This permit, issued on November 30, 2020 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, covered platform, boatlift, floating platform, and other, structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the ' docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the iChair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. i This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature Lawrence Sharp ADDITIONAL CONDITIONS Permit No.114-20 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 5) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 6) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 7) This permit authorizes a maximum of three (3) formalized boat slips. 8) Should the property to the west of the applicant be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorizing to construct of a portion of the docking facility within the property owner's riparian setback, and submit this authorization to the Division of Coastal Management prior to initiating construction of the docking facility. 9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner to the east area of riparian access. 10) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource agencies, stops shall be placed on the boat lifts at a minimum height of 18" above the bottom substrate to prevent the boat lifts from disturbing the bottom substrate. The physical stops shall remain in place for the life of the permitted docking facility. 11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 12) The roof of the covered platform shall not be designed for second story use. USACE Conditions 13) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at his://www.fws.gov/raleigh/t)dfs/ManateeGuidelines20ll.2df. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Lawrence Sharp Permit No. 114-20 Page 3 of 3 ADDITIONAL CONDITIONS 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms I and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 17) All debris associated with the removal or construction of the permitted docking facility shall be contained within the authorized project area and removed to an appropriate upland location. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, . approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2020-01670). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1666. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. Dunn, Coastal Coordinator Habitat Conservation Division DATE: October 27, 2020 SUBJECT: CAMA Dredge/Fill Permit Application for Lawrence Sharp, Brunswick County, North Carolina Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 6632 Kings Lynn Dr. adjacent to Eastern Channel in Oak Island, NC. Our comments are provided in accordance with, provisions oftheCoastal Area Management -Act (G.S.'113A-100 through 113A-128), as amended; Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to install a new, private pier extending 420' from NHW. The docking: facility will include an 8' by 15' floating dock, 10' by 8' roof covered deck, and two boadifts to create three. formalized slips: The lifts are to be installed with auto -stops at 1.5' MLW with the application stating the most waterward position of the lift has water depths of -1.6' MLW. The Eastern Channel in this area is classified SA by the Environmental Management.Commission and is designed a,primary nursery area (PNA)hy the NC Division of Marine Fisheries (NCDMF). i The NCWRC has reviewed the proposal and has concern with the establishment of slips in water depths less than -2' NLW. While there are other existing docking facilities in the:area, this proposal would introduce a new docking facility and therefore increased impacts to shallow water areas. Boating and mooring activity within the shallow depths of the proposed project modification would create•a continued source of chronic sediment disruption and elevated turbidity. Therefore, we support concerns stated by. NCDMF to avoid and minimize impacts to marine resources. These suggestions may include the removal of the slips and floating dock or an extension of the docking. facility to water depths that would minimize the likelihood of bottom disturbance. The applicant is proposing to install a new pier extending 420' from normal high water. The docking facility will include a floating dock (8' x 15'), roof covered deck (10' x 8'), and two boatlifts (13' x 13') for a total of three (3) formalized boat slips. The proposed project is located at 6632 Kings Lynn Drive, in the Eastern Channel adjacent to Lockwoods Folly River Inlet on the west end of Oak Island, Brunswick County. The waters of the channel system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the September 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the proposed boatlift is approximately 1.6' relative to MLW. The most landward proposed boatlift would be located over an area of shallow water (-0.2' NLW) over soft bottom. Soft bottom is important as a storage reservoir of nutrients, chemicals, and microbes in coastal ecosystems, allowing for both deposition and resuspension of nutrients and toxic substances. The surface supports benthic microalgae, contributing substantial primary production to the coastal system. Estuarine soft bottom supports over 400 species of benthic invertebrates in North Carolina. The installation of stops located 18" above the substrate would theoretically reduce impacts to soft bottom habitat and limit usage to periods of mid to high tides. Despite using stops to physically limit the cradle height above the substrate, prop scouring is still a concern during ingress and egress. However, due to the proposed project is occurring in non -designated nursery habitat, DMF has no objection. The high ground portion is elevated approximately 10'-15' above the normal high water (NHW) level. The shoreline (+/- 50 linear feet) is naturally vegetated with coastal wetland species (Sparlina altemiflora). There is a span of coastal wetlands (approximately 357' wide) within the riparian corridor of the applicant's property. Residential properties border the project site to the east and west. Existing docking facilities exist to the west and east. The property is bordered by Eastern Channel to the north and residential property to the south. The width of the water body measures approximately 590'. The waters of the channel system are classified SA by the Division of Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the September 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the proposed boatlift is approximately 1.6' relative to MLW. PROPOSED PROJECT The applicant proposes to install a new pier extending 420' from normal high water. The docking facility will include a floating dock (8' x 15), roof covered deck (10' x 18'), and two boatlifts (13' x 13') for a total of three formalized boat slips. According to the applicant one boatlift would be standard cradle and the other would be an elevator style lift. The proposed pier would extend 420 ft. below NHW and is designed to stop at the established pier headline. At the waterward terminus of the proposed pier there would be a 10'x18' covered deck with an 8'x15' floating dock to the north and the standard cradle boat lift to the west. A gangway is positioned on the east side of the fixed deck leading to the floating dock. An elevator style boatlift would be approximately 6' south of the covered fixed deck. The proposed boatlift (standard cradle) will encroach approximately 9' into the western property owner's 15' riparian buffer but a waiver has been documented and included with the permit application The boatlifts are to be installed with auto -stops at 18". The application states that existing water depth at the most waterward position of the proposed boatlift was approximately 1.6' @ NLW. The proposed docking facility will encroach into the 15-foot riparian corridor setback of the western property owner and a waiver has been obtained. As part of that permitting process, Oak Island Tek delivered to Mr. Sharp an Adjacent Riparian Property Owner Notification Form and sealed drawing that identified a surveyed riparian line between Oak Island Tek's property and Mr. Sharp's property with specific measurements as to the length of the Oak Island Tek pier. We attach the General Permit for reference. Mr. Sharp's Site Plan does not contain surveyed riparian lines, nor does it contain sufficient measurements or information about the intended length of the new pier out into Lockwood Folly Sound. Its common practice/standard routine for piers to extend to the pier headline. We disagree with the claim of " if the Sharp pier is wedged in the tight space between our client's pier and the pier to the west and it extends beyond our clients pier on the west side, our client cannot navigate an access the dock safely". The "tight space" referred to in the objection is the common riparian area that is identical to all single (50' lots) in the Kings Lynn area. The said "tight spot" is the same allotted riparian width that the Oak Island TEK pier was constructed over. Thus we argue that this objection is either a misunderstanding or double standard. The second concern of not being able to navigate and access their dock safely is one that we also disagree with. The Sharp pier will not extend beyond the Oak Island TEK pier and will not impede navigation. Inspection of the proposed site plan reveals that the Oak Island TEK floater exten*ECEIVED SEP 2 2 2020 i)CMN-MHD CITY further than the Sharp pier based on the alignment of the existing pier headline. We urge Oak Island TEK to review our previous objection response as well as the scaled site plan. Additionally, the Sharp pier will maintain a 15' riparian offset (within the sharp's riparian area) leaving plenty of space for maneuvering. Oak Island TEK's boat lift is within the riparian setback limits. We question if Oak Island TEK's concern is related to accessing their lift? Regardless of the length of the pier we argue that the 15' corridor/offset to be maintained in addition to the width of the boat lift (12'-15'+/-) is more than enough to safely access the boat lift and contend that Mr. Sharp should not be penalized for encroachment of the neighboring water dependent structure, if this is indeed a concern of Oak Island TEK. As can be seen from the photos provided by Ms. Wang, their boat lift is accessible straight in from the channel so navigability concerns are unwarranted. For more clarity I've attached another photo which shows the orientation of their boat lift. Site visits by Sea Dog indicated that reasonable water depths could be achieved by extension to the existing pier headline. Previous conversations with Mrs. Mcpherson indicated that due to the large channel and waterbody width through this area it was likely that we could, extend past the Oak Island TEK pier. Although we considered this option during design current site plans propose extending to the existing pier head line instead, since reasonable water depths can be achieved. Reducing the length of the Sharp pier would result in unsuitable water depths.
