This permit, issued on August 19, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Shoreline Stabilization - Bulkhead 1) The bulkhead shall not extend waterward more than 4 feet from the existing bulkhead at any point along its alignment at the time of construction. 2) No vegetated wetlands or open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department �j%��R personnel when the project is inspected for compliance. 4X Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee John and Patti Rochevot W i Permit No. 87-20 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 9) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 10) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 11) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 12) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 13) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfrlling activities. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) All debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and removed to an appropriate upland location 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2020-01113). Division of Water Resources authorized the proposed project by way of General Watet Quality Certification 4175 and assigned the project DWR Project No. 2020-0854 issued 8/18/20. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. I spoke to the applicant today and he provided information that was not immediately clear in the permit application that the stone block bulkhead requires a 4 foot base in order to the uplands in place. Mr. Rochevot will provide me with an engineer's justification and I will pass along., With that new information we are comfortable with the 4 foot in front of existing. Mr. Rochevot also told me that the upland retaining wall is gone now after the storm and he is concerned that the house may slide off the foundation due to the eroding slope that was held up by the retaining wall. So he would appreciate any expediency you can offer. Josh I know after our discussion that you authorized 2 foot in front of existing, so let me know if you are able to amend your permit to accommodate after review of the engineer's justification. The property is located at 145 Apache Road, Harrellesville, Hertford County adjacent to the Chowan River. The development proposal involves the Public Trust Area (PTA), Estuarine Shorelines' (ES), Public Trust Shorelines (PTS), and Estuarine Waters (EW) Areas of Environmental Concern. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H .0208 USE STANDARDS k (a) addresses General Use Standards, and subparagraph (1) requires that uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks, private roads, factories, and parking lots are examples of uses that are not water dependent. Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches. (a) (2) (A) requires that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning and nursery areas. Consistent: The development meats the intent of this rule. (a) (2)(B) requires that the development shall comply with state and federal water and air quality Consistent: This development will not violate water and air quality. (a) (2) (C) requires that the development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural resources. Consistent: There are no known archaeological or historic resources on the property. (a)(2)(D) requires that the development shall not increase siltation. Consistent: It does not appear that this development will measurably increase siltation. (a) (2) (E) requires that the development shall not create stagnant water bodies. Consistent: It does not appear that the development will create stagnant water bodies. (a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The development will have minimum adverse effects on life cycles or estuarine resources. (a)(2)(G) requires that the development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. (b)(7)(A) requires that bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level. Possible Inconsistency: The proposed bulkhead is to be placed an average of 4 foot below Normal Water Level most of which is due to the width of the blocks proposed to be used as bulkhead material. An engineers need for the distance has been submitted. (b)(7)(B) requires that bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources. Consistent: The propose bulkhead will not be constructed near wetlands. (b)(7)(C) requires that bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a part of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead. Consistent: The applicant has indicated that the fill will be obtained from an upland location. (b) (7) (D) requires that bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule. Consistent: The property has a steep grade bank with identifiable erosion problems as the upland retaining wall keeps failing. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features. Consistent: There has been recent erosion on this property. (v) the property to be bulkheaded is in a non -oceanfront area. Consistent: The proposed bulkhead is in a non -oceanfront area. (b)(7) (E) requires that where possible, sloping rip rap, gabions, or vegetation shall be used rather than bulkheads. Constant: The proposed development of a bulkhead is consistent with the intent of this rule. Overview: The .23 acre subject property has 61 linear feet of shoreline along the Chowan River. The upland portion of the property has an elevation of approximately 25 feet above Normal Water Level (NWL). The site is primarily vegetated with yard grasses and trees. A steep, eroding hillside slopes down to NWL. According to the NC FRIS website, the property is located primarily outside of a Floodzone, with the shoreline located in the AE (7) Floodzone. Existing site improvements consist of a single-family house with associated driveway and parking and a failing upland retaining wall. Existing shoreline improvements consist of a deteriorated bulkhead located along NWL. Installation of 61 linear feet of concrete block bulkhead with 6 foot long return walls, grading to a 2.5:1 slope and installation of a flexmat concrete block mat overlay are proposed. The bulkhead will be 6 feet in height and installed 4 feet waterward of NWL. A 4 inch French drain will be installed 3 feet above the bottom of the bulkhead. The failing upland retaining wall will be removed and fill will be placed and graded to the bulkhead. The flexmat will be placed along the slope to prevent erosion and provide for vegetation. Anticipated impacts resulting from this project are expected to include: the filling of 242 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and 2,659 sq. ft. of High Ground within the Estuarine Shoreline AEC. Basis for Determination: The Hertford County Land Classification Map identifies the site area as 'Rural'. The proposed project is located at 145 Apache Road, Harrellsville, within Hertford County. The applicant is proposing to install a new concrete bulkhead waterward of the normal water line (NWL), fill and grade an eroding steeply -sloped hillside to the shoreline, then stabilize the hillside with a "flexomat" vegetated concrete block mat. The water classification for this site is Primary Recreation, Freshwater (B) and Nutrient Sensitive Waters (NSW). Submerged aquatic vegetation (SAV) was not observed within the project area, and is closed to shellfishing. The proposed project is located within a portion of the Chowan River that has been designated as Anadromous Fish Spawning Area (AFSA) by the DMF and the NC Wildlife Resources Commission (WRC). AFSAs are areas where evidence of spawning of anadromous fish species has been documented by direct observation of spawning, capture of running ripe females, or indication of eggs or early larvae. Anadromous species within this area include, but are not limited to, alewife, American and hickory shad, blueback herring, and striped bass. In order to minimize potential negative impacts to these important species during these critical life stages, DMF recommends a moratorium of 15 February through 30 September be included in the permit conditions. Project Setting The property proposed for development is located at 145 Apache Road (SR1460) in Harrellesville and consists of 0.23 acres adjacent to the Chowan River. The upland portion of the property has an elevation of +/- 25 feet above NWL and contains a single family residence and failing upland retaining wall. A steep, eroding hillside slopes down to an existing deteriorated bulkhead located along NWL. The property to the northwest is a residential property with a bulkhead and single family dwelling and the property to the southeast is a vacant lot with a bulkheaded shoreline. Vegetation on the site includes, but is not limited to, indigenous yard grasses, loblolly pine (Pinus taeda), and red maple (Acer rubrum). Soil types include Craven Fine Sandy Loam (CrA). The shoreline with a length of 60.64 feet currently contains an old wooden bulkhead and failing retaining wall. The water classification for this site is Primary Recreation, Fresh Water (B) and Nutrient Sensitive Waters (NSW). Submerged aquatic Vegetation (SAV) was not found within the project area. Development Proposal The applicant proposes to replace the existing wooden bulkhead with a new interlocking block bulkhead that is 6 feet in height and 4 feet out from the existing bulkhead. The applicant then proposes to remove the failing upper retaining wall and place 450 cubic yards of fill to grade the lot into a new slope of 2.5:1 and cover it with flexamat overlay to prevent erosion and provide vegetation. The applicant also proposes to install a 4-inch French drain 3 feet above the bottom of the new bulkhead. Anticipated Impacts The proposed development will result in the filling of 2,659 square feet of Estuarine Shorelines and 241.8 square feet of Estuarine Waters Area of Environmental Concern. With the sequence of conctruction events as listed above there will be no negative environmental effects. After project completion the elimination of erosion and shore line deteriation will be markedly Improved and the use of the waterfront area will become more functional. An initial screening of the submittal package has been conducted as per 15A NCAC 07J.0204 (copies enclosed). This revealed certain deficiencies, which must be corrected before the application package can be accepted as complete. To assist you in expediting the permitting process as much as possible, I am notifying you of these deficiencies immediately so that they can be quickly corrected to facilitate my detailed review. Because the deficiencies are easily correctable, I am not returning the original application package. Please make the needed changes, and submit the appropriate documentation. With the retained copy of the application, I can commence the detailed review. Please understand that the subsequent detailed review may reveal additional areas where further information or documentation is required to demonstrate compliance with the rules directly applicable to the proposed development. MAY 14 2020 DCM-MHD CITY To expedite our response to your permitting request, we will commence the detailed review of your application for a permit pending the receipt of the additional information requested above. However, the statutorily provided 75/150 days allowed for review cannot commence until such time as we have received a complete application package. Once your application has been accepted as complete, you will receive a separate notification letter. If it is not possible to render a permit decision within 70 days of the date when your application is received complete, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. I am also sending a copy of this letter to you by Email to try to expedite the review process. Our procedures provide for the processing clock to not be suspended if within 3 working days of the Email, or within 5 working days from the date of this letter, we receive a reply from you that adequately addresses the issues that have been raised.
