2238 and 2240 Sailfish Rd. in Carova Beach S/D, near Corolla, as requested in the permittee's application dated
6/26/19, incl art workplan drawings (7), Sheets 1,2,3,5,6,7 of 7 dated 7/17/19 and Sheet 4 of 7 dated "Revised 8/12/19".
This permit, issued on April 2, 2020 , is subject to compliance with the application (where
consistent with -the -permit), all applicable -regulations, -special conditions -and -notes set forth below. —Any -violation -
if these terms may be subject to tines, imprisonment or civil action; or may cause the permit to oe nun anu vuiu.
Excavation
1) A turbidity curtain shall be left between the area to be excavated and the existing canal and a 24-hour
period after completion of excavation shall elapse prior to turbidity curtain removal to prevent
unnecessary siltation into the adjacent water body.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -4 feet below the normal water level. In no case, shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding
waters.
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters
and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of
petroleum products or any other hazardous waste, the permittee shall immediately report it to the National
Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
Spoil Disposal
7) No spoil material shall be placed within 30 feet of the normal water line, except that which will be used
to backfill the area behind the permitted bulkhead, once properly dried.
8) All excavated materials shall be confined above normal water and landward of regularly or irregularly
flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any
marsh or surrounding waters.
9) Spoil from the authorized dredge footprint shall be dewatered before use as backfill. All remaining
backfill material shall be obtained from a high ground source and confined behind the permitted
bulkhead.
10) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
Maintenance Clause
11) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permitplans with cross -hatching indicating the area _to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a
representative of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Shoreline Stabilization - Bulkhead
12) The bulkhead alignment shall approximate the normal water level at the time of construction.
13) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the
approved bulkhead alignment.

14) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a
representative of the Division of Coastal Management within a maximum of 30 days prior to the start of
construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse
weather conditions, shall require the alignment to be re -staked by permittee and verified by DCM within
a maximum of 30 days prior to the new expected start of construction. 11
15) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles,
or other suitable materials approved by Division personnel.
16) The bulkhead shall be constructed prior to any backfilling activities.
17) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the
structure.
18) The fill material shall be clean and free of any pollutants except in trace quantities.
19) No backfill material is to be placed within 30 feet of the normal water level, except that which will be
used to backfill the area behind the permitted bulkhead.
Sedimentation and Erosion Control
20) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately
landward of the bulkhead cap immediately following completion of backfilling activities:
Docking Facility
21) This permit authorizes only the docks, piers, and other structures and uses located in or over the water
that are expressly and specifically set forth in the permit application. No other structure, whether
floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust
waters without permit modification.
22) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout
the entire existence of the permitted structure.
23) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
24) This permit authorizes a maximum of 2 formalized boat slips.
25) No attempt shall be made by the permittee to prevent the'full and free use by the public of all navigable
waters at or adjacent to the authorized work.

26) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

27) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
28) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
29) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2019-01761) issued 3/25/20.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2019-1236.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

package to be complete. Items (a) — (1) are always applicable to any major development application. Please consult the application
Instruction booklet on how to property prepare the required items below.

b. An accurate, dated work plat (including plan view and cross -sectional drawings) drawn to scale. Please give the present status of the

SUBJECT: Coastal Area Management Act (CAMA) Permit Application Submittal for James
Salmons III in Currituck County
Dear Mr. Salmons III:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Elizabeth City's office on August 23, 2019. Processing of the
application is ongoing. However, it has been determined that additional information will be
required prior to the Division taking final action on your application. The required item is
summarized below:
1) In accordance with 15A NCAC 07H.0208(a)(2)(B), it is the policy of this Division that,
prior to taking final action on a project of this nature, a Water Quality Certification for
the proposed development must first be approved by the Division of Water Resources
(DWR). Based upon the attached hold for additional information from the DWR dated
October 14, 2019, it appears as though additional information from the applicant will be
required before a final decision on issuance of a Water Quality Certification can be made.
Therefore, it is necessary that processing of your permit application be placed in abeyance until
such, time as the required information is provided to the DWR and a copy of the approval
supplied to this office.

On September 16, 2019, the Division of Water Resources (Division) received your application September
16, 2019, requesting a 401 Water Quality Certification from the Division for the subject project. The
Division has determined that your application is incomplete and cannot be processed. The application is
on -hold until all of the following information is received:

A complete review of the project cannot be conducted until the U.S. Army Corps of Engineers has
verified all wetland locations for the project area. [15A NCAC 02H .0502 (a)(7)]
2. Construction Details- USACE
Please provide a narrative describing measures (i.e. utilization of matting, silt fence and/or
turbidity curtain) that will be taken during construction to minimize impacts to 404 wetlands
and/or waters during the subject project. [15A NCAC 02H .0506 (b)(1-5) and (c)(2)]
Pursuant to 15A NCAC 02H .0506(a)(7), 15A NCAC 02H .0506 (b)(1-5) and 15A NCAC 02H .0506 (c)(2), the
applicant shall furnish all of the above requested information for the proper consideration of the
application. Please respond in writing within 30 calendar days of receipt of this letter by sending one (1)
copy of all of the above requested information to the 401 & Buffer Permitting Branch, 1617 Mail Service
Center, Raleigh, NC 27699-1617 OR by submitting all of the above requested information through this

The applicant proposes to dredge and re-establish a canal that has filled in due to land erosion,
bulkhead a canal shoreline along three Lots and install a floating dock.
The site of the proposed development is located at 2237, 2238 & 2240 Sailfish Road adjacent to
both the main man-made canal and a ±840' long finger canal located between Sailfish & Tarpon
Road, within the Carova Beach subdivision in the 4x4 area of Corolla, Currituck County.
The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and
Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:

Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (1) Navigation,
channels, canals and boat basins, (6) Piers and Docking Facilities and (7) Bulkheads pertain to
this project, and those subparagraphs not listed are not applicable to this project.
Paragraph (1) Navigation Channels, Canals, and Boat Basins
Paragraph 1 states that navigation channels, canals and boat basins shall be aligned or located so
as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as
defined by the MFC, or areas of coastal wetlands except as otherwise allowed within this
subchapter.
Consistent: The proposed development is consistent with the intent of this rule.

Subparagraph (1)(A) states that navigation channels and canals may be allowed through fringes
of regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no
significant adverse impacts on fishery resources, water quality or adjacent wetlands, and, if there
is no reasonable alternative that would avoid the wetland losses.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (1)(B) states that all dredged material shall be confined landward of regularly and
irregularly flooded coastal wetlands and stabilized to prevent entry of sediments into the adjacent
water bodies or coastal wetlands.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (1)(C) states that dredged material from maintenance of channels and canals
through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles,
or disposed of by a method having no significant, long-term wetland impacts. Under no
circumstances shall dredged material be placed on regularly flooded wetlands. New dredged
material disposal areas shall not be located in the buffer area as outlined in 15A NCAC 07H
.0209(d)(10).
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (1)(D) states that widths of excavated canals and channels shall be the minimum
required to meet the applicant's needs but not impair water circulation.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (1)(F) states that any canal or boat basin shall be excavated no deeper than the
depth of the connecting waters.
Consistent: The proposed development is consistent with the intent of this rule
Subparagraph (1)(H) states canals shall be designed so as not to create an erosion hazard to
adjoining property. Design may include shoreline stabilization, vegetative stabilization, or
setbacks based on soil characteristics.
Consistent: The proposed development is consistent with the intent of this rule
Subparagraph (1)(I) states that maintenance excavation in canals, channels and boat basins
within primary nursery areas and areas of submerged aquatic vegetation as defined by the MFC
shall be avoided. However, when essential to maintain a traditional and established use,
maintenance excavation may be approved if the applicant meets all of the following criteria: Q

(ii) There exists a previously permitted channel that was constructed or maintained under
permits issued by the State or Federal government. If a natural channel was in use,
or if a human -made channel was constructed before permitting was necessary, there
shall be evidence that the channel was continuously used for a specific purpose;
Potentially Consistent: The existing canal system was constructed before permitting was
necessary and the proposed dredge area has not been maintained; however, the system as a
whole has been continuously maintained and used.
(iii) Excavated material can be removed and placed in a disposal area in accordance with
Part (b)(1)(B) of this Rule without impacting adjacent nursery areas and submerged
aquatic vegetation as defined by the MFC; and
Consistent: The proposed development is consistent with the intent of this rule.
(iv) The original depth and width of a human -made or natural channel shall not be
increased to allow a new or expanded use of the channel:
Consistent: The proposed development is consistent with the intent of this rule.
Paraeranh (6) Piers and Docking Facilities
Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a
maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips
shall not be counted in the total. Projects requiring dimensions greater than those stated in this
Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur. Size restrictions
do not apply to marinas.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(F) states that piers and docking facilities shall be single story. They may be
roofed but shall not be designed to allow second story use.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(G) states that pier and docking facility length shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same shoreline
for similar use; (This restriction does not apply to piers 100 feet or less in length unless
necessary to avoid unreasonable interference with navigation or other uses of the waters by the
public);
Consistent: The proposed development is consistent with the intent of this rule.

(ii) not extending into the channel portion of the water body;
Consistent: The proposed development is consistent with the intent of this rule.
(iii) not extending more than one-fourth the width of a natural water body, or human -made canal
or basin. Measurements to determine widths of the water body, canals or basins shall be made
from the waterward edge of any coastal wetland vegetation that borders the water body. The
one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or
a local government in consultation with the Corps of Engineers, has established an official
pier -head line. The one-fourth length limitation does not apply when the proposed pier is located
between longer piers or docking facilities within 200 feet of the applicant's property. However,
the proposed pier or docking facility shall not be longer than the pier head line established by the
adjacent piers or docking facilities, nor longer than one-third the width of the water body.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(I) states that piers and docking facilities shall not interfere with the access to
any riparian property and shall have a minimum setback of 15 feet between any part of the pier
or docking facility and the adjacent property owner's areas of riparian access.
Consistent: The proposed development is consistent with the intent of this rule.
Paraeraph (7) Bulkheads
Subparagraph (7)(A) states that bulkhead alignment, for the purpose of shoreline stabilization,
shall approximate the location of normal high water or normal water level.
Inconsistent: The proposed bulkhead alignment averages 2' waterward of NWL with a
maximum of 5' waterward.
Subparagraph (7)(B) states that bulkheads shall be constructed landward of coastal wetlands in
order to avoid significant adverse impacts to the resources.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (7)(C) states, Bulkhead backfill material shall be obtained from an upland source
approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a
part of a permitted project involving excavation from a non -upland source, the material so
obtained may be contained behind the bulkhead."
Consistent: The proposed development is consistent with the intent of this rule.

Subparagraph (7)(D) states, `Bulkheads shall be permitted below normal high water or normal
water level only when the following standards are met:
(i) the property to be bulkheaded has an identifiable erosion problem, whether it results from
natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep
grade bank, which will cause the applicant unreasonable hardship under the other provisions of
this Rule;
Consistent: The proposed development is consistent with the intent of this rule.
(ii) the bulkhead alignment extends no further below normal high water or normal water level
than necessary to allow recovery of the area eroded in the year prior to the date of application, to
align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the
unusual geographic or geologic features;
Consistent: The proposed bulkhead averages 2' waterward of NWL with a maximum of 5'
waterward. This alignment is consistent with the CAMA General Permit rule found in
7H.1105(a)(2) for new bulkheads in man-made canals.
(iii) the bulkhead alignment will not adversely impact public trust rights or the property of
adjacent riparian owners;
Consistent: The proposed development is consistent with the intent of this rule.
(iv) the need for a bulkhead below normal high water or normal water level is documented
by the Division of Coastal Management;
Consistent: The proposed development is documented in a Field Investigation Report.
(v) the property to be bulkheaded is in a nonoceanfront area.
Consistent: The proposed development is consistent with the intent of this rule.
15A NCAC 07H.0209 Coastal Shorelines
(c) Management Objective. The management objective is to ensure that shoreline development
is compatible with the dynamic nature of coastal shorelines as well as the values and the
management objectives of the estuarine and ocean system. Other objectives are to conserve and
manage the important natural features of the estuarine and ocean system so as to safeguard and
perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a
management system capable of conserving and utilizing these shorelines so as to maximize their
benefits to the estuarine and ocean system and the people of North Carolina.
Consistent: The proposed development is consistent with the intent of this rule.

(d) Use Standards. Acceptable uses shall be those consistent with the management objectives in
Paragraph (c) of this Rule. These uses shall be limited to those types of development activities
that will not be detrimental to the public trust rights and the biological and physical functions of
the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid,
mitigate or reduce adverse impacts of development to estuarine and coastal systems through the
planning and design of the development project. In every instance, the particular location, use,
and design characteristics shall comply with the general use and specific use standards for
coastal shorelines, and where applicable, the general use and specific use standards for coastal
wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section.
Development shall be compatible with the following standards:
(1) All development projects, proposals, and designs shall preserve and not weaken or eliminate
natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum
protective fringe areas adjacent to vulnerable shorelines.
Consistent: The proposed development is consistent with the intent of this rule.
(2) All development projects, proposals, and designs shall limit the construction of impervious
surfaces and areas not allowing natural drainage to only so much as is necessary to adequately
service the major purpose or use for which the lot is to be developed. Impervious surfaces shall
not exceed 30 percent of the AEC area of the lot, unless the applicant can effectively
demonstrate, through innovative design, that the protection provided by the design would be
equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas
exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are
not increased and the applicant designs the project to comply with the intent of the rule to the
maximum extent feasible.
Consistent: The proposed development is consistent with the intent of this rule.
(3) All development projects, proposals, and designs shall comply with the following mandatory
standards of the North Carolina Sedimentation Pollution Control Act of 1973:
(A) All development projects, proposals, and designs shall provide for a buffer zone along the
margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of
the buffer zone nearest the land disturbing development.
Consistent: The proposed development is consistent with the intent of this rule.
(B) No development project proposal or design shall permit an angle for graded slopes or fill
which is greater than an angle which can be retained by vegetative cover or other erosion -control
devices or structures.

(C) All development projects, proposals, and designs which involve uncovering more than one
acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of
completion of the grading; provided that this shall not apply to clearing land for the purpose of
forming a reservoir later to be inundated.
Consistent: The proposed development is consistent with the intent of this rule.
(4) Development shall not have a significant adverse impact on estuarine and ocean resources.
Significant adverse impacts include development that would directly or indirectly impair water
quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic
Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or
cause degradation of shellfish beds.
Consistent: The proposed development is consistent with the intent of this rule.
(5) Development shall not interfere with existing public rights of access to, or use of, navigable
waters or public resources.
Consistent: The proposed development is consistent with the intent of this rule.
(7) Development shall not cause irreversible damage to valuable, historic architectural or
archaeological resources as documented by the local historic commission or the North Carolina
Department of Cultural Resources.
Consistent: The proposed development is consistent with the intent of this rule.
(8) Established common-law and statutory public rights of access to the public trust lands and
waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach
upon public accessways nor shall it limit the intended use of the accessways.
Consistent: The proposed development is consistent with the intent of this rule.
(10) Within the Coastal Shorelines category (estuarine and public trust shoreline AECs), new
development shall be located a distance of 30 feet landward of the normal water level or normal
high water level, with the exception of the following:
(A) Water -dependent uses as described in Rule 07H .0208(a)(1) of this Section;
Consistent: The proposed development is consistent with the intent of this rule.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application and plans, I recommend a permit be issued to Jim Salmon, III for the
development as proposed.

Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 2006 Core Land Use Plan (LUP) certified by the CRC on
May 18, 2007 as amended through July 2, 2019.
Overview: The project areas consist of a man-made canal that connects to Knotts Island Bay
along 2238 Sailfish Road and a connecting finger canal along adjoining properties at 2237, 2238
and 2240 Sailfish Road; the terminus of the finger canal along the east side of 2229 Sailfish Road,
and; nearby undeveloped lots along the canal at 2231 Sailfish Road and 2246, 2244, 2238 and
2230 Tarpon Road. Water depths in the canals along 2237, 2238 and 2240 Sailfish Road average
1.7 feet below Normal Water Level (NWL). Shoreline along the property at 2238 Sailfish Road
and the adjacent man-made canal are primarily within the AE (4) Floodzone, with the finger canal
and remaining properties being located primarily outside of a Foodzone. Properties in this area
are within. the Coastal Barrier Resource System (CBRS) zone where federal expenditures and
financial assistance that encourage development, such as federal flood insurance, are restricted.
The properties at 2237, 2238 and 2240 Sailfish Road total 1.47 acres and have a combined
shoreline of 610 liner feet. The majority of shoreline either slopes to NWL or has a 1 foot to 3
foot vegetated erosion escarpment. Approximately 120 feet of the shoreline contains a Section
404 wetland; fringe growing along NWL. Site elevations range from 4 feet to 5 feet ab eIV ED

The highground area is vegetated with live oaks, pines and other upland vegetation. Existing site
improvements are limited to a single-family house with associated septic system at 2240 Sailfish
Road. Existing shoreline improvement consist of a 4 foot wide by 6 foot long pier with a 4 foot by
16 foot terminus platform at 2240 Sailfish Road. A 36 foot wide Section 404 wetland extending 25
feet landward of NWL is located along the .35 acre 2229 Sailfish Road property at the terminus
of the finger canal. The finger canal has not been maintained. Adjacent highground area has
eroded into the canal creating two (2) choke points that are 10 feet to 15 feet wide with water
depths of .5 feet to 1 foot below NWL across from 2240 and 2237 Sailfish Road and the terminus
of the finger canal has filled in along 2229 Sailfish Road. Erosion and filling in of the canal system
is a common occurrence after major storm events due to the sandy nature of the highground area
and the lack of stabilizing vegetation.
Dredging of 36 foot wide by 230 foot long area in the manmade canal and a 36 foot wide by 530
foot long connecting area in the finger canal to a connective depth of 4 feet below NWL at 2237,
2238 and 2240 Sailfish Road; dredging of a 36 foot wide by 90 foot long area at the terminus of
the finger canal at 2229 Sailfish Road; storage of spoil within nine (9) 50 foot by 50 foot silt fenced
areas located on the above properties and at 2231 Sailfish Road and 2246, 2244, 2238 and 2230
Tarpon Road; installation of 606 linear feet of bulkhead with return walls totaling 34.5 linear feet
at 2237, 2238 and 2240 Sailfish Road, and; installation of a 6 foot wide by 10 foot long walkway
connecting to a 6 foot wide by 40 foot long floating dock at 2240 Sailfish Road are proposed.
Canal widths will be 36 feet after dredging. Escarpments associated with dredging will be graded,
sloped and stabilized to prevent further erosion. Dredge spoil storage areas will be located
greater than 30 feet from the shoreline. Spoils will be stored for future use in the construction of
single-family houses, leveling of highground or as backfill for bulkhead. Bulkhead return walls will
be 23.5 feet long to the southwest and 11 feet long to the east. Bulkhead alignment will average
2 feet waterward of NWL with a maximum distance of 5 feet waterward of NWL. Bulkhead will be
backfilled with dried dredge spoils. The floating dock will be located adjacent and parallel to the
bulkhead. The floating dock will provide two (2) wet slips.
The waters of the man-made and finger canals connecting to Knotts Island Bay are classified as
SC.(fish propagation) and Joint Waters, and are closed to shellfish taking. Submerged Aquatic
Vegetation (SAV) is not present_ within the canal. A review of historic or archaeological resources
was not provided. .
Anticipated impacts resulting from this project are expected to include: the dredging of .75 acre
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC), 1,700 sq. ft. of
Section 404 wetlands within the Estuarine Shoreline AEC and 1,890 sq. ft. of Highground within
the Estuarine Shoreline AEC; the filling of 1,211 sq. ft. of Public Trust Area/Estuarine Waters
AEC; the shading of 240 sq. ft. of Public Trust Area/Estuarine Waters AEC, and; the disturbance
of .79 acre of Highground within the Estuarine Shoreline AEC.

Basis for Determination:
The project area is located within the "Carova Sub -Area" and is designated as "Limited Service
Areas (Areas Preferred for Low Density Development)" on the Currituck County Future Land Use
Map (FLUM); with Areas of Environmental Concern (AECs) designated as "Conservation Areas"
as indicated on Page 11-1.
As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the long-
term management and protection of significant, limited, or irreplaceable areas. Proper
management is needed to conserve the natural, cultural, recreational, scenic or biologically
productive values of these areas. The designation is applied to areas that should not be
developed at all (preserved), or if developed, done so in a very limited manner characterized by
careful planning and cautious attention to the conservation of environmental features.
Land Use Plan policies address the use of vegetated buffers to reduce pollutants and protect
water quality. The project areas contain shoreline along an existing man-made canal and finger
canal with erosion escarpments. Bulkhead will help protect water quality by reducing soil erosion
and sedimentation.
Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or
foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply
financial support".
The following LUP policies may be applicable to this request:

essential to the quality of life of residents and visitors, as well as the
economy of the area. The County supports the establishment of

critical habitat for many plant and animal species. Currituck County
supports the efforts of the U.S. Army Corps of Engineers in protecting
such wetlands through the Section 4042 permit program of the Clean
Water Act, as well as Section 4013 water quality certifications by the

On September 16, 2019, the Washington Regional.Office of the Division of Energy, Mineral,
and Land Resources receiveda copy of your CAMA Major application for a -project site located at .
2240 Sailfish, Road in Corolla, NC. The pro posal.involves.maintenance dredging in,the adjacent
canal and the construction of a wooden bulkhead. Staff review"of the plans .and specif cations has
determined that the project, as proposed, consists of activities thatwill not pose surface water
quality threats from stormwater runoff. The'Director has determined that projects that are
reviewed and approved by the Division as not posing water quality threats from stormwater runoff
should.not be subject to the stormwater management permitting requirements of 15A NCAC
2H.1000. For this reason, we are.informing you by way of this letter that the current project will
not require a State Stormwater management permit.
The stormwater rules require the Division to permit the common plan of development,
therefore, any future development.on the.property, regardless of whether a SEC plan or CAMA
Major permit is also required, will require a Stormwater Management Permit application and
permit issuance from the Division of Energy,,Mineral, and Land Resources prior to any
construction. Any construction on the subject site, prior to receipt of the required permit,will
constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement actions by
this Office.

The Permittee shall adhere to Title 15A NCAC 02B .0220 Tidal Salt Water Quality for SC Waters,
including but not limited to:
(12) pH: shall be between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is
the result of natural conditions; [15A NCAC 02B .0220(12)]
(19) Turbidity: the turbidity in the receiving waters shall not exceed 25 NTU; if turbidity exceeds this
level due to natural background conditions, the existing turbidity level shall not be increased.
Compliance with this turbidity standard shall be met when land development management activities
employ Best Management Practices (BMPs); [15A NCAC 02B .0220(19)]

This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as

Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition

Reference the application of Mr. James Salmons to maintenance dredge approximately 32,760
square feet of shallow water bottom, and 1,700 sq ft of 404-wetlands (2,895 cubic yards), construct
a 605 linear foot bulkhead with 1,211 sq ft of backfill, construct 40x6 floating dock and 1 Ox6
walkway at 2240 Sailfish Road, in Corolla, Currituck County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or

maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's
right to free navigation on all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout water GIE IVfh= D

11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
12. In order to protect the endangered West Indian manatee (Trichechus manatus) the Permittee
shall implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at http://www.fws.gov/nc-
es/mammal/manatee_guidelines.pdf.

Project Seftinp
The site of the proposed development is located at 2237, 2238 & 2240 Sailfish Road adjacent
to both the main man-made canal and a ±840' long finger canal located between Sailfish &
Tarpon Road, within the Carova Beach subdivision in the 4x4 area of Corolla, Currituck County.
These three properties have a total combined size of±63,900 ft2, have elevations of 4'-5' above
Normal Water Level (NWL) and the highground area is vegetated with live oaks, pines and
other upland vegetation. Man-made features include a residential single-family dwelling with
septic (2240 Sailfish Road). According to the USDA's Natural Resources Conservation
Service's Web Soil Survey, the soil within this entire area is made up of Newhan-Corolla
complex (NhC).
The applicant's properties have a total combined shoreline length of ±610'. The majority of the
shoreline either slopes down to NWL or has a ±1'-3' erosion escarpment that is vegetated with
wax myrtles, small pines, upland grasses and shrubbery. Approximately ±120' of the shoreline
contains what appears to be fringe USACE 404-wetland growing along NWL. A small 6'x4' pier
with a 16'x4' platform is located along the shoreline off of 2240 Sailfish Road.
The canal system that the project will impact has ±1,955' of shoreline that is similar to the
applicants both in erosion escarpment heights and vegetation. An area of USACE 404-
wetlands is located at the end of the finger canal that is ±36' in width and extends ±25'
landward of NWL at which point elevations quickly rise to highground area. This finger canal
has not been maintained and overthe years the adjacent highground area has eroded into the
canal creating two choke points that are ±10'-15' in width with water depths of ±0.5'-1' below
NWL as well as filling in the end of the canal. This is a common occurrence in the canal system
after major rain events due to the sandy nature of the highground area as well as the lack of
stabilizing vegetation.
The waters of the canals lead to Knotts Island Bay and are classified as SC, are closed to the
taking of shellfish and are considered Joint Waters. With the exception of the choke points,
water depths within the project area range from ±1'-4' below NWL. The bottom substrate is
made up of fine sands and silt. Submerged Aquatic Vegetation (SAV) is not present within the
project area; however, patches of eurasion water milfoil (Myriophyllum spicafum) were
observed.
Both adjacent riparian properties are undeveloped, as are the majority of the Lots along the
finger canal.
Development Proposal
The applicant proposes to maintenance dredge two sections of canal in order to restore
navigation. The dredging will be done mechanically using a long reach excavator positioned on
land.

Ze box cut will be dredged to the connective depth of 4' below NWL. This depth is found

Section 2 is located at the end of the finger canal and is ±90' in length. Only ±20' of the
dredge area is proposed within the waters of the canal itself, the remaining distance will be
landward of NWL within the platted confines of the canal. This section will also be dredged
to a depth of 4' below NWL with a 36' wide box cut. Water depths within the ±20' canal area
average ±1.9' below NWL. It is estimated that dredging within this section will remove ±900
ft2 of USACE 404-wetlands located between NWL and highground.
The resulting dredge spoils will be stored on nine separate Lots within 50'x50' silt fenced areas
located landward of the CAMA 30' Buffer. The resulting spoils will be stored for future use in
the construction of single-family dwellings, used to level the highground area or used as a
bulkhead backfill source.
Any resulting steep sloped escarpments along the shoreline resulting from the dredging will
graded, sloped and stabilized to prevent future erosion.
After dredging is complete, the applicant then proposes to stabilize the shoreline along 2237,
2238 & 2240 Sailfish Road with a wooden bulkhead. This bulkhead will be ±605.5' in length
with a 23.5' return on the southwest end and a 11' return on the eastern end. The proposed
alignment will average 2' waterward of NWL with a maximum distance of 5' waterward of NWL.
The bulkhead will be backfilled with dried dredge spoils.
The applicant then proposes to install a 10'x6' walkway on land leading to a 40'x6' floating dock
installed adjacent and parallel to the bulkhead at 2240 Sailfish Road. It is anticipated that the
canal width upon dredging and bulkhead completion will be ±36', creating a Y. width of 9'
waterward of NWL. Two wet slips will be associated with the proposed dock.
Anticipated Impacts
• The proposed 36' wide box cut and anticipated bottom sloughing for slope (42' top width)
will result in ±32,760 ft2 of shallow water bottom disturbance within the PTA and EW AEC's.
• The proposed dredging will result in the removal of ±1,700 ft2 of USACE 404-wetlands
within the ES AEC.
• The proposed dredging will result in ±1,890 ft2 of highground excavation within the ES AEC.
• Within Section 1, the proposed dredging will result in ±2,331 cubic yards of sandy material
being removed. Within Section 2, ±51 cubic yards will be removed waterward of NWL and
±513 cubic yards will be removed landward of NWL. (Total is estimated at ±2,895 cubic
yards)
• The nine dredge spoil sites will result in ±22,500 ft2 of highground disturbance within the ES
AEC and should be adequate to store the volume of spoils.
• The proposed dredging will temporarily increase turbidity.
• The construction of the bulkhead along the proposed alignment will result in the filling of
±1,211 ft2 of the PTA and EW AEC's. RECENED

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval to dredge and re-establish a canal that has filled in due to land erosion, bulkhead
canal shoreline along three lots and install a floating dock, located at 2237, 2238, & 2240 Sailfish
Road, Corolla, in Currituck County, was received complete on August 23, 2019 and appears to be,
adequate for processing at this time. The projected deadline for making a decision is November
6, 2019. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or
about the 75th day.
If this agency does not render a permit decision within 70 days from August 23, 2019, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.

Sailfish/Tarpon Rd Dredge Project, Carova Beach
Our group is applying for a North Carolina Major Development Permit in order to dredge out the
canal and achieve boating access. The canal became blocked years ago due to the area formerly being
used as a cow pasture and the cows crossing sloughed shoreline. The dredge spoils will be used to make
house pads, raise septic areas, and level properties. We will be mechanically dredging using a long reach
excavator from land and stacking material on the landowners' lots. We will be putting silt fence on spoil
areas along with sloping the bank while digging to prevent future erosion. Once dried, a bobcat or small
bulldozer will grade the material out. Our goal is to improve the water quality and water depth for
boating traffic in the canal.
Mr. Salmons is also applying for a structural permit to bulkhead his 3 lots (37,38, and 39) along
with adding a 40'x6' floating dock to lot 38. This new dock will replace an existing dock on the property.

April 4, 2019
The NC Division of Coastal Management acknowledged receipt of your application on April
4, 2017, for State approval for the development of the referenced project At that time, an
initial screening of the submittal package was conducted as per 15A NCAC 07J.0204 that
revealed certain deficiencies which had to be corrected before the application package could
be accepted as complete. On March 26, 2019, our office received a resubmittal of your
application for the referenced project which included additional proposed development. A
screening of this submittal package revealed certain deficiencies, which must be corrected
before the application package can be accepted as complete. To assist you in expediting the
permitting process as much as possible, I am notifying you of these deficiencies immediately
so that they can be quickly corrected to facilitate my detailed review.
I am returning the original application package so that the needed changes can be made, but
will retain a copy so that I can commence the detailed review. Please understand that the
subsequent detailed review may reveal additional areas where further information or
documentation is required to demonstrate compliance with the rules directly applicable to
the proposed development. If this occurs, you will be notified of such issues separately.
Our initial screening has identified the following deficiencies:
1. Not all questions on the application have been answered, or indicated as "not
applicable." Please address the following items:

- Number 3, add Lot #39 to the Lot numbers (added to project).

• Form DCM-MP-2:
- Within the Table at the top of page one:
1. The identified length of 670' for the main dredge area appears
to be —90' short. The submitted site plan was not to scale, so I
overlaid an image of it in Google Earth and got it to be scaled to
determine this. I get a value of —760' measuring the centerline
of the identified dredge area.
2. Indicate a dredge 36' width
3. The average existing depth lists a depth of 1.9" for the 90'
section. I believe this is supposed to be 1.9'. Please confirm.
- Number 1(a), this amount needs adjusted for the additional dredge
area within the main canal that was added since the last review.
- Number 1(c), I previously indicated that there is a total of —1,700 sf
of 404-wetland areas being excavated. The end of the canal has —25'
area between the shoreline and highground that is wetlands.
25'x36'=900sf + approximately 800 sf of additional fringe wetlands
that will be excavated.
- Number 3. The proposed bulkhead must be shown on the site plan
and match the information provided in this section. When the
bulkhead's proposed alignment is shown on the site plan, this section
will be reevaluated.
- A signature is required at the end of MP-2
• Form DCM-MP-3:
- Number 1(g), the number of slips proposed is listed as 0. Is this
correct? You are not planning to moor any vessels at the proposed
docks?
- Number 7(c), indicate the width of the canal at the proposed dock
location, not the main canal width.
- Number 8, add the walkway dimensions that extend from land to the
floating docks
2. Adequate Work Plans or Drawings have not been submitted. Please address the
following items:

- Shows updated and corrected Normal Water Level (NWL). See
attached corrected drawings. Google Earth updated to 2018 Imagery
since the 2017 submittal and I have the ability to overlay the site plan
to see the correct NWL verses the site plan NWL. As you can see, in
some areas it is quite a bit off, especially in the proposed dock areas.
- Correct the 30' CAMA Buffer and 75' AEC lines in relation to the
corrected NWL.
- Shows the floating docks waterward of the NWL. As shown, they are
on land.

Shows the existing dock in the correct location and indicated as 'to be
removed'.
Shows the proposed bulkhead alignment in relation to NWL on the
same site plan as the proposed dredging and docks. You should
accurately show this on the site plan as any deviation will require
permit modification, which could take some time to approve.

■ A Drawing reflecting other regulatory requirements for Sedimentation and
Erosion Control may be required; or you may include on the submitted plat
any permanent or temporary structures or grading that will take place within
the AEC to achieve compliance with Sedimentation and Erosion Control Plan.
3. A Narrative Description of the proposed development was provided; however, it did
not include the proposed bulkhead. Please add that to it. Also, please address what
measures will be taken to prevent sedimentation back into the canal where a steep
slope may occur (adjacent to Bonney) due to cutting into the bank. Examples could
be sloping the shoreline or installing silt fence and vegetating the bank.
4. A copy of a Deed or other Title Indicating Document must be provided for 2237, 2238
& 2240 Sailfish Road. Please submit the needed documentation.
S. Regarding documentation of Notification of Riparian Property Owners:
■ Since the 2017 submittal, 2228 Tarpon Road was sold to Nosay, but Nosay was
not notified.
• Six recent notifications (March 2019) used old forms with an incorrect address
to contact us. The notification forms were also not fully filled out indicating
who was applying for the permit and where the project is located.
■ The remaining notifications are dated from 2016 and 2017 and those
notifications would not have included the proposed docks or bulkhead and are
now considered expired.
Please renotify all parties using the enclosed notification form and provide the latest
application and site plan showing all of the proposed development.
Please submit the signed Certified Return -Mail Receipts (or signed notification forms)
for this notification, along with a copy of the notification letter provided to these
owners and any comments received in reply.

To expedite our response to your permitting request, we will commence the detailed review
of your application for a permit pending the receipt of the additional information requested
above. However, the statutorily provided 75/150 days allowed for review cannot commence
until such time as we have received a complete application package. Once your application
has been accepted as complete, you will receive a separate notification letter.
If it is not possible to render a permit decision within 70 days of the date when your
application is received complete, you may request a meeting with the Director of the Division
of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall
include the property owner, developer, and project designer/consultant.

Dear Mr. Salmons:
On March 26, 2019, the NC Division of Coastal Management acknowledged receipt of your application for a project
located within the Carova Beach subdivision, Corolla, Currituck County. An initial screening of the submittal package
was conducted, which revealed certain deficiencies that required your attention. The entire original application was
returned to you, with an office copy retained for my review.
On July 24, 2019, our office received documents for your re -submittal of the application. My subsequent review has
revealed that your application is still incomplete. My office must receive the following data before the Major Permit
Application can be accepted as complete:
1. On MP-2, #3(c)&(d), it was indicated that the average and maximum distance waterward of NWL for the
proposed bulkhead alignment is 0'. However, the submitted site plan scales the bulkhead alignment --10'
waterward of NWL at several locations adjacent to Lot 39. Either MP-2 needs to be corrected to reflect this or
the bulkhead alignment on the site plans needs adjusted. I don't believe it was your intention to go that far out
with the bulkhead and it's hard to gauge at a 1 "=100' scale, so bringing the alignment closer to the NWL with
a statement that the proposed bulkhead will approximate NWL may be the needed correction for this.
2. The submitted photocopied sheets of the green & white certified mail receipts cut off the tracking numbers on
6 of the receipts, so they cannot be tracked by our office. Please submit the original receipts, or more
importantly, submit the signed and dated certified mail return green cards or any signed fortes, comments or
objections.
