This permit, issued on October 26, 2020 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
oe subject to nnes, imprisonment or crvu action; or may cause the permit to ne null ano vota.
Conditions
1) Unless specifically altered herein, this permit authorizes the replacement or installation of Aids to
Navigation (ATONS), as expressly and specifically set forth in the attached permit application and
workplan drawings.
2) The Division of Coastal Management shall be notified at least two (2) weeks in advance of any
newly marked navigation corridors authorized by this permit.
3) Any navigation channels requiring excavation shall obtain a modification of this permit prior to
excavation. Please contact the Major Permits Coordinator of DCM at (252)808-2808 to determine the
authorization required.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
4) In accordance with commitments made by the permittee, no channels shall be located in areas with
water depths less than -2.5' NWL/NLW.
5) All ATONS shall be maintained and inspected in accordance with NC Wildlife Resources Commission
rules.
6) During installation of ATONs, new dredging in any manner, including "kicking" with boat propellers, is
not authorized, without modification of this permit.
7) No sewage, whether treated or untreated, shall be discharged at any time from any boats working in
conjunction with the ATON program.
8) No ATONs shall be placed in Coastal Wetlands or Shellfish beds.
9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
General
11) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the structural work or obstructions
caused thereby, without expense to the United States or the state of North Carolina. No claim shall be
made against the United States or the state of North Carolina on account of any such removal or
alteration.
12) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification.
13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development may require a modification of this permit. Contact a representative of the
Division at (252) 808-2808 prior to the commencement of any such activity for this
determination.
NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project
No. 20-0957 dated 8/21/20.

8. PROJECT SUMMARY: The Wildlife Resources Commission is requesting a
programmatic permit to allow the installation of new pilings and buoys and the
replacement of existing pilings and associated with Aids to Navigation, hazardous areas,
no wake zones and information signs.

9. NARRATIVE DESCRIPTION: The Wildlife Resources Commission (WRC) is
responsible for maintaining floating buoys and pilings marking navigational corridors,
hazardous areas and no -wake zones throughout the 20 coastal counties of North Carolina.
The statewide program consists of 1634 markers and 692 buoys and is referred to as the
ATON's program. In the past, the WRC would apply to DCM for a CAMA permit for
replacement. Depending on the size of the project and the number of pilings or buoys
necessary, the Division would process the request through either the Major Permit process
or consider it to be repair/replacement of an existing structure. Due to the number of
pilings and buoys requiring maintenance, DCM and WRC are working to establish a
programmatic process that allows for the streamlining of approval of projects. The current
process of the Wildlife Resources Commission for approving and maintaining new and
existing buoys and pilings is provided in the project narrative provided as part of this
application.
10. PROJECT DESCRIPTION: In the case of buoys, the buoys are brought to the location by
boat and placed at the designated location. The buoys are anchored by concrete blocks. In
the case of pilings, the work is performed by a contractor and the pilings are installed by
vibratory hammer. The No Wake Buoys would be of Standard NCWRC size and markings
and would be placed in open water areas with no impacts to Coastal Wetlands. The
placement of the buoys and associated anchors should pose no environmental impact.
11. ANTICIPATED IMPACTS: The impacts associated with the various projects will be
minimal and limited to the impacts associated with the placement of pilings and concrete
anchoring systems.

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for a programmatic permit to allow the installation of new pilings and buoys
and the replacement of existing pilings and buoys associated with aids to navigation,
hazardous areas, no wake zones and information signs throughout the navigable water of
the 20 coastal counties of North Carolina. It was received on June 10, 2020 and appears to be
adequate for processing at this time. The projected deadline for making a decision is August
24, 2020. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day. Jonathan Howell, Major Permits
Coordinator for the Division of Coastal Management is responsible for processing your
permit and he can be reached at 252-808-2808 or via email at Jonathan.Howelloncdenr.gov
if you have any questions.
If this agency does not render a permit decision within 70 days from June 10, 2020, you may
request a meeting with the Director of the Division of Coastal Management and permit staff
to discuss the status of your project. Such a meeting will be held within five working days
from the receipt of your written request and shall include the property owner, developer,
and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way fronting your property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

NCWRC maintains Aids to Navigation markers to enhance public safety for the boating public. The Aids to Navigation
markers can be No Wake Zone markers, Hazard markers, or Channel Markers.

Floating markers are installed by NCWRC technicians. They bring the buoy to the site by motorboat and place it. Markers
that pile -mounted are placed by contractors. The pile is vibrated into place using a vibraotry hammer and the sign mounted
on the pile.

Program Summary
NCWRC operates an Aids to Navigation (ATONs) program statewide consisting of 1634 markers,
including 692 in the 20 coastal counties. Markers fall into 3 categories: No Wake Zone Markers, Channel
Markers, and Hazard Markers. Markers can be either floating or mounted on a piling.
Following interagency coordination with NCDMC and other regulatory agencies, NCWRC proposes a
Programmatic CAMA Major Permit to operate its ATONs program in the 20 coastal counties.
Marker Categories:
1. No Wake Zone Markers
a. State rule 15A NCAC 10E.0104(d) establishes a No Wake Zone within 50 yards of an
NCWRC public boating access area. A floating NWZ buoy is placed at the end of every
NCWRC boat ramp to enhance safety for the boating public.
b. State statute NCGS 75A-15 gives NCWRC authority to establish No Wake Zones through
rule -making. As part of the rule -making process, USACE-Navigation in Wilmington, NC is
consulted for each individual No Wake Zone and USACE must concur on each No Wake
Zone before the Commission can approve It. NCWRC established No Wake Zones on a
basis of safety evaluation by Enforcement Officers. NCWRC proposes to place No Wake
Zone markers at previously -established and newly -established No Wake Zones to
enhance safety for the boating public.
c. The local government or entity that requests a No Wake Zone through NCWRC rule
making has financial responsibility to install the associated No Wake Zone Markers.
d. NCWRC has maintenance responsibility of all No Wake Zone buoys.
2. Channel Markers
a. Channel markers are placed to mark navigable channels from NCWRC public boat ramps
Into deep/open waters. These are also commonly referred to as red/green pairs.
b. NC's 20 coastal counties include a variety of water bodies, ranging from the ICW to
shallow marsh creeks. Different types and sizes of vessels are expected to access
different water bodies, therefore target depths are site -specific. In some shallow,
smaller bodies a minimum target depth may be as low as 2.5' (at normal low water). In
large, deeper water bodies a minimum target depth may be as low as 3.5' (at low tide).
c. Channel markers are placed at channel bends and at intervals (typically -500 yards)
along straight channel sections that provide clear navigation to the boating public.
NCWRC aims to minimize channel markers as each one requires semi-annual
maintenance and inspections.
d. Some navigation channels are naturally -occurring and no dredging is required. The
channels may still warrant channel markers when they are not centered in a waterI eD

or are not aligned directly from the ramp to open water. NCWRC proposes to place
channel markers as determined necessary in naturally occurring channels to provide
safe navigation for the boating public.
e. Some navigation channels are created and maintained by dredging. Both new and
maintenance dredging require CAMA Permits. NCWRC proposes to place channel
markers to mark dredged channels to provide safe navigation for the boating public.
f. The majority of channels marked by NCWRC are associated with navigation to and from
specific public boating access areas. However, there are a few locations where NCWRC
marks general public navigation channels when it is evaluated by agency staff that it will
benefit public safety.
3. Hazard Markers
a. Hazard markers are placed to alert the boating public to submerged hazards.
b. There is no minimum depth requirement for a Hazard marker as it is intended to
prevent boat traffic in the vicinity.
c. Hazards are identified by multiple sources including citizens, local governments, and
NCWRC staff. Hazards reports are evaluated based on public safety by NCWRC staff
before a Hazard Marker is placed.
Marker Types
1. Floating
a. Floating markers are the preferred type of marker by NCWRC and are used in all
locations where conditions allow.
b. Floating markers are anchored by concrete blocks.
c. Floating markers can be attached to concrete blocks by either chain or coated cable.
Connector length is 3 times the water depth.
d. Floating Buoys w/ collar base: "One Mile Buoys" and "Half Mile Buoys"
i. This type is used for No Wake Zones, Channel Markers, Hazards. NCWRC Field
staff determine buoy type based on site -specific conditions.
ii. "One Mile Buoy" Collar base is 38" diameter. Can is 19" diameter. Height is 36"
above water level. Roylan Buoy product #BSNPRSW or equivalent.
III. "Half Mile Buoy" Collar base is 30" diameter. Can is 14" diameter. Height is 28"
above water level. Roylan Buoy Models #428SWP (No Wake Zone), #B1428SWG
(green channel marker), #B1428NSW (red channel marker), and #81428SWP
(Danger) or equivalents.
e. Floating Buoys w/out collar base: "Pencil Buoy"
i. This type is used for No Wake Zones, Channel Markers, Hazards. NCWRC Field
staff determine buoy type based on site -specific conditions.
H. "Pencil Buoy" 9" Diameter. Height is 36" above water. Roylan Buoy models #81
147DG (Danger), #147NW (No Wake), #147R (red channel marker), and #14811
(green channel marker), or equivalent.

2. Pile -Mounted
a. Pile -mounted markers consist of a sign mounted to a pile. They are used in locations
where conditions are not well -suited for floating markers.
b. Typical sign size is 4'x4'.
c. Typical pile is 8"-diameter timber pile.
d. Sign is typically mounted to provide 10'vertical clearance between bottom of sign and
high tide level.
e. Pile length, and minimum embedment is site -specific.
f. NCWRC Regional Supervisors may determine that Individual site conditions warrant
geometry that differs from typical details.
NCWRC Agency Standards
1. Purchasing and Manufacturing
a. Floating markers are purchased ion state contract through NCWRC's Wildlife Inmate
Services (WISe) program following State Purchasing requirements. Exact manufacturer
and models may change each time the contract is re -bid.
b. Pile -Mounted marker signs are manufactured at NCWRC's WISe facility.
i. NCWRC utilizes Florida Fish and Wildlife Conservation Commission's guidance
document Guidelines for Posting Uniform Water Markers in Florida's Waterways
in making site -specific ATONs decisions for any custom needs.
2. Habitat Conservation Consultation
a. All NCWRC projects, including ATONs, go through an internal consultation with
Conservation Biologists, prior to work beginning.
b. Internal consultations by Conservation Biologists include data such as nearby shellfish
areas and any applicable in -water moratoriums on pile driving.
3. Installation
a. Floating markers at boat ramps, hazards, and navigation channels are installed by
NCWRC technician crews using a motorboat.
b. NCWRC consults internally with its Habitat Conservation biologists to determine if a
moratorium exists on pile -driving activities at each location.
c. Pile -Mounted markers maybe installed by either NCWRC technician crews or a
contractor.
I. All work requiring a barge will be performed by a contractor
ii. NCWRC crews can only install piles that can reached by an excavator from dry
land. All equipment will be operated on mats.
d. Installation of new No Wake Zone markers is the responsibility of the local government
or entity that requested the No Wake Zone. Each entity, acting as NCWRC's agent,
determines the appropriate installation method and if installation shall be performed by
their internal staff or a contractor.
e. Installation of NCWRC's typical ATONs do not result in any fill in the water body.

f. NCWRC typically installs ATONs markers in open water with no impacts to wetlands and
without equipment crossing wetlands. Any markers that needs to be installed in a marsh
or that would require equipment to cross a marsh for installation will require an
additional consultation with DCM prior to installation. NCWRC's No Wake Zone
coordinator will add standard language to the No Wake Zone request process for local
governments or other requesting entities alerting them to that requirement.
4. Maintenance and Inspections
a. NCWRC maintains a database of all NCWRC-owned ATONs that includes gps locations of
each marker
b. NCWRC technician crews inspect all ATONs twice a year.
S. Reporting
a. NCWRC's GIS Program maintains a location and conditions database on all NCWRC-
owned marks. The database is updated continuously as inspections occur.
b. NCWRC's GIS Program provides its ATONs database the US Coast Guard Auxiliary on an
annual basis in spreadsheet format.
c. NCWRCs GIS Program converts its ATONs database to a Google Earth kmz file at a
minimum of once year. Updates are also made on an as -requested basis.
d. NCWRC Proposes to provide its ATONs database to DCM on an annual basis as a
concurrent step with US Coast Guard updates.
