This permit, issued on November 30, 2020 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, covered platform, boatlift, floating platform, and other,
structures and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, shall become a permanent part
of this docking facility without permit modification. No non -water dependent uses of structures shall
be conducted on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the '
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the iChair
qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. i

personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023

your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) The authorized structures and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
6) Any portion of the permitted access pier and docking facilities built above Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as
measured from the bottom of the decking.
7) This permit authorizes a maximum of three (3) formalized boat slips.
8) Should the property to the west of the applicant be sold prior to the initiation of construction of the
docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the
minimum setback, and authorizing to construct of a portion of the docking facility within the property
owner's riparian setback, and submit this authorization to the Division of Coastal Management prior to
initiating construction of the docking facility.
9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner to the east area of riparian access.
10) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource
agencies, stops shall be placed on the boat lifts at a minimum height of 18" above the bottom substrate to
prevent the boat lifts from disturbing the bottom substrate. The physical stops shall remain in place for the
life of the permitted docking facility.
11) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches are
permitted. Lattice is specifically excluded from being used under this authorization.
12) The roof of the covered platform shall not be designed for second story use.
USACE Conditions
13) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

15) The permittee shall maintain the authorized work in good condition and in conformance with the terms I
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
17) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, .
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit
197800056 (Action ID SAW-2020-01670).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-1666.
NOTE: Future development of the permittee's property may require a modification of this permit.

dependent activities are not authorized within 30 feet of the normal high water level. i

Recommendations for State Permit — Sharp Docking Facility September 15, 2020
The square footage of the proposed docking facility is calculated as follows:
Shoreline length = 50 ft. x 8 sq. ft. = 400 sq. ft. allowable.

Elevator Boatlift = 13' x 13' = 169 sq. ft. (not counted)
Floating Dock = 8' x 15' = 120 sq. ft.
Proposed Covered Deck beside Gangway Landing = (4' x 4') + (18' x 10') = 196 sq. ft.
Total (proposed) = 316 sq. ft.
Total (existing) = 0 sq. ft.
The proposed development would provide docking space for three vessels. As proposed, the project
would be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight -
square foot rule and the '/< width rule. The docking facility would be located entirely over open water.

Carolina
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 6632 Kings
Lynn Dr. adjacent to Eastern Channel in Oak Island, NC. Our comments are provided in accordance with,
provisions oftheCoastal Area Management -Act (G.S.'113A-100 through 113A-128), as amended;
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to install a new, private pier extending 420' from NHW. The docking: facility will
include an 8' by 15' floating dock, 10' by 8' roof covered deck, and two boadifts to create three.
formalized slips: The lifts are to be installed with auto -stops at 1.5' MLW with the application stating the
most waterward position of the lift has water depths of -1.6' MLW. The Eastern Channel in this area is
classified SA by the Environmental Management.Commission and is designed a,primary nursery area
(PNA)hy the NC Division of Marine Fisheries (NCDMF).

The NCWRC has reviewed the proposal and has concern with the establishment of slips in water depths
less than -2' NLW. While there are other existing docking facilities in the:area, this proposal would
introduce a new docking facility and therefore increased impacts to shallow water areas. Boating and
mooring activity within the shallow depths of the proposed project modification would create•a continued
source of chronic sediment disruption and elevated turbidity. Therefore, we support concerns stated by.
NCDMF to avoid and minimize impacts to marine resources. These suggestions may include the removal
of the slips and floating dock or an extension of the docking. facility to water depths that would minimize
the likelihood of bottom disturbance.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has reviewed the
CAMA Major Permit application for proposed actions that impact fish and fish habitats. The
applicant is proposing to install a new pier extending 420' from normal high water. The docking
facility will include a floating dock (8' x 15'), roof covered deck (10' x 8'), and two boatlifts (13' x
13') for a total of three (3) formalized boat slips. The proposed project is located at 6632 Kings
Lynn Drive, in the Eastern Channel adjacent to Lockwoods Folly River Inlet on the west end of Oak
Island, Brunswick County. The waters of the channel system are classified SA by the Division of
Water Quality and ARE NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of
Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made
by DCM staff during the September 2020 site visit, there appears to be NO Submerged Aquatic
Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the proposed
boatlift is approximately 1.6' relative to MLW. The most landward proposed boatlift would be
located over an area of shallow water (-0.2' NLW) over soft bottom.
Soft bottom is important as a storage reservoir of nutrients, chemicals, and microbes in coastal
ecosystems, allowing for both deposition and resuspension of nutrients and toxic substances. The
surface supports benthic microalgae, contributing substantial primary production to the
coastal system. Estuarine soft bottom supports over 400 species of benthic invertebrates in North
Carolina. The installation of stops located 18" above the substrate would theoretically reduce
impacts to soft bottom habitat and limit usage to periods of mid to high tides. Despite using stops to
physically limit the cradle height above the substrate, prop scouring is still a concern during ingress
and egress. However, due to the proposed project is occurring in non -designated nursery habitat,
DMF has no objection.

This project is'consistent with the 2017 Town of Oak Island Comprehensive Land Use Plan.
The applicant proposes to install a new pier extending 420 feet from normal high water.
The docking facility will include a floating dock (8' x 15'), roof covered deck and two
boatlifts for a total of three formalized boat slips. The project is located at 6632 Kings
Lynn Drive in Eastern Channel on the west end of Oak Island.
I have reviewed this proposal for consistency with the Town of Oak Island CAMA Land
Use Plan and offer the following comments.
The general area of the project is classified as Residential. Waters at the project site are
classified as SA; HQ W and are not open to the harvesting of shellfish. The area is not a
Primary Nursery Area. Areas of Environmental Concern (AEC's) are EW, ES and PTA.
Oak Island allows development in Residential classified AECs, which is consistent with
the State's minimum use standards. The Oak Island Land Use Plan contains some
policies, which exceed the State's minimum use standards. However, none of these
policies appear to be applicable to this project.
This project is consistent with the Town of Oak Island Land Use Plan Update.

If you are unable to comply with any of the conditions of the attached Water Quality General
Certification or with the additional conditions itemized below, you must notify the Wilmington Regional
Office within 24 hours (or the next business day if a weekend or holiday) from the time the permittee
becomes aware of the circumstances.
The permittee shall report to the Wilmington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards [15A NCAC 02B .0200] including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next
business day if a weekend or holiday) from the time the permittee became aware of the non-compliance
circumstances.

1. All mechanized equipment operated near surface waters shall be inspected and maintained
regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or other
toxic materials. Construction shall be staged in order to minimize the exposure of equipment to surface
waters to the maximum extent practicable. Fueling, lubrication and general equipment maintenance
shall be performed in a mannerto prevent, to the maximum extent practicable, contamination of
surface waters by fuels and oils. [15A NCAC 02H .0506(b)(3) and (c)(3) and 15A NCAC 02B .0211 (12)]
2. The Permittee shall adhere specially to 15A NCAC 02B .0221 Tidal Salt Water Quality for Class
SA Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range between 6.8 and
8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions; (1)
Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this level

9. PROJECT DESCRIPTION
The proposed project is located at 6632 Kings Lynn Drive, in the Eastern Channel adjacent to
Lockwoods Folly River Inlet on the west end of Oak Island, Brunswick County.
The property can be reached by traveling US-74 W/Martin Luther King Jr Parkway. Merge onto NC-
133 S/US-74 W via ramp to Whiteville. Turn left onto US-421 S/US-74 W. Take US 17 S/Ocean Hwy
E toward Oak Island. Take NC-906 and W. Beach Drive to 6632 Kings Lynn Drive.
Existing structures on the project site include a single family residence and a pool. The project site is
approximately 0.41 acres and is vegetated primarily with domestic grasses and ornamental
landscaping. The high ground portion is elevated approximately 10'-15' above the normal high water
(NHW) level. The shoreline (+/- 50 linear feet) is naturally vegetated with coastal wetland species
(Sparlina altemiflora). There is a span of coastal wetlands (approximately 357' wide) within the
riparian corridor of the applicant's property. Residential properties border the project site to the east
and west. Existing docking facilities exist to the west and east. The property is bordered by Eastern
Channel to the north and residential property to the south. The width of the water body measures
approximately 590'.
The waters of the channel system are classified SA by the Division of Water Quality and ARE NOT
designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are
CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the
September 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the
surrounding waters. Water depths at the waterward end of the proposed boatlift is approximately 1.6'
relative to MLW.
PROPOSED PROJECT
The applicant proposes to install a new pier extending 420' from normal high water. The docking
facility will include a floating dock (8' x 15), roof covered deck (10' x 18'), and two boatlifts (13' x 13')
for a total of three formalized boat slips.
According to the applicant one boatlift would be standard cradle and the other would be an elevator
style lift. The proposed pier would extend 420 ft. below NHW and is designed to stop at the
established pier headline. At the waterward terminus of the proposed pier there would be a 10'x18'
covered deck with an 8'x15' floating dock to the north and the standard cradle boat lift to the west. A
gangway is positioned on the east side of the fixed deck leading to the floating dock. An elevator style
boatlift would be approximately 6' south of the covered fixed deck.
The proposed boatlift (standard cradle) will encroach approximately 9' into the western property
owner's 15' riparian buffer but a waiver has been documented and included with the permit
application The boatlifts are to be installed with auto -stops at 18". The application states that existing
water depth at the most waterward position of the proposed boatlift was approximately 1.6' @ NLW.
As proposed the boatlift would be located within the established pier head line and within 1/. of the

10. ANTICIPATED IMPACTS
The proposed docking facility would shade approximately 316 sq. ft. of Coastal Wetland Area and
incorporate approximately 3,098 sq. ft. of Estuarine Waters and Public Trust Area The docking facility
would remain consistent with similar adjacent pier length requirements. The proposed docking facility
will encroach into the 15-foot riparian corridor setback of the western property owner and a waiver
has been obtained. Construction will not take place within the eastern riparian corridor setback. Minor
increases in turbidity should be expected during piling installation.

The owner of 6632 Kings Lynn Drive hopes to construct a new pier with three slips extending approximately 420 LF waterward
of normal high water into eastern channel in the vicinity of the Lockwood Folly Inlet. Due to grandfather structures on both sides
of this particular property it's our understanding that this area has a history of modified riparian limits that do not conform to
traditional limits that intersect the channel centerline at a ninety -degree angle. Riparian limits through this area instead generally
conform to the alignment of existing structures (see site plan). This project is not located in primary nursery area.
The property has a total waterfrontage of fifty linear feet allowing for up to 400 Square feet of shaded area impacts. See table
below detailing the shaded area resulting from the proposed project:

The adjacent property owner to the west has agreed to waive their shared 15' riparian offset limit allowing room for construction
of the proposed layout. Construction will not take place over the eastern 15' offset. Sea Dog Marine Construction has conducted
a detailed site visit to confirm the site plan attached with this narrative.
Construction will take place on the water by barge. The barge will be spudded in place during construction at the project site.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Lawrence
Sharp for State approval for development of the subject property located at 6632 Kings Lynn Drive, adjacent to the
Eastern Channel of the Lockwoods Folly River Inlet, in Oak Island, Brunswick County. It was received as complete on
September 11, 2020 and appears to be adequate for processing at this time. The projected deadline for making a decision
is November 25, 2020. An additional 75-day review period is provided by law when such time is necessary to complete
the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the
review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However,
an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 11, 2020 you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State

We represent Oak Island Tek, LLC ("Oak Island Tek") which owns the property at 6630
Kings Lynn Drive in Oak Island. On August 5, 2020, Oak Island Tek received an Adjacent
Riparian Property Owner Notification Form and Site Plan from Lawrence Sharp for a new
pier, covered dock and two boat lifts. On August 12, Oak Island Tek requested a copy of
the CAMA Major Permit Application from the Division of Coastal Management. Oak
Island Tek finally received a complete copy of the Application on August 20, 2020.
Oak Island Tek objects to the proposed development.
You may recall issuing Oak Island Tek CAMA General Permit No. 71862 to repair its
existing pier and boat lift and expand its existing fixed pier on April 8, 2020. As part of
that permitting process, Oak Island Tek delivered to Mr. Sharp an Adjacent Riparian
Property Owner Notification Form and sealed drawing that identified a surveyed riparian
line between Oak Island Tek's property and Mr. Sharp's property with specific
measurements as to the length of the Oak Island Tek pier. We attach the General Permit
for reference.
Mr. Sharp's Site Plan does not contain surveyed riparian lines, nor does it contain
sufficient measurements or information about the intended length of the new pier out into
Lockwood Folly Sound. It does illustrate an estimated pier headline. It also illustrates a
Normal High Water line indicating little difference between the Sharp and Oak Island Tek
shorelines.

The Application itself contains a measurement for the length of the Sharp pier at 442
linear feet. Oak Island Tek's pier is 425 feet long. However, Mr. Sharp's Site Plan
illustrates the proposed pier as shorter than Oak Island Tek's pier, which is impossible by
the measurements that indicate the Sharp pier will be 17 feet longer than the Oak Island
Tek pier.
Oak Island Tek objects to approval of a pier length that will extend the Sharp pier further
into the Lockwood Folly River beyond the Oak Island Tek pier and the pier on the western
side of the Sharp property. Such length will interfere with navigability of the public trust
waters of Lockwood Folly Sound and to access Oak Island Tec's existing pier and boatliR.
We request that the Application as proposed be denied.

The Sharp's pier has been designed to extend to the existing pier headline. Its common
practice/standard routine for piers to extend to the pier headline. We disagree with the claim of " if
the Sharp pier is wedged in the tight space between our client's pier and the pier to the west and it
extends beyond our clients pier on the west side, our client cannot navigate an access the dock
safely".
The "tight space" referred to in the objection is the common riparian area that is identical to all
single (50' lots) in the Kings Lynn area. The said "tight spot" is the same allotted riparian width that
the Oak Island TEK pier was constructed over. Thus we argue that this objection is either a
misunderstanding or double standard.
The second concern of not being able to navigate and access their dock safely is one that we also
disagree with. The Sharp pier will not extend beyond the Oak Island TEK pier and will not impede
navigation. Inspection of the proposed site plan reveals that the Oak Island TEK floater exten*ECEIVED

further than the Sharp pier based on the alignment of the existing pier headline. We urge Oak
Island TEK to review our previous objection response as well as the scaled site plan. Additionally, the
Sharp pier will maintain a 15' riparian offset (within the sharp's riparian area) leaving plenty of space
for maneuvering. Oak Island TEK's boat lift is within the riparian setback limits. We question if Oak
Island TEK's concern is related to accessing their lift? Regardless of the length of the pier we argue
that the 15' corridor/offset to be maintained in addition to the width of the boat lift (12'-15'+/-) is
more than enough to safely access the boat lift and contend that Mr. Sharp should not be penalized
for encroachment of the neighboring water dependent structure, if this is indeed a concern of Oak
Island TEK. As can be seen from the photos provided by Ms. Wang, their boat lift is accessible
straight in from the channel so navigability concerns are unwarranted. For more clarity I've attached
another photo which shows the orientation of their boat lift.
Site visits by Sea Dog indicated that reasonable water depths could be achieved by extension to the
existing pier headline. Previous conversations with Mrs. Mcpherson indicated that due to the large
channel and waterbody width through this area it was likely that we could, extend past the Oak
Island TEK pier. Although we considered this option during design current site plans propose
extending to the existing pier head line instead, since reasonable water depths can be achieved.
Reducing the length of the Sharp pier would result in unsuitable water depths.

We are not willing to withdraw the objection. Our primary concern is the length of the Sharp's
proposed pier. I've attached photos that show the existing dock to the east of our client's property

that is missing from the Sharp application. Our client's pier is the one with the boat docked. As you
can see, the pier to the east (not present on submitted Site Plan) is longer than our client's pier. If
the Sharp pier is wedged in the tight space between our client's pier and the pier to the west and it
extends beyond our client's pier on the west side, our client cannot navigate and access the dock
safely. We request that the Sharp pier extend no further than the pier to his west.

We appreciate all of Mr. Greene's responses and clarifications. However, our client's concerns continue to be access,
safety, and navigability because there are discrepancies in the permit binder between the Site Plan and the Application,
specifically the length of the Sharp pier versus the length of the entire structure through the end of the floater.
We request that if the Division issues a CAMA Major Permit it include conditions that clearly require the existing pier
head line to be maintained as illustrated on the Site Plan and require the entire structure to be no longer than 442 linear
feet so it be constructed no further than our client's existing pier. Based on Mr. Greene's comments highlighted below
and in his initial clarification letter of August 31, 2020, it appears that the intent is to not extend beyond the Oak Island
Tek pier and to retain the pier headline. Conditions in the Permit will make that clear.
