C. Homeowner's Association (HOA) for the construction of a bulkhead extension and groin along the peninsula off Ballast Point Drive, Manteo, Dare County. Yvonne Carver, Field Representative of the Division of Coastal Management, was recently on site to evaluate the permit applicant's request. The permit applicant has requested a permit to add a 200-foot bulkhead and a 24-foot groin. Under the Coastal Area Management Act (CAMA), the Coastal Resources Commission (CRC) has established Rules for General Permits for this type of development that are found in 15A NCAC 07H.1100 and 07H.1400 (copies enclosed). The Division of Coastal Management received a copy of email correspondence between Jill Etheridge, Executive Assistant/Broker of P.C. HOA and yourself, in which you stated that you objected to the project and would not be signing the riparian notification form. Mrs. Carver spoke with you on 01/27/2022 in regard to your objections to the proposed development. Your objections to this proposed development related to the issue of persons' use of the 'strip', resulting in driving of golf carts along the property, potential drug activity, large gatherings resulting in high noise level ... which are all issues that should be addressed by the HOA. The Division has reviewed your objections, along with all aspects of this development proposal for consistency with the aforementioned Rules, which describe the CRCs standards and guidelines for this type of development. After having given careful consideration to your objections to this proposed development, we have determined that it is consistent with the Rules of the CRC and the State's Coastal Management Program, and that all pre -requisites have been satisfied. Therefore, the Division of Coastal Management issued General Permit No. 86263A on March 8, 2022 (copy enclosed) for the proposed development. I hope this email finds you well. As you know the peninsula behind your Pirate's Cove property has been on our watch for years. There has been a lot of maintenance involved in preserving this area. In years past, owners who are directly impacted by the peninsula have been asked to contribute towards the cost of dredging that area to allow proper ingress and egress to the back portion of their property. While owners have been responsible for the dredging the Association has always picked up the cost of spreading the material and then installing bulkheads and groins where necessary. At a recent Board meeting the PCHA Board has decided that in 2022 the Association will be picking up all expenses associated with approved projects as outlined below including the dredging. However the dredging in the future may be the responsibility of the affected property owners. As an adjacent property owner CAMA (Coastal Area Management Agency) has requested that all adjacent owners sign a riparian right form which I have attached to this email. By signing this for you are acknowledging the work that will commence in 2022.
