Southport, at 4909 Fish Factory Road , as requested in the permittee's application dated 7/2/20, including attached
workplan drawings (4), "South Harbor Village Project Area" dated "received DCM Wilmington, NC" 6/19/20, and drawings 24 of 4 dated 3/19/20.
This permit, issued on November 20, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Excavation
1) In order to protect juvenile shrimp and finfish populations, no excavation or filling shall be permitted
between April 1 and September 30 of any year without the prior approval of the Division of Coastal
Management, in consultation with appropriate resource agencies.
2) No excavation shall take place outside of the area indicated on the workplan drawings.
3) Excavation shall not exceed -8 feet below the normal low water level. In no case shall the depth of
excavation exceed the depth of connecting waters.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible, on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
5) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding
waters outside of the alignment of the fill area indicated on the workplan drawing.
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
7) In order to prevent leakage, dredge pipes shall be routinely inspected. If leakage is found and repairs
cannot be made immediately, pumping of material shall stop until such leaks are fixed.
Spoil Disposal
8) No spoil material shall be placed within 30 feet of the normal high water line.
9) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters. The barriers shall be maintained and functional until the
site is graded and stabilized.
10) The disposal area effluent shall be contained by.pipe, trough, or similar device to a point at or beyond
the normal low water level to prevent gully erosion and unnecessary siltation.
11) The terminal end of the pipeline shall be positioned at or greater than 50 feet from any part of the dike
and a maximum distance from spillways to allow settlement of suspended sediments.
12) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance
with water quality standards.
13) The diked disposal area shall be constructed a sufficient distance'from the normal high-water level or
any marsh and sufficiently maintained to eliminate the possibility of dike erosion or spoil deposition into
surrounding wetlands or waters.
14) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
15) If the alignment of the dredge pipe changes from the attached workplan drawings, the permittee and/or
his or her contractor shall meet with a representative of the Division prior to project initiation.
16) The permittee shall obtain any authorizations necessary for the placement of the dredge pipeline above
the normal high water line. Failure to obtain these authorization may result in a violation of this permit.

17) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the peimittee's signature shown anew on the original plan.
Stormwater Manaaement
18) The Division of Energy, Mineral and Land Resources (DEMLR) has determined this project will require
a Stormwater Management permit. The permittee shall receive a Stormwater Management permit from
DEMLR prior to the initiation of any construction. Submit this plan to the Division of Energy, Mineral
and Land Resources, Land Quality Section, 127 Cardinal Drive Extension, Wilmington, NC
28405. Any violation of the permit approved by DEMLR shall be considered a violation of this CAMA
permit.
Sedimentation and Erosion Control
19) An Erosion and Sedimentation Control Plan will be required for this project. This plan must be filed at
least thirty (30) days prior to the beginning of any land disturbing activity. Submit this plan to the
Division of Energy, Mineral and Land Resources, Land Quality Section, 127 Cardinal Drive Extension,
Wilmington, NC 28405.
20) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
22) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
USACE / FEDERAL CONDITIONS
23) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

24) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.

25) All debris associated with the permitted dredging activity shall be contained within the authorized
project area and removed to an appropriate upland location.
26) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit No. 198000291 (Action ID SAW-1 998-0069 1).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0909.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

It is the staffs recommendation that the proposed increased dredging depths and excavation area for maintenance excavation
within the existing developed basin area and the AIWW is CONSISTENT with the Rules of 15 NCAC 7H.0208 (b)(5) Marinas
(G), which states that manna basins shall be designed to promote Flushing with the basin and channel depths never deeper than
the waters they connect to. This office has no objection to the proposed work provided it is consistent with all other state and
federal permitting requirements.

This project is consistent with the City of Southport Land Use Plan.
The applicant proposes to increase the permitted dredging depths from -6 ft. at NLW to -
8 ft. at NLW and to expand the existing dredge footprint for future hydraulic dredging
maintenance events. The project is located at 4909 Fish Factory Road, adjacent to the
Intracoastal Waterway in Southport.
Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine
Shoreline. Waters at the project site are classified as SA/HQW and are not open to the
harvesting of shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Southport Land Use Plan and offer
the following comments.
The general area of the project is classified as Residential Mixed Use.
In general, the Southport Land Use Plan allows development in Residential Mixed Use
classified AECs which is consistent with the State's minimum use standards. The
Southport Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
Provided all local, state and federal requirements can be met, this project appears to be
consistent with the City of Southport Land Use Plan.

South Harbour Village Maintenance Excavation Project - Southport NC 28461
Dear Mr. Brown:
You have our approval, in accordance with the attached conditions and those listed below to increase
the permitted dredging depth from -6' to -8' at normal low water (NLW), and expand the dredging
footprint within an existing marina basin, impacting approximately 5.5 acres of shallow bottom
habitat, as described in your CAMA Major Development Permit application, which was received by
the Division of Water Resources (Division) on July 10, 2020. After reviewing your application, we
have decided that the impacts are covered by General Water Quality Certification Number 4175 (GC
4175).
This Certification allows you to use the General Permit No. 198000291 when issued by the US Army
Corps of Engineers and the CAMA Major Permit when issued by the Division of Coastal Management
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, Water Supply Watershed, and stormwater regulations. Also, this approval
to proceed with your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 or CAMA Permit.
This approval requires you to follow the conditions listed in the attached certification and any
additional conditions listed on the following pages.
The Additional Conditions of the Certification are:
1. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you change
your project, you must notify the Division and you may be required to submit a new application
package with the appropriate fee.

2. The applicant shall require his contractors (and/or agents) to comply with all of the
terms of this Certification, and shall provide each of its contractors (and/or agents) a copy of
this Certification.
3. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the Certification
for a specific project shall remain in effect for the life of the project, regardless of the expiration of
this Certification.
4. The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State\water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of State
and Federal law. If the Division determines that such standards or laws are not being met, including
failure to sustain a designated or achieved use, or that State or Federal law is being violated, or that
further conditions are necessary to assure compliance, than the Division may reevaluate and modify
this General Water Quality Certification.
5. All mechanized equipment operated near surface waters shall be inspected and maintained
regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or
other toxic materials. Construction shall be staged in order to minimize the exposure of equipment
to surface waters to the maximum extent practicable. Fueling, lubrication and general equipment
maintenance shall be performed in a manner to prevent, to the maximum extent practicable,
contamination of surface waters by fuels and oils. [15A NCAC 02H .0506(b)(3) and (c)(3) and 15A
NCAC 02B .0211(12)]
6. The permittee shall report to the Wilmington Regional Office at (910) 796-7215 (after
hours and on weekends call 800-858-0368) any noncompliance with this certification, any
violation of stream or wetland standards [15A NCAC 02B .0200] including but not limited to
sediment impacts [15A NCAC 02B .0200]. Information shall be provided orally within 24 hours (or
the next business day if a weekend or holiday) from the time the applicant became aware of the
circumstances. A written submission shall also be provided within 5 business days of the time the
applicant becomes aware of the circumstances. The written submission shall contain a description
of the noncompliance, and its causes; the period of noncompliance, including exact dates and times,
if the noncompliance has not been corrected, the anticipated time compliance is expected to
continue; and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the
noncompliance. The Division may waive the written submission requirement on a case -by -case
basis.
7. Moratoriums
You will comply with any moratoriums per the NC Division of Marine Fisheries and the NC
Wildlife Resources Commission. Dredging moratoriums shall be observed as required by the NC
Division of Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and National Marine
Fisheries. If such activities should take place during periods of high biological activity (e.g.
anadromous species and shorebirds), biological monitoring may be required at the request of
other state and federal agencies and coordinated with these dredging activities.
8. Please understand that the waters adjacent to your project area have been identified by the
Division of Marine Fisheries as Primary Nursery Area (PNA). Should the need for dredging within
the proposed project area arise in the future, please be aware that new dredging within a PNA is not

allowed under 15A NCAC 02B .0221 and is a degradation of water quality standards and therefore
considered a water quality violation. [15A NCAC 02B .0221].
9. The Permittee shall adhere specially to 15A NCAC 02B .0221 Tidal Salt Water Quality for
Class SA Waters (3)(g) pH: shall be normal for waters in the area, which generally shall range
between 6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of
natural conditions; (1) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if
turbidity exceeds this level due to natural background conditions, the existing turbidity level
shall not be increased. [15A NCAC 02B .0221]
10. Dredging shall not cause Shellfish Closures. The effluent water from the dredge spoil should
not be released into open shellfish waters. Marine Fisheries Shellfish Sanitation Section and the
Division of Water Resources must be notified if this is to occur.
11. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant and/or authorized agent is required to return
the enclosed certificate of completion form to the NCDENR DWR 401 and Buffers Unit North Carolina
Division of Water Resources,1617 Mail Service Center, Raleigh, NC, 27699 within ten days of project
completion (the certification of completion is also available at:

Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit
This approval and its conditions are final and binding unless contested. This Certification can be
contested as provided in Articles 3 and 4 of General Statute 150B by filing a written petition for an
administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A petition
form may be obtained from the OAH at htW*//www.ncoah.com/ or by calling the OAH Clerk's Office
at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A

Reference the application by SMH SHV, LLC (Safe Harbor) to conduct dredging adjacent
to the South Harbor Village Marina located in Waters adjacent to the AIW W at 4909 Fish
Factory Road, Town of Southport, Brunswick County, North Carolina.
The proposal is to increase the permitted dredging depths from -6 ft NLW to -8 NLW and to
expand the existing dredge footprint for future hydraulic dredging events. The existing dredge
basin measures approximately 450 feet long by 510 feet wide and the applicant proposes to
expand this to 475 feet long by 510 feet wide (an increase of 20,834 square feet with irregular
shape) to connect to deeper waters waterward toward and adjacent to the AIW W. The applicant
estimates a total of 25,500 cubic yards of sediment would be dredged and the total dredged area
would be 242,250 square feet. The applicant is proposing to conduct all dredging outside the
moratorium period as previously permitted. The applicant is proposing to utilize a previously
permitted upland on -site spoil pond (Parcel 2360001806) to dispose of the dredged material.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
Special Conditions
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.

2. No dredging shall be permitted between April 1 and September 30 of any year without
the prior approval of the USACE, in consultation with appropriate resource agencies.
3. Except as authorized by this permit or any USACE approved modification to this permit,
no dredge, fill, or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project within waters outside the designated
permitted boundary. This permit does not authorize temporary placement or double
handling of excavated or fill material within waters outside the permitted area.
4. Work in wetlands are prohibited during the dredging, material disposal, or any other
aspects of work associated with this project. All dredged material must be deposited on
high ground.
5. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other
toxic materials. In the event of a spill of petroleum products or any other hazardous
waste, the permittee shall immediately report it to the N.C. Division of Water Resources
at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act will be followed.
6. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including all
conditions, shall be available at the project site during construction and maintenance of
this project.
The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas.
Additionally, the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973.
8. The activity must be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout
waters by the North Carolina Division of Environmental Management (NCDEM), 25
NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less
in trout waters, are not considered significant.
9. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at

10. Violations of these conditions or violations of Section 404 of the Clean Water Act or

mainland. The property has approximately 1,472 linear ft. of shoreline.
The newly purchased portion of the marina property is a combination of parcels 2360001806, 236EB03842 and
208614438875, which encompasses 537,317 sq. ft, of land. This includes a full -service marina facility consisting of 157
permitted wet slips, bulkhead, marina office and upland spoil basin. The 4.6 acre Marina and 8.5 acre spoil pond were sold to
Safe Harbor (SMH SHV, LLC ) on September 30, 2019. The facility also includes a pump out station and fuel dock. The
existing facility consists of: A, B C and D-Docks with floating docks and finger piers within the upland basin (the end of A -Dock
also includes an existing approximately 490 linear ft. fueling dock). The property is bordered by residential housing to the
west, Duke Energy to the east, the AIWW to the south and private undeveloped land to the north. The elevation of the tract
ranges from 3ft. to 9 ft. above Mean High Water (MHW). There are wetlands on site, but there are no coastal wetlands within
the marina basin project area.
Former owners of the project area utilized the site as a fish processing plant and upland areas were previously part of a
remediation program until 1995. State Permit No. 31-99 was originally issued to South Harbour Village, LLC on April 8, 1999
for excavation of an upland basin (to -6 ft. at NLW), construction of a marina with shoreline stabilization, associated upland
development (including residential development) and a designated spoil site. This permit was modified on April 1, 2002 for
additional of finger piers and boatslips waterward of the existing fuel dock along with a maintenance dredging clause. The
permit was further renewed on January 3, 2003, March 14, 2005 under a Maintenance 5. Additional minor modifications were
issued on November 23, 2004 and June 28, 2006 for additional slips and again on May 19, 2009 for additional excavation to
be dredged at the end of A and D docks to a depth of - 6 ft. at NWL (NAVD88), this also included a docking facility
reconfiguration. In 2010 South Harbour Marina received a Pumpout Grant Award from the NC Marine Sewage Pumpout
Station Grant Program for installation of a pumpout onsite. A minor modification was issued on March 6, 2012 to change the
excavation methodology from bucket to barge to hydraulic dredging, this modification also included the redevelopment on the
permitted disposal area. On February 13, 2013 another minor modification was issued for installation of two silt barriers
underneath A -Dock and D -Dock and to add 4 slips on C-Dock. At this time the marina was permitted for a total of 157
formalized boatslips, although it is currently operating with 153 boatslips. An additional modification issued on April 23, 2014
authorized construction of a 25 linear ft. rip rap groin at the western end of the marina. Further authorization to raise the dike
walls and increase capacity at the designated spoil site was issued on December 12, 2014. The latest renewal was issued on
December 6, 2018 and State Permit No. 31-99 is due to expire on December 31, 2023. According to the permit file
maintenance events have occurred in 2006 and 2012. It is the intent of the current applicant to submit this new major
permit application for parcels 2360001806 (Spoil Site), 236EB03842 (Vacant Upland), 208614438875 (Marina) only, this
includes the marina basin and upland spoil site.
The waters of the AIWW in this location are classified as "SA/HQW" by the North Carolina Division of Water Resources. The
area is NOT designated as a Primary Nursery Area by the North Carolina Division of Marine Fisheries and is closed to the
harvest of shellfish.

The applicant is requesting a new major permit for the marina and spoil site only in order to increase the permitted dredging
depths from — 6 ft. at NLW to — 8 ft. at NLW (NAVD 88) and to expand the existing dredge footprint for future hydraulic
dredging maintenance events. According to the applicant the additional dredging depth will to reduce the frequency of
dredging events within the existing basin, which measures approximately 450 ft. long by 510 ft. wide. The proposal would
expand the existing dredge footprint to an area measuring approximately 475 ft. long by 510 ft. wide in order to connect to
deeper waters (see Sheet 3 of 4). The applicant estimates a total of 25,500 cubic yards of material would need to be removed
(based on current water depths). The application indicates that the current average existing depth is — 5 ft. at NLW (NAVD88)
and has provided a hydrographic survey for reference (see Sheet 3 of 4). The applicant states that the marina is not
proposing a dredging event at this time and all dredging will be done outside the moratorium as permitted.
The previously permitted spoil site (Parcel: 2360001806) is a triangular shaped upland spoil pond measuring approximately
550 ft. wide. This spoil site has historically been utilized for disposal of material from South Harbour Village maintenance
excavation projects. No wetlands are proposed to be impacted.
10. ANTICIPATED IMPACTS:
The project would result in an additional 2 ft. of excavation depth within the expanded dredge footprint for a total of 242,250
sq, ft. of open water impacts within Estuarine Water and Public Trust Areas. The spoil disposal on high ground would impact
up to 126,828 sq. ft. within the existing spoil site and basin.

on June 24, 2020 and appears to be adequate for processing at this time. The projected deadline for making a decision is
September 7, 2020. An additional 75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 24, 2020 you may request a meeting with the
Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be
held within five working days from the receipt of your written request and shall include the property owner, developer, and

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed

South Harbour Village Marina has a recently changed ownership. The previous owners have a
current maintenance dredge permit that allows hydraulic dredging to a depth of -6.0' elevation in
NAVD88 datum.
The new owners, SMH SHV, LLC (Safe Harbor), would like to apply for a maintenance dredge
permit to perform hydraulic dredging to an elevation of -8.0' NAVD88, This elevation would allow
better use of the marina and would reduce the frequency of maintenance dredging. The bottom
of marina dredge will slope to existing grades and the existing bulkhead at a slope of 1:5 to reduce
potential scour. The maintenance dredge footprint will increase by 20,384 square feet more than
previously approved for South Harbour Village Marina. The purpose of increasing the dredge
footprint is to reach the naturally occurring -8.0' bottom elevation. The dredge spoil will be
deposited in an onsite spoil pond that is permitted for this purpose. There are currently 153 boat
slips see dock layout.
The marina is not requesting to perform dredge operations during the hydraulic dredge
moratorium.
We reserve the right to modify our conclusions and recommendations if new information becomes
available.

1) The project shall be carried out in strict compliance with the following work plan drawings:

2) In order to protect juvenile finfish and shellfish populations, no excavation may take place
This permiLaction may be appealed by the permittee or
other qualified persons within twenty (20) days of the
issuing date. An appeal requires resolution prior to work
initiation or continuance, as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not
covered hereunder requires further Departmental approval.
All work must cease when the permit expires on
December 31, 2002
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina
Coastal Management Program.

between April 1 and September 30 without authorization from the Division of Coastal
Management in consultation with the Division of Marine Fisheries (DMF).
3) An earthen plug shall be left between the area to be excavated and the AIWW, and a 24 hour
period after completion of excavation in the basin will elapse prior to plug removal to prevent
unnecessary siltation into the adjacent waters.
NOTE: Depending on methodology and need, work behind sediment curtains will be
considered in consultation with the DMF upon request from the permittee.
4) All excavated materials will be confined landward of the mean high water (MHW) elevation contour
and any regularly or irregularly flooded vegetated wetlands within adequate dikes or
other retaining structures to prevent spillover of solids into any vegetated wetlands or surrounding
waters.
5) The terminal end of the pipeline from the dredge into the diked retention area will be positioned at
or greater than 50 feet from any part of the dike and a maximum distance from spillways to prevent
dike erosion and to allow adequate settlement of suspended solids.
6) A water control structure will be installed at the intake end of the effluent pipe leading from the
retention area in order to ensure maximum settlement of suspended solids.
7) Flow from the diked retention area will be confined by pipe, trough, or similar device to a point at
or below the mean low water (ML)W) elevation contour to prevent gully erosion and siltation.
8) No excavated materials will be placed at any time, including temporarily, in any vegetated wetlands
or waters.
9) No vegetated wetlands will be excavated.
10) Excavation will not exceed 6 feet below the elevation of ML W.
11) Should basin excavation cause contaminants to be introduced into adjacent public trust waters due
to prior use of the property, the permittee will cease work and request a consultation site visit by a
DCM representative who will involve other appropriate agencies.
Bulkhead
12) The bulkhead must be constructed prior to any backfilling activities.

13) The bulkhead must be structurally tight so as to prevent seepage of backfill materials through the
structure.
14) The bulkhead must be solid and constructed of treated wood, concrete slabs, metal sheet piles or
other suitable materials approved by department personnel.
15) The fill material will be clean and free of any pollutants, except in trace quantities.
Marina Operation
16) Prior to the occupancy of any slips or other docking facility authorized by this permit, the
permittee will install and maintain operational for the life of the project a pumpout facility to
service boats with holding tanks.
17) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structures,
whether floating or stationary, may become a permanent part of this boating facility without
permit modification. No non -water dependent uses of structures may be conducted on, in, or
over public trust waters without permit modification.
18) No sewage, whether treated or untreated, shall be discharged at any time from boats using the
boating facility. Any sewage discharge at the boating facility shall be considered a violation of
this permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.
19) The permittee will post at the basin entrance and on the transient dock a "No Sewage Discharge
Policy".
20) Marine maintenance is not authorized at the facility.
21) No attempt will be made by the permittee to prevent the full and free use by the public of all
navigable waters at or adjacent to the authorized work. Use of the permitted activity must not
interfere with the public's right to free navigation on all navigable waters of the United States.
22) If the display of lights and signals on the authorized structure is not otherwise provided for by
law, such lights and signals as may be prescribed by the U. S. Coast Guard will be installed and
maintained by, and at the expense of, the permittee.

23) This permit does not authorize interference with any existing or proposed Federal project.
24) No portion of the permitted structure will be located closer than 80 feet from the near bottom
edge of Federally -maintained Intracoastal Waterway. An as -built survey of the completed
structures will be submitted to the Corps of Engineers to verify compliance with this setback.
Easement Required
25) Prior to the construction of any part of the marina in the public trust waters, the permittee must
acquire an Easement from the State Property Office, Department of Administration. Telephone

Upland Development
26) The Division of Water Quality Issued Stormwater Management Permit No SW8980508 on
February 22, 1999 for this project. Any violation of the SWMP will be considered a violation of
this CAMA permit. ,
NOTE: The Division of Water Quality approved wetland fill for this project on July 17,
1998 under General Water Quality Certification No. 3112.
NOTE: An Erosion and Sedimentation Control Plan will be required for this project.
This plan must be filed at least thirty (30) days prior to the beginning of any
land -disturbing activity. Submit this plan to the Department of Environment
and Natural Resources, Land Quality Section, 127 Cardinal Drive Extension,
Wilmington, NC 28405-3845.
NOTE: The spoil disposal area(s) proposed for this project may produce a mosquito
breeding problem. For information concerning appropriate mosquito breeding
measures, the permittee should contact the Public Health Pest Management
