This permit, issued on December 2, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Dockine Facility 1) This permit authorizes only the docks, boatlifts, piers, platforms, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Davis, Director Division of Coastal Management This permit and it;.conditions are hereby accepted. of Permittee Anne and Haywood Proctor Permit No. 115-20 Page 2 of 3 ADDITIONAL CONDITIONS 3) The authorized structures and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 4) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 5) No portion of the permitted structure shall be located within 80 feet of the near bottom edge of the federally maintained AIWW channel. 6) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 7) This permit authorizes a maximum of two (2) formalized boat slips. 8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 9) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner to the east area of riparian access. 10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 11) The roof of the covered platform shall not be designed for second story use. 12) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. USACE / FEDERAL CONDITIONS 13) In order to further protect the endangered West Indian Manatee, Dichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at his://www.fws. ovg/raleigh/pdfs/ManateeGuidelines20l7.r)df. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of. Coastal Management. Anne and Haywood Proctor ADDITIONAL CONDITIONS Permit No.115-20 Page 3 of 3 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 17) All debris associated with this development shall be contained within the authorized project area and removed to an appropriate upland refuse disposal site. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 197800056 (Action ID SAW-2011-01803). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-1669. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. PROJECT DESCRIPTION To locate the project site from the Wilmington Regional Office (WiRO), travel southwest from Wilmington to Sunset Beach on US 74 W (Martin Luther King Jr Pkwy) & US 17 S for approximately 45 miles until you reach Ocean Isle Beach Road SW on your left. Travel about 2 miles down Ocean Isle Beach Road SW and then turn right at the round -about onto Old Georgetown Road SW. Go down Old Georgetown Road SW for about 3 miles until you reach Seaside Road SW (NC 179 / NC 904) and make a left at the traffic light. Then travel almost a mile and a half down Seaside Road SW (NC 179 / NC 904) until you meet Sunset Boulevard N at the intersection and make a right. Take your next left onto Park Rd SW and continue .4 miles. Take a right onto Shoreline Drive E and then take the next left onto Waterway Drive. Continue past the residence at 710 Waterway Drive and the vacant lot will be on the right-hand side. The property consists of a vacant lot located on a .39-acre parcel approximately 3' above normal high water (NHW) and is vegetated with landscape grasses and typical coastal -plain tree species. The property has approximately 75 linear feet of shoreline frontage along the AIW W and is stabilized with native vegetation. High marsh Coastal Wetlands within the property's riparian corridor extend approximately 55' waterward of the high ground and include Black Needlerush (Juncus roemeriamts), Saltmeadow Coidgrass (Spartina patens) and Sea Lavender (Limonium spp.). The low marsh extends approximately 86' waterward of the high marsh and consists of a dense stand of Smooth Cordgrass (Spartina alternii lora). The proposed docking facility would be located entirely over open water in the AIW W. Residential properties border the project site to the west and east. The width of the AI W W measures approximately 560' at the proposed project site. The waters of the AIW W are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. Based on visual observations made by DCM staff during the July 2020 site visit, there appears to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end of the proposed boatlift are approximately -.5' NLW. These measurements were confirmed by DCM during a site visit on 7-29-2020. Tidal amplitude in the project area is approximately 4' between NLW and NHW. PROPOSED PROJECT The applicant proposes to install a private pier with a gazebo, boatiift, and floating dock for a total of 2 slips. The total proposed length of the docking facility would be approximately 201' from NHW. The application states that a 6' x 185' access pier (as measured from NHW) would originate from an upland point and extend toward the southeast. The proposed access pier would lead to a 6' x 12' (72 sq. ft.) finger pier on the west side of the pier. The finger pier would lead down a gangway to an 8' x 16' (128 sq. ft.) floating dock (Slip 1) that is proposed to be outfitted with `stops' at 24" above the substrate. The access pier would continue beyond the finger pier another 15' where it would terminate with a 16' x 16' (256 sq. ft.) gazebo. To the east of the gazebo, a 14' x 14' open boatlift (Slip 2) is proposed to be outfitted with `stops' at 18" above the substrate to minimize damage to the soft bottom habitat. Water depths verified by DCM staff show -.5' NLW at the waterward end of the proposed boatlift and floating dock. Water depths on the landward side of the proposed boatlift and floating dock show 0' NLW. The property has approximately 75 linear feet of shoreline and the facility's design appears tore applicant's area of riparian access and would not encroach into either 15 ft. adjacent riparian accei." applicant's design extends to the pier head line of adjacent docking facilities and does not exceed the % width of the waterbody. The proposed design would terminate approximately 115' landward of the USACOE 80' federal channel setback. 10. ANTICIPATED IMPACTS According to the application, the proposed docking facility would incorporate approximately 1,250 sq. ft. of Estuarine and Public Trust Area and would shade approximately 846 sq. ft. of Coastal Wetlands. The proposed boatlift and floating dock would be located over an area of shallow water (0' NLW to -.6' NLW as measured by DCM staff) in a Primary Nursery Area. The installation of stops located at 18" and 24", respectively, is proposed above the substrate to reduce impacts to soft bottom habitat while limiting usage to periods of mid and high tides. Despite using stops to physically limit the structure height above the substrate, prop scouring in critical habitat could still be a concern during ingress and egress. The proposed development would be located outside of the adjacent 15' riparian corridor setbacks on both sides and would be constructed outside of the federal channel setback. Minor increases in turbidity should be expected during construction. Due to the limited amount of water, approximately 0.0' to -0.6' at NLW located on this side of the AIWW as shown in the attached proposal, there will be potential for bottom disturbance and displacement of the substrate "kicking" by vessel propellers to access the channel of the creek. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom and primary nursery area. The project site is located at 712 Waterway Drive adjacent the AIW W in Sunset Beach, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to install a new private pier with gazebo, boathft, and floating dock to create two now slips. The docking facility would be approximately 201' from NHW, with a 6' by 185' access pier that leads to a 6' by 72' finger pier on the west side. The finger pier would lead to an 8' by 16' floating dock (Slip 1) with stops set 24" above substrate. The access pier would continue beyond the finger pier another 15' where it would terminate in a 16' by 16' gazebo. East of the gazebo would be a 14' by 14' open slip with stops set 18" above substrate (Slip 2): Water depths at the waterward end of the lift and floating dock are -0.5" NLW and -0.0" NLW landward the lift and dock. The design would terminate approximately 115' landward the US Army Corps of Engineers (USACE) 80' federal channel setback. The AIW W in this area is classified SA by the Environmental Management Commission and is designed a primary` nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). The NCWRC has reviewed the proposal and has concern with the establishment of slips and a floating dock witbin -6.5" NLW water depths. While we understand there is an approximate 4' tidal amplitude, there will be a significant amount of time when there is minimal water for vessel use. There are other existing docking facilities in the area. As a designated PNA, this waterbody provides an important rearing area for this variety of estuarine fishes and invertebrates that need relatively undisturbed habitats. Boating and mooring activity within the shallow depths of the proposed project modification would create a continued source of chronic sediment disruption and elevated turbidity. Therefore, we support concerns stated by NCDMF to avoid and minimize impacts to marine resources. These suggestions may include the removal of the slips and floating dock or an extension of the docking facility to water depths that would minimize the likelihood of bottom disturbance. The applicant proposes to install a private pier with a gazebo, boatlift, and floating dock for a total of two slips. The proposed project is located on the Atlantic Intracoastal Waterway (AIWW) at 712 Waterway Drive, on the mainland side of Sunset Beach, Brunswick County. The waters of the AIWW are classified SA and HQW by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the Marine Fisheries Commission (MFC). They are CLOSED to the harvest of shellfish. NO submerged aquatic vegetation (SAV) was observed by DCM or DMF staff on site visits that occurred in June, October, and November 2020. There are existing docks on both sides of the applicant's property. Primary Nursery Areas are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by most native coastal fish species in North Carolina. The habitat is particularly productive by providing refuge from predators, and therefore is an important nursery area. Species dependent on shallow soft bottom habitat include clams, crabs, flounder, spot, Atlantic croaker, sea mullet, and rays. Many benthic predators are highly associated with the shallow soft bottom habitat, including flounders, weakfish, red drum, sturgeon and coastal sharks although almost all fish will forage on microalgae, infauna, or epifauna on the soft bottom. There is a wide fringing marsh (approximately 80') along the shoreline of the proposed dock, transitioning to a wide area of shallow subtidal muddy bottom, with numerous isolated oyster beds. The wetland vegetation, and oyster shell, in combination with shallow muddy substrate provide excellent conditions for productive juvenile fish habitat. The proposed boatlift would be located in a designated PNA with minimal to no water at low tide (0' NLW to -0.6' NLW), as confirmed by DCM staff. The proposal includes the installation of stops set at 18" above the substrate for the boat lift and at 24" above the substrate for the floating structure. The physical stops would theoretically reduce impacts to soft bottom habitat and limit usage to periods of mid to high tides. Despite using stops to physically limit the cradle height above the substrate, prop scouring in critical habitat is still a concern during vessel ingress and egress. Nothing Compares.—.... Box 769 1 Morehead City, North Carolina 28557 252-726-7021 N Due to the possible impacts to critical PNA habitat, DMF does not recommend use of stops within extremely shallow PNAs such as the proposed site. Alternatively, the docking facility could be extended into deeper waters to avoid PNA impacts. The DCM staff conducted a water depth survey on July 29, 2020 during a low tide of -0.43 MLLW. DMF staff also conducted water depth surveys on October 27and 29 during a low tide of -0.42' MLLW and -0.30' MLLW, respectively. During the two October site visits, DMF's surveys showed water depths at the landward and waterward ends of the 714 Waterway Drive referenced pier head to be -1.92' NLW to -2.0' NLW and -1.5' NLW to -1.83' NLW. The DMF revisited the site on November 10, 2020 with a low tide of -0.34' MLLW to investigate surrounding water depths and a potential alternative design to minimize impacts. Water depths were taken from the waterward end of the pier head at 710 Waterway Dr., which is approximately 10' longer than the 714 Waterway Drive (the pier head used for this proposal). Depth recordings were taken from the waterward end of the pier out 27' to the Y4 distance of the AIWW setback line. Water depths ranged from -2.25' NLW to -2.75' NLW. The DMF found that the water depths nine feet past the PH of 710 Waterway Drive, to be -2.5' NLW, a sufficient depth to minimize soft bottom habitat impacts created by the proposed docking facility. This siting will put the waterward end of the proposed pier at 27', and in a depth of -2.75' NLW. As currently proposed, the project would likely result in impacts to soft bottom habitats within a PNA. The DMF does not believe these impacts have been avoided or minimized and is concerned with the proposal. The division therefore recommends the docking facility be extended into deeper waters as described above to avoid PNA impacts. If the applicant incorporates this recommendation for the extension of the pier; adequate water depths would be obtained, minimizing PNA habitat impacts and addressing our concerns.
