Permit Class NEW STATE OF NORTH CAkOLINA Department of Environmental Quality and ^Q� Coastal Resources Commission �+ Vermit for X Major Development in an Area of Environmental Concern pursuant to NCGS I I3A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Pointe Bogue POA,10205 Corree Cove Dr., Emerald Isle, NC 28594 Permit Number 72-20 Authorizing development in Carteret County at adi. to Bogue Sound. off Corree Dr. in Pointe Bogue S/D, in Emerald Isle , as requested in the permittee's application dated 9/21/19 (MP-1) and 9/19/19 (MP4), including attached workplan drawings (4), Sheets 14 of 4 all dated "Rec DCM MHD City 10/31/191, This permit, issued on June 15, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terns may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Ezoansion 1) This permit authorizes only the dolphin piling removal, pier extension, finger piers and boat lifts, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission. This permit must be accessible on -site to Department �� personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Pointe Bogue POA ADDITIONAL CONDITIONS Permit No. 72-20 Page 2 of 3 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes a maximum of 9 formalized boat slips. Furthermore, no cleats, tie piles or other formal mooring structures shall be constructed on any portion of the docking facility outside of the formalized boat slips. Any additional vessel or mooring structures that would increase the number of formalized boat slips without permit modification shall be considered a violation of this permit. 5) The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions shall be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized facility. Should dredging of these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV beds. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) Should either Lot to the east or west be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the 15-foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. USACE Conditions 8) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at hqp://www.fws.gov/nc-es/mammal/manatee guidelines.adf. General 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. Pointe Bogue POA Permit No. 72-20 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Regional General Permit 197800056 (Action ID SAW-2020-00636). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2020-0477. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Here is some suggested condition language if we don't already have a model for that: • No individual property owner within the Pointe Bogue subdivision shall construct a dock with any temporary, transient, or permanent docking space, slips or mechanized docking means. (should we add "without a review and approval by DCM"?). Preferably, would rather have them put that in their restrictive covenants and if not already in covenants, then: • Pointe Bogue shall incorporate within the property owners restrictive covenants that prohibits any individual property owner from construction a dock with any temporary, transient, or permanent docking space, slips or mechanized docking means. I also would like to ensuring that no other space is used for docking, and not to extend waterward any further than existing dock footprint. If we don't have any other previous condition models, here is what I suggest: • No space or portion of the Pointe Bogue Community dock shall be used for dockage regardless of the type of vessel and whether dockage is temporary, transient, or permanent docking space, slips or mechanized docking means. • The community dock authorized by this permit shall not extend any further waterward than the existing dock footprint as shown on the working plans dated MMIDDNYYY. Overview: The project is located off of Corree Cove Dr. in the community of Pointe Bogue in Emerald Isle, Carteret County. The property is .88ac of mostly undeveloped maritime forest woodland and has 50' of shoreline. Existing development includes a community day dock (with dolphins) that provides access to Bogue Sound for Pointe Bogue property owners. It was reconstructed after Hurricane Florence and currently extends 150' into Bogue Sound. There are no private docking facilities within Point Bogue. AECs involved include EW (Estuarine Waters) and PTA (Public Trust Area). Bogue Sound within this area carries a water classification of SA/ORW. This area of Bogue Sound is not designated as a Primary Nursery Area and is open to the taking of shellfish. SAV does exist in the area and clusters of oysters exist along the shoreline. Along the shoreline is a —300' fringe of Coastal Wetlands predominantly consisting of Smooth Cordgrass (Spartino alterniflora). The bottom substrate in this area is primarily sand and silt. A report on cultural resources was not included. The applicant is proposing to extend the existing dockwaterward by 23', and construct five 1.5' x 9' finger piers off the east and west side of the dock to create 9 additional slips, each slip will have a 10' x 13' boat lift. The overall dock expansion would be within the footprint of existing dolphin pilings which currently exist 25' water ward of the existing dock. A benchmark nail has been placed on the existing docking facility by Shane Staples of DMF and surveyed in to indicate adequate water depths in SAV area. This nail is indicated on submitted work plat drawings. Water depths in this area range from -2.5 to -3' at NLW. Anticipated impacts The current dock shades a total of 1,300 ft' of open water and coastal wetlands. The proposed docking project would usurp an additional 3,000 ft' and shade 182 ft' of Public Trust Area. Any turbidity resulting from driving of mooring piles would be temporary. The typical boats docked would be runabout type, so the water depths which range from -2.5' to -3' would be sufficient for navigation without impacting the bottom. Basis for Determination: The project site is located in the Town of Emerald Isle and is subject to the town's 2018 Land Use Plan. The Future Land Use Map (FLUM) designates the site as "Single/Dual Family Residential", "Coastal Wetlands" and "Non -Coastal Wetlands". The proposed project is consistent with the future land use categories. Land Use Policies: The following LUP policies may be applicable to this request. Policies - Conservation P.15 - The Town will only allow uses in estuarine waters that are compatible with protection and conservation of their biological and community values. The proposed project will be located off Corree Cove Drive at the community access of Point Bogue Subdivision in Emerald Isle, within Carteret County. The applicant is proposing to construct five 1.5' by 9' finger piers, nine 10' by 13' boat lifts within nine boat slips by the finger piers creating nine slips. Additionally, the project will extend the existing dock by 23' but would remain within the footprint of the existing dolphin pilings, which extend 25' from the existing dock. The waters at the project site are classified as SA- ORW, and are open to shellfishing. The proposed project occurs within an area with a historical record of submerged aquatic vegetation (SAV). Additionally, the field report submitted with the permit application indicated that SAV exists in the area. SAV is a highly valuable habitat, both environmentally and economically. These habitats provide nursery, foraging, and/or spawning areas for various recreationally and commercially important fish and invertebrate species. Additionally, SAV plays a critical role in natural erosion control and shoreline stabilization, as well as water quality enhancement, primary production, and nutrient cycling. Therefore, it is crucial that SAV habitat be protected, in order to maintain these critical environmental contributions. The field report also indicated that clusters of oysters exist along the shoreline at the project location. Shellfish is an extremely productive, self -building habitat that can be impacted through development projects. This vital habitat is limited in North Carolina, and restoration and conservation of shellfish habitat is at the forefront. Measures should be included to avoid and/or minimize impacts to SAV and shellfish habitat. A survey for SAV should be completed prior to construction to determine the presence or absence of SAV in relation to the proposed work. Bogue Sound is the adjacent waterbody to the north. %i The property is .88ac of mostly undeveloped maritime forest woodland and has 50' of shoreline. Along the shoreline is a —300' fringe of Coastal Wetlands predominantly consisting of Smooth Cordgrass (Spartina alterniflora). An existing community day dock currently provides access to Bogue Sound for Pointe Bogue property owners. It was reconstructed after Hurricane Florence and currently extends 150' into Bogue Sound. There are no private docking facilities within Point Bogue. The Division of Water Resources classifies this area as SA-ORW waters. This is not a Primary Nursery Area. This portion of Bogue Sound is open to harvesting shellfish. SAV does exist in the area and clusters of oysters exist along the shoreline. The bottom substrate in this area is primarily sand and silt. 10. PROJECT DESCRIPTION: Point Bogue POE is proposing to add 9 additional slips and 5 finger piers to the existing day dock. This would be done by extending the existing dock water ward by 23'. The applicant proposes to construct five 1.5 x 9' finger piers that would extend off the east and west sides of the main dock. Nine (9)10'X13' boatlifts would be placed within the 9 slips by the finger piers creating a total of 9 slips. The overall dock expansion would be within the footprint of existing dolphin pilings which currently exist 25' water ward of the existing dock. The docking facility would extend no further into the waterbody than the existing facility which currently is 185' from edge of marsh. A benchmark nail has been placed on the existing docking facility by Shane Staples of DMF and surveyed in to indicate adequate water depths in SAV area. This nail is indicated on submitted work plat drawings. Water depths in this area range from -2.5 to -3' at NLW. There would be a total of 9 slips associated with this docking facility which is within the DWR guidelines for this ORW. The applicant has stated in their narrative that each slip would be assigned to individual property owners with no plans for future individual docks. There are no planes for dredging. 11. ANTICIPATED IMPACTS: The current dock shades a total of 1,300ft2 of open water and coastal wetlands. The proposed docking project would usurp an additional 3000ft2 of Public Trust Area and shade 182112. Any turbidity resulting from driving of Mooring piles would be temporary. The typical boats docked would be runabout type, so the water depths which range from -2.5' to -3' would be sufficient for navigation without impacting the bottom. Name: Ryan Davenport Date: 04/01/2020 Morehead City March 9, 2019 Ryan Davenport Division of Coastal Management 400 Commerce Ave. Morehead City, N.C. 28557 Dear Mr. Davenport: I am applying for a CAMA Major permit on behalf of Pointe Bogue PDA to construct a 23' pier extension and nine (9) boatlifts, located in Pointe Bogue Subdivision, Town of Emerald Isle, in Carteret County, North Carolina. The present pier is shown on the recorded plat, which was recorded April 12,1990. The pier is also shown on 2004 aerial photography on the Carteret County GIS site. Repairs from hurricane damage have recently been completed on the pier. The proposed extension and boatlift location do not extend past the footprint of the original pier, and is needed to ensure 2+' of water depth at normal low water. The width of the water body at its narrowest point is 650+'. The nearest pier to the east is more than 460' away. There are no piers within 1500' to the west. The SAV survey and normal low water were determined by NCDEQ, Division of Marine Fisheries. The mean high water line was determined using vegetation species as well as elevation. There are currently nine (9) property owners in Pointe Bogue. The boatlifts are for the private use of the property owners in Pointe Bogue. A boatlift is intended to be allocated to each of the nine property owners. One pier for nine property owners would be advantageous monetarily to the property owners; one pier versus individual piers. A much greater advantage to this proposal is the protection of the natural resources in this area. The property owners could pursue 9 individual piers with at least one boatlift per pier. Most likely the pier owner would want more than one boatlift. There are currently 1400+ feet of shoreline along Pointe Bogue with one existing pier versus potentially nine more piers. Boat traffic in one particular area would protect submerged aquatic vegetation as well as shellfish and other sea life along the vast majority of this 1400+ feet of shoreline. There would be much less wave action from boat traffic which would prevent erosion along the length of this shoreline. Nine new piers would be excessively long, thus adversely affecting a vast amount of 404 wetlands as well as coastal wetlands. Of course, there would also,be many wildlife species impacted that inhabit the 404 wetlands and coastal wetlands. They are concerned about SAV within the boat lift area and are asking for an SAV survey. If SAV is found within the areas of the lifts they are asking for 24" stops to be placed on the lifts. So if the SAV survey does not indicate SAV then the lifts are not required. I can continue the processing of the permit while the SAV survey is conducted. But the default would be 24" stops unless the survey shows no SAV. That is my interpretation anyway. The comments have DMF's contact info on it if you have any questions about the survey or comments in general. After discussion it sounds like the dock will no longer have an L-head and just be straight to the end of the current mooring pilings and the new slips will be perpendicular to the pier on either side. Once we got out past the muddy area near shoreline a fairly dense bed of eel grass was evident with some'plants nearly reaching the surface. In the area where grass was observed the sediment was much more firm than the area near shore and furtherout and the water depths we made shallower by some shoaling that was evident on both sides'of the pier. Near the end of the pier where water depths dropped back to -2' @NLW or greater the SAV seemed to drop off. I assume due to light availability. Attached you will find a drawing of what we observed. I used google earth imagery and used the outer mooring pilings and not shoreline as my starting point. The current area at the end of the pier were SAV seem to be limited and the water depth were greater may fit the 9-slips that the residents of the community are requesting but the innermost slips mat have limited water depths and have some impact on the areas where SAV is growing. In order to limit the potential impacts to SAV and bottom I would like to see the pier lengthen by 16 to 24ft (based on 8ft piling spacing). Not only would this limit resource impacts but It would also make any slips added to the pier more useable at all tide ranges. It does not appear this would hamper navigation in the area as there is onlyone pier to the east over 100 yards away. Please let me know what you think and if that extension would be possible to alleviate potential resource concern.
