Rd., in Hertford , as requested in the permittee's application dated "Rec DCM-EC 7/6/20", including
attached workplan drawings (4) Survey dtd 3/22/12 and Pages 2-4 of 4 all dated 7/4/20.
This permit, issued on November 2, 2020 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
if these terms maybe subject to fines, imprisonment or civil action; or may cause trte penult w VILU« auu .�.
Docking Facility Expansion and Reconfiguration
1) This permit authorizes only the platform addition, jet ski lift relocation and platform section
demolition, and uses located in or over the water that are expressly and specifically set forth in the
permit application. No other structure, whether floating or stationary, shall become a permanent part
of this docking facility expansion and relocation without permit modification. No non -water
dependent uses of structures shall be conducted on, in or over Public Trust waters without permit
modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure..

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) This permit authorizes 1 additional formalized boat slip for a maximum of 3 formalized boat slips at this
docking facility.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
General
7) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
8) All debris associated with the removal or construction of the permitted docking facility shall be
contained within the authorized project area and removed to an appropriate upland location
9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way.of Programmatic General
Permit 198000291 (Action ID SAW-2020-01355).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2020-0997.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

Permit to undertake development activities to expand and reconfigure an existing docking
facility, in Perquimans County.
Although processing of the application is nearing completion, additional time is needed for this
office to complete the review and make a decision on your request. Therefore, it is necessary that
the standard review time be extended. An additional 75 days is provided by G.S. 113A-122(c)
which would make December 6, 2020 the new deadline for reaching a decision on your request.
However, we expect to take action prior to that time and will do so as soon as possible. In the

SUBJECT: John P. Powels; 268 Ainsley Road Major Permit Recommendations
The applicant proposes to construct a new 10 foot by 12 foot platform at the terminus of an
existing boat house and relocate two jet ski lifts from under the boathouse area to the
outside of the boathouse on the east side. The property is located at 268 Ainsley Road,
Hertford, Perquimans County adjacent to the Perquimans River.
The development proposal involves the Public Trust Area (PTA) and Estuarine Waters
(EW) Areas of Environmental Concern.
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to
this project and my findings are as follows:
15A NCAC 07H .0208 USE STANDARDS
(a) addresses General Use Standards, and subparagraph (1) requires that uses which are
not water dependent shall not be permitted in coastal wetlands, estuarine waters, and
public trust areas. Restaurants, residences, apartments, motels, hotels, trailer parks,
private roads, factories, and parking lots are examples of uses that are not water
dependent. Uses that are water dependent include: utility crossings, wind energy facilities,
docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments,
bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels,
access channels and drainage ditches.

Consistent: The applicant proposes to construct a platform and move two jet ski lifts.
This sub -paragraph lists these structures as water dependent.
(a)(2)(A) requires that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC (Rule .0203 of this subchapter) and shall be sited and
designed to avoid significant adverse impacts upon the productivity and biologic integrity
of coastal wetlands, shellfish beds, submerged aquatic vegetation as defined by the Marine
Fisheries Commission, and spawning and nursery areas.
Consistent: The development is designed to not interfere with Shellfish beds or
submerged aquatic vegetation.
(a)(2)(B) requires that the development shall comply with state and federal water and air
quality
Consistent: This development will not violate water and air quality.
(a)(2)(C) requires that the development shall not cause irreversible damage to
documented archaeological or historic resources as identified by the N.C. Department of
Cultural resources.
Consistent: There are no known archaeological or historic resources on the
property.
(a) (2) (D) requires that the development shall not increase siltation.
Consistent: It does not appear that this development will measurably increase
siltation.
(a) (2) (E) requires that the development shall not create stagnant water bodies.
Consistent: It does not appear that the development will create stagnant water
bodies.
(a)(2)(F) requires that the development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The development will have minimum adverse effects on life cycles or
estuarine resources.
(a)(2) (G) requires that the development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.

Consistent: The development proposal minimal effects on navigation.
(b) Specific Use Standards
(b)(6) Addresses Piers and Docking Facilities.
(b)(6)(B) requires that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline
with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open
water slips shall not be counted in the total. Projects requiring dimensions greater than
those stated in this Rule shall be permitted only if the greater dimensions are necessary for
safe use, to improve public access, or to support a water dependent use that cannot
otherwise occur. Size restrictions shall not apply to marinas.
Consistent: The proposed platform addition adds an additional 120 square feet of
shading for a total of 549 square feet which is less than the 1,032 square feet allowed
for the 129 foot shoreline.
(b)(6)(F) requires that piers and docking facilities shall be single story. They may be
roofed but shall not be designed to allow second story use.
Consistent: The proposed platform addition will not add second story use.
(b)(6)(G) requires that pier and docking facility'lengths shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same
shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length
unless necessary to avoid unreasonable interference with navigation or other uses of the
waters by the public);
Consistent: The proposed addition will increase the piers length to 100 feet which is
not more than the 100 foot length.
(ii) not extending into the channel portion of the water body; and
Consistent: The proposed platform addition will not extend into the channel portion
of the waterbody.
(iii) not extending more than one-fourth the width of a natural water body, or human -made
canal or basin. Measurements to determine widths of the water body, canals or basins shall
be made from the waterward edge of any coastal wetland vegetation that borders the
water body. The one-fourth length limitation does not apply in areas where the U.S. Army
Corps of Engineers, or a local government in consultation with the Corps of Engineers, has
established an official pier head line. The one-fourth length limitation shall not apply when
the proposed pier is located between longer piers or docking facilities within 200 feet of
the applicant's property. However, the proposed pier or docking facility shall not_be

than the pier head line established by the adjacent piers or docking facilities, nor longer
than one-third the width of the water body.
Consistent: The proposed platform addition will increase the pier length to 100 feet
which is still less than 1,345 feet which is the % width of the waterbody.
(b)(6)(1) requires that piers and docking facilities shall not interfere with the access to any
riparian property and shall have a minimum setback of 15 feet between any part of the pier
or docking facility and the adjacent property owner's areas of riparian access. The line of
division of areas of riparian access shall be established by drawing a line along the channel
or deep water in front of the properties, then drawing a line perpendicular to the line of the
channel so that it intersects with the shore at the point the upland property line meets the
water's edge.
Consistent: The proposed addition will remain outside of the 15 foot setback.
Based on my review of the applicable subsections of the North Carolina Administrative
Code, the permit application, and plans, I recommend a Major Permit be issued to John P.
Powels with standard permit conditions.

I was on site today at 268 Ainsley Rd. and did 3 different sections across the waterward portion of the existing platform
with my rake. All I found was sand and the water was a tannin color as that area is. I also saw on half of a clam shell on
the rake closest to the existing steps. If you need any further information please let me know.

River; at 268 Ainsley Road, in Parkville, Perquimans County.
DATE: August 6, 2020
Consistency Determination: The request is consistent with/not in conflict with the
Perquimans County / Town of Hertford / Town of Winfall Land
Use Plan (LUP) certified by the CRC on February 10, 2016, as
amended through March 5, 2018.
Overview: The subject property is a .85 acre lot with 129 linear feet of shoreline along the
Perquimans River. Water depths are approximately -3 feet below Normal Water Level (NWL) at
a distance of 50 feet from the shoreline. Property elevation is approximately 3 feet above NWL.
Vegetation on the property consists primarily of indigenous yard grasses. The shoreline is located
in the AE Floodzone, with the remainder of the property being outside of a Floodzone.
Existing site improvements consist of a single-family house and associated driveway and septic
improvements. Existing shoreline improvements consist of a bulkhead, pier, and a boathouse
with two (2) jet ski lifts inside.
Installation of a 10 foot by 12 foot platform and a 10 foot by 13 foot boatlift and relocation of two
(2) jet ski lifts are proposed. The platform will be located at the terminus of the boathouse. The
jet ski lifts will be relocated outside of the boathouse and the boatlift will be installed inside the
boathouse.
The waters of the Perquimans River in this area are classified as Class SB waters and Coastal
Waters and are closed to shellfish taking. A review of submerged aquatic vegetation (SAVs) was
not provided. A review of historic, cultural or archaeological resources was not provided.

Anticipated. Impacts resulting from this project are expected to include: the shading of 120 sq. ft.
of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC).
Basis for Determination:
The project area is located on the Perquimans River. The river is classified as "Designated
conservation/open space areas". As indicated on Page IX-34 "(t)he precise location of
protected/regulated areas that have a conservation or open space connotation such as coastal
wetlands, estuarine waters, estuarine shoreline, public trust areas, and Section 404 wetlands
must generally be determined by field investigation on a case by case basis. These areas,
scattered throughout the County and generally found along creeks and rivers, are not individually
identified on the future land use map."

Reference the application of John P. Powles for a Department of the Army permit to
construct a new platform and boat lift, and replace two existing jet ski lifts, on property located
at 2678 Ainsley Road, in the Cove Grove Estates Subdivision, adjacent to the Perquimans River,
near Hertford, in Perquimans County, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
3. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Permit application for proposed actions that impact fish and fish
habitats. The proposed project is located at 268 Ainsley Road, Hertoford, in Perquimans
County, North Carolina. The applicant is proposing to construct a new 10 foot by 12 foot
platform at the terminus of the existing boathouse, relocate two jet ski lifts, and install a
new 13 foot by 10 foot boatlift under the existing boathouse.
Additional information is needed in order to adequately and accurately assess the project's
potential impacts to aquatic resources. This information was requested on August 14th, but
was not provided. First, there is a historical record of submerged aquatic vegetation (SAV)
in the project area, near the terminus of the existing structure. However, no mention of
SAV presence, or absence, was mentioned in the site description. This information is
needed in order to determine potential impacts to SAV. The site should be surveyed for
SAV, and the results should be included on a map that depicts the existing structure and
proposed additions/changes. Second, the site plans appear to include the installation of
two additional pilings. However, this aspect was not mentioned in the project description,
nor was the method of installation. DMF requests that the method of installation be
described. Additionally, the two pilings should not be installed in SAV beds or patches.
Finally, measures should be taken in order to avoid and/or minimize impacts to SAV from
turbidity increases during pile installation, such as installing turbidity curtains.

4. During construction of the proposed project, fueling, lubrication and general equipment maintenance should not take place
within 50 feet of a waterbody or wetlands to prevent contamination by fuel and oils. [35A NCAC 02H .0506 (b)(3) and (c)(3) and

5. The permittee shall report to the Washington Regional Office any noncompliance with this certification, any violation of stream or
wetland standards 135A NCAC 028.02001 Including but not limited to sediment Impacts, and any violation of state regulated
riparian buffer rules [35A NCAC 02B.02001. Information shall be provided orally within 24 hours (or the next business day if a
weekend or holiday) from the time the applicant became aware of the circumstances. A written submission shall also be
provided within 5 business days of the time the applicant becomes aware of the circumstances. The written submission shall
contain a description of the noncompliance, and its causes; the period of noncompliance, Including exact dates and times, if the
noncompliance has not been corrected, the anticipated time compliance is expected to continue; and steps taken or planned to
reduce, eliminate, and prevent reoccurrence of the noncompliance. The Division may waive the written submission requirement
on a case -by -case basis.

PROJECT SUMMARY
The applicant proposes to construct a platform addition, install a new boatlift and relocate two
existing jet ski lifts on an existing docking facility that's adjacent to the Perquimans River.
Project Setting
The property proposed for development is located at 268 Ainsley Road in Perquimans
County and consists of approximately 37,068 square feet or 0.85 acres adjacent to the
Perquimans River. The property currently contains a single family residence with a bulkhead
stabilizing the shoreline. Along the water there is an existing pier and boathouse that extend
out into the Perquimans River. The properties to the east and west are single family
residences.
Vegetation on the site includes, but is not limited to, indigenous yard grasses. Soil Types
include Yeopim Loam (YeA). The property has an elevation of approximately 3 feet above
normal water level (NWL) along the shoreline.
The shoreline is 129.14 feet in length contains a bulkhead along its entirety. The water
classification for this area is Primary Recreation, Salt Water (SB) and are coastal waters that
are closed to shellfishing. The water depths at the terminus of the pier are -3 feet.
Development Proposal
The applicant proposes to construct a new 10 foot by 12 foot platform at the terminus of the
existing boathouse on the east side of the existing pier where the water depth is -3 feet. The
applicant also proposes to relocate two jet ski lifts from under the boat house area to the
outside of the boathouse on the east side. Once the jet ski lifts are relocated the applicant
proposes to install a new 13 foot by 10 foot boatlift under the existing boathouse.
Anticipated Impacts
The proposed development will result in the shading of 120 square feet of additional Estuarine
Waters and Public Trust Areas of Environmental Concern. Temporary turbidity will possibly
occur during construction.

The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 07109/20. John Powles proposes to
construct a platform addition, install a boatlift and relocate two existing jet ski lifts on an
existing docking facility at 268 Ainsley Road in Perquimans County.
A copy of the entire application may be reviewed at the office of the Division of
Coastal Management, located at 401 S Griffin St, Ste 300, Elizabeth City, NC, 252-264-
3901 during normal business hours. Comments mailed to Braxton Davis, Director, DCM,
400 Commerce Avenue, Morehead City, NC 28557, prior to 08/25/20, will be considered
in making the permit decision. Later comments will be considered up to the time of permit
decision. Project modification may occur based on review & comment by the public, state
& federal agencies. Notice of the permit decision in this matter will be provided upon
written request.

Dear Mr. Powles:
The NC Division of Coastal Management hereby acknowledges receipt of your application
for State approval to construct a platform addition, install a boatlift and relocate two existing jet
ski lifts on an existing docking facility at 268 Ainsley Road in Perquimans County.
It was received complete on July 9, 2020 and appears to be adequate for processing at this time.
The projected deadline for making a decision is September 22, 2020. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review
period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 9, 2020, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of
your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will ford a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
