5/12/20. and the drawing titled "CAMAM Maior Permit Site Plan dated "received DCM Wilmington" 6/3/2020.
This permit, issued on August 6, 2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
to tines, imprisonment or civtt action; or may cause me permit to oe null anti vmu.
Ocean Hazard Development
1) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with
the development of the above referenced property, including the single family residence with lot fill,
all as expressly and specifically set forth in the attached permit application and workplan drawings.
Any additional land disturbing activities and/or construction may require a modification of this
permit. Contact a Division of Coastal Management representative at (910)796-7215 for this
determination.
2) Unless specifically altered herein, no fill material shall be placed at any time in any vegetated
wetlands outside of the alignment of the wetland fill area indicated on the workplan drawing.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) Prior to the initiation of construction within the Ocean Hazard AEC, a representative of the Division of
Coastal Management shall stake the first line of stable, natural vegetation and appropriate structure
setbacks.. These setback determinations shall replace those done at the time the permit application was
processed and approved. Construction shall begin within sixty days of this determination or the
measurement is void and shall be re-established. In the case of a major shoreline change within that
period, a new setback determination shall be required before construction begins.
4) Prior to the initiation of construction within the Ocean Hazard AEC, the permittee shall stake the Town
of Oak Island Development Line. All authorized development shall be located landward of the Town of
Oak Island Development Line.
5) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the
N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are
inconsistent with any of the following NEC standards, the more restrictive standard shall apply.
6) All buildings in the Ocean Hazard Area of Environmental Concern shall be on pilings not less than 8
inches in diameter if round, or 8 inches to a side if square.
7) All foundations shall be adequately designed to be stable during applicable fluctuations in ground
elevation and wave forces during a 100-year storm.
8) All pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under
the structures.
9) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure shall be relocated or dismantled within
two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or
subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two (2)
years of the time the structure becomes imminently threatened, so that the structure is no longer
imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not
affect the permit holder's right to seek authorization of temporary protective measures allowed under
CRC Rules.
Filling
10) All fill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence,
diversion swales or berms, etc.).
12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.

13) Dune disturbances should only be allowed to the extend necessary for development and if the dunes
protective value is not weakened to reduced. Disturbed dune areas will be immediately stabilized.
14) All unconsolidated material resulting from associated grading and landscaping shall be retained onsite
by effective sedimentation and erosion control measures.
USACE / FEDERAL CONDITIONS
15) In order to compensate for impacts associated with this permit, mitigation shall be provided in
accordance with the provisions outlined in the U.S. Army Corps of Engineers, Wilmington District,
Compensatory Mitigation Responsibility Transfer Form. The requirements of this form, including any
special conditions listed on this form, are hereby incorporated as special conditions of this permit
authorization.
General
16) The permittee shall obtain any necessary authorizations or approvals from the U.S. Army Corps of
Engineers prior to initiation of any permitted activity. Unless altered by a specific Condition of this
Permit, the permittee shall adhere to all conditions on the Federal approval.
17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
18) All debris associated with this development shallbe contained within the authorized project area and
removed to an appropriate upland refuse disposal site.
19) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not convey any rights, either in real estate or material.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including any authorizations from the US Army
Corps of Engineers and the Town of Oak Island.
NOTE: Future development of the permittee's property may require a modification of this permit. Contact
a representative of the Division at (910) 796-7215 prior to the commencement of any such activity
for this determination.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No. 2020-
0785.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project Action ID No. SAW-2020-
00825
NOTE: An application processing fee of $400 was received by DCM for this project. This fee alsc
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Recommendations for State Permit — Poteat-Smith Properties 6/ 8 /2020
It is the staff's recommendation that the construction of the proposed structure is CONSISTENT with the Rules
of 15 NCAC 7H.0306 (a)(5) Use Standards for Ocean Hazard Areas pending the receipt of a formal
Jurisdictional Determination by the USACE. Any permit issued should include standard conditions for
oceanfront development.

The attached completed "Compensatory Mitigation Responsibility Transfer Form" must also be provide to the Corps prior to wetland
disturbance at the site.

the permittee to a stop work order, a restoration order, a Class 1 administrative penalty, and/or appropriate legal action.

Conditions for Transfer of Compensatory Mitigation Credit:
• Once this document has been signed by the Mitigation Sponsor and the USACE is in receipt of the signed form, the
Permittee is no longer responsible for providing the mitigation identified in this form, though the Permittee remains

• Construction within jurisdictional areas authorized by the permit identified on page one of this form can begin only after

The Division of Water Resources (DWR) has received a copy of your CAMA Major application
request dated received by this office on June 12, 2020. DWR issues approval in the form of a
Water Quality Certification (WQC) in conjunction with the CAMA Major Permit and Nationwide
Permit number 29 issued by the US Army Corps of Engineers (USACE). This Certification allows
you to use the CAMA Major Permit when the Division of Coastal Management issues it.
In accordance with the attached General Certification #4175 (GC 4175), the impacts described in
your application do not require written authorization to utilize GC 4175. However, you are required
to follow the conditions listed in the attached certification. You should get or otherwise comply
with any other federal, state and local requirements before you go ahead with your project
including (but not limited to) erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at htto:/ANww.ncoah.com/
or by calling the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH

PROJECT DESCRIPTION:
The project site is located at 5205 E Beach Drive, in the Town of Oak Island, Brunswick County. To
locate the project site from Wilmington, travel west on NC-1 33/US-1 7S/US-74/76W for approximately
3 miles then take the US-17 exit toward Shallotte and continue for approximately 13 miles. Turn left
onto NC-906 and travel for approximately 11 miles. Then, turn left onto E Beach Drive and travel 2.9
miles to the property of interest.
The site consists of one 0.172 acre parcel with an elevation of an average of 6 ft. above normal high
water. Vegetation on the tract consists of native vegetation including Saltmeadow Cordgrass
(Spartina patens), Pennywort (Hydrocotyle bonariensis), Sea Oats (Uniola paniculata), Wax Myrtle
(Morelia cerifera), Red Cedar (Juniperus virginiana) and Pennywort (Hydrocotyle bonariensis).
According to the application approximately 1,458.5 ft2 of Section 404 Wetlands exist along the
northern edge of the property (see Site Map sheet 1 of 2). The site is currently undeveloped and no
permit history could be located for the property. The FLSNV was flagged in February 2020 by Town
of Oak Island LPO. The project site is bordered on the west by a single family dwelling, to the east
by an undeveloped lot, to the north by E Beach Drive and to the south by the Atlantic Ocean.
The waters of the Atlantic Ocean are classified as SB by the NC Division of Water Resources (DWR).
The NC Division of Marine Fisheries (DMF) has not designated this area of the Atlantic Ocean as
Primary Nursery Area and the waters adjacent to the proposed project are closed to the harvesting
of shellfish. The project site IS located within an area of the Town of Oak Island that undergoes
beach renourishment. The erosion rate for this area is two feet (2') per year, according to the 2013
Erosion Rate Maps, creating a total Ocean Erodible Area AEC of 180'.
PROPOSED PROJECT:
The applicant proposes to construct one (1) single family residence with associated freshwater
wetland fill. According to the application, the proposal to construct a single-family home on the lot
would result in the filling of approximately 1,458.5 ft2of 404 Wetlands and would disturb
approximately 2,261.5 ft2of high ground. The home would be located landward of the 60' setback
from the first line of stable natural vegetation (FLSNV) and the Town of Oak Island Development
Line. The proposed decking on the waterward side of the house, will encroach into the 60' setback
from the FLSNV but not the Town of Oak Island Development Line. The total disturbed area would
be 3,720 ft2. The application states that the Section 404 wetlands on the property were reviewed
by the USACE, but a formal jurisdictional determination was not submitted with this application
(see email attachment -Action ID Number SAW-2020-00825).
10. ANTICIPATED IMPACTS:
The construction of the single family residence would result in the disturbance of approximately
2,261.5 ft2 of high ground and the fill of approximately 1,458.5 ftz of Section 404 Wetlands, for a
total of 3,720 ft2 of disturbance within the Ocean Erodible AEC. The application states that sewer
and water supply services would be provided by the local municipality.

Introduction:
Southern Environmental Group, Inc. (SEGi) has been retained by Poteat-Smith Properties, LLC (see AppendixA), herein
referred to as "Applicant", to secure a Coastal Area Management Act (CAMA) Major Permit for the proposed fill of
0.034-acre of depressional wetlands, at 5205 East Beach Drive, in Oak Island, Brunswick County, North Carolina. The
fill is necessary to facilitate the construction of a single family dwelling, with driveway, on the property. The proposed
work is to take place within the NC Division of Coastal Management's (DCM) Ocean Hazard Area of Environmental
Concern (AEC) jurisdictional area (see Appendix B). Due to the fact that the proposed work will impact US Army Corps
of Engineers' Section 404 wetlands and pursuant to 15A NCAC 07J .0201, the proposed development will require a
CAMA Major Permit. The following information is being submitted as supplemental information to the CAMA Major
Permit Application and serves as the required "Project Narrative".
Parcel Information and Project Location:
The project is located at 5205 East Beach Drive, within the incorporated limits of the Oak Island, in Brunswick County,
North Carolina. According to the recorded deed, the Applicant purchased the property on 11 February 2020 (see
Appendix J). Parcel ID Number 249DEO12 has been assigned to the property (see Appendix C). The parcel is bordered
by the Atlantic Ocean, to the east, an undeveloped lot, to the north, a residential dwelling, to the south, and East Beach
Drive, to the west (see Appendix D).
From the DCM's Wilmington Regional Office, one can find the project site by heading taking N Cardinal Dr/Cardinal
Dr Extension to Market St. Turn left onto Market St. Turn right onto US-74 W/Martin Luther King Jr Pkwy (signs for
Wihnington/Downtown); use the right lane to merge onto NC-133 S/US-74 W/Isabel Holmes Bridge, via the ramp, to
Whiteville; use the left 2 lanes to turn left onto US-421 S/US-74 W, keep right at the fork, follow signs for US-17 S/US-
74 W/US-76 W/NC-133 SBrunswick County Beaches and merge onto NC-133 S/US-17 SMS-74 WIUS-76 W; continue
to follow US-17 SIUS-74 W/US-76 W, use the right 2 lanes to take the US-17 exit toward Shallotte/Myrtle Beach;
Continue onto US-17 S/Ocean Hwy E; continue straight to stay on US-17 S/Ocean Hwy E; Keep right to continue on
US-17 S; Continue straight to stay on US-17 S; Turn left onto US-17 BUS S; turn left onto NC-906; and then left onto
E Beach Dr. The property will be on the right. Please see attached vicinity map (Appendix E).
Site Information:
The property encompasses approximately 0.172-acre (7,500 SF) of land and abuts the Atlantic Ocean (Cataloging Unit
030030005), which is classified SA;HQW, by the North Carolina Division of Water Resources (DWR) (see Appendix
F). The site is approximately 6' above normal high water and is within the VE12 Flood Zone (see Appendix G).
Vegetation, within the uplands on the site, consists of Sparrina patens and Hydrocotyle bona•iensis. A small, depressional
wetland pocket, measuring 0.034-acre, is situated at the front of the property and encroaches into approximately two
thirds of the property, from east to west (see Appendix F). Wetland vegetation, within this area, consists of Morella
cerifera, Juniperus virgimana, Spartina patens and Hydrocotyle bonariensts. SEGi submitted a Preliminary
Jurisdictional Determination request, to the USACE, on or about May 5, 2020. At the time of this applicationRECO E D
had not responded to that submittal.
Ms. Donna Coleman flagged the First Stable Line of Vegetation (FSLVG) in February 2020. ,J U N 12 2020
Project Purpose and Need:

The purpose of this project is to construct one single family dwelling, with associated driveway and atten eatures.
The filling of 0.034-acre of Section 404 wetlands is necessary to facilitate the construction of the dwelling and driveway
(see Appendix B).
Project Description:
Prior to undertaking land disturbing activities, silt fence and a construction entrance will be installed. Once this has been
completed, removal of vegetation and grading work will commence. Clean earthen dirt will be used to bring the wetland

area up to the desired grade. Typical building materials will be used to construct the dwelling. The final phase of the
development will consist of landscaping and installing the driveway, which will be constructed of concrete.
In total, the project will generate approximately 1290 SF of built upon area (BUA) or 17.2% of the site. The dwelling
will be positioned as to not extend waterward of the 60' Setback, from the FLOSV. A detached, uncovered deck will
extend beyond the 60' Setback. No fill is proposed to be placed waterward of the 66' Development Line. Stormwater
trenches will be used to treat runoff, through infiltration. A stormwater permit will be sought, through the Town of Oak
Island. Please see Appendix B, for details of the proposed development.
Heavy machinery, such as dump trucks, front end loaders and pile drivers will be used to complete the work. Machinery
will be stored within uplands, on the subject property, when not in use.
Adjacent Riparian Property Owners:
As per 15A NCAC 07J .0204(bx5), the Applicant shall notify, by US Postal Service Certified Mail, the adjacent riparian
property owners (ARPOs) of the proposed work. According to the New Hanover County GIS Map, there are two ARPOs.

Summary:
In summary, the Applicant is seeking approval, in the form of a CAMA Major Permit, to perform work that will take
place within the Ocean Hazard Area of Environmental Concern. The proposed work, which consists of filling 0.034-acre
of Section 404 wetlands and constructing a single family dwelling, with associated driveway and attendant features, at
5205 East Beach Drive, in Oak Island, North Carolina. The proposed work is consistent with the current rules and

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent
for Poteat-Smith Properties, LLC for State approval for development of the subject property located at
5205 East Beach Drive, adjacent to the Atlantic Ocean, on Oak Island in Brunswick County. It was
received as complete on June 4, 2020 and appears to be adequate for processing at this time. The
projected deadline for making a decision is August 18, 2020. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 4, 2020, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following application was submitted for a development permit in an Area of Environmental
Concern as designated under the CAMA: On June 4, 2020, Poteat-Smith Properties, LLC proposed to
construct a single family residence with associated freshwater wetland fill at 5205 E. Beach Dr., adjacent

This notice is intended to snake you, the applicant, aware of the
special risks and conditions associated with development in this
area, which is subject to natural hazards such as storms, erosion
and currents. The rules of the Coastal Resources Commission
require that you receive an AEC Hazard Notice and acknowledge
that notice in writing before a permit for development can be
issued.
The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazard By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for fixture damage to
the development. Permits issued in the Ocean Hazard Area of
Enviromnentat Concern include the condition that structures be
relocated or dismantled if they become imminently threatened by
changes in shoreline configuration. The structwr(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
locatedis feet per year.

Studies also indicate that the shoreline could move as much as
3z5 landward in a major storm.
The flood waters in a major storm are predicted to be about
