This permit, issued on February 28, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
if these terms may be subject to fines, imprisonment or civil action; or may cause me permit to De null ana vola.
Shoreline Stabilization - Bulkhead
1) In accordance with commitments made by the permittee and in order to satisfy concerns of the U.S.
Army Corp of Engineers, the bulkhead shall not extend waterward more than 10 feet from the normal
high water at any point along its alignment at the time of construction.
2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead
alignment.
3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start
of construction.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
5) The bulkhead shall be constructed prior to any backfilling activities.
6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
7) The fill material shall be clean and free of any pollutants except in trace quantities.
8) All backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
9) No backfill material is to be placed within 30 feet of the normal high-water level, except that which will
be used to backfill the area behind the permitted bulkhead.
10) All fill material to be placed below normal high-water level shall be confined behind the permitted
bulkhead.
Sedimentation and Erosion Control
11) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities.
USACE Conditions
12) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
14) The permittee shall maintain the authorized work in good condition and in conformance with ithe terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including but not limited to an engineer's land
disturbance plan required from the Town of Atlantic Beach.

ADDITIONAL CONDITIONS
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-02418) issued 2/27/20.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-1719.
NOTE: Future development of the pennittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The following is my assessment and consequent recommendations of the above
Bayview Blvd,
proposal:
There is an existing bulkhead along the shoreline of the property that is landward df adjacent bulkheads
approximately 10'to 12.5' depending on location. According to the applicant then inset wall has unusual
amounts of backsplash due to its current alignment and is causing washouts etc. Due to this, the
applicant is to tie into the adjacent bulkheads to help cut down on "backsplash" caused by the current
alignment. The proposed new alignment would tie into existing adjacent bulkheads and would not usurp
more than 875 square feet of shallow bottom habitat. The development conforms to the guidelines set
forth under 15A NCAC 07H .0208. Assuming that state and federal agencies concL
the District recommends the project be authorized as proposed, contingent upon
conditions:
• The bulkhead shall not exceed an average of 12.5' and a maximum of 15'
current alignment and shall tie into the adjacent bulkheads.
• Grading shall not increase stormwater runoff into the adjacent waterbody

Consistency Determination: The request is consistent with/not in conflict the Town bfAtlantic Beach Land
Use Plan certified by the CRC on July 24, 2008.
Overview: The project is located on the southeast side of Bogue Sound at 228 Bayview Blvd in Atlantic
Beach., Carteret County, North Carolina. The property is 12,633 square feet in its entirety and is an
average of 4' above NHW, with 70' of shoreline. The site currently has an onsite septic and an older in -set
bulkhead along the shoreline.'The high ground portion of the tract is covered wit h typical grasses. The
adjacent neighboring bulkheads extend 10 to 12.5' waterward than the applicants existing bulkhead.
There are single family residential properties to the north and south.
The current proposal is to construct a new bulkhead 12'5' waterward of the existing bulkhead and tie into
the adjacent bulkheads. The proposed development includes a 1' wide x 70'I long vinyl bulkhead
waterward of the existing bulkhead. It would be an average distance of 12.5' waterward of NHW and not
exceed a maximum distance of 15' beyond NHW at any point. The proposed bulkhead would not exceed
existing ground level height (4' above NHW). The bulkhead would be backfilled with clean sand fill dirt.
Per the applicant due to "backsplash" issue with the current in -set bulkhead,
would tie into the adjacent bulkheads would help alleviate this issue.

Anticipated impacts resulting from this project are expected to include: the filling of 875 sf of shallow
bottom habitat, no SAV or shellfish were observed within the proposed location. The bulkhead has the
potential to cause a temporary increase in turbidity during construction. The proposed grading of the
additional 12' x 70' high ground could increase storm water runoff, unless measures are taken to return
storm water onsite and/or to treat stromwater sheet flow runoff prior to discharging into the adjacent
waterbody.
Basis for Determination:
The project is subject to the 2008 Town of Atlantic Beach Core Land Use Plan. The Town of Atlantic
Beach Future Land Use Map (FLUM) designates the site as a "Residential Medium Density".
Policies — Conservation
P.22 -The Town of Atlantic Beach supports 15A NCAC 7H for the protection of all AECs.
1.36 - Except in ocean hazard areas, the Town of Atlantic Beach will not oppose bulkhead construction
within its jurisdiction as long as construction fulfills the use standards set forth in 15A NCAC 7H and the
town zoning ordinance. The town is opposed to all bulkhead construction in ocean hazard areas.
Schedule: Continuing Activity.
1.37 - Atlantic Beach recognizes the uncertainties associated with sea level rise. Although the rate of rise
is difficult to predict, the town will support the following actions:
(3) Atlantic Beach will allow the construction of bulkheads which satisfy 15A NCAC 7H in all
areas, except ocean hazard areas, to protect structures and property from rising sea level.

Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management
(NCDCM) has forwarded to our office a copy of the CAMA permit request for the subject project. The attached notice
requests federal agency comments on this project by February 24, 2020.
The applicant proposes to replace an existing bulkhead within waters adjacent to Bogue Sound, at 228 Bayview
Boulevard, in Atlantic Beach, Carteret County, North Carolina. Coordinates in Decimal Degrees are: 34.707175 N, -
76.734389 W
As currently proposed, the project would be to construct the new bulkhead an average distance of 12.5' waterward of
NHW, and not exceed a maximum distance of 15' beyond NHW, at any point. A total of 875 sf of shallow bottom habitat
would be filled with the bulkhead. The proposed bulkhead would not exceed existing ground level height (4' above
NHW). The bulkhead would be backfilled with clean sand fill dirt. Per the applicant due to "backsplash" issue with the
current in -set bulkhead, the new alignment that would tie into the adjacent bulkheads would help alleviate this issue.
The backsplash is caused by wave action in the area (boat traffic, wind) which is causing washout behind the existing
bulkhead. In further coordination with DCM and the applicant, they have indicated that they may be able to reduce the
footprint to 10 feet waterward of NHW, and still achieve the goal to reduce the backsplash.
Please see the attached application request, plans, bioreport dated December 10, 2019, and location map for more
detailed information concerning the proposed project.

This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery
Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but is not
likely to adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management
Councils or the National Marine Fisheries Service.

given a copy of this approval letter and General Certification and is responsible for complying
with all conditions. Any new owner must notify the Division and request the Certification be
issued in their name {15A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The applicant
will also be required to evaluate all acquired permits to assure that they are consistent, and all
relative impacts are accounted for and shown on the construction plans. [15A NCAC 02H .0502
(b) and 15A NCAC 02H .0506 (4)] The applicant shall require his contractors (and/or agents) to
comply with all of the terms of this Certification, and shall provide each of its contractors (and/or
agents) a copy of this Certification.
3. A pre -construction meeting is recommended to be held with the Division prior to the start
of the project phases so that the contractors and/or agents fully understand the conditions
associated with this certification. [15A NCAC 02H .0507 (c) and 15A NCAC 02H .0502 (a)]
4. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 213 .0220. Appropriate sediment and erosion control practices must be
used to meet this standard. Turbidity curtains shall be used as appropriate. Please notify this
Office if any turbidity issues arise at 910.796.7215
5. All wetlands, streams, surface waters, and riparian buffers located within 50 feet of the
construction area on the project site shall be clearly marked (example- orange fabric fencing)
prior to any land disturbing activities and must be maintained on the property until the project
phase is completed. [15A NCAC 02H .0506 (b)(2) and (c)(2) and 15A NCAC 02H .0507 (c)]
6. Appropriate measures should be installed prior to any land clearing activities to protect
waters and wetlands from turbidity and/ or sedimentation. These measures should be routinely
inspected, and properly maintained, and excavated materials should be contained outside the
wetland boundary. Excessive silt and sediment loads can have numerous detrimental effects on
aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of
gills of aquatic species. [15A NCAC 02H .0506 (b)(3) and (c)(3)]
7. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless of
the expiration of this Certification.

permit in the construction and maintenance of this project and shall provide each of its

1. The new bulkhead will not exceed a distance of 10 feet waterward of Normal High
Water.
2. In order to further protect the endangered West Indian Manatee, Trichechus
manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee
Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manatee guidelines.pdf.
3. The permittee must install and maintain, at his expense, any signal lights and
signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized
facilities. For further information, the permittee should contact the U.S. Coast Guard Marine
Safety Office at (910) 772-2191.
4. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
5. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation
patterns within waters or wetlands or to reduce the reach of waters or wetlands.
6. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does
not authorize temporary placement or double handling of excavated or fill material within
waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill
activities connected with this project.
7. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-
5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
8. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean an f
pollutants except in trace quantities. Metal products, organic materials (i 1e1 al
land clearing activities), or unsightly debris will not be used.

9. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
10. The permittee shall require its contractors and/or agents to comply with the terms
and conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or maintenance
of this project with a copy of this permit. A copy of this permit, including all conditions, shall
be available at the project site during construction and maintenance of this project.
11. The permittee shall employ all sedimentation and erosion control measures
necessary to prevent an increase in sedimentation or turbidity within waters and wetlands
outside the permit area. This shall include, but is not limited to, the immediate installation of
silt fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally,
the project must remain in full compliance with all aspects of the Sedimentation Pollution
Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4).
12. The activity will be conducted in such a manner as to prevent a significant increase
in turbidity outside the area of construction or construction -related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout
waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or
less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout
waters, are not considered significant.
13. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in
such time and manner as the Secretary of the Army or his authorized representative may
direct, restore the water or wetland to its pre -project condition.
14. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

8. PROJECT SUMMARY:
The project proposed is to construct a new bulkhead to tie into the neighboring adjacent
bulkheads.
9. Narrative Description
The Cyrus H. Sloan project is located on the southeast side of Bogue Sound at 228 Bayview
Blvd in Atlantic Beach. The project area is found by turning right off of Highway 70 East
in Morehead City onto the Atlantic Beach Causeway, follow the causeway

until the four-way stoplights are reached and turn left onto East Fort Macon Road. Bayview
Blvd is 1255 feet (.24 miles) on the left and located on the south side of Bogue Sound. Once
you turn left onto Bayview Blvd., follow for approximately 2,408 feet. The property will be
located on the right.
The property is 12,633 square feet in its entirety and is an average of 4' above NEW. The
shoreline length for this property is 70'. The site currently has an older in -set bulkhead along
the shoreline. The high ground portion of the tract is covered with typical grasses.
The adjacent neighboring bulkheads extend 10 to 12.5 `more waterward than the project
area existing bulkhead. The proposed development is a private project. There are single
family residential properties to the north and south.
The Town of Atlantic Beach's Land Use Plan classifies this property as single family
residential with all parts of the AEC classified conservation. This area of Bogue Sound is
not designated as Primary Nursery Area, is closed to the taking of shellfish and carries a
water classification of HQW. Water depths range from -0'nlw to -4' nlw depending on
location in the project area. No SAVs or shellfish were observed within the project area.
10. Proiect Description:
The current proposal is to construct a new bulkhead 12.5' waterward of the exiting bulkhead
to tie into the adjacent bulkheads.
The applicant is proposing to construct a 1' wide x 70' long vinyl bulkhead waterward of
the existing bulkhead. It would be an average distance of 12.5' waterward of NHW and not
exceed a maximum distance of 15' beyond NHW at any point. A total of 875 sf of shallow
bottom habitat would be filled with the bulkhead. The proposed bulkhead would not exceed
existing ground level height (4' above NHW). The bulkhead would be backfilled with clean
sand fill dirt. Per the applicant due to "backsplash" issue with the current in -set bulkhead,
the new alignment that would tie into the adjacent bulkheads would help alleviate this issue.
11. Anticipated Impacts:
The proposed bulkhead would fill 875 sf of shallow bottom habitat, however no SAV or
shellfish were observed within the proposed location. The bulkhead has the potential to
cause a temporary increase in turbidity during construction. The proposed grading of the
additional 12' x 70' high ground could increase stormwater runoff, unless measures are
taken to return storm water orisite and/or to treat stromwater sheet flow runoff prior to
discharging into the adjacent waterbody.

bulkheads that have stepped out over time. They might be able to do 10 waterward of high water but probably not to

You are correct in that the backsplash is from the wave action in the area (caused by boat traffic, wind etc.) and is
causing washout behind the bulkhead. If you want to discuss the alternative you mentioned with Gregg then he could
contact the applicant to see if they are willing to do as you suggest. I believe Gregg sent an email answering your
question for what is considered access and what is considered platform in this situation due to the fact I have been out
of the office for two weeks. Please let me know if you need anything else.

I hope you all had a merry Christmas and are enjoying some time off. I have 2 applications I recently received that I am
looking for additional information/clarification on the impacts/purpose.
Sloan bulkhead/Corps AID: SAW-2019-02418: What exactly is "backsplash"? I'm guessing it is from wave action on the
bulkhead... just looking for clarification on that. The application mentions washouts, but didn't include any pictures. Is
the shoreline experiencing significant erosion? An alternative to filling the 875 square feet of shallow bottom would be
to protect the existing bulkhead with rip rap in a smaller footprint.
The distance of 10-12.5 feet from the existing bulkhead alignment exceeds the limits allowed under the GP 80 (must not
exceed and average of 2 feet and a maximum of 5 feet waterward of MHW) and would not qualify as a minor deviation
under our NWP 3 for maintenance. Recommending revising the fill footprint or modify the fill material to comply with
the GP 80 requirements. Otherwise we will be placing the project as submitted on federal notice through the 291
process.
Please let me know how the applicant intends to proceed.
Hasty dock/Corps AID: SAW-2019-02430: Trying to figure out which permit to use on this one (291 or 56-depinding on
the square footage counted). I attached the plans and 2014 DCM guidance on calculating shaded impacts for reference.
My question is related to the pier extension and what the difference is between the proposed extension and figure 3 in
the guidance. If counting extension and platform (3400 square feet, we would go 291. If just counting the platform (400
square feet), we would utilize the GP 56.
Please advise.

Project Narrative for Hamilton Sloan Seawall Project
To Whom it may concern,
Our project is located at 228 Bayview Blvd. in Atlantic Beach, NC. We are proposing to
install a new seawall in front of the existing seawall from the furthest most seaward part of the
neighboring seawall on each side. We are proposing to leave the current seawall in plan and
install the new seawall and bacUill in between with clean sand fill dirt. The purpose of this
project is to extend the yard to enlarge the building area of the lot as well as help cut down the
amount of "backsplash" the inset wall creates due to its alignment. Thank you for your time

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development of your project at 228 Bayview Blvd. in Atlantic Beach, Carteret County.
The application was received as complete on 11/12/19 and appears to be adequate for processing at
this time. The projected deadline for making a decision is 1/26/20. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 11/12/19, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at
the property of your proposed development. You should postthis notice ata conspicuous point along
your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property, or at a
point along the road right-of-way where a private road would lead one into your property. Failure
to post this notice could result in an incomplete application.
