This permit, issued on January 2, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation )f these terms may be subject to fines, imprisonment or civil action; or may cause the permit to oe min aria voia. Dockine Facility Replacement 1) This permit authorizes only the demolition of the existing docking facility and the construction of the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Joa -and Glenn Petty Permit No. 1-20 Page 2 of 4 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 2 formalized boat slips. 6) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches are permitted. Lattice is specifically excluded from being used under this authorization. 7) The roof of the covered platform shall not be designed for second story use. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Excavation 9) In order to protect juvenile shrimp and frnfrsh populations, no excavation or filling shall be permitted between April 1 and September 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. 10) No excavation shall take place outside of the area indicated on the workplan drawings. 11) Excavation shall not exceed -4.5 feet below the normal low water level. In no case shall the depth of excavation exceed the depth of connecting waters. 12) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 13) No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters. Spoil Disposal 14) No spoil material shall be placed within 30 feet of the normal high water line. 15) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 16) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 4oa r� and Glenn Petty Permit No. 1-20 Page 3 of 4 ADDITIONAL CONDITIONS 17) The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the spoil material has been addressed. 18) In order to protect waters adjacent to the designated dredge spoil disposal site, the permittee shall provide the Division of Marine Fisheries — Shellfish Sanitation Section the dredge plan and the location of the spoil disposal site prior to any dredging activity, so a swimming advisory or shellfish closure determination can be made, and documentation of this coordination provided to the Division of Coastal Management. Maintenance Clause 19) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to. be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. USACE Conditions 20) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.aov/ne-es/iiiai-ninal/maiiatee auidelines.odf. General 21) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 22) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third parry. 23) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2019-02174). Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2019-1287. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. Because the dredge material is being removed from an area that is closed to shellfishing, discharges from the dewatering of the spoils into swimming waters between the months of April and October will cause a swimming advisory to be posted. Additionally, any discharge from the dredge spoils at any time into approved shellfishing waters will cause a shellfish closure. Overview: The project is located at 113 Maxwell Dr., Harkers Island, Carteret County; adjacent to Brooks Creek. The property is .69 acres and existing development includes a single family home and a two slip docking facility. The applicant is proposing to excavate around their planned dock to create a channel to connect to the existing channel that leads to into Harker's Island Harbor of Refuge. The excavation would be 47.5' long and 48.3' wide with a final depth of-4.5' at NLW. A total of 213 cubic yards of material would be excavated during this project. The new dock would be located in the same footprint as the existing dock. The new dock would have a 17' x 21' covered platform, and a 13' x 13' boatlift would be placed on either side of the platform. AECs onsite include Estuarine Waters and Public Trust Areas. Brooks Creek surface water classifications are SA (Market Shellfishing, Salt Water) and HQW (High Quality Water). The site is not designated as a Primary Nursery Area, SAV is located near the shore, and is closed to the harvest of shellfish. A 50' fringe of high and low marsh exists along the shoreline. There are oysters in the intertidal zone along the shoreline. A review of historic/cultural resources was not provided. Anticipated impacts Excavation will result in the disturbance of 2,294 ft2 of shallow bottom habitat that has not been previously excavated. Turbidity impacts can be expected during the removal of the 213 cubic yards of material. Final bottom soundings will be -4.5' NLW connecting to -6' NLW and greater. Intended use of this project is for boating ingress and egress to an existing two slip docking facility that will be replaced in the same North Carolina Department of Environmental Quality i Division of Coastal Management Morehead City Office i 400 Commerce Avenue I Morehead City, North Carolina 28557 252.808.2808 footprint. The 300 ftZ of Coastal Wetland shading would remain the same. The dock would usurp 995ft2 of PTA and shade 657ft2. Basis for Determination: The project site is subject to the 2005 Carteret County Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as Limited Transition (land) and Conservation (Areas of Environmertal Concern). Uses allowed in Areas of Environmental Concern are those consistent with the State's minimum use standards and state and federal regulations. The following LUP policies may be applicable to this request: Policy 2.4 Carteret County's policies for development in estuarine and public trust waters are as follow: 1. Carteret County will only allow development activities in estuarine and public trust waters that are associated with water -dependent uses, consistent with state and federal standards, and meet all local policies contained in this plan. 3. Marinas and other docking facilities must be constructed in accordance with state requirements and must meet local requirements contained in 1.0 Public Access. All wetlands, streams, surface waters, and riparian buffers located within 50 feet of the construction area on the project site shall be clearly marked (example- orange fabric fencing) prior to any land disturbing activities and must be maintained on the property until the project phase is completed. Appropriate measures should be installed prior to any land clearing activities to protect waters and wetlands from turbidity and/ or sedimentation. These measures should be routinely inspected and properly maintained, and excavated materials should be contained outside the wetland boundary. Excessive silt and sediment loads can have numerous detrimental effects on aquatic resources including destruction of spawning habitat, suffocation of eggs, and clogging of gills of aquatic species. [15A NCAC 02H .0506 (b)(3) and (c)(3)] 7. This General Certification shall expire on the same day as the expiration date of the corresponding General Permit. The conditions in effect on the date of issuance of the Certification for a specific project shall remain in effect for the life of the project, regardless of the expiration of this Certification. 8. Specifically, the applicant proposes to reconstruct the existing fixed 5' X 117' pier with a 17'X21' covered platform. The MP-4 form and plans show that (2) 18'X12' boatlifts would be installed, however, the bioreport states that (2) 13 'X 13' boatlifts would be installed, one on either side of the platformp. The docking facility would have a total of two slips. Additionally, the applicant proposes to excavate a new basin surrounding the dock. The proposed basin would extend off the existing harbor of refuge channel. It would be 47.5' long and 48.3' wide with a final depth of-4.5' at NLW. A total of213 cubic yards of material would be excavated during this project. Spoils would be trucked offsite to an approved location to be determined It should be noted that there is a discrepancy in the applicant's volume of dredged material to be removed provided on the plans, based on the dredge footprint provided in the application. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the modification to the State authorization: 1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at 0 -2- htto://www.fws.aov/nc-es/mammal/manatee auidelines.pdf 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 3. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 11. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 12. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 13. PROJECT SUMMARY: The applicant is proposing to excavate around their proposed dock and create a channel to connect to the existing channel leading into the Harker's Island Harbor of Refuge. Field Investigation Report: Glenn Petty Page 02 9. NARRATIVE DESCRIPTION: The Glenn Petty project is located at 113 Maxwell Dr. on Harkers Island adjacent Brooks Creek. Brooks Creek connects to Back Sound and has an existing federal channel connecting to Harker's Island Harbor of Refuge. This property is .69 ac in its entirety and has an existing single family home. Extending off of high ground is a two slip docking facility. A 50' fringe of high and low marsh exists along the shoreline. There are oysters in the intertidal zone along the shoreline. The bottom of Brooks Creek in this area is mostly sand and silt with patches of SAV near shore. The channel leading into the Harkers Island Harbor of Refuge is approx. 30' offshore of the existing dock. A new channel West of this project was excavated and authorized under CAMA Major Permit #29-19. Water depths around the existing dock are -1' to -2' at NLW. Water depths in the harbor of refuge channel are -4' to -6'. The Division of Water Resources classifies this area of Core Sound as SA waters. This is not a Primary Nursery Area. This portion of Brooks Creek is closed to harvesting shellfish. The parcel is classified in the Carteret Co. LUP as Limited Transition. 10. PROJECT DESCRIPTION: Glenn Petty is proposing to construct a new dock in the same footprint of the existing dock. The new dock would have a ITX21' covered platform. A 13'X13' boatlift would be placed on each side of the platform. No additional shading impacts to Coastal Wetlands would occur. The docking facility would have a total of two slips. Additionally, Mr. Petty wishes to excavate a new basin surrounding the dock. The proposed basin would extend off the existing harbor of refuge channel. It would be 47.5' long and 48.3' wide with a final depth of -4.5' at NLW. A total of 213 cubic yards of material would be excavated during this project. Spoils would be trucked offsite to an approved location to be determined. Offloading of barges would occur in Brooks Basin. No additional slips would result from the project. There are patches of SAV existing along the shoreline but none were noted in the excavation area at the time of site visit. Excavation would occur 35' away from nearest Coastal Wetlands. Applicant has chosen not to connect to basin to the West because of connecting water depths. 11. ANTICIPATED IMPACTS: Excavation will result in the disturbance of 2294sq ft of shallow bottom habitat that has not been previously excavated. Turbidity impacts can be expected during the removal of the 213 cubic yards of material. Final bottom soundings will be -4.5' NLW connecting to -6' NLW and greater. Intended use of this project is for boating ingress and egress to an existing two slip docking facility that will be replaced in the same footprint. The 300ft2 of Coastal Wetland shading would remain the same. The dock would usurp 995ft2 of PTA and shade 657ft2. The existing pier and boat lift facilities were damaged by recent and past storm events and are in a state of disrepair. It is proposed that the existing timber pier and single boat lift be removed in its entirety. All timber piles will be completely removed by pulling with a barge mounted excavator. No bottom disturbance is proposed to occur associated with the planned demolition activities. Following demolition, it is proposed that dredging activities as outlined on the project plans be completed. The dredging activities are required to increase water depths at the pier facilities to allow proper access for boating activities. The extent of dredging depicted on the project plans was minimized to the extent possible to ensure full access to the adjacent channel area and access to the proposed boat lifts. All dredging will be completed with a barge -mounted excavator. Dredge spoil will be stockpiled within a secure enclosure on the barge. The spoil will be transported to a remote unloading area where it will be unloaded into dump trucks and transported to an approved dredge spoil disposal area. A total of approximately 432 cubic yards of dredge spoil will be generated by the excavation. All dredging activities will be completed by a competent local dredging contractor who will be selected after the CAMA permitting process has been completed. Following the dredging operation, a new timber -framed and concrete decked (Hog Slat Decking) pier walkway and platform will be constructed. A sheltered area covering a total of 234 SF (drip line) will be constructed over a portion of the platform area. Two boat lifts will be installed as shown on the project plans. Piles for the new pier and the boat lifts will be installed utilizing a barge -mounted pile driver. Decking installation will be completed from the barge and from upland areas of the site. Normal hand tools will also be employed to complete the construction. All construction waste will be collected on upland areas of the site and will be properly disposed of. It is proposed that no coastal wetland areas or coastal vegetation be disturbed to complete the project. The existing pier and boat lift facilities were damaged by recent and past storm events and are in a state of disrepair. It is proposed that the existing timber pier and single boat lift be removed in its entirety. All timber piles will be completely removed by pulling with a barge mounted excavator. No bottom disturbance is proposed to occur associated with the planned demolition activities. Following demolition, it is proposed that dredging activities as outlined on the project plans be completed. The dredging activities are required to increase water depths at the pier facilities to allow proper access for boating activities. The extent of dredging depicted on the project plans was minimized to the extent possible to ensure full access to the adjacent channel area and access to the proposed boat lifts. All dredging will be completed with a barge -mounted excavator. Dredge spoil will be stockpiled within a secure enclosure on the barge. The spoil will be transported to a remote unloading area where it will be unloaded into dump trucks and transported to an approved dredge spoil disposal area. A total of approximately 432 cubic yards of dredge spoil will be generated by the excavation. All dredging activities will be completed by a competent local dredging contractor who will be selected after the CAMA permitting process has been completed. Following the dredging operation, a new timber -framed and concrete decked (Hog Slat Decking) pier walkway and platform will be constructed. A sheltered area covering a total of 234 SF (drip line) will be constructed over a portion of the platform area. Two boat lifts will be installed as shown on the project plans. Piles for the new pier and the boat lifts will be installed utilizing a barge -mounted pile driver. Decking installation will be completed from the barge and from upland areas of the site. Normal hand tools will also be employed to complete the construction. All construction waste will be collected on upland areas of the site and will be properly disposed of. It is proposed that no coastal wetland areas or coastal vegetation be disturbed to complete the project. The existing pier and boat lift facilities were damaged by recent and past storm events and are in a state of disrepair. It is proposed that the existing timber pier and single boat lift be removed in its entirety. All timber piles will be completely removed by pulling with a barge mounted excavator. No bottom disturbance is proposed to occur associated with the planned demolition activities. Following demolition, it is proposed that dredging activities as outlined on the project plans be completed. The dredging activities are required to increase water depths at the pier facilities to allow proper access for boating activities. The extent of dredging depicted on the project plans was minimized to the extent possible to ensure full access to the adjacent channel area and access to the proposed boat lifts. All dredging will be completed with a barge -mounted excavator. Dredge spoil will be stockpiled within a secure enclosure on the barge. The spoil will be transported to a remote unloading area where it will be unloaded into dump trucks and transported to an approved dredge spoil disposal area. A total of approximately 432 cubic yards of dredge spoil will be generated by the excavation. All dredging activities will be completed by a competent local dredging contractor who will be selected after the CAMA permitting process has been completed. Following the dredging operation, a new timber -framed and concrete decked (Hog Slat Decking) pier walkway and platform will be constructed. A sheltered area covering a total of 234 SF (drip line) will be constructed over a portion of the platform area. Two boat lifts will be installed as shown on the project plans. Piles for the new pier and the boat lifts will be installed utilizing a barge -mounted pile driver. Decking installation will be completed from the barge and from upland areas of the site. Normal hand tools will also be employed to complete the construction. All construction waste will be collected on upland areas of the site and will be properly disposed of. It is proposed that no coastal wetland areas or coastal vegetation be disturbed to complete the project.
