the Atlantic Intracoastal Waterway (AIWW) at 720 Waterway Drive, on the
mainland side of Sunset Beach, Brunswick County.
To locate the project site from the Wilmington Regional Office (WiRO), travel southwest from Wilmington to
Sunset Beach on US 74 W (Martin Luther King Jr Pkwy) & US 17 S for approximately 45 miles until you reach
Ocean Isle Beach Road SW on your left. Travel about 2 miles down Ocean Isle Beach Road SW and then turn
right at the round -about onto Old Georgetown Road SW. Go down Old Georgetown Road SW for about 3
miles until you reach Seaside Road SW (NC 179 / NC 904) and make a left at the traffic light. Then travel
almost a mile and a half down Seaside Road SW (NC 179 / NC 904) until you meet Sunset Boulevard N at the
intersection and make a right. Take your next left onto Park Rd SW and continue .4 miles. Take a right onto
Shoreline Drive E and then take the next left onto Waterway Drive. Continue to the end of the street and the
destination will be on the right.
Existing structures on the project site include a single family residence and a fixed pier located on the south side
of the property. The existing 4' wide x 162' long access pier leads to a 12' long x 15' wide gazebo with a 10'
long x 7' wide fixed platform on the east side. Just east of the fixed platform is a 7' wide x 15' long step-down.
An 8' wide x 6' long step-down continues around the south side of the fixed platform (See Sheet 1 of 2).
The project site is approximately .52 acres. The high ground is vegetated primarily with domestic grasses and
ornamental landscaping. High ground elevations are approximately 4' - 8' above the normal high water (NHW)
level, and the applicant's entire shoreline (+/- 82 linear feet) is stabilized by bulkhead. High marsh Coastal
Wetlands within the property's riparian corridor include Saltmeadow Cordgrass (Spartina patens) and Sea
Lavender (Limonium spp.). The low marsh extends approximately 40' waterward of the high marsh and consists
of a dense stand of Smooth Cordgrass (Spartina alterniora). The proposed project would be located entirely
over open water in the AIWW. Residential properties border the project site to the west and a natural slough
borders the property to the east. The width of the AIWW measures approximately 576' feet from edge at the
proposed project site.
The waters of the AIWW are classified SA by the Division of Water Quality and ARE designated as a Primary
Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.
Based on visual observations made by DCM staff during the June 2020 site visit, there appears to be NO
Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the
proposed boatlift are approximately -.9' NLW. These measurements were confirmed by DCM during a site visit
on 6-28-2020. Tidal amplitude in the project area is approximately 4' between NLW and NHW (See Sheet 2 of
2).
PROPOSED PROJECT
The applicant proposes to install a boatlift with stops on the west side of an existing fixed pier for a total of one
boatslip.
The applicant proposes to build a new 12' wide x 12' long boatlift adjacent to the existing 12' wide x 15' long
gazebo. The boadift would be fitted with permanent stops located 18" above the substrate to minimize damage
to the soft bottom habitat. Measurements show -.7' NLW of water on the landward edge of the proposed boatlift
and -.9' NLW on the waterward edge of the proposed boatiift (See Sheet 1 of 2). The proposed boatlift would
not encroach into either east or west adjacent riparian setback nor the 80' Federal Channel setback. The

proposed boatlift would not exceed the existing pier -head alignment nor the ''/. width of the waterbody.

Dear Mrs. Debbie Wilson:
The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for Mr. Dean
Stroupe, for State approval for the construction of a boatlift which would allow for one vessel slip, located at 720
Waterway Drive, Sunset Beach, Brunswick County, NC. It was received complete on July Zed, 2020 and appears to
be adequate for processing at this time. The projected deadline for making a decision is September 1511, 2020. An
additional 75-day review period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 21, 2020 you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS I13A-1 19(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
