Elevated Boardwalk and Bridge Maintenance 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the construction of a 6' wide by 1,417' long elevated boardwalk and maintenance of two existing bridges, including associated abutment walls and riprap stabilization, and other associated infrastructure, all as expressly and specifically set forth in the attached permit application and workplan drawings. 2) The bridges shall be elevated a minimum of 6' above normal water level (NWL). (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 123-20 Page 2 of 3 4) The retaining walls shall be structurally tight so as to prevent seepage of backfill materials through the structure. 5) The retaining walls shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles or other suitable materials approved by Department personnel. 6) The fill material shall be clean and free of any pollutants except in trace quantities. 7) The authorized rip rap shall be located landward of all vegetated wetlands. 8) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 9) If the crossing of wetlands with mechanized construction equipment is necessary, temporary construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed immediately upon completion of construction. Sedimentation and Erosion Control 10) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 11) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 12) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. General 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 15) All debris associated with this development shall be contained within the authorized project area and removed to an appropriate upland refuse disposal site. PROJECT DESCRIPTION: To find the project site, travel west of US Hwy 74/76 out of Wilmington to NC Highway 133 South towards Southport. Travel approximately 12.5 miles to Plantation Road SE. Continue approximately 0.75 miles more along NC Highway 133 South to Telegraph Rd. Turn right onto Telegraph Road, which leads onto the property. The property is located between NC Highway 133 to the south, Allen's/Lilliput Creek to the north (subsequently referenced to as Allen's Creek), the Cape Fear River to the east, and Boiling Spring Lakes to the west. It is advisable to contact the applicant's agent to arrange a site visit as it is a large unmarked property and the project site may be difficult to access. The property consists of a 4,275-acre parcel; however, the applicant also owns an additional 2,000+ acre parcel to the north of Allen's Creek that is adjoining the property. The property is primarily undeveloped and maintained as a managed pine savannah. Existing roadways lead through the parcel and other manmade structures include stables, equipment sheds and a caretaker house. An existing roadway leads to the project area from both directions. The project area is adjacent to McKinzie Pond off an existing dirt road that crosses two existing bridges permitted by CAMA Permit # 87-15. There appears to be negligible tidal flow in this area; as such, plans reference Normal Water Level (NWL). Upstream, these two branches of Allen's Creek lead to McKinzie Pond, downstream they connect to form Lilliput Creek. Lilliput Creek crosses under NC Highway 133 and connects to the Cape Fear River. The waters of Allen's Creek are classified as C:SW by the NC Division of Water Resources. They are not designated as Primary Nursery Area (PNA) by the NC Division of Marine Fisheries, nor open to the harvesting of shellfish. 191101.9481;J09111*1 F The applicant proposes to construct a 6' wide by 1,417' long elevated boardwalk and maintain two existing bridges. The proposed boardwalk would loop through the edges of the cypress swamp. The boardwalk would extend from the existing dirt road in four locations (see Sheet 2 of 3). Three access points would be north of the existing bridges and one access would be in between the existing bridges heading west toward McKinzie Pond. The anticipated uses for the boardwalk are to serve as a nature trail for plant and wildlife observation. The boardwalk will be above NWL for about 148' (-888 sq. ft.) and extend over 1,323' at — -1' below NWL (-7,938 sq. ft.). The path layout was designed to avoid surveyed significant trees. The piling -supported boardwalk decking will be elevated at least 4' above the NWL and 3' above existing grade with wetland vegetation (SAW-2015-01379). The boardwalk will have spaced wooden planking providing drip -through function. No impervious surfaces are proposed. The applicant is also seeking authorization to maintain two existing 50' long bridges when necessary to improve vehicular access within the property. The bridges were previously authorized under State Permit No. 87-15. This permit was issued to Orton Plantation Holdings, LLC on September 1, 2015 and expired on December 31, 2018. The existing bridges span two branches of Allen's Creek (also known as Lilliput Creek downstream) just east of McKinzie Pond and are included in the project area. This site is approximately two miles upstream of the creek's flow under a bridge on NC Highway 133 toward the Cape Fear River. The waters at the site are defined by the NC Marine Fisheries Commission (NCMFC) as inland fishing waters featuring a 30' public trust AEC. The waters here are classified by the NC Environmental Management Commission (NCEMC) as "C: SW" waters. The normal water level here is approximately+2.0' NAVD 88. No coastal wetlands are present and the creek's swamp forest is dominated by bald cypress. 3.33.1.2 Proposed Action The proposed project consists of constructing an elevated wooden boardwalk extending from both sides of the existing dirt drive looping through the edges of the cypress swamp forest and returning to the dirt drive. The anticipated uses of the boardwalk are to serve as a nature trail for plant and wildlife observation and recreation. The boardwalk will have a 6' width and the total length will be approximately 1,417'. Along its path, the boardwalk will extend over approximately 1,278' of 404 wetlands/waters and approximately 139' of upland.
