HomeMy WebLinkAbout111-20 Safe HarborPermit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission ,pernnit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Safe Harbor, 4909 Fish Factory Rd., Southport, NC 28461 Permit Number 111-20 Authorizing development in Brunswick County at adi. to the AIW W, within the Town of Southport, at 4909 Fish Factory Road , as requested in the permittee's application dated 7/2/20, including attached workplan drawings (4), "South Harbor Village Project Area" dated "received DCM Wilmington, NC" 6/19/20, and drawings 24 of 4 dated 3/19/20. This permit, issued on November 20, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation It these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be nun ana voia. Excavation 1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 2) No excavation shall take place outside of the area indicated on the workplan drawings. 3) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible, on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Safe Harbor Permit No. 111-20 Page 2 of 4 ADDITIONAL CONDITIONS 4) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 5) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters outside of the alignment of the fill area indicated on the workplan drawing. 6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7) In order to prevent leakage, dredge pipes shall be routinely inspected. If leakage is found and repairs cannot be made immediately, pumping of material shall stop until such leaks are fixed. Spoil Disposal 8) No spoil material shall be placed within 30 feet of the normal high water line. 9) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the site is graded and stabilized. 10) The disposal area effluent shall be contained by.pipe, trough, or similar device to a point at or beyond the normal low water level to prevent gully erosion and unnecessary siltation. 11) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 12) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance with water quality standards. 13) The diked disposal area shall be constructed a sufficient distance'from the normal high-water level or any marsh and sufficiently maintained to eliminate the possibility of dike erosion or spoil deposition into surrounding wetlands or waters. 14) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 15) If the alignment of the dredge pipe changes from the attached workplan drawings, the permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) The permittee shall obtain any authorizations necessary for the placement of the dredge pipeline above the normal high water line. Failure to obtain these authorization may result in a violation of this permit. op Safe Harbor ADDITIONAL CONDITIONS Maintenance Clause Permit No. 111-20 Page 3 of 4 17) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the peimittee's signature shown anew on the original plan. Stormwater Manaaement 18) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA permit. Sedimentation and Erosion Control 19) An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC 28405. 20) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 22) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. USACE / FEDERAL CONDITIONS 23) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found httns://www.fws.eov/raleigh/t)dfs/ManateeGuidelines20l7.pdf. General 24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Safe Harbor Permit No.111-20 Page 4 of 4 ADDITIONAL CONDITIONS 25) All debris associated with the permitted dredging activity shall be contained within the authorized project area and removed to an appropriate upland location. 26) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit No. 198000291 (Action ID SAW-1 998-0069 1). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0909. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $400 was received by DCM for this project. The existing dredge basin measures approximately 450 feet long by 510 feet wide and the applicant proposes to expand this to 475 feet long by 510 feet wide (an increase of 20,834 square feet with irregular shape) to connect to deeper waters waterward toward and adjacent to the AIW W. The applicant estimates a total of 25,500 cubic yards of sediment would be dredged and the total dredged area would be 242,250 square feet. The applicant is proposing to conduct all dredging outside the moratorium period as previously permitted. The applicant is proposing to utilize a previously permitted upland on -site spoil pond (Parcel 2360001806) to dispose of the dredged material. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: Special Conditions 1. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. N 2. No dredging shall be permitted between April 1 and September 30 of any year without the prior approval of the USACE, in consultation with appropriate resource agencies. 3. Except as authorized by this permit or any USACE approved modification to this permit, no dredge, fill, or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project within waters outside the designated permitted boundary. This permit does not authorize temporary placement or double handling of excavated or fill material within waters outside the permitted area. 4. PROJECT DESCRIPTION The project site is located at 4909 Fish Factory Road off of Hwy 133 adjacent to the Atlantic Intracoastal Waterway, in Southport, Brunswick County, North Carolina. The property is located between Southport and the Oak Island Bridge on the mainland. The property has approximately 1,472 linear ft. of shoreline. The newly purchased portion of the marina property is a combination of parcels 2360001806, 236EB03842 and 208614438875, which encompasses 537,317 sq. ft, of land. This includes a full -service marina facility consisting of 157 permitted wet slips, bulkhead, marina office and upland spoil basin. The 4.6 acre Marina and 8.5 acre spoil pond were sold to Safe Harbor (SMH SHV, LLC ) on September 30, 2019. The facility also includes a pump out station and fuel dock. The existing facility consists of: A, B C and D-Docks with floating docks and finger piers within the upland basin (the end of A -Dock also includes an existing approximately 490 linear ft. fueling dock). The property is bordered by residential housing to the west, Duke Energy to the east, the AIWW to the south and private undeveloped land to the north. The elevation of the tract ranges from 3ft. to 9 ft. above Mean High Water (MHW). There are wetlands on site, but there are no coastal wetlands within the marina basin project area. Former owners of the project area utilized the site as a fish processing plant and upland areas were previously part of a remediation program until 1995. State Permit No. 31-99 was originally issued to South Harbour Village, LLC on April 8, 1999 for excavation of an upland basin (to -6 ft. at NLW), construction of a marina with shoreline stabilization, associated upland development (including residential development) and a designated spoil site. This permit was modified on April 1, 2002 for additional of finger piers and boatslips waterward of the existing fuel dock along with a maintenance dredging clause. The permit was further renewed on January 3, 2003, March 14, 2005 under a Maintenance 5. Additional minor modifications were issued on November 23, 2004 and June 28, 2006 for additional slips and again on May 19, 2009 for additional excavation to be dredged at the end of A and D docks to a depth of - 6 ft. at NWL (NAVD88), this also included a docking facility reconfiguration. In 2010 South Harbour Marina received a Pumpout Grant Award from the NC Marine Sewage Pumpout Station Grant Program for installation of a pumpout onsite. A minor modification was issued on March 6, 2012 to change the excavation methodology from bucket to barge to hydraulic dredging, this modification also included the redevelopment on the permitted disposal area. On February 13, 2013 another minor modification was issued for installation of two silt barriers underneath A -Dock and D -Dock and to add 4 slips on C-Dock. At this time the marina was permitted for a total of 157 formalized boatslips, although it is currently operating with 153 boatslips. An additional modification issued on April 23, 2014 authorized construction of a 25 linear ft. rip rap groin at the western end of the marina. Further authorization to raise the dike walls and increase capacity at the designated spoil site was issued on December 12, 2014. The latest renewal was issued on December 6, 2018 and State Permit No. 31-99 is due to expire on December 31, 2023. According to the permit file maintenance events have occurred in 2006 and 2012. It is the intent of the current applicant to submit this new major permit application for parcels 2360001806 (Spoil Site), 236EB03842 (Vacant Upland), 208614438875 (Marina) only, this includes the marina basin and upland spoil site. The waters of the AIWW in this location are classified as "SA/HQW" by the North Carolina Division of Water Resources. The area is NOT designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is closed to the harvest of shellfish. ANTICIPATED IMPACTS: The project would result in an additional 2 ft. of excavation depth within the expanded dredge footprint for a total of 242,250 sq, ft. of open water impacts within Estuarine Water and Public Trust Areas. NOTE: Depending on methodology and need, work behind sediment curtains will be considered in consultation with the DMF upon request from the permittee. 4) All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands within adequate dikes or other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding waters. 5) The terminal end of the pipeline from the dredge into the diked retention area will be positioned at or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent dike erosion and to allow adequate settlement of suspended solids. 6) A water control structure will be installed at the intake end of the effluent pipe leading from the retention area in order to ensure maximum settlement of suspended solids. 7) Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at or below the mean low water (ML)W) elevation contour to prevent gully erosion and siltation. 8) No excavated materials will be placed at any time, including temporarily, in any vegetated wetlands or waters. 9) No vegetated wetlands will be excavated. 10) Excavation will not exceed 6 feet below the elevation of ML W. 11) Should basin excavation cause contaminants to be introduced into adjacent public trust waters due to prior use of the property, the permittee will cease work and request a consultation site visit by a DCM representative who will involve other appropriate agencies. Bulkhead 12) The bulkhead must be constructed prior to any backfilling activities. Marina Operation 16) Prior to the occupancy of any slips or other docking facility authorized by this permit, the permittee will install and maintain operational for the life of the project a pumpout facility to service boats with holding tanks. 17) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structures, whether floating or stationary, may become a permanent part of this boating facility without permit modification. No non -water dependent uses of structures may be conducted on, in, or over public trust waters without permit modification. 18) No sewage, whether treated or untreated, shall be discharged at any time from boats using the boating facility. Any sewage discharge at the boating facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 19) The permittee will post at the basin entrance and on the transient dock a "No Sewage Discharge Policy". 20) Marine maintenance is not authorized at the facility. 21) No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work.
